RIDER TO SITE PLAN APPLICATION
The undersigned as applicant for Final Site Plan Approval does
hereby acknowledge, represent and agree that all plans,
specifications, drawings, engineering, and other data
submitted with this application for review by the City of
Boynton Beach shall be reviewed by the various boards,
commissions, staff personnel and other parties designated,
appointed or employed by the City of Boynton beach, and any
such party reviewing the same shall rely upon the accuracy
thereof, and any change in any item submitted shall be deemed
material and substantial.
The undersigned hereby agrees that all plans,
specifications, drawings, engineering and other data which may
be approved by the City of Boynton Beach, or its boards,
commissions, staff or designees shall be constructed in strict
compliance with the form in which they are approved, and any
change to the same shall be deemed material and shall place
the applicant in violation of this application and all
approvals and permits which may be granted.
The applicant agrees to allowing the City of Boynton
Beach all rights and remedies as provided for by the
applicable codes and ordinances of the City of Boynton Beach
to bring any violation into compliance, and the applicant
shall indemnify, reimburse and save the City of Boynton Beach

CHECKLIST ITEMS:
1) We are resubmitting the original Site Plan Review/Conditional Use
application with all changes crossed out with new information added in its place
for the applicable item.
2) There are no buildings on property adjacent to the subject site(s), In
addition there are no buildings on the subject site,
3) Color elevation of building improvements to be constructed on site is
being submitted at this time,
4), Color samples, Benjamin Moore Mooreguard Royal Blue and GN6 (light
grey) paint chips along with a stucco sample are being submitted at this time,
Response to TRC Comments
1) We have reviewed all comments made by Engineering, Bill Hukill. It is our
understanding that all comments must be complied with prior to issuance of a
Building Permit.
2) We have reviewed all comments made by Planning and Zoning, Mike
Haag. New plans being submitted on this date reflect changes regarding Items
#1 and #2. All other items will be complied with prior to the issuance of a
Building Permit. A sign package will be submitted at a later date prior to
issuance of C, O. on the completed building,
3), We have reviewed all comments made by Director of Utilities, John
Guidry. Plans are being redrafted to reflect all comments made and it is our
understanding that no Building Permits will be issued until all comments have
been addressed and changes made to the plans.

4) We have reviewed all comments made by City Forester, Kevin Hallahan,
We have met with the City Forester and the revised landscape plans reflect tree
removal mediation, tree relocation on site, It is our understanding that no
Building Permits will be issued until all conditions of the City Forester have been
met.
Preliminary Sewer and Water plans have been forwarded to Fire, Engineering
and Public Works for review and comments, The plans submitted were not a
formal submittal, but for discussion and comments only. Engineer for the project,
Mark Williams of Southern Design will/has contacted the various departments to
get comments and will have final drafts ready for submittal to the City agencies,
HRS, and SFWMD on Monday or Tuesday of next week,
Based on comments made at TRC and based on engineering imput we have
decided to pursue three points of ingress / egress to the subject site. This
decision was made after looking at the ultimate design of the medians as they
relate to parcels on the opposite side of the street as well as the subject
properties side of the street. The center island will be labeled as a right turn in
right turn out only with no U-turn in the median,
We would like to have staff explore how we can most easily accomodate having
three points of ingress/egress approved for the site without holding up the site
plans approval process.

RIDER TO SITE PLAN APPLICATION
The undersigned as applicant for Final Site Plan Approval does
hereby acknowledge, represent and agree that all plans,
specifications, drawings, engineering, and other data
submitted with this application for review by the City of
Boynton Beach shall be reviewed by the various boards,
commissions, staff personnel and other parties designated,
appointed or employed by the City of Boynton beach, and any
such party reviewing the same shall rely upon the accuracy
thereof, and any change in any item submitted shall be deemed
material and substantial.
The undersigned hereby agrees that all plans,
specifications, drawings, engineering and other data which may
be approved by the City of Boynton Beach, or its boards,
commissions, staff or designees shall be constructed in strict
compliance with the form in which they are approved, and any
change to the same shall be deemed material and shall place
the applicant in violation of this application and all
approvals and permits which may be granted.
The applicant agrees to allowing the City of Boynton
Beach all rights and remedies as provided for by the
applicable codes and ordinances of the City of Boynton Beach
to bring any violation into compliance, and the applicant
shall indemnify, reimburse and save the City of Boynton Beach
harmless from any cost, expense, claim, liability or any
action which may arise due to their enforcement of the same.
