I am transmitting a copy of this letter to our Finance Director, Mr. Grady Swann, and requesting that he process the attached direct requisition payment request for the return of Ms. Morgan's surety. As verified by the Minutes, the City Commission essentially eliminated the original date by which the surety was to be posted (August 21, 1991), and replaced it with the requirement that the new owner would be responsible for posting surety, and that such surety would be posted prior to further construction on the site. OLD BUSINESS Status of Lawrence Lake P.U.D. postinq of Surety Mr. Cutro said in August 1991, the City Commission approved an extension for the owners of Lawrence'Lakes PUD'to complete the infrastructure improvements, with the condition r.hat the surety had to be posted by August 21~ 1991. Prior to being.able to post surety, the FDIC took over the bank that held the property that was requesting that extension. There is now an interested buyer. Mr. cutro recommended that the City accept the surety at the time of closing on the property. aill Jarkesv, of Perry, Shapiro & Miller, said. she went before the Planning & Zoning Board in August. At that time she represented the Bank of South Pal~ Beach and the bank had agreed to post surety. That following Friday, the FDIC took over the bank. Presently she represents the FDIC and they have set the property up for bid and are anticipating selling it within the next sixty days. She requested the City Commission wait until the new purchaser comes in and then allow surety to be posted by the new purchaser. Commissioner Matson moved that the extensions of concurrency and master plan to August 21, 1992 be left in place and that prior to any construction of infrastructure or homes at . Lawrence.Lakes that the new owner be required to do the following: Prepare a full engineering.report for the City and request inspections of complete~ infrastructure if appropriate and that surety for the-remainder of the infrastructure be posted. Nevertheless, we would like to preserve our rights pursuant to the status ox this Planned Unit Development. Dear Mr. Miller: Bank of South Palm Beaches holds a first mortgage on the 33 Unit residential project known as Lawrence Lakes on Lawrence Road. Mr. Vince Finizio contacted the Bank upon the expiration of the l~tter of credit , 191 which ensured completion of the infrastructure. At this time, the Developer is in default and the Bank is pursuing it's rights under the loan documents. In the event the Bank must foreclose, it requests the city of Boynton Beach to take no action with respect to the expiration of surety and agrees that upon resolution of the matter in it's favor, it will promptly provide surety in the form of a letter of credit for the balance of the uncompleted infrastructure. Due to the length of time anticipated to bring the matter to conclusion, Bank of South Palm Beaches also requests a 12 month extension during which to complete said infrastructure. I understand these requests must be heard before the city Commission and would greatly appreciate your assistance in getting them presented. The Lake Worth Drainage District (LWDD) L-21 Canal right-of-way forms the northern project boundary, undeveloped lands form the southern and eastern boundary and Lawrence Road and two private residences form the western project boundary. 2. PROPOSED: A series of grassed swales, inlets and culverts will direct runoff into a 1.71-acre lake.
