Dear Mr. Williams:
This letter is in response to your inquiries regarding the
property located at 3400 South Congress Avenue in Boynton Beach,
Florida, as described on the attached Exhibit A. The current
zoning of the referenced property is M-1, Light Industrial and
the land use designation is Industrial. The current zoning, M-1,
is within the Industrial land use category as shown on the City
of Boynton Beach Future Land Use Map and allows mini-storage
facilities as a permitted use in this zoning district (see
attached pages from the City's comprehensive plan and zonipg
code). The property is not part of a development of regional
impact and was not granted any special or conditional use permits
or variances in connection with the approval of the existing
mini-storage facility. To the best of my knowledge there are no
potential violations of applicable zoning and land use laws
relative to the existing facility.
As a point of information, the recorded drainage easement on the
adjacent, vacant property to the south, required as a condition
of site plan approval to meet minimum stormwater retention
requirements, is a perpetual easement. The property owner
granting this easement cannot utilize this property in connection
with future development of the vacant property to the south.

Also, landscaping of the Congress Avenue right-of-way, adjacent
to the referenced property's frontage, is an outstanding
condition of project approval. Due to the near future widening
of Congress Avenue, the property owner at the time of project
construction, was required to post a $10,000 bond to ensure
future installation of this landscaping. Surety, in an amount
equal to the in-place performance bond, in a form acceptable to
the City Attorney, must be substituted by the new property owner
in order to ensure completion of this obligation in compliance
with the original condition of approval.
Since the existing facility has a certificate of occupancy and is
licensed for operation of a mini-storage use, the only task
remaining, from the City's perspective, prior to opening for
business, other than the substitution of surety, is transfer of
the occupational license to the new property owner. If you have

A. M-1 INDUSTRIAL DISTRICT.
1. Permitted uses. no distance requirement. Within any M-I
industrial district, no building, structure, land or water, or
any part thereof shaIl be erected, altered or used, in whole
or in part, for other than one or more of the JoIlowing
specified uses; provided, however, that any use or process
that would be subject to a minimum distance requirement
under section B.A.2., would require an environmental re-
view permit under section B.A.3., would require conditional
use approval under section B.A.4., or would be prohibited
under section B.A.5. shall fully comply with the provisions of
those sections, where applicable. No distance requirement
other than district set hack regulations shall apply for the

to cutting, stamping, folding, laminating, lining,
coating, and treating of purchased paper, paper-

approved the referenced site plan modification, subject to staff
comments, copies of which are attached.
These plans were approved subject to your compliance with the attached
stipulations. After you have amended your plans to reflect these
stipulations, please submit two copies to the Building Department for
further processing in connection with our pre-permitting process.
The approval of the City entitles you to construct only the
improvements shown on the site plan. The site plan will be viewed
procedurally as an as-built or record drawing.

SITE PLAN MODIFICATION - SAFE KEEPING SELF STORAGE
RE:
As a condition of site plan modification, the following comments
should be incorporated into the related documents by the appli-
cant:
1. Landscaping and a fence are shown in the drainage easement.
Language must be provided in the drainage easement agreement
to allow for these elements to be placed in the easement and
for perpetual maintenance of these elements.
2. Irrigation must be provided from a well.
3. The landscaping plans conflict with the engineering plans
at the northeast property corner.
4. Curbing must be provided around landscape areas adjacent to
parking stalls.
5. Rooftop air conditioning units must be baffled.
6. The zoning ordinance prohibits residences in M-1 industrial
zones.
7. The structures must comply with Table 400 and Chapter 6 of
the Standard Building Code.
8. Handicap accessibility must be provided to all structures.
9. South Florida Water Management District approval is required.
10. A turn-out permit from the Palm Beach County Engineering De-
partment is required.
11. Provide documentation for right-of-way dedication.
12. The landscape ordinance requires a two and one-half (2.5)
foot wide landscape buffer between the property line and
on site vehicular use areas.
13. The zoning code states that all required parking areas be
under the same ownership as the building it serves.
The applicant's prompt compliance with the preceding comments
will insure a timely permitting process.

STAFF COMMENTS
Please be advised of the Planning Department's comments with respect to the
above-referenced request for an amended site p1ap.
1. The easement document must be revised ,revie.wed 'by the City Atto,rney,
re-recorded, and a copy of the a.R.B. reference provided to include that
an additional purpose of the easement is to provide the required land-
scaping along the south edges of the front parking lot and the rear
parking lot. As long as the parking lots exist to serve a use on the
Safe Keeping site, the easement on the adjacent property shall exist in
perpetuity and be used exclusively for dry retention, $urplus off-site
parking (see comment #13) and required landscaping.
2. Revise data on sheet A-la and page 4 of site plan application regarding
parking. The total gross floor area including-that used for warehouse
storage and accessory office "space requires 1 parking ~pace for every
800 square feet. Therefore, baserl upon 112,519 gross floor area, 141
parking spaces are required; 143 parking spaces have been provided.
(The ratio of 1/800 applies to all bays that are "smaller than 500
square feet. The bays that are larger than 500 square feet require not
less than 2 parking spaces).
3. Delete the word "apartment" from "building A first floor plan" on sheet
A-4. If it is the desire to pursue allowing a residence, accessory to
the principal storage use, (currently prohibited in the M-l district)
documentation should be provided and submitted as a future site plan
modification for review and recommendation by the Technical Review Board.
4. The north elevations for building C and D have not been provided.
5. The screen connecting buildings A and E and the stairs on the northeast
corner are not located on the site development plan (sheet 2 of 6) and
the horizontal control plan (sheet 3 of 6).
6. Add dimension of side setback from the north property line of building
A and E, and side setback from the south property line of building B.
7. Dimension the landscape strip at the southeast corner of the site on the
site development plan.
8. Sheet 2 of 6, the site development plan, does not correspond to the other
plans submitted. Building E projects 5 feet further west than building B
on all other drawings, but it is shown "lining up with" building D on the
site development plan. Also the parallel parking spaces between building
E and Buildings C and D and th~ parking area east of building E are laid
out differently on the site development plan. Comparing this plan to the
survey, the site development plan reflects a deeper piete of property
than what is indicated on the survey.
9. Gate is not shown on sheet 2 of 6 or sheet 3 of 6.
10. The official record book reference for the revised easement documentation
will be needed on the survey.

11. Provide documentation prior to final sign-off verifying that the
additional 7 feet of right-of-way for Congress Avenue has been
dedicated. I
12. Sheets 3 of 6, Eland 1 of 2 do not show the paved access to the manhole.
13. If a C.A.B. landscape variance is applied for and not approved for
required landscaping provided off-site, parking along the southern
property line will have to shift. To do this, total building square
footage may have to be reduced if more than the two surplus parking spaces
are deleted. ,The City Forester's comment regarding a shortage of
required interior. landscaping within the parking areas which should
be summarized in table form on the landscape plan may also result in
a reduction of square footage. Any changes in building footprint or
parking layout must be shown on the following drawings: 2 of 6, 3 of 6,
A-la, E 1, 1 of 2 and 2 of 2. The elevations on sheets A-6 and A-7
may change. Also the following floor plan drawings may be affected:
unit schedule on A-la, A-2, A-3, A-4, A-5, E-2, E-3, E-4, M-2 and M-3.

Please be advised of the Planning Department's comments with
respect to the above-referenced request:
1. Provide copy of deed verifying that the right-of-way
dedication of Congress Avenue has occurred.
2. The two parking spaces shown on the adjacent property
are not required by code and may be deleted if desired.
One parking space for every 800 square feet of gross
floor area is needed, including the office space, and
provided that there are no bays 500 square feet in size
or larger.
3. At this time, residences are not permitted in the 00-1,
Light Industrial, zoning district, even if accessory and
is necessary for the principal use. If, however, it
is the desire to pursue this issue, documentation should
be provided and submitted as a future site plan
modification for review and recommendation by the
Technical Review Board. In the interim, the floor plan
showing the residence should be modified.
4. It appears that the west elevation for Building B which
faces Congress was never provided.
5. The screen connecting Buildings A and E on the south
elevation is not located on the site plan (sheet 2 of 6)
and the landscape plan (sheet 1 of 2). The stairs on
the east (rear) side of Building A are not shown on the
site plan, landscape plan or horizontal control plan
(sheet 3 of 6).
6. Sheet E4, light specifications A and J, does not indicate
photocell activation. The average illumination level is
also not indicated. Provide mounting detail for building
lights.
7. Indicate side setback to south property line for Building A
on horizontal control sheet (3 of 6).
8. Dimension the m~n~mum 4 1/2 foot landscape strip at the
southeast corner of the site on sheet A-la, consistent with
the horizontal control sheet (sheet 3 of 6).
9. Dimension the parking spaces on the west side of Building C
as a minimum of eighteen (18) feet deep (sheet A-1a).
10. Has the easement document been recorded prior to approval by

The developer of the above-referenced project, Omni Development
Corporation, has not been able to complete the sign~off procedure
for their mini-warehouse project as a result of the property
owner selling a portion of the property where a water retention
area is proposed on the east side of the site. As an
alternative, the developer has reached an agreement with the
property owner to obtain some additional property on the south
side of the site and is to be granted an easement on the adjacent
property to the south for relocation of the water retention area.
Concerning the above, it is the Planning Department's position
that the changes to the drainage system, parking lot, and survey
will require submission of a site plan modification to allow for
staff coordination of the proposed changes and to ensure code
compliance. It is also the Planning Department's position that
the proposed drainage easement on the adjacent parcel to the,
south should be in perpetuity and that it cannot be utilized by
the future developer of this property for any purpose.
