Dear Mike,
As a follow-up to our phone conversation, a side yard setback variance for
the above referenced lot(s) is requested by virtue of this letter. As shown on
the attached plot plan the side setback on Lot 159 is 7.23 feet instead of the
required 7.50 feet. This will result in 14.73 feet between the unit on Lot 159
and the unit on Lot 158. I talked to Mike Haig in the Zoning Dept. and he
indicated that an administrative appr val could be granted if both Zoning and
Planning agreed to the 7.23 feet. If yo ould review this situation at your
earliest convenience it would be greatly a reciated as time is of the essence
for my client.

This is to confirm our conversation of May 2, 1996, in which I informed you that I
reviewed the Sausalito Place Declaration of Covenants, Articles of Incorporation and
the By-Laws. Any concerns that I had with the documents have been cleared up by
Larry Rothenberg, Esq, The only outstanding issue which remains is whether the City
is responsible for fire prevention and trash removal in the development. According to
our conversation, we both believe this isn't a problem, however Mr. Rothenberg is
checking with his client regarding the matter.
I hereby approve these documents as to form subject to any concerns you may

Plat Documents
l. Plat drawings shall be amended to show compliance with comment
number 2 of the Planning and Zoning Department Memorandum No.
95-495 (attached).
Infrastructure Drawinqs
2, On sheet 3 of II dimension (to code standards) the following
parking lot components for all parking areas (satellite
recreation parking area, handicapped spaces at recreation
area, recreation area parking and gate house parking space) :
i. access aisle width (backup space);
ii. width and length of regular parking spaces;
iii. width and length of handicapped parking space and
required access aisle (note: gate house parking
space shall be designed to meet handicapped
standards) ;
iv. location of wheelstops for the handicapped parking
spaces located east of the recreation building;
v. width of the two-way driveways at the three parking
areas.
3. Add to sheet 3 of 11 a callout referencing the location of
the type "D" curbing required for the four parking areas. The
location of the curbing shall be in compliance with the
location standards identified in Chapter 23 - Parking Lots, of
the City Land Development Regulations.
4. On sheet 6 of 11 modify the configuration of the parking area
located east of the recreation building to match the
configuration depicted on sheet 3 of ll.
5. Add to sheet 6 of 11 the stop signs and stop bars required at
the egress of the three parking areas.

the Declaration of Covenants Restrictions and Easements a

by the Sausalito Place Homeowners Association.
8. Submit Exhibit "A" - Legal Description of Project. It is
recommended that the legal description be identified as the
plat book and page number assigned by Palm Beach County when
the plat was recorded.
9, Submit Exhibit "B" - Legal Description of Common Properties.
It is recommended that the common property be identified with
the same designations listed on the plat.
10. The Sausalito Place Homeowners Association Documents shall not
be recorded in Palm Beach County until the City attorney and
staff have approved the documents.
ll. Provide the Planning and Zoning Department a copy of the

To ensure that the plat document coincides with the
master plan, the applicant shall submit to the Planning
and Zoning Department three (3) sets of the master plan
drawings. The master plan drawings shall be uncondi-
tionally signed-off by the Technical Review Coromi ttee
(TRC) prior to further processing of the plat. Following
the submittal of the three (3) sets of drawings, I will
transmit them to your office so that the master plan and
plat review/sign-off may run concurrently. It is recom-
mended that the Building Department copy of the approved
site plan for 5ausalito place be used with the approved
master plan to review the proposed plat.
Dimensions shall be provided on the plat drawing that
verify that the lot frontages, identified on the curve
table and plat drawing, comply with the minimum lot
frontage regulations identified on the approved master
plan.
The following note shall be added to the plat document:
Building and site regulations for the residential
lots, common ground and recreations areas are
specified on the current master plan.
The applicant shall submit, for review by staff and the
ci ty I S legal department, home owner association documents
that reflect the dedications and notes identified on the
plat. The document shall include declarations, coven-
ants and restrictions that will show perpetual operation
and maintenance of the subject property without expense
to the public. Following the City's approval of the
documents, the documents are required to be recorded in
Palm Beach County and the copies of same transmitted to
the Development Dep.rtment and the Planning and Zoning
Department. The City'S approval of these documents is
required prior to approval of the plat. [Chapter 5 -
Platting, Article V, Section 1, D.ll.]
Tract E shall be included with the reoreation tracts.
The approved site plan identifies this area as required
pa~king spaces for the recreation facility. Tract E is
not open area.
The reference to Palm Beach County shall be Changed to
City of Boynton Beach.

To ensure that the plat document coincides with the
master plan, the applicant shall submit to the Planning
and zoning Department three (3) sets of the master plan
drawings. The master plan drawings shall be uncondi-
tionally signed-off by the Technical Review commi ttee
(TRC) prior to further processing of the plat, Following
the submittal of the three (3) sets of drawings, I will
transmit them to your office so that the master plan and
plat review/sign-off may run concurrently. It is recom-
mended that the Building Department copy of the approved
site plan for Sausalito Place be used with the approved
master plan to review the proposed plat.
Dimensions shall be provided on the plat drawing that
verify that the lot frontages, identified on the curve
table and plat drawing, comply with the minimum lot
frontage regulations identified on the approved master
plan.
The following note shall be added to the plat document:
Building and site regulations for the residential
lots, common ground and recreations areas are
specified on the current master plan.
The applicant shall submit, for review by staff and the
city's legal department, home owner association documents
that reflect ~le dedications and notes identified on the
plat. The document shall include declarations, coven-
ants and restrictions that will show perpetual operation
and maintenance of the subject property without expense
to the public. Following the City's approval of the
documents, the documents are required to be recorded in
Palm Beach County and the copies of same transmitted to
the DevelopmQnt Oep.rtment ~nd the Planning and Zoning
Department. The City's approval of these documents is
L~equired prior to approval of the plat. [Chapter 5 -
Platting, Article V, Section 1, D.ll.]
Tract B shall ba includ.d with the recreation tract..
The approved site plan identifies this area as required
pa~ki~g spaces for the recreation facility. Tract E is
not open area.

Remember, this is a preliminary review to assist an applicant in
the preparation of final documents. Construction documents for
required improvements are not included at this time as the
applicant has not requested that the review include them. They
will, as always, be submitted with the final plat, or sooner. This
review should be conducted in a manner which will provide the
applicant with a maximum amount of guidance and assistance.
In the spirit of helpfulness, please be prepared to discuss this
pre-application, albeit informally, at the September 12 TRC
meeting. Please have any written comments in our hands by
September l5 for transmission to the applicant.
For those of you not addressed in this memo but copied instead,
please stop by the Engineering Division prior to the TRC meeting to
review the documents.
