Please place the above-referenced item on the December 17, 1996 City Commission
agenda under Development Plans.
DESCRIPTION: Burlison Gentry, agent for Frank Pinto, property owner, is requesting site
plan approval for perimeter buffer landscaping and wall, common area landscaping, gated
entry, preserve area fencing and signage at the Hills at Lake Eden PUD. The PUD is
located between Seacrest Boulevard and Swinton Avenue, immediately north of S.E. 36th
Avenue extended (Gulfstream Boulevard). For further details pertaining to this request,
please see attached Planning and Zoning Department Memorandum No. 96-641,
RECOMMENDATION: The Planning and Development Board, with a 6-0 vote,
recommends approval subject to all staff comments in Exhibit "C " - Conditions of Approval,
with the exception of rewording Comment No, 22 to delete the option of proving a wood
fence and deleting Comment No. 25 (the comment is now satisfied). In addition, the Board
recommends that the applicant construct a 20 foot long return of the entrance wall around
the northeast, southeast and southwest corners.

specified on the color elevation drawings. Where applicable, identify on sheet 6 of
7 the color code and manufacturer of the taupe color proposed on the plans for the

10, The total area of undisturbed preserve area shall not be less than 1.29 acres as
indicated on sheet 1 of 7 of the current submittal or as approved by the city
forester/environmentalist. The 1,29 acres may include the required Fire Department
access area, Submit a copy of the preserve area management plan approved with
the master plan/rezoning for staff to determine where the exact location of the fence
was approved (on tract line vs. inside the tract line),
11, For clarity in depicting the area where the platted lots abut the undisturbed preserve
area it is recommended that a dimensioned typical section view drawing of the area
be added to the landscape plan. Identify and include in the section view drawing the
following improvements proposed: the edge of the buildable area of the homes, the
buildable area for pools and screen roof enclosures, the preserve area tract line, the
proposed fence (type and height) and the undisturbed preserve area.
12, Amend the typical Swinton Avenue landscape plan to show, dimension and label the
approved rear building setback of 29 feet from Swinton Avenue and include a
symbol that represents the required 25 foot rear setback for pools and screen roof
enclosures. All setbacks are dimensioned from the property lines and shall match
the dimensions on the approved master plan, Omit the incorrect rear setback
reference of +/- 9'.
13, As discussed at the TRC meeting, the applicant shall provide a utility easement
along the south side of the main entrance to the project. Show on the drainage and
landscape plans the location, type and size of the easement. Where applicable,
remove trees from the easement.
14, Specify on sheet 6 of 7, the color name, color code and manufacturer proposed for
the colors of the wall sign, [LOR, Chapter 4 - Site Plan Review, Section 7.8.2.]
15, Identify on the plan, the dimensions of the proposed wall sign, The dimensions of
the wall sign shall comply with the sign code regulations, [Chapter 21- Signs, Article
IV, Section 1 and 7J
16, It is recommended that the proposed wall signs be approved administratively,
subject to the signage complying with the sign code regulations and the sign
specifications listed in the community design plan,
17, Identify on the drainage plan the height of the berms proposed along the north, east
and south property lines, Also, add to the landscape plan the proposed berms and
indicate the slope of each berm,
18, It is recommended that the 40 watt fluorescent light fixture proposed to illuminate the
walls signs be ground mounted and directed towards the face of each wall sign.
19, To comply with the rezoning conditions of approval regarding the Swinton Avenue
and Seacrest Boulevard landscape specification change the height of the cocoplum
hedge material from eighteen (18) inches to twenty-four (24) inches at time of
planting.
20, Add to the landscape plans the location, type and size of the fence and berm
easement shown on the drainage plan along the north and south property lines, As
previously indicated, the easements shall be dedicated to the H,OA for perpetual
maintenance.
21. Show and specify on the landscape plan (sheet 3 of 7) the location and type of the
ground cover proposed for the fence and berm easement proposed along the north
and south property lines.
22, It is recommended that the proposed 6 foot height, black vinyl chain link fence with
black vinyl slats proposed along the south and a majority of the north property line
be replaced with either a solid wood fence painted a neutral color or a continuous
(2 foot on center, 24 inch tall at time of planting) native hedge and 6 foot tall black
vinvl chain link fence without slats,

23. For clarity in determining what existing landscape material is required to be
maintained in the project, submit for review the tree survey and approved tree
management plan including preserve area documents.
24, To allow a stacking area, outside of the right-of-way, for emergency vehicles at the
emergency access driveway located on Seacrest Boulevard, it is recommended
that the gate be moved no less than 20 feet into the project.
25, Unconditional sign-off by all TRC staff will be required on the rectified master plan,
prior to plat approval for the subject project.
26. Recommendations will be forwarded for board and commission review, If the
recommendations are approved by the city commission, they shall be incorporated
into the working drawings required for permits for the project.
27, The content of the plans are subject to compliance with all applicable city code of
ordinances and previous conditions of approval. It is the applicant's responsibility
to show compliance.
28. Provide drainage and location map to the Lake Worth Drainage District (LWDD), as
they've requested for them to complete their review.

Mr. Diamond commended staff for being very helpful and getting him here in record time.
He agreed with all of staff's comments.
Motion
Vice Chairman Golden moved to recommend approval of the subdivision master plan for
Orchard Landing, to subdivide a 2 acre parcel into three lots for single-family homes,
subject to staff comments. Mr. Elsner seconded the motion, which carried 6-0.

Request for site plan approval for perimeter wall and
buffer landscaping, common area landscaping, gated
entry, preserve area fencing and signage.
Mr. Gentry and Mr. Pinto were present. Mr. Gentry advised that this site plan has been
developed in conformi1}t with the master plan. The setbacks relating to the spacing of the
trees and the heights have been complied with. The wall will be six feet with a concrete
cap, and there will be a feature on the entrance. He stated that the sign was not indicated
on the plan that was originally presented. When he applies for a building permit for that
sign, he will make sure it complies with the minimum requirements of 32 square feet. He
said the developer is willing to comply with all the staff comments and will satisfy them prior
to pulling the building permit.
Mr. Aguila would like to delete comment 22. He could not imagine why we would want to
replace the chain link fence with a wooden fence which will eventually rot and fall apart.
In addition, on the northeast, southeast, and southwest corners of the property where the
north/south masonry walls end, he asked the applicant to return those walls 90 degrees

towards the property for a distance of 60 feet. He felt that bringing the chain link fence all
the way up to the wall on the street is not going to look nice.
Mr. Burlison said the developer would be willing to make a return there, at least for one of
those sections, so there would be a column set back at least 20 feet. He pointed out that
the owners will probably bring in some landscaping that will be a part of the single family,
and the fence would take over from there. He assumed the people who buy in there will
do a substantial amount of landscaping on the lots as part of the building permit process.
After conferring with Mr. Pinto, Mr. Burlison offered 10 feet. Mr. Aguila recommended no
less than 20 feet. Mr. Haag asked if Mr. Aguila was talking about returning on all four
corners. Mr. Aguila clarified that the northwest corner already has a wall. He was
concerned that as you travel on Seacrest and Swinton that you not see some return to that
element. He did not think 20 feet was enough, but considered it a compromise.
With regard to comment 22, Mr. Aguila recommended that the wooden fence be omitted.
Mr. Haag was agreeable to that. He said his concern was that the vinyl slats in the fence
are not attractive after the first three or four months they are in place.
Mr. Haag advised that comment 25 has been complied with. All of staff had signed off the
master plan today.
Chairman Dube allowed comments from the audience.
Mrs. William Eckler, 2750 Seacrest Boulevard, Delray Beach, said her husband and she
own the 5 acres immediately south of this property. She asked if the chain link fence is
going to be landscaped. Chairman Dube advised that the developer agreed to install a
native hedge along there, as suggested by staff.
Stella Rossi, 625 Whispering Pines Road, thinks the two strips are an insult to the
preservation of that site and to the environment. She commended the applicant for
agreeing to buffer the south and north with a native hedge. However, she felt there should
be some native trees, and that if you destroy native, you should replace with native. She
stated that Queen Palms from Australia do nothing for the habitat or wildlife and do not
provide shade.
Mr. Aguila agreed with Mrs. Rossi that there should be landscaping on the north and south
property lines as they abut residential. Chairman Dube explained that what the developer
originally asked for is no where near what he has, and what is before this board was

worked out with the City Commission. The whole site is a compromise from what the
developer wanted and what the City wanted. If this board recommends something else,
it would be going against what the City has already comprised with the developer.
Motion
Mr. Aguila moved to approve the request for site plan approval for perimeter wall and buffer
landscaping, common area landscaping, gated entry I preserve area fencing and signage
for the Hills at Lake Eden PUD, subject to staff comments and the following:
. Delete the words "either a solid wood fence painted a neutral color or" from
Comment 22;
. Delete Comment 25 since it has been resolved; and
. Add the following comment: The developer will return a minimum of 20 feet on the
masonry walls in the northeast, southeast, and southwest corners of the property
before commencing the chain link fence.
Mr. Reed seconded the motion. Vice Chairman Golden said he is going to vote against
this to be consistent with previous actions.
The motion carried 5-1. Vice Chairman Golden cast the dissenting vote.

preserving 1.28 acres of the ecosystem as required by the PUD's
master plan approved at time of the rezoning of the property.
(see Exhibit "B" - proposed site plan)
The site plan request is in connection with the development of 56
single-family, detached homes on platted lots. The site plan
improvements include installing landscaping along the project
frontage at Swinton Avenue and Seacrest Boulevard, including
common ground landscaping around the waterfall entry feature
located adjacent to the project's main entrance on Swinton Avenue.
Other improvements include construction of a combination site wall
and chain link fence around the perimeter of the project, including
wall signs on the site wall at the project entrance on Swinton Avenue.
Security gates are proposed for the main entrance and at the project
egress located on Seacrest Boulevard. Placement of a six (6) foot tall
black vinyl chain link fence around both preserve areas is also part of
this site plan review request.
Traffic -
The request does not affect traffic concurrency.
Drainage - The request does not affect drainage.
There are no driveways included with the subject request.
There are no parking facilities included with the subject request.
A three (3) foot tall berm, continuous hedge, native trees spaced
twenty (20) foot on center and a six (6) foot tall stuccoed site wall are
shown along the Swinton Avenue frontage of the project. A six (6)
foot tall stuccoed site wall, continuous hedge and native trees spaced
twenty (20) foot on center are also shown along the Seacrest
Boulevard frontage of the project. A combination six (6) foot tall
stuccoed site wall and six (6) foot tall chain link fence are proposed
along the north border of the project and a six (6) foot tall chain link
fence is proposed along the south property line. As previously stated
trees, palms and hedge material are proposed to be planted in the
common ground area located on both sides of the entrance to the
project on Swinton Avenue and around the proposed waterfall entry
feature located directly east of the gated entry. The 1.28 acre
preservation area is divided into two tracts of land. Both preserve
areas are protected by a six (6) foot tall chain link fence located
approximately three feet within the preservation tract boundary.
There are no buildings included with the subject request.
There are no buildings included with the subject request. A six (6)
foot tall site wall is proposed along the Swinton Avenue and Seacrest
Boulevard frontage of the project. The site wall consists of columns
spaced 20 foot on center and a continuous cap. The tan color of the
site wall with a white cap will blend in with the adjacent existing and

proposed new homes in the development.
Signage:
The details regarding color, copy and size of the proposed wall signs
at the Swinton Avenue entrance were not included with the submittal.
However, the location of the wall signs on both sides of the Swinton
Avenue entrance are shown on the site plan. See Exhibit "C" -
Conditions of Approval for staff comments regarding the wall signs.
RECOMMENDATION:
The Planning and Zoning Department recommends approval of this site plan request,
subject to the comments included in Exhibit C - Conditions of Approval. The Technical
Review Committee (TRC) recommends that the deficiencies identified in this exhibit be
corrected on the set of plans submitted for building permit.

15, Identify on the plan, the dimensions of the proposed wall sign, The dimensions of
