Please place the above-referenced item on the City Commission
agenda for December 21, 1993 under Development Plans - Non-
Consent Agenda.
DESCRIPTION: Roger G. Saberson, agent for Boynton Nurseries, is
requesting a third one-year time extension to the expiration of
the Boynton Nurseries PUD concurrency exemption and of the PUD
zoning and associated master plan. The Boynton Nurseries PUD
master plan was approved on September 5, 1990, to allow 162
single-family units and 238 multi-family units (total 400 units)
on the 83.85 acre parcel located at the northwest corner of
Lawrence Road and the L.W.D.D. L-21 Canal. The current extension
expires March 5, 1994 unless a preliminary plat application is
filed by this date. The applicant is requesting to extend the
expiration to March 5, 1995.
RECOMMENDATION: The Planning and Development Board, with a 4-1
vote, recommended approval of a six-month time extension that
would expire September 5, 1994, rather than the one-year time
extension requested.

NATURE OF REOUEST
Roger G. Saberson, agent for Boynton Nurseries, is requesting a
time extension to the expiration of the Boynton Nurseries PUD
concurrency exemption and of the PUD zoning and associated master
plan.
BACKGROUND
The Boynton Nurseries PUD, located at the northwest corner of
Lawrence Road and the L.W.D.D. L-21 Canal (see attached location
map) was approved September 5, 1990 (see attached master plan) .
Since the applicatlon for PUD zoning was filed prior to the
effective date of the City's Concurrency Management Ordinance
(June 1, 1990), the master plan was exempt from the City's
traffic, drainage and neighborhood park levels of service (LOS).
Planned development district master plans, such as the Boynton
Nurseries PUD master plan, and their accompanying concurrency
certification or exemptlons, expire within 18 months of the
approval date if a preliminary plat has not been filed with the
City.
To avoid the March 5, 1992 expiration of the Boynton Nurseries
PUD master plan, Boynton Nurseries requested their first one-year
extension in January, 1992, which was granted by the City
Commission. To avoid the March 5, 1993 expiration of the first
time extension, Boynton Nurserles flIed a second one-year time
extension which was granted by the City Commission. ThlS second
extension expires March 5, 1994.
section 19-92(e) of Chapter 19, Article VI of the Code of
Ordinances states that such requests for time extensions "may be
filed not later than 60 days after the expiration of said
certificate or exemption". It further states that "time
extensions may be granted for any length of time WhlCh does not
exceed one year". Although this language is not clear whether
more than one time extension can be granted as long as each
extension does not exceed one year, it has been interpreted as
such.
ANALYSIS
As noted in Mr. Saberson's attached letter of request, Boynton
Nurseries has a contract to purchase on the property with Pulte
Horne Corporation. In addition, I have received inquiries from
Land Design South regarding a near future master plan
modification.
It should also be noted that the next development order
application for this property (a preliminary plat) will be
subject to all of the other current levels of service--potable
water, sanitary sewer, solid waste, district parks, and
recreation facilities.

Despite the fact that the requested time extension would continue
exemption to the City's traffic, drainage and neighborhood park
levels of service, with the exception of traffic, the drainage
and neighborhood park proposals approved in connection with the
1990 master plan, meet the City's current levels of service.
RECOMMENDATION
The Technical ReVlew Committee (TRC) met on November 30, 1993 to
discuss this request. The consensus of the TRC was to recommend
approval of a six-month time extension that would expire on
September 5, 1994, rather than the one-year extension requested
by the applicant. This recommendation was made based on the
number of extenslons that have been granted to date, for the
project. Engineering Department Memorandum #93-355, which
reiterates this recommendation, is attached.

TIME EXTENSION: Request for a one-year time exten-

Ms. Heyden made the presentation. This project was approved in 1990 for 400
units. This is a request for a third one-year time extension to the expiration
of their concurrency for traffic, drainage and neighborhood parks, PUD zoning
and master plan. The current extension expires on March 5, 1994, unless the
preliminary plat application has been filed by that date. The applicant wishes
to extend this until March 5, 1995. The Planning and Development Board recom-
mended approval of a six-month extension.
Description:
Even though the time extension would exempt them from traffic, drainage and
neighborhood parks, when the proposal came through, drainage and neighborhood
parks met the current level of service. Ms. Heyden contacted the County to see
what roadway links might be impacted if they were subject to current traffic
levels and they indicated that Gateway Boulevard and HYPoluxo Road would be
impacted.
Roger Saberson said a contract currently exists with Pulte Homes.
Unfortunately, Boynton Nurseries is not a developer. Under the contract, Pulte
will do a number of studies and tests prior to expending the funds to prepare
and file the preliminary plat. The engineering fees for the preliminary plat
could amount to $150,000 to $170,000 for the project. The problem for Boynton
Nurseries is that as Pulte moves forward, if they do not wish to proceed with
the project near the end of the six months, Boynton Nurseries will need the
additional six months to get another developer on board.
Motion
Commissioner Walshak moved to approve the request in VIII-B.2. Mayor Pro Tem
Matson seconded the motion.
Commissioner Katz pointed out that a six month extension would actually provide
nine months because it expires on March 5, 1994.
Mr. Saberson feels that amount of time would be necessary to secure the services
of another developer.
The motion carried 3-1. (Commissioner Katz cast the dissenting vote.)
