CHECKLIST
The following list and information is provided as a checklist to ensure
that the submittal of amended plans and documents is substantially complete
for review. Turning in the list and the appropriate plans and documents
will enable the submittal to be efficiently checked prior to being accepted
by the Site Development Division of the Planning and Zoning Department.

Submit an amended Site Plan Review application form that reflects the
changes that were made as a result of amending the plans and documents
to comply with the Code of Ordinances and the Technical Review
Committee comments. A copy of the original form with a distinguishable
symbol identifying the change(s) may be submitted or a completed new
form with the changes identified. It is the agent of the owners
responsibility to notify the owner(s) of changes. If there are no
changes required to be documented on the application form, a letter
from the applicant stating same must be turned in with the amended
submittal.
~ Submit twelve (12) assembled and complete sets of plans and documents
that show compliance with the Code of Ordinances and comments made by
the Technical Review Committee. Two (2) of the sets shall have the
appropriate legible raised seal and signature of the designer
responsible for the drawing(s). Plans and documents shall be assembled
\ in twelve (12) individual complete packages with the title of the
UU- ~project on all pages and/or sheets and each page or sheet numerically

~ Submit a completed Community Appearance Board (CAB) review application
form with fifty dollars ($50.00) application fee payable to the City
of Boynton Beach. Copies of the form are available at the Site
Development Division of the Planning and Zoning Department.

We approve with the following comments.
1) Sidewalk shall continue across the northeast entrance to the
limit of construction line. Handicapped accessibility must be
provided on all walks.
2) Yellow centerline should be added to the Knuth Road entrance.
3) Plans as submitted are incomplete with respect to drainage.
Applicant must provide drainage calculations verifying capacity
of temporary dry retention. The contribution of off-site runoff
must be considered. Also, since pretreatment is being accomplished
off-site, a third party agreement is necessary along with a
statement of how future pretreatment is to be accomplished.
4) Applicant must obtain a South Florida Water Management District
permit or exemption and a Lake Worth Drainage District permit
prior to permitting.
5) Statement #6, Sheet C-2, requiring unsuitable material to be
disposed of on-site should be clarified by distinguishing between
topsoil and unsuitable debris.
6) At time of permit a blowing dust and sand mitigation plan must
be submitted for City approval.
7) Improvements to Knuth Road, including a bike path from Boynton
Beach Blvd. to the Knuth Road extension at Tara Oaks P.C.D., are
a condition of the larger P.C.D. Plans showing the location of
the bike path along this property have not been submitted or
approved. Approval of the 5' concrete sidewalk on the west side
of Knuth Road implies the developer's intention of construction
of the bike path along the east side of Knuth Road. Developer
shall confirm this assumption.
8) Bench mark must be shown on the construction plans.
9) The driveway on Boynton Beach Blvd. is located within 25' of the
proposed property line.
10) Access easement or suitable third party agreement for the Knuth
Road entrance must be provided prior to permitting.
11) Since there is an increase in trips per day over the previously
approved site plan, it will be necessary to submit the revised
traffic analysis to the County for review.

request to extend the limits for recordlng plats for the Knuth
Road p.e.D., Boynton Beach p.e.D. and Tara Oaks P.U.D.
These developments were approved by the City Commission on
December 18, 1990 and would expire on June 18, 1992 lf not
extended by the City Commission.
The City Commission has approved a preliminary plat and site plan
for the Knuth Road p.e.D. and infrastructure improvements for the
Tara oaks P.U.D. In addition, as indlcated in the attached
letter, removal of the exotics on the Boynton Beach p.e.D. has
been discussed with staff.
This request has been discussed with the members of the
Concurrency Review Committee and no objections have been raised
to the requested extensions.
This item has been scheduled for City Commission review on June
16,1992.

Dear Mr. Cutro.
It has recently come to our attention that the approvals for
the followin~ three proiects: Knuth Road PCD. Boynton Beach
Boulevard PCD. and Tara Oaks PUD. will require an extension
as of June 18. 1992. This letter serves as a formal request
for a time extension for these approvals.
Needless to say. the ~eneral economic state of the country
has substantially effected the ability of these proiects to
move ahead over the past 18 months. Unfortunately. due to
the substantial time requirements required in obtainin~
Comprehensive Plan amendments and development approvals
(approximately one year from date of application to final
approval). economic conditions can chan~e substantially
between the time an applicant makes application for a
proiect and an applicant is in a position to receive
approval to build that proiect. Nevertheless. we have
worked continuously on all three proiects durin~ the last 18
months to brin~ them to fruition.
As you are aware. several of the proiects are now in the
approval process and will most likely receive some final
approvals durin~ either the month of June or July. However.
in order to be sure that no deadlines are missed. we are
reQuestine official time extensions for all three proiects
to ensure that finai plattin~ can be recorded at such time
as ail governmental approvals are received.

The matter is scheduled to be heard by the Planning and
Development Board on May 12. 1992 and the City Council
on June 2. 1992. Assumi nf! approva I at th is time. the
proiect will then commence final platting. The proiect
is anticipated to be developed as a phased proiect with
the construction of a single outparcel initially and
the remainder ot the proiect to develop as economic
times allow. However. with the filing of the first
plat. it is our understanding that all further timin~
requirements of the Ordinances will be met.
3. Tara Oaks Planned Unit Development - Tara Oaks PUD is
currentlv in the process of platting for Phase I.
Specifical Iv. a portion of the PUD was master planned
for the utilization of the church at the corner of
Woolbrleht Road and Knuth Road. The applicant has
entered into contract with the church who wishes to
construct on said property. In this case. the
construction of Woolbri~ht Road was necessary in order
to provide proper access to the church parcel. Now
that t.his road has been constructed. the applicant has
filed all necessary permits for the construc~lon ot
Knuth Hoad alon~ the church's fronta~e. 'rhe church
wi II then subsequentlv fi Ie for a Phase I plat. for the
utilization of thIS property. It is anticipated that
the plat should be recorded for the site prIor to the

The following are comments in response to the submittal of the site plan
for the above referenced project. The project is scheduled for review of
comments at the February 13, 1992 Technical Review Committee Meeting.
1. An approved variance shall be required from the Board of Adjustment
due to the fact that the location of the property line of the proposed
service station is within the minimum 1000 feet of the nearest
property line of the lot or plot of land upon which a semi-public club
"The Lions Club" where large numbers of people congregate and a church
the "Corner Stone Christian Center" has services. Both the "Lions
Club" and the "Corner Stone Christian Center" share the same location
(3615 W. Boynton Beach Boulevard) on different days of the week. Since
these uses are outside the City we are verifying the comment with the
City Attorney and will inform you if this comment is valid. An
application for a variance from the Board of Adjustment can be
obtained at the Planning and Zoning Department.
2. The site is located in the II. Mediterranean/Spanish Design District.
Colors for the exterior elevations identifying color by name,
manufacturers and model or architectural style has not been submitted
or identified on the plans in compliance with the
Mediterranean/Spanish Design. Landscaping/ground cover do not comply
with the Mediterranean/Spanish Design District. The applicant shall
amend the plans to comply with the requirements of the Community
Design Plan. (Section 8.5.4, Chapter 4, Site Plan Review)
3. When reviewing and comparing the submitted site plan drawing sheet 2
of 7 and floor plan drawings sheet 5 of 7, there are inconsistencies
with the shape, size and location of the canopy above the pump island.
There are also inconsistencies with the pump islands. The plans do not
match. submit drawings that match.
4. The required off-street parking spaces are not clearly identified and
shown on the site.
5. The following have inconsistencies in the drawings for the on-site
required parking:
1. Site plan - Sheet 2 of 7
2. Floor plan - Sheet 5 of 7
3. Drainage plan - sheet 7 of 7
The above drawings do not match. (Section 7.2, Chapter 4, Site Plan
Review) Submit corrected site, floor and drainage plans that match.
6. A clearly defined vehicular circulating system cannot be determined
due to the inconsistencies on the submitted drawings. (Section 7.2.2
and Section 8.3, Chapter 4, site Plan Review)
7. The limits of construction shall be clearly indicated on the plans.
(Section 7.2.1, Chapter 4, Site Plan Review) Identify on the plans.
8. The property line shall be identified. It is not shown on the
drawings. (Section 7.2.1, Chapter 4, Site Plan Review)

9. If the property line is to be maintained, a perimeter landscaped
barrier shall be provided to form a continuous screen between the
off-street parking area and other use areas and shall be located
between the common abutting line of both properties. An administrative
appeal to the Landscape Code is required for a variance from this
requirement.
10. Prior to or with building permit applications, a cross access and
cross parking agreement between all concerned property owners shall be
submitted with the site plan documents.
11. There are no setback dimensions shown for the car wash building on the
south side of the site. (Section 7.2, Chapter 4, Site Plan Review)
12. The vehicles that exit the car wash are immediately in the
ingress/egress access aisle that passes directly in front of the exit
side of the car wash. This created an unsafe condition with regards to
the line of sight for the driver exiting the car wash. The car wash
should be repositioned to a location that would allow for an area at
the exit of the car wash to accommodate a vehicle. The new location
should in no way decrease the existing distance allocated at the
entrance of the car wash. The plans presently show a stack allowance
for three (3) cars.
13. The County Engineering Department is presently performing a traffic
analysis of the Master Plan for the Knuth Road P.C.D. site which
includes the service station. The analysis is required because of the
ingress/egress on Boynton Beach Boulevard that was added to the
service station site and other minor changes to the entire project.
The applicant must incorporate into the amended plans the conditions
that may be required as a result of the traffic analysis.
14. Identify setbacks on the site drawings for the sign on the Northeast
corner. (Minimum setback is 10'0")
15. The attached Community Appearance Board application form must be
completed and submitted by the applicant with a fifty dollar ($50.00)
application fee. Color samples of the exterior finish materials are
required to be submitted with the Community Appearance Board
application form. (Section 19-43, Article III, Chapter 19)
16. To determine compliance with the Landscape Code, the following
information must be added to the landscape plan: Identify the site
specific landscape specifications regarding the placement, location
and spacing of required landscape material. The specifications shall
be noted as identified in the text of the Landscape Code. Complete the
specifications by identifying the actual distance in feet and/or area
in square feet for each type of required site specific landscaping for
the proposed site. (Section 8.1 Chapter 4, Site Plan Review)
NOTE: The trees located in the perimeter greenbelt must comply with
the previous Planning Department comment regarding the entire PCD.

Several questions impacting ultimate site design were addressed at the previous
Technical Review Committee meeting, the main being the receipt of the Palm Beach
County Traffic comments. Because the outcome of these issues would require
re-examination of the site plan, we choose not to review or consider approval at
this time.
In lieu of approval we offer the following courtesy comments.
1) The internal driveway between the bank and the gas station must be closed
to eliminate the possibility of cut through traffic.
2) The entrance off Knuth Road must, at construction of the remainder of the
shopping center, have a 100' throat.
Since these outstanding issues also impact the master plan and plat submittal
we recommend action on these submittals also be postponed.

Find attached for your review the plans and exhibits for the
above referenced project(s). To ensure that the review of the
project(s) meet the procedural goals of the Site Plan Review
Ordinance, I request that the plans and exhibits be reviewed and
formal comments transmitted to the Site Development Division of
the Planning and Zoning Department no later than 5:00 P.M. on
February 6, 1992.
Adhering to the following review guidelines will promote a
comprehensive review and enable the applicant to efficiently
obtain Technical Review Committee approval:
1. Use the review standards specified in Part III, Land
Development Regulations, Chapter 4, Site Plan Review,
Section 8 to review and formulate comments. (See attached)

2. The documents submitted for the project were determined to
be substantially complete based on the submittal
requirements identified in Section 7 of the Site Plan Review
Ordinance. However, if the data provided to meet the
submittal requirements is insufficient to properly evaluate
and process the project based on the review standards,
additional data should be requested by the reviewer through
the Planning and Zoning Department.
3. Each comment shall reference the code section its based on
and if necessary include the language of the submittal
requirements and review standards that require the data to
be submitted for review.
4. Technical Review Committee member(s) shall identify in their
comments when the plans depict or when the location and
installation of their departmental required improvements may
conflict 'lith other departmental improvements.
5. When a TRC Member finds a code deficiency that is outside of
his/her review responsibility, the comment and the specific
code section may be included in their review comments with
the name of the appropriate TRC Member that is responsible
for the review of the item.
6. If a TRC member finds the plans acceptable, he/she shall
forward the plans and a memo, within the time frame stated
above, to the Planning and Zoning Director stating that the
plans are approved and they do not have any comments on the
plans submitted for review.
All comments shall be typed and addressed to the Planning and
Zoning Director and transmitted to the Site Development Division
for distribution to the applicant. Please include the name and
phone number of the reviewer on this memo.
The Site Development Division will send to the applicant a cover
letter which includes the comment(s) and directions to amend the
plans to comply with the comments and submit to the Site
Development Division within 90 days for review. When the Site
Development Division receives the amended plans, they will
distribute the corrected plans with a cover memo to all TRC
Members for review and final approval.

Phase I Preliminary Plat Submittal
In confirmation of our discussions on this matter, I understand
that Mr. Rossi will deliver documentation as requested prior to
the TRC meeting. In addition, Mr. Rossi is proceeding with a
master plan modification through the Planning Department. The
Phase I plat can be accepted and reviewed without a master plan
modification being submitted. However, if the plat doesn't agree
with the master plan previously approved or reviewed, the Engi-
neering Department should so note in the plat review comments.
The Engineering Department must coordinate with the Planning
Department to verify the plat submittal conforms to the master
plan.
