Box 243 Delray Beach, Florida 33447 Attention: Burl Gentry Re: Hills at Lake Eden - Fees Dear Mr. Gentry: Please recall the recent brief conversation I had with you and your client regarding master plan fees. You indicated that Planning and Zoning Department Director Heyden had informed you that all you had to do to obtain a refund from the City was ask for it from us, and that unless you paid the full $1500 to her department your requested review would not be processed. Enclosed please find an exchange of thoughts on this subject between Ms. Heyden and this writer. It is obvious from her memo that her position is somewhat different than that which was represented to me. The bottom line here is that you have paid $2500 to the City of Boynton Beach for a process which I interpret to be a master plan process. The Commission established fee for a master plan review is $1000. If a modification is involved, it is another $500. Ms. Heyden refers to your application as a "brand new rezoning, which also required a master plan review". The fee for rezoning a Planned Development District was established by the Commission as $1500 for areas larger than 5 acres. Adding to that the separate master plan review fee of $1000 which she referred to results in a match for the $2500 you have paid. Based on her position, you are not entitled to a refund or credit. By copy of this letter (and referenced memos) I am asking our City Attorney to review this situation. I will then discuss it with him to determine if legal issues are involved, and react accordingly. Box 310 Boynton Beach, Fl. 33425-0310 Re: Hills at Lake Eden Dear Mr. Hukill, I have been requested to expand on our previous report for our master plan of Hills at Lake Eden for the long access roadway. As we discussed previously, I have attempted to preserve the topographic features of the area, therefore, rather than making a cut through the existing dune line, I have created a roadway which traverses around the dune line and preserves the character of this area as much as possible. We have provided an emergency accessway to Seacrest Blvd. which gives emergency vehicles such as Fire trucks and police vehicles access and would be available to reseidents for emergency access to Seacrest Blvd. In regard to the traffic analysis the traffice for a single family unit based on the Palm Beach County Unified Land Development Code is 10 vehicle trips per day (2 directions) for single directional a single family unit would develop 5 vehicle trips per day. Since this development would create 48 single family lots, the traffic generated would be 48 x 5 vehicle trips per day which equals 240 trips per day single directional, which is significantly less than the threshold of 3,000, 1 directional trips required by the code for a full traffic study. For the vehicle trips per hour the average vehicle trip per hour would be multiplied by the peak factor of 2.5, 240 V.T.P.D. = 10 V.T.P.H. x 2.5 = 25 Vehicle Trips Per Hour peak 24 hours Which again in significantly less than the threshold given by the code of 250 vehicle trips per hour which would require a full traffic study. In review of the surrounding roadways, it was found the roadways were significantly below capacity therefore, this development would not have a signficant impact on the surrounding roadway system. The name of the proposed subdivision shall be HILLS AT LAKE EDEN and according to the current records this name is not a duplication of any other subdivision names in Palm Beach County. 2. The vicinity sketch has been added to each sheet referencing other areas of the City as shown thereon. 3. The North arrow, graphic scale and date has been indicated on each sheet, as required. 4. The name and address of the developer, surveyor and engineer is indicated on Sheet 1 of 2. 5. The adjoining subdivisions together with plat book and page is indicated on the master plan ( sheet 1 of 2). 6. Tract boundary and bearings, together with a written description has been indicated on each sheet. 7. The topographic conditions of this site has been indicated on sheet 2 of 2. All existing conditions on site have been indicated and there are presently not any water courses, marshes or water bodies on this site. 8. Utilities are currently available along Swinton Avenue and Seacrest Blvd. as well as existing sewer and water which the proposed system will be tied into as indicated on the master plan and will be coordinated with all subject utilities. 18. sites for proposed parks (recreation areas) are shown on the proposed master plan as Tracts "B" and "C". 19. At the present time the developer does not wish to obtain approval for a temporary structure, but prior to obtaining a construction permit a temporary trailer/office will be submitted in accordance with the required site plan approval to be approved by the City Council prior to commencing construction. D. The subject property will not generate 3000 vehicle single directional trips per day or 250 vehicle single trips in a one hour period, therefore traffic impact analysis is not required. A traffic study will be submitted prior to final plat approval to satisfy the traffic impact fee schedule. E. The master storm water management plan (Sheet 2 of 2) outlining the primary and sceondary drainage and storm water treatment facilities have been shown. The 100 year flood elevation to establish minimum finish floor elevation has been found to - be El 20.90 and the minimum finish floor is proposed at El 21.00 except along Swinton Avenue, which has a pre-established 100 year flood elevation based on the existing elevation of Swinton Avenue and the proposed finish floor elevation would be 16" above the existing elevation of swinton Avenue and this area would be covered under the existing FEMA maps indicating that Swinton Avenue is above the 100 year flood elevation for this area. F. We are submitting herewith the fee for $ 1,000.00 for master plan review and request that the plan be placed before the Technical Review Board at their next meeting.
