TRAFFIC OBSERVATIONS - LAWRENCE ROAD
DATE:
The 1994 average traffic count on Lawrence Road between NW 22nd
Avenue (Gateway) and Hypoluxo has been reported to us by the County
to be 7972 trips. The current FDOT Level of Service Manual defines
the threshold traffic level for LOS D for 2 lane undivided streets
as 13,400 trips.
Those two numbers are important in studying Lawrence Road traffic
because the Palm Beach County Traffic Engineering Division has
informed Mr. Hall of this office that widening of two lane roads in
the County system is not seriously considered until LOS D is
reached. Lawrence Road is a County road.
The Traffic Division has also opined that about 1000 more units can
be occupied on Lawrence Road before LOS D is reached. Well over
1000 more units have been approved by either the City or County, as
follows:

The figure 1680 is not propounded to be exact, because each of the
entries marked "unbuilt units" represents our estimate of how many
units remain to be occupied in uncompleted developments. Traffic
from occupied units appears in actual traffic counts totaling 7972
trips. We believe it is reasonable to predict that when all
unoccupied units in all listed developments are in place, the Level
of Service Standard will exceed LOS Standard E, which is 15,000
trips. LOS D will be reached when approximately 2/3 of the 1680
future units are occupied.

We have been unable to obtain accurate estimates of revenue
collected from dwelling units now contributing to the 7972 trips on
Lawrence Road. If we assume 1600 dwelling units have generated
those trips, and the average traffic impact fee collected was $1500
per unit, the total fees generated to date exceed $2,400,000. The
total fees due from 1680 additional units will exceed $2,500,000,
representing a total at build-out of $5,000,000~ generated by these
developments to be spent in the immediate area. These numbers are
estimates, of course, and should be adjusted for traffic impact
fees generated by other users who pay such fees (commercial, etc.)
and those who don't (schools).
Our conclusion is that it is time for the County to begin planning
for widening of Lawrence Road so that when LOS D is reached, action
can be immediately implemented to begin construction. A four lane
undivided road will support 23,520 trips at LOS D, which is
adequate for all completed and currently proposed development along
Lawrence Road.

master plan modification to allow a conventional lot layout for
houses with 5 foot side setbacks.
It is unclear from the applicant's letter and the original
comments made by departments during the master plan modification
review, whether the modification applied only to phase one or
phase two.

To be certain that the whole master plan has been reviewed, we
have attached a copy of the full master plan with the setback
limits for both phase one and phase two shown. (Phase two is the
~rea north and east of Bedford Blvd.) Please determine if your

either in writing or verbally by August 9, 1993.

Pursuant to our discussions of this day, please be advised that I
am requesting that you ~ee & Jenso~ perform a review of the above
referenced plat and associated construction plans and forward the
comments to my attention as soon as possible.
Comments were due from Mr. Archdeacon on July 16, 1993 (see attached
Engineering Department Memorandum No. 93-186) and yesterday he sent
a letter to the Developer's Engineer, that being Enrico "Ricn Rossi,
indicating that the City Engineer would not comment on the plans for
the reasons stated in the letter (see attached letter).
As you are aware, K. Hovnanian has submitted over $17,000.00 in sub-
mission fees and should rightfully be afforded a comprehensive review,
i.rrespective of the number of plat or construction elements not in
conformance with City Codes.
Without specific direction from City staff relative to what is per-
cieved to be areas of non-conformance, the Developer may begin to
revise plans in such a way as to generate yet another review, resulting
in unnecessary delays.
I do not understand what has happened between Friday July 16, 1993
and this day, reference why the Developer's Engineer wasn't contacted
sooner reference providing comments in an expeditious and timely
manner. Your immediate assistance would be greatly appreciated.

Commission ruling of July 20, 1993, I would suggest that this
plat be thoroughly checked prior to resubmission to this
department. I am not listing my comments as they are too

In addition, your cost estimate for bonding is insufficient in
that no clearing, earthwork, sidewalks nor irrigation items were
included. Also landscaping and shoulder quantities are
insufficient. Please rework and resubmit.

Request for Departmental Review and Comments
The Engineering Department for the Ctiy of Boynton Beach, Florida
is in receipt of the above referenced final plat submission and
requests that your department(s) review the provided final plat
documents and associated construction plans.
Procedurally there will be no Technical Review Committee meeting
relative to the review of this project and departments are requested
to submit staff comments to the attention of Vincent A. Finizio,
Deputy City Engineer, no later than 5 p.m., Friday, July 16, 1993.
Should your department find the plans acceptable, we request that
you visit the Engineering ~artment and sign off on the submitted
Development Plans and prel ~ Plat. This project is scheduled
before the City Commission for their final disposition on
August 3, 1993, therefore, your adherence to the comment submission
due date would be greatly appreciated.
Pursuant to City Code, each staff member shall track man/woman hours
expended during the review of this plat and shall report to the
undersigned the number of hours in review and the current rate of
pay for each staff member involved.
In any event, please return the plans, along with your comments,
so they may be distributed to the City Commission.

We offer the following comments under the premise that the subject
plans are for a Preliminary Plat approval, as stated in the third
paragraph of your memo no. 93-186:
1) The sewer runs from MH 7 - 7A and MH 7A - 7B must be deepened
to maximum depth so as to allow extension of the sewer to the south
property I ine of the adjacent property, thereby el iminating the
need for an additional lift station. (Sect. 26-16)
2) A reservation fee of $ 13,582.80 is due within 30 days of City
Commission approval of the Preliminary Plat, or prior to my
approval of the Health Unit applications, whichever comes first.
(Sect. 26-34 E)
3) Previous Palm Beach County Heal th Uni t/HRS permi ts for the
water and wastewater systems have expired. Permit #5088-4946 OX
for the water system expired on April 22, 1990, and permit # cs-
103-88 for the wastewater system expired on April 25, 1990. Active
permits must be in place and submitted prior to Final Plat_ing.
All water and wastewater plans and HRS applications shall be re-
submitted to this office, and shall be revised to conform with
current standards. (App. C, Art. VIII sect. 7A)
4) Provide a typi ca 1 detai 1 showing the I oca t ion of power,
telephone, and television cables to be co-located in front utility
easements with water and sewer services.

a) Sewer services near MH #10 on line A, and MH #9 on line B
shall be re-aligned.

Final plat
Based upon the July 20, 1993 City commission one year, retroactive
extens ion of the Lawrence Grove, Plat No. 2, which expired on
December 21, 1988, the comments below have been revised accordingly
as we discUS8 ed on Thursday, July 22 f 1993, I concur with your
statement that the plans contain many problems, some of which are
serious in nature, therefore I would recommend that a Technical
Review Committee meeting be scheduled for this request. Our office
alone has spent eight hours researching the 1988 preliminary plat,
conducting a site visit, reviewing the new plans, coordinating with
other departments and preparing comments; an inordinate amount of
time for a final plat submittal, which could have been
significantly reduced if a Technical Review Committee meeting were
scheduled.
1. The 1988 approval of the Lawrence Grove plat No, 2,
preliminary plat predates the City!s June 1: 1990 adoption of
the concurrency management ordinance, therefore since the 1988
preliminary plat plans are resurrected and retroactively
extended to July 20, 1994, concuiTency 2.-eview of public
facilities (potable water, sanitary sewer, solid waste,
district parks and recreation facilities) that would normally
occur as part of the preliminary plat process, must occur now.
OUi- office has completed the concurrency i-evlew for solid
waste (see attached Exhibit "All) and district parks and
recreation facilities (see Exhibit "E").
Relative to recreation facilities, it is assumed that the land
value set in 1988 for the purpose of calculating the park and
recreation fee in lieu of dedlcating land is to be used. It
should be noted that the additional unit approved last month
as part of the master plan modification is within the
boundaries of plat 2 (see comment #2 below). This will
affect the fee previously calculated since the formula factors
in number of units. Appendix C - subdivisions, Platting,
Article IX, Sectlon 8.

Due to a conflict on recently approved master plan
modification drawings, it is unclear whether the additional
unit approved as part of a master plan modification request,
is within the boundaries of plat 2 or plat 1. The applicant
has expressed his interest in waiting to commit to the
construction of the additional unit and the additional unit is
not shown on the plans submitted, making them inconsistent
with last month's approved master plan modification. since
the location of the unit would impact the submitted drawings,
the appl icant Dust commit one way or another and proceed
accordingly with a master plan modification, a replat of plat
1 or revision of the submitted plans.

proposed on the plans submitted, there could be a problem with
constructing the conventional units according to the setbacks
shown on the master plan on lots 1, 4, 13, 53, 57, 70, 78, 80
and 94. In addition, the note on the plat cover sheet
regarding setbacks are the setbacks approved by a master plan
modification for plat Fl, not the subject plat. Furthermore,
any reference to setbacks on the plat should be removed,

approval of a master plan modification, approved after the
plat is recorded, necessitating a separate instrument to be
prepared and recorded to negate the setbacks established on
the plat,

The landscape plans for the two lakes, grove preservation area
and the buffer wall were approved by the Community Appearance
Board in February of 1988. Landscaping was installed at the
time the infrastructure for plat #1 was installed, however a
final inspection has not yet occurred. A field check has
determined that the landscaping within plat #2 needs
maintenance. Since no master landscape drawings were
submitted with the plans, the applicant shall verify that all
of the landscaping shown on the 1988 plans is existing or file
amended landscape plans to reflect changes. Verification can
be combined with the City Forester's procedure for littoral
zone/preservation monitoring reports submitted to Kevin
Hallahan.
There is a difference in the acreage of the referenced plat as
shown on the 1988 preliminary plat drawings versus the plans
submitted for final plat approval. Verify the acreage within
the boundaries of plat #2.

The 1988 preliminary plat drawings indicate a four feet wide
easement on the zero lot line side of all lots for wall
maintenance and roof drainage, The submitted plans do not
show these easements. If zero lot line units are proposed,
such easements are necessary.

The plat indicates a combined road way/drainage/utility
easement. The plat cover sheet does not mention the purpose
of a road way easement and the only improvements within this
easement are utilities and drainage. Therefore, it is
recommended that the reference to road way be deleted; the
roads are included within separate tracts, not encumbrances to
private 10tE.
8.
Lot 29 on the plat is missing proper drafting dimensions for
the ten feet wide utility easement.
9 .
Tract "X" on the plat is missing proper survey data.
The four feet v.lide buffer wall easement shown on the plat
shall be referenced on the plat cover sheet for dedication and
maintenance purposes.

If a sidewalk on a least one side of the local street is

get a determination on sidewalks prior to the submitted plans
being revised.

minimum width of a private local street is 22 feet; two,

SUBJECT: Lawrence Groves Plat 2-Concurrency Review for Solid Waste
The level of service standard adopted for solid waste is 7.2 pounds
per capita per day. Since it is unclear to me whether this
standard is to reflect total processing ability, from source to
landfill, or just the City's capacity to manage solid waste (since
each government producing a Chapter 163 plan adopted their own
solid waste standard), I am not certain how this standard should be
monitored. Furthermore, even if it applied to our local system,
monitoring would be difficult since certain commercial and multi-
family waste is combined (thus making it impossible to record
strictly the volume of residential waste). Until such time that a
method is developed to closely monitor residential waste and
therefore this standard, we must assume, for obvious reasons, that
the standard is being met. I will keep you advised.

The following analysis of the availability of parks and recreation
facilities was based on a current peak population of 55,350 persons
(Bureau of Economic and Business Research's most current permanent
population estimate of 48,144, and an estimate of 7,206 seasonal
residents), and the needs analysis of parks and recreation facilities
utilized in the city's Comprehensive Plan. This analysis was conducted
pursuant to the requirements for concurrency review and certification.
According to the City's Concurrency Ordinance, Plat 2 of the
Lawrence Groves PUD is a "B" category development order. Concurrency
review must therefore, in part, consist of a review of district parks
and recreation facilities.

Developer's Request for Retroactive Time Extension Authorizing
the Late Filing of a Final Plat
Rossi & Malavasi Engineers, Inc.
PROJECT HISTORY
K. Hovnanian Corporation, thru their Developer's Engineer, that being
Rossi & Malavasi Engineers, Inc., filed a preliminary plat for Lawrence
Groves, Plat #1 and Plat #2 on April 26, 1988 (see attached speed
memo). In May of 1988, the final plat for Lawrence Groves, Plat #1
(see attached location plan) was approved by the City Commission on
June 7, 1988, as recorded in Plat Book #60 on pages 21 thru 23 on
June 24, 1988. The Developer then commenced construction of Plat #1
which to date is nearing final completion.
The subject matter of this request involves Lawrence Grove, Plat #2
preliminary plat which was approved by the City Commission (technical
compliance) on June 21, 1988 (see attached Planning Director's letter
to Developer's Engineer, dated June 29, 1988) at which time the
Commission established the per acre value of $61,989.38 to be utilized
in the formula for the required submission fee relating to Parks and
Recreation dedications. According to the City's code at that time,
the Developer had a time interval of 12 months in which to submit for
final plat review (required filing date June 29, 1989). The
Developer did not file the final plat in the aforementioned time
interval.
BASIS OF DEVELOPER'S REQUEST
The Developer, pursuant to the attached July 13, 1993 letter, requests
a retroactive time extension from June 21, 1989 thru August 3, 1993
(City Commission meeting). The applicant's request for the time
extension is founded upon the following:
The preliminary plat and associated construction plans were
previously approved by the City and that the applicant's failure
to submit within the twelve month time period is harmless, as the
City's Code of Ordinances, reference Appendix "C", Sub4ivision and
Platting Regulations, has not substantially changed since the

approval date, therefore, a denial of the time extension would
require the Developer to proceed back to "square one" requireing
a complete re-review by all boards and committees, when in fact
the plan currently is in a state of conformance with City
standards in effect in 1988.
Hovnanian Companies has submitted the appropriate Subdivision
Ordinance Filing Fees, the required 2% Administration Fees and fees
relating to street light submissions. Additionally, based upon City
records, Hovnanian Companies shall, upon approval of the time
extenion or approval in the future of resubmitted plans by the City
Commission, be responsible to submit monies in the amount of
$109,349.26 constituting a fee in lieu of recreation.
SPECIAL CIRCUMSTANCES
The master plan for Lawrence Grove, including the preliminary and
final plat for Plat #1, as well as the preliminary plat for Plat #2,
was approved by the various City boards and committees without benefit
of depicting sidewalks upon approved plans. Current City policy,
established after 1990 under the direction of J. Scott Miller, City
Manager, requires the installation of sidewalks within all subdivisions,
irrespective of zoning classification or PUD status. At the time of
review for the Lawrence Grove project, City staff, committees and
boards frequently approved subdivisions without sidewalks, ie., Boynton
Lakes, Quail Run, Meadows Tract A, Meadows Tract M, various sections
of Golfview Harbour, various sections of Forest Park subdivision,
Dos Lagos, etc. etc. The Lawrence Grove, Plat #2 subdivision plans
were created consistent with that policy in existence during the 1988
review, resulting in a roadway system comprised of 22' pavement
within 24' right-of-way with drainage, utility and other easements
situated in the exact spot where sidewalks would have been installed
had this project been reviewed to today's policy. As the residential
lots were platted within I' of the edge of pavement, the installation
of sidewalks would either encroach over utility easements or cause
these utility easements to be moved behind a sidewalk easement which
would be added possibly necessitating expensive sidewalk removal and
replacement programs each time repair work would be initiated to
correct future anticipated normal damage to said lines. The sidewalks
(if required by City Commission) would, with lots as currently depicted,
have to be placed solely on private individual residential lots thereby
decreasing front lawn areas, further encroaching over drainage easements
shown within the private lot frontal areas. Of further note is the
fact that the 24' wide roadways within Plat #1 (in place) does not
contain sidewalks, therefore a requirement to construct sidewalks within
Plat #2 may result in a sidewalk system which is not compatible with
the remainder of the master plan site.

ENGINEERING DEPARTMENT RECOMMENDATION
The Engineering Department for the City of Boynton Beach, Florida
does not recommend approval of the requested retroactive time extension,
based upon the fact that the Developer did not follow standard
procedures developed by the City in requesting time extensions and
thereby forfeited his rights to the approved plans. In addition to
sidewalks, there may be additional engineering concerns affecting
our review and approval.
