SUBJECT: New Site Plan - 2nd Review
Project: Hills at Lake Eden
Location: Between Seacrest Boulevard and Swinton Avenue, along the
south limit of the City of Boynton Beach

The following is a list of comments regarding the second review of the above-referenced
project. It should be noted that the comments include recommendations. I believe the
recommendations will enhance the aesthetics and function of the project.
All comments and recommendations can be rectified on the plans at time of permitting if
the site plan request is approved. The applicant must understand that additional
comments may be generated upon review of the documents and working drawings
submitted to the Building Division for permits for the proposed project.
1. Identify on sheet 6 of 7 the color code and manufacturer of the taupe color
proposed on the plans for the background color of the wall signs. [LOR, Chapter 4 -
Site Plan Review, Section 7.0.1.]
2. The total area of undisturbed preserve area shall not be less than 1.29 acres as
indicated on sheet 1 of 7 of the current submittal or as approved by the city
forester/environmentalist. The 1.29 acres may include the required Fire Department
access area. Submit a copy of the preserve area management plan approved with
the master plan/rezoning for staff to determine where the exact location of the fence
was approved (on tract line vs. inside the tract line).
3. For clarity in depicting the area where the platted lots abut the undisturbed preserve
area it is recommended that a dimensioned typical section view drawing of the area
be added to the landscape plan. Identify and include in the section view drawing
the improvements between the edge of the buildable area of the proposed adjacent
homes, buildable area for pools and screen roof enclosures, preserve area tract
line, proposed fence (type and height) and undisturbed preserve area.
4. Amend the typical Swinton Avenue landscape plan to show, dimension and label
the approved rear building setback of 29 feet from Swinton Avenue and include a
symbol that represents the required 25 foot rear setback for pools and screen roof
enclosures. All setbacks are dimensioned from the property lines and shall match
the dimensions on the approved master plan. Omit the reference rear setback +/-
9' as previously stated, the rear setback to the building is 29 feet.
5. As discussed at the TRC meeting the applicant shall provide a utility easement
along the south side of the main entrance to the project. Show on the drainage and
landscape the location, type and size of the easement. Where applicable, remove
tree landscape material from the easement.
6. Specify on sheet 6 of 7 the plan the color name, color code and manufacturer
proposed for the colors of the wall sign. [LOR, Chapter 4 - Site Plan Review, Section
7.B.2.]

7. Identify on the plan the dimensions of the proposed wall sign. The dimensions of
the wall sign shall comply with the sign code regulations. [Chapter 21- Signs, Article
IV, Section 1 and 7]
8. It is recommended that the proposed wall signs be approved administratively,
subject to the signage complying with the sign code regulations and the sign
specifications listed in the community design plan.
9. Identify on the drainage plan the height of the berms proposed along the north, east
and south property lines. Also, add to the landscape plan the propose berms and
indicate the slope of each berms.
10. It is recommended that the 40 watt fluorescent light fixture proposed to illuminate
the walls signs be ground mounted and directed towards the face of each wall sign.
11. Add to the landscape plans the location, type and size of the fence and berm
easement shown on the drainage plan along the north and south property lines.
As previously indicated, the easements shall be dedicated to the H.O.A. for
perpetual maintenance.
12. Show and specify on the landscape plan (sheet 3 of 7) the location and type of the
ground surface cover proposed for the fence and berm easement proposed along
the north and south property lines.
13. It is recommended that the proposed 6 foot height, black vinyl chain link fence with
black vinyl slats proposed along the south and a majority of the north property line
be replaced with either a solid wood fence painted a neutral color or a continuous
(2 foot on center, 24 inch tall at time of planting) native hedge and 6 foot tall back
vinyl chain link fence without slats.
14. For clarity in determining what existing landscape material is required to be
maintained in the project, submit for review the approved tree management plan
and preserve area documents.
15. To allow a stacking area, outside of the right-of-way, for emergency vehicles at the
emergency access driveway located on Seacrest Boulevard, it is recommended
that the gate be moved no less than 20 feet into the project.
16. Unconditional sign-off by all TRC staff will be required on the rectified master plan,
prior to plat approval for the subject project.
17. Recommendations will be forwarded for board and commission review. If the
recommendations are approved by the city commission, they shall be incorporated
into the working drawings required for permits for the project.
18. The content of the plans are subject to compliance with all applicable city code of
ordinances and previous conditions of approval. It is the applicant's responsibility
to show compliance.
19. Lake Worth Drainage District (LWDD) requires drainage and location map before
commenting.

The applicant should include the Preservation Area Management Plan dated November 1995
(document A) as part of the Homeowner Association documents. The site plan should indicate this
as a written comment near the two preservation areas.
The Preservation Area Management Plan should be referenced on the site plan as a comment which
states that the procedures outlined in document A will be completed and inspected by the city , prior
to turning the preserve areas over to the Homeowners Association (see document A #4.0 A, page 7
and #8.0, page 12)
The applicant shall install a six foot high, black vinyl-coated chain link fence around the perimeter
of the preserve areas (inside boundary) and place "Natural Area Preserve" signs on the fence at the rear
of each lot adjacent to the preserves (see document A, #4.0 A, page 7 and #8.0, page 12). The location
of this fence shall be indicated on the site plan. The total acreage of both preserves inside the fences
should be in accordance with the required 25% set aside requirement.(1.28acres).There should be a
cross section of the fence installation showing the "transition" area where there will be an elevation
difference between the back of the lots and the preserve area fences.
The paragraph #5 described on #10.0 page 13 of document A shall be included as a comment on the
site plan.
There should be a total of 211 trees on the site in accordance with the quantity shown on the tree
survey. The no net loss of trees should be quantified and indicated on the site plan. The trees in the
road right-of-way and building areas which can be relocated should be transplanted to the landscape
buffer areas shown along Seacrest Blvd. or Swinton Ave. or other common areas along the perimeter
of the project. The tree management plan for the landscape buffer areas should be completed as part
of the site plan.
The additional Oak trees required by the City Commission to be planted in the landscape buffer areas
must be shown on the site plan.
The applicant should add the contents of Building Division Memorandum No. 96-0 II to the
comments section of the site plan.
The project should continue in the normal review process.

RE: Security Gates & Emergency Access
To Whom It May Concern:
Boynton Beach Fire-Rescue continues to maintain the position that security gates are
potentially detrimental to fire and rescue operations. The proliferation of security gated
communities has resulted in many problems for responding emergency apparatus trying to gain
entry.
The minimum performance for all security gates should be as follows:
1) All gates must have one security entry code (0911)
2) The gate must remain open until the Fire-Rescue units have completed the call and have
reentered 0911 while leaving.
3) Gates may be operable by telephone from our dispatch office. A phone call from our
dispatchers will open the gate and a second call will be required to close the gate.
4) In case of power failure, the gate shall open automatically and remain -open.
5) An exception will be where a 24-hour security guard is stationed at the gate.
6) Authorized key security boxes (Le. Knox, NuTech, Supra) should be located on all
buildings where alarms and/or sprinkler systems are located to assist in minimizing
damage due to rapid forcible entry.
7) Authorized key security boxes may be used on gates, provided each gate has one and it
is well marked. A key security box on a gate will not be used in lieu of any other section
of this letter.
8) No other code numbers, operating methods or key systems will be kept on file by the Fire
Department.
9) In the event our units are unable to gain rapid entry with the above methods, it will
require us to use rapid forcible entry methods to gain entry.
10) Information on where authorized key security boxes can be purchased is available from
Boynton Beach Fire-Rescue Fire Safety Division by calling #(561) 735-0272 during
normal business hours.
The liability of a delayed Fire-Rescue response to an emergency in your community should be a
serious concern.

The following is a list of comments regarding the first review of the above-referenced
project. It should be noted that the comments include recommendations I believe will
enhance the aesthetics and function of the project.
The comments that identify deficiencies from the City's Land Development Regulations
(L.D.R.) or previous conditions of approvals are required to be corrected and shown in
compliance on the plans and/or documents submitted for second (2nd) review in order for
the project to continue through the site plan review process.
The applicant shall understand that all documents and plans submitted for site plan review
are subject to additional comments. I recommend that the applicant/agent contact me
regarding questions related to the comments. If the applicant is not intending to correct
code deficiencies or deficiencies from previous conditions of approval and they request that
the project remain on the review schedule identified they should contact me regarding the
procedures, application forms, fees and submittal deadline dates for seeking relief from the
code requirement or previous condition of approval.
1. For clarity in reviewing the request it is recommended that sheet 2 of 9 (master
plan), 4 of 9 (water plan) and 5 of 9 (sewer plan) be removed from the submittal and
the set of plans renumbered. The subject of the request is buffer planting, entrance
features, perimeter fencing, site wall and preserve area protection. Amend the
submittal accordingly.
2. Identify on sheet 6 of 9 and sheet 8 of 9 the color code and manufacturer of the
cream and white colors specified on the plans of the site wall. [LDR, Chapter 4 - Site
Plan Review, Section 7. 0.1.]
3. Remove the title and notes that reference conceptual landscape plan from sheet
6 of 9 and sheet 8 of 9. The submitted documents are not conceptual. [LOR,
Chapter 4 - Site Plan Review, Section 7. C. 1. and Section 8. A.]
4. The total area of undisturbed preserve area shall not be less than 1.29 acres as
indicated on sheet 1 of 9 of the current submittal or as approved by the city
forester/environmentalist. The 1.29 acres may include the required Fire Department
access area. Submit a copy of the preserve area management plan approved with
the master plan/rezoning for staff to determine where the exact location of the fence
was approved (on tract line vs. inside the tract line). If the applicant is requesting

to reduce the undisturbed area below 1.29 acres the applicant will be required to
process a request to modify the approved master plan prior to site plan approval.
As referenced in the letter to Mr. Frank Pinto, dated October 21, 1996 (see
attached letter).
5. To clarify the location and size of the preserve area, show on the drainage plan and
landscape plan, within the preserve area tracts, the total area of each preserve
area tract in square feet and acres. The total square footage and acreage of both
undisturbed preserve areas shall not be less than 1.29 acres. As previously stated
the 1.29 acres may include the required fire department access area.
6. For clarity in depicting the area where the platted lots abut the undisturbed preserve
area it is recommended that a dimensioned typical section view drawing of the area
be added to the landscape plan. Identify and include in the section view drawing
the improvements between the edge of the buildable area of the proposed adjacent
homes, buildable area for pools and screen roof enclosures, preserve area tract
line, proposed fence (type and height) and undisturbed preserve area.
7. Amend the typical Swinton Avenue landscape plan to show, dimension and label
the approved rear building setback of 29 feet from Swinton Avenue and include a
symbol that represents the required 25 foot rear setback for pools and screen roof
enclosures. All setbacks are dimensioned from the property lines and shall match
the dimensions on the approved master plan. Omit the reference rear setback +/-
9' as previously stated the rear setback to the building is 29 feet.
8. As discussed at the TRC meeting the applicant shall provide a utility easement
along the south side of the main entrance to the project and adjust the landscaping
accordingly.
9. Remove all notes and drawings that make reference to landscaping that is not part
of the subject request such as; typical AC. landscape treatment and fire hydrant
clear zone. Landscaping on individual lots and within the private roads is not part
of this request. It is recommended that the fire hydrant clear zone detail drawing be
shown on the infrastructure drawings associated with the plat submittal.
10. Specify on the plan the color name, color code and manufacturer proposed for the
colors of the wall sign. [LOR, Chapter 4 - Site Plan Review, Section 7.B.2.]
11. Identify on the plan the dimensions of the proposed wall sign. The dimensions of
the wall sign shall comply with the sign code regulations. [Chapter 21- Signs, Article
IV, Section 1 and 7]
12. To clarify the proposed signage provide a larger scale dimensioned detailed
elevation view drawing of both signs including the wall the signs are mounted on.
13. Show on the drainage plan the required three (3) foot tall berm along the west
property line of the project. If there are berms proposed for other areas of the
project add them to the drainage plan and landscape plan. [LOR, Chapter 4 - Site
Plan Review, Section 7. F.]
14. Correct the inconsistency regarding the configuration of the lots and right-of-way
shown on the site distance triangle drawing found on the landscape detail drawing
and the actual conditions shown on the submitted plans. The detail drawing shall
represent the actual site conditions at lot 1, block 1 and comply with the zoning

code and landscape code line-of-sight regulations. Show and dimension on the
landscape plan the zoning code and landscape code required line-of-sight cross
visibility triangles. [LOR, Chapter 2 - Zoning, Section 4. E.] and Chapter 7.5,
Article II - Landscape Code, Section 5. H.1.]
15. To ensure changes to approved landscape plans are properly processed, add a
general note to the landscape plan indicating that relocation, removal or changes
to landscape material will require approval of permit drawings processed through
the Development Department for city approval.
16. Indicate on the sign drawing whether the sign is illuminated and if it is specify on the
plan the type of illumination. [LOR, chapter 4 - Site Plan Review, Section 7.B.1]
17. To ensure that the perimeter fencing is maintained equally on all lots it is
recommended that an easement, be established along the north and south property
line of the project. The easement shall be dedicated to the H.O.A. for perpetual
maintenance. The location and width of the easement shall be of adequate size to
allow installation and repair of the fencing. Add to the landscape plans a
dimensioned typical section view drawing of the area between the edge of the
proposed homes to the perimeter of the project. Include in the section view drawing
the improvements between the edge of the buildable area established for the
proposed homes, buildable area established for pools and screen roof enclosures,
recommended easement, proposed or recommended fence (including type and
height) and perimeter of the project. Specify on the drawing the location and type
of the ground surface cover proposed for the area.
18. It is recommended that the proposed 6' height, black vinyl chain link fence w/black
vinyl slats be replaced with a solid wood fence.
19. For clarity in determining what existing landscape material is required to be
maintained in the project, submit for review the approved tree management plan
and preserve area documents.
20. Show, label and dimension on the drainage plan and landscape plan the 30 foot
wide utility easement required at the emergency access tract.
21. Show on the landscape plan the location and configuration of the gate proposed for
the emergency access that abuts Seacrest Boulevard.
22. Submission of a rectified master plan showing compliance with the conditions of
approval for the project will be required to be submitted to the Planning and Zoning
Department, in triplicate, prior to platting and the subject site plan review request
being forwarded to the Planning and Development Board.
23. Recommendations will be forwarded for board and commission review. If the
recommendations are approved by the city commission, they shall be incorporated
into the working drawings required for permits for the project.
24. The content of the plans are subject to compliance with all applicable city code of
ordinances and previous conditions of approval. It is the applicant's responsibility
to show compliance.

1 st Review - New Site Plan
Project - Hills at Lake Eden
Location - Between Seacrest Boulevard and Swinton Avenue, along the South
limit of the City of Boynton Beach.

Find attached for your review the plans and exhibits for the above-referenced project. New Site
Plan approval for this project will be granted by the City Commission. To ensure that the project
stays on line with the review time frame, I request that the plans and exhibits be reviewed
and formal written comments transmitted to the Director of the Planning and Zoning
Department no later than 5:00 P.M. on November 15. 1996. Do not return plans and exhibits.
Retain same for the review of the amended plans (second review).
Adhering to the following review guidelines will promote a comprehensive review and enable the
applicant to efficiently obtain Technical Review Committee approval:
1. Use the review standards specified in Part III, Land Development Regulations, Chapter 4,
Site Plan Review, Section 8 of the Code of Ordinances to review and formulate comments.
2. The documents submitted for the project were determined to be substantially complete
based on the submittal requirements identified in Section 7 of the Site Plan Review
Ordinance. However, if the data provided to meet the submittal requirements is insufficient
to properly evaluate and process the project based on the review standards or the
documents show code deficiencies, additional data and/or corrections should be requested
by the reviewer through the Planning and Zoning Department.
3. Each comment shall reference the section of the code that is incorrectly depicted on the
documents.
4. Technical Review Committee member(s) shall identify in their comments when the plans
depict or when the location and installation of their departmental required improvements may
conflict with other departmental improvements.
5. When a TRC Member finds a code deficiency that is outside of his/her review responsibility,
the comment and the specific code section may be included in their review comments with
the name of the appropriate TRC Member that is responsible for the review specified.

6. If a TRC member finds the plans acceptable, he/she shall forward a memo, within the time
frame stated above, to the Planning and Zoning Director stating that the plans are approved
and they do not have any comments on the plans submitted for review and recommend the
project be forwarded through the approval process.
All comments shall be typed, addressed and transmitted to the Director of the Planning and Zoning
Department for distribution to the applicant. Please include the name and phone number of the
reviewer on this memo. Michael Haag will be the Planning and Zoning Department staff member
coordinating the 1 st review of the project.
The Planning and Zoning Department will send the applicant a cover letter which includes the
comment(s) and directions to amend the plans to comply with the comments and the procedures
for resubmission. When the Planning and Zoning Department receives the amended plans, they
will distribute the plans with a cover memo to all TRC Members for review and approval.

RE: Security Gates & Emergency Access
To Whom It May Concern:
Boynton Beach Fire-Rescue continues to maintain the position that security gates are
potentially detrimental to fire and rescue operations. Th~ proliferation of security gat~d .
communities has resulted in many problems for responding emergency apparatus tryIng to gaIn
entry .
The minimum performance for all security gates should be as follows:
1) All gates must have one security entry code (0911)
2) The gate must remain open until the Fire-Rescue units have completed the call and have
reentered 0911 while leaving.
3) Gates may be operable by telephone from our dispatch office. A phone call from our
dispatchers will open the gate and a second call will be required to close the gate.
4) In case of power failure, the gate shall open automatically and remain :open.
5) An exception will be where a 24-hour security guard is stationed at the gate.
6) Authorized key security boxes (i.e. Knox, NuTech, Supra) should be located on all
buildings where alarms and/or sprinkler systems are located to assist in minimizing
damage due to rapid forcible entry.
7) Authorized key security boxes may be used on gates, provided each gate has one and it
is well marked. A key security box on a gate will not be used in lieu of any other section
of this letter.
8) No other code numbers, operating methods or key systems will be kept on file by the Fire
Department.
9) In the event our units are unable to gain rapid entry with the above methods, it will
require us to use rapid forcible entry methods to gain entry.
10) Information on where authorized key security boxes can be purchased is available from
Boynton Beach Fire-Rescue Fire Safety Division by calling #(561) 735-0272 during
normal business hours.
The liability of a delayed Fire-Rescue response to an emergency in your community should be a
serious concern.

RE: Hills of Lake Eden PUD (3rd Submittal) Master Plan

1. The applicant should include the Preservation Area Management Plan dated November 1995
(document A) as part of the Homeowner Association documents.
2. The Preservation Area Management Plan should be referenced on the master plan as comment
# 18 and all procedures outlined in document A will be completed by the applicant prior to
turning the preserve areas over to the Homeowner Association. (See document A, #4.0,
page 7).
3. The applicant shall install a six foot high black, vinyl-coated chain link fence around the
perimeter of the preserve areas (inside boundary) and place ''Natural Area Preserve" signs on
the fence at the rear of each lot adjacent to the preserve. (See document A, #4.0 A, page 7
and #8.0, page 12). The location of this fence shall be indicated on the master plan.
4. The applicant will add a note to the master plan prohibiting ~ intrusion into the natural area
preserves by application of wording suitable to the Department of Development Director.
This connnent will prohibit abutting lot owners from applying to the City of Boynton Beach
to construct any improvement to the lot which intrudes into the preserves. (See Building
Division Memo No. 96-011).
5. The preserve areas shall be designated by the appropriate term "tract" or "easement"
predicated on keeping these areas maintained in accordance with the Preserve Area
Management Plan by the Homeowner Association. The appropriate term selection shall be
reviewed by the Department of Development Director and the City Attorney.
(See document A, #9.0, page 12, #10.0, page 13).
6. The paragraph #5 described on #10.0 page 13 of document A shall be included as a note on
the maser plan.

1/2) inch by eleven (11) inch transparencies of the proposed landscape plans, wall
signage and detail drawings of the site wall and fencing. The documentation
depicted on the transparencies shall match the documentation shown on the
amended plans submitted for second (2nd) review. The amended plans required
for 2nd review and the transparencies are required by November 22, 1996.
26. For the presentation of the project to the Planning and Development Board and City
Commission, submit to the Planning and Zoning Department elevation view
drawings of the proposed site wall, special entry feature and project identification
signage that are colored (not mounted). The colored drawings shall specify the
color name, color code and manufacturer of the colors of all proposed colors. The
colors depicted on the color elevation view drawings shall match the colors specified
on the elevation view drawings submitted for 2nd review. The Planning and Zoning
Department staff will mount the colored elevation view drawings for presentations
to the Planning and Development Board and City Commission. The colored
elevation view drawings are required by November 22, 1996.
27. To compare the proposed design of the site wall, fencing and landscaping of the
proposed request to the adjacent properties, the applicant shall submit four (4) inch
by six (6) inch colored photographs of the adjacent properties. The photographs
shall be taken on the subject site outward to the adjacent property in all four
compass directions. More than one photograph from each side of the property may
be required to fully illustrate the architectural design and landscaping on the
adjacent property. To delineate what the picture is representing, place a label on the
front of the photographs identifying the compass direction with respect to the
subject site. The Planning and Zoning Department staff will mount the photographs
for presentations to the Planning and Development Board and City Commission.
The photographs are required by November 22, 1996.
28. Where applicable, the data identified on the site plan review application shall be
modified to be compatible with the data and information that is shown and identified
on the twelve (12) sets of plans that were amended to comply with staff comments.
The 12 sets of amended plans, including survey, are required to be submitted
no later than 5:00 PM, November 22, 1996. If the amended plans, revised
application and the other required supporting documentation are submitted
on November 22, 1996 before 5:00 PM the site plan review request will be
presented to the Planning and Development Board on December 10, 1996 and
forwarded to the City Commission on December 17, 1996 for final
determination.
29. Following review of the amended plans staff will prepare a staff report which
includes supporting documentation regarding the request. The staff report
(Planning and Zoning Department project package) will be transmitted to the
Planning and Development Board for their review. The Planning and Zoning
Department staff will notify the applicant's agent, as identified on the site plan
review application, when the documentation will be available for their review.
