Notification of City Commission Action
Dear Mr. Rossi:
Please notify your client, that being Ms. Morgan, that the City
Commission, during their regular September 7, 1993 meeting, approved
your request for a partial bond reduction, therefore, the posted
surety in the amount of $53,000.00 has been reduced to the amount
of $8,000.00 which shall be retained by the City in order to ensure
the completion of required infrastructure improvements within the
Lawrence Lake subdivision.
I am transmitting a copy of this letter to our Finance Director,
Mr. Grady Swann, and requesting that he process the attached direct
requisition payment request for the return of Ms. Morgan's surety.
For further details as to when the monies will be available, please
contact Mr. Swann at (407) 375-63ll.

Dear Mr. Fuller:
As requested, I am providing you with the necessary documentation
that verifies the status of the Lawrence Lakes PUD with respect
to concurrency and the completion of required improvements.
Accompanying this letter please find an excerpt from the Minutes
of the October 21, 1991 regular city Commission meeting. As
verified by the Minutes, the City Commission essentially
eliminated the original date by which the surety was to be posted
(August 21, 1991), and replaced it with the requirement that the
new owner would be responsible for posting surety, and that such
surety would be posted prior to further construction on the site.

VII. OLD BUSINESS
Status of Lawrence Lake P.U.D. postinq of Surety
Mr. Cutro said in August 1991, the City Commission approved
an extension for the owners of Lawrence'Lakes PUD'to
complete the infrastructure improvements, with the condition
r.hat the surety had to be posted by August 21~ 1991. Prior
to being.able to post surety, the FDIC took over the bank
that held the property that was requesting that extension.
There is now an interested buyer. Mr. cutro recommended
that the City accept the surety at the time of closing on
the property.
aill Jarkesv, of Perry, Shapiro & Miller, said. she went
before the Planning & Zoning Board in August. At that time
she represented the Bank of South Pal~ Beach and the bank
had agreed to post surety. That following Friday, the FDIC
took over the bank. Presently she represents the FDIC and
they have set the property up for bid and are anticipating
selling it within the next sixty days. She requested the
City Commission wait until the new purchaser comes in and
then allow surety to be posted by the new purchaser.
Commissioner Matson moved that the extensions of concurrency
and master plan to August 21, 1992 be left in place and that
prior to any construction of infrastructure or homes at .
Lawrence.Lakes that the new owner be required to do the
following: Prepare a full engineering.report for the City
and request inspections of complete~ infrastructure if
appropriate and that surety for the-remainder of the
infrastructure be posted. Vice Mayor Harmening seconded the
motion which carried 5~O. .

entered into a contract to purchase this property from FDIC.
It is my understanding that an extension of time was granted by the

a letter of credit, as per your memorandum #91-243.
I would appreciat~ a confirmation to the effect that the extension

Please be advised that on Tuesday, August 13, 1991 the Planning
and Zoning Board approved your request and granted a one (1) year
time extension to the Lawrence Lake PUD concurrency exemption
status. Said time extension will be valid from August 21, 1991
to August 21, 1992.
As previously discussed, surety for the unbuilt portion of the
required infrastructure must be posted prior to the twenty-one
(21) month expiration (August 21, 1991), of the original approval
of the final plat.

This xirm represents the Bank ox the South Palm Beaches relative to
Lawrence Lake Planned Unit Development. In June, 1991, the Bank
xoreclosed on this property which was previously owned by James R.
Merola, as Trustee.
We were just recently retained by the Bank ox the South Palm
Beaches, and thus, have not reviewed the PUD xile at the City ox
Boynton Beach. Nevertheless, we would like to preserve our rights
pursuant to the status ox this Planned Unit Development.
Therexore, we request that the City ox Boynton Beach extend both
the PUD Master Plan approval and/or the 21-month time period
required to complete all required improvements pursuant to the
xinal plat. Furthermore, we respectxully request that the City ox
Boynton Beach grant an extension xor the Lawrence Lake PUD
concurrency.
It is my understanding that this request will need to be reviewed
by the Concurrency Review Committee, the Planning and Zoning Board
and perhaps the City Commission. Please advise accordingly.

Dear Mr. Miller:
Bank of South Palm Beaches holds a first mortgage on the
33 Unit residential project known as Lawrence Lakes on
Lawrence Road. Mr. Vince Finizio contacted the Bank upon the
expiration of the l~tter of credit , 191 which ensured
completion of the infrastructure.
At this time, the Developer is in default and the Bank
is pursuing it's rights under the loan documents. In the
event the Bank must foreclose, it requests the city of
Boynton Beach to take no action with respect to the
expiration of surety and agrees that upon resolution of the

NOTICE OF RIGHTS
This Notice of Rights is intended to inform the recipient of the administrative and judicial review which may be available as
mandated by section 120.60(3), Florida Statutes. Be advised that although this notice is intended to be comprehensive, the review
procedures set forth herein have been the subject of judicial construction and interpretation which may affect the administrative of
judicial review available. Recipients are therefore advised to become familiar with Chapters 120 and 373, Florida Statutes, and the
judicial interpretation of the provisions of these chapters.
1. If a substantially affected person objects to the staff's recommendation, that person has the right to request an administrative
hearing on the proposed agency action. The substantially affected person may request either a formal or an informal hearing,
as set forth below. Failure to comply with the prescribed time periods shall constitute a waiver of the right to a hearing.
2. If a substantially affected person believes a genuine issue of material fact is in dispute, that person may request a formal hearing
pursuant to section 120.57(1), Florida Statutes, by filing a petition not later than:
a. IF NOTICE OF THE APPLICATION WAS PUBLISHED BYTHE APPLICANT, within fourteen (14) days after
mailing of the proposed agency action or

Administrative Code, a copy of which is attached. Petitions are deemed filed upon receipt by the District. Failure to
substantially comply with the provisions of Rule 40E-1.521, Florida Administrative Code. shall constitute a waiver ofthe rightto
a 120.57(1) hearing. If a petition for administrative hearing is not timely filed, the staff's proposed agency will automatically
mature into final agency action.
3. If a substantially affected person believes that no issues of material fact are in dispute, that person may request an informal
hearing pursuant to section 120.57(2), F.S., by filing a petition for hearing not later than:
a. IF NOTICE OF THE APPLICATION WAS PUBLISHED BY THE APPLICANT, within fourteen (14) days after
mailing of the proposed agency action or
b. IF NOTICE OF THE APPLICATION WAS NOT PUBLISHED, within fourteen days after receipt of actual
notice.
A request for informal hearing shall be considered as a waiver ofthe right to request a formal section 120.57(1), F.S., hearing. A
request for a section 120.57(1), F.S., formal hearing not in substantial compliance with the provisions of rule 40E-1.521, FAC.,
may be considered by the District as a request for informal hearing. If a petition for administrative hearing Is not timely filed, the
staff's proposed agency action will automatically mature into final agency action. I
4. Pursuant to section 373.114, Florida Statutes, a party to the proceeding below may seek review of a Final Order rendered on the
permit application before the Land and Water Adjudicatory Commission, as provided therein. Review under this section is
initiated by filing a request for review with the Land and Water Adjudicatory Commission and serving a copy on the Department
of Environmental Regulation and any person named in the Order within 20 days after rendering of the District's Order.
However, when the order to be reviewed has statewide or regional significance, as determined by the Land and Water
Adjudicatory Commission within 60 days after receipt of a request for review, the commission may accept a reqllest for review
from any affected person within 30 days after the rendering of the order. Review under section 373.114, Florida Statutes, is
limited solely to a determination of consistency with the provisions and purposes of Chapter 373, Florida Statutes. This review
is appellate in nature and limited to the record below.
5. A party who is adversely affected by final agency action on the permit application is entitled to judicial review in the District
Court of Appeal pursuant to section 120.68, Florida Statutes, as provided therein. Review under section 120.68, Florida Statutes
in the District Court of Appeal is initiated by filing a petition in the appropriate District Court of Appeal in accordance with
Florida rule of appellate Procedure 9.110. The Notice of Appeal must be filed within 30 days of the final agency action.
6. Section 373.617(2), Florida Statutes. provides:
Any person substantially affected by a final action of any agency with respect to a permit may seek review
within 90 days of the rendering of such decision and request monetary damages and other relief in the circuit court
in the judicial circuit in which the affected property is located; however, circuit court review shall be confined
solely to determining whether final agency action is an unreasonable exercise of the state's pOlice power
constituting a taking without just compensation. Review of final agency action for the purpose of determining
whether the action is in accordance with existing statutes or rules and based on component substantial evidence
shall proceed in accordance with Chapter 120.
7. Please be advised that exhaustion of administrative remedies is generally a prerequisite to appeal to the District Court of
Appeal or the seeking of Circuit Court review of final agency action by the District on the permit application. There are,
however, exceptions to the exhaustion requirement. The applicant is advised to consult the case law as to the requirements of
exhaustion exceptions.

1. EXISTING: The existing site consists of farm fields and associated ditches.
The Lake Worth Drainage District (LWDD) L-21 Canal right-of-way
forms the northern project boundary, undeveloped lands form the
southern and eastern boundary and Lawrence Road and two private
residences form the western project boundary.
2. PROPOSED: A series of grassed swales, inlets and culverts will direct runoff
into a 1.71-acre lake. Discharge from the lake is via 1-2' wide
weir with a crest at elevation 16.9' NGVD, 1-6" high by 6" wide
inverted triangular orifice with. an invert at 12.5' NGVD and 50 LF
of 24" diameter CMP culvert into the LWDD L-21 Canal.
