Saint Mark Catholic Church Site Plan, Conditional Use,
Parking Lot Variance and Community Design Plan Appeal
Saint Mark Catholic Church has submitted a site plan, conditional
use, parking lot variance and community design plan appeal for
the expansion of the school for a pre-kindergarten and
kindergarten building to be located on their site. Due to
complications in the code, the site plan, conditional use and
community design plan appeal were reviewed by the Community
Redevelopment Advisory Board, while the parking lot variance was
reviewed by the Planning and Development Board.
To simplify this request for the City Commission, I will review
each of the elements of each request separately in a logical
progression.
Conditional Use
The Central Business District zoning district requires the pre-
kindergarten school to go through conditional use review. The
proposed new use will be an extension of the existing school on
the site and will not have negative impacts on the surrounding
land uses.
The Community Redevelopment Advisory Board reviewed this request
and forwarded it to the City Commission with a recommendation for
approval.
Community Design Plan Appeal
The proposed new building is designed to match the existing
school building in color and roof configuration. Overall the
site contains four buildings which are of a consistent color and
roof style. Making the new structure conform to the Coastal
Village Design Guidelines would be inappropriate.
The Community Redevelopment Advisory Board reviewed this request
at its meeting of February 8, 1993 and forwarded the appeal to
the City commission with a recommendation for approval.
Parking Lot Variance
In the Central Business District landscape code, there are a
series of separate requirements included in the parking
requirements such as parking lot design, drainage, landscaping
and lighting. The applicant requested a blanket variance to
these requirements, however, subsequent negotiations with staff
have reduced the actual variances to minor requirements.
Presently, drainage of the site is unacceptable, because almost
all of the stormwater on site runs east into the Mangrove area.
The applicant has agreed to create swales and a retention area on
the east site line. This will bring the site up to 50% of the
requirement required by Code. The City Engineer feels this is a
major improvement over the existing conditions.

The Planning and Development Board at its meeting of February 9,
1993 reviewed this request and forwarded the drainage portion of
the variance to the City Commission with a recommendation for
approval.
Lighting and landscaping are considered one requirement under the
Central Business District landscape code. At the present time,
the lighting on site is substandard. The applicant has agreed to
upgrade the lighting to an average of one footcandle at grade
level in the vehicular use areas and .75 footcandles at grade
level in the pedestrian area. These are the requirements of the
CBD landscape code.
The caD landscape code requires a certain design of fixtures and
lighting tyPe. These should be waived so that all the fixtures
on the site can match both in fixture design and lighting.
The landscaping on the site is missing hedge material in places,
as well as 24 trees on the site and the north swale, no
landscaped entrance exists, the species on the site are not
acceptable under the CBD landscaping code and do not meet the 90%
native requirement.
The site on which the new structure is to be located contains
trees that can be moved elsewhere on the site. The applicant has
agreed to do this and then supplement the number moved up to the
24 trees. The applicant has agreed to add an entrance feature on
the south side of the site. Any new material being planted on
the site will meet the 90% native requirement and the CBD plant
lists. Any hedges will be filled in and lengthened as needed.
The only variances being granted to landscaping are as follows:
1. Hedge material is planted and will be planted spaced at
24 inches instead of 18 inches on center;
2. The existing ficus and black olive trees which will
remain are not an acceptable species in the CBD;
3. Grass will be allowed to remain below the hedges
instead of ground cover;
4. No landscaping is being provided around the dumpster;
5. No pedestrian furnishings are being provided;
6. The 90% native plant material requirement will not be
met for the entire site.
The Planning and Development Board, at its meeting of February 9,
1993, reviewed the landscaping and lighting section of the
parking lot variance and forwarded it to the City Commission with
a recommendation for approval.
Site Plan Review
Due to the other reviews that took place regarding this site, the
site plan review is easier than most. The new structure meets
the building requirements for the CBD zoning district and the
overall site meets the parking and landscaping requirements if
the community design plan appeal and parking lot variances are
granted.
The Community Redevelopment Advisory Board reviewed the site plan
at its meeting of February 8, 1993 and forwarded the plan to the
City Commission with a recommendation for approval.

One condition on the site plan is that a section of 5th Avenue,
which still exists as a right-of-way, but has been encroached
upon by the church parking lot and other developments to the
west, be abandoned.
We would suggest that staff be instructed to prepare this
application as soon as possible under our alley abandonment
program and that this condition should not stop building permits
from being issued.
To save time at the City Commission meeting, staff will make one
consolidated presentation on all the requests for this site.
These items have been scheduled for final review before the City
Commission on February 16, 1993.

RE: St. Mark Catholic school and Church Parking Lot Variance
For Landscaping and Drainage
The Planning and Zoning Department agrees with the conditions of
approval for the variance to drainage stated in the attached three
page package from the Engineering Department dated February 2,
1993.
Due to the fact that Section 7.5-57 of Article III, Central
Business District Landscape Code refers to many site improvements
the attached list of code sections titled Exhibit "A" is provided
to help evaluate each section of the Landscape Code as it relates
to the condition of the project. A copy of the Central Business
District Design Guidelines will be available at the meeting.
The list will be divided into sections with the following headings:
code language, variance requested and condition of the existing and
new site. Under the first heading the code section and code
language will be listed. The second column will have a yes that
indicates the applicant is requesting relief from that specific
section of the code or a N/A which indicates that the section is
not applicable to the project. The third column will be a brief
analysis of how the existing and new site as shown on the documents
submitted (Exhibit "C") compare to the requirements of the code.
The results of field visits to the site will be incorporated into
the third column. The order of the list correlates with the order
in which the sections of the code are listed in the letter
submitted by Mr. Dan O'Connell, agent for the applicant, describing
the specific section of the code the applicant is seeking relief.

Site and pedestrian lighting; the site shall be lit to
safe levels of illumination, installed to the
requirements of the code and activated, as determined by
the Police and Engineering Department. Staff comment
Memorandum No. 93-016 from the Administrative
Coordination of Engineering suggests that safe levels of
illumination may be accomplished by adding new fixtures,
changing and/or increasing the size of the existing
fixtures. Where new pedestrian lighting is required said
fixtures shall conform to the pedestrian light fixtures
described in the Central Business District Design
Guidelines. Where new site lighting fixtures are required
they shall match the existing fixtures, and in no case
shall the new pole and/or fixture exceed the height of
the existing fixtures and poles.
Dumpster enclosure; remain a wooden fence without
landscaping with the exception that the wooden fence be
painted dark brown to match the window frames of the
adjacent school building. The Public Works Department is
satisfied with the location and capacity of the existing
dumpster enclosure. It appears the applicant has removed
the gates. However, the removal of the gates enables the
sanitation workers clear access to the dumpster without
waiting for someone to open the gates.

c. Exterior furnishings i We believe the intent for the
requirement of providing exterior furnishings is based on
the development being commercial in nature where the
public would frequent and take advantage of aesthetically
created seating, fountains, sculpture, bollards and
garbage receptacles. The school and church are not
commercial by nature therefore, we agree with the request
to vary said requirement.
d. Entrance treatment; As described in the Design Guidelines
shall be incorporated into the existing landscaping area
at the west side of the west driveway off of N.E. 4th
Avenue. The entrance treatment shall contain two ( 2)
native flowering trees aesthetically placed in a new
mulch or ground cover planting bed that contains a
grouping of three (3) mature palm trees. Note: The palm
trees may be palms replanted from the new site. See staff
comment fro~ Environmentalist/Forester Memorandum No. 93-
038. The entrance landscaping shall be in addition to the
other recommended landscaping material.
e. The remaining landscape recommendations consider:
perimeter screening of vehicle use areas, landscaping for
interior parking spaces and planting specifications.
Perimeter screening. The existing gaps in the required
continuous hedge shall be filled in. The existing hedge
shall be extended where the hedge does not form a
complete continuous visual barrier with the exception
that the east property line and northeast corner of the
site shall not be required to have hedge material. The
existing mangroves will be acceptable for the visual
barrier. The specie of the new hedge material shall match
the existing hedge material. However, the spacing and
size shall be consistent with the code specifications.
The required number of perimeter trees shall be planted
for the lineal footage of the vehicle use area along the
south, west and north sides of the property. A total of
forty-one (41) trees are required, five (5) new trees
shall be installed around the perimeter of the site. The
tree specie may match the existing trees and the size
shall comply with the specifications listed in the code.
Note: All line of sight visibility requirements shall be
in compliance with the code and specified on the plan.
The location of the five (5) new trees will be worked out
with the staff and the applicant.
Interior parking landscaping. The nineteen (19) missing
trees shall be installed and the specie shall be a specie
listed in the Central Business District Design
Guidelines. The size of the trees shall comply with the
code. The location of the nineteen (19) trees will be
worked out with staff and the applicant.
Planting specifications. As described above.
Considering Comprehensive Plan Policy No. 4.4.6 (Fifty
(50) percent of required landscaping shall be native.)
We recommend that the existing site be acceptable and the
proposed new site have the native hedge material spacing
be changed from 24" on center to 18" on center.

In response to the Planning Director's decision to consider the request
for a variance to the Landscape Code (Central Business District) as
also a variance for Parking Lot Lighting, please consider the
following objection based upon our City's Zoning Code, Appendix "A",
Central Business District "Off-Street" Parking.
Although the Landscape Code, reference the Central Business District,
indicates a lighting illumination standard of one foot candle
(average), the regulations relative to "Zoning-Appendix A" for the
Central Business District clearly sets forth that the standards for
parking lot construction layout and standards are those that are set
forth in Section IlH. Section IlH states that all off street parking
shall comply with Chapter 5, Article X, "Boynton Beach Parking Lot
Regulations", therefore, the minimum allowable lighting levels must
comply with those standards clearly set forth in our City's Parking
Lot Regulations, which among other things provides for photocell
activation of the lighting system, pedestrian lighting and safe,
energy efficient lighting for the entire parking facility serving
this complex. The parking lot variance should be denied and the 'owners
should be required to install various numbers of lighting fixtures to
existing poles and/or to new poles mounted internally and along its
perimeter. The plans, as submitted, do not detail safe illumination
levels within this facility, nor does it detail safe illumination
levels along pedestrian walkways, therefore, the applicant must comply
with City Codes so as not to set a dangerous precedent relative to the
safety of our City's citizens.

On January 15, 1993 and in the presence of the applicant's Design
Engineer, an on-site inspection was conducted at St. Marks Catholic
Church and to my surprise found most all grassed traffic separator/
islands devoid of substantial landscaping throughout this entire
parking facility.
I do not believe the applicant has exhibited a hardship, reference
his assertion that the differences in material heights, breadth, etc.
as they relate to newly installed landscaping in areas where there
is established landscaping, is a cause for visual incompatibilities
as implied in their application, therefore, according to the Planning
Director's written policy regarding comments under the jurisdiction
of other departments, I herein transmit my objections to the
applicant's variance requests to your attention.

Parking Lot Variance
At the TRC meeting of January 14, 1993, the parking lot variance for the St. Marks major site
plan modification were discussed. The engineering department has the following comments on
the drainage and landscaping variances requested.
Drainage Variance
The proposed building site does have room for the addition of french drains onsite. However,
french drains are most effective in providing water quality treatment, and none is required for the
classroom addition. However, trenches should be provided for the drop off area and swales
along N.E. 6th Avenue should be reconstructed. An area of the parking lot at the S.E. corner
of the entire site has been modified to provide some water quality treatment of the existing
parking lot runoff. Also, two swale areas are proposed east of the existing entry roadway at the
N.E. corner of the entire site.
The engineering department recommends the north 30 feet of the north swale be eliminated to
provide access to the property to the east. This property is presently leased by the City from the
Church and is to be developed as the Downtown Mangrove Park. Access to this proposed park
is important. The drainage swale can be extended to the south to mitigate any loss of swale
volume resulting from providing the 30 foot access corridor.
The engineering department recommends an expansion of the proposed swale area in the S.E.
quadrant of the site (more than the 14 spaces proposed). The applicant's engineer estimated
0.4- of runoff from the entire site was handled by these two swale systems. The parking stall
tabulation on the drainage modification plan seems to indicate an additional 33 spaces are
existing but not required by the present and proposed uses. All or many of these spaces could
be added to the swale area in the S.E. quadrant of the site.
The engineering department recommends approval of the drainage variance request with the
above noted comments. The engineering department has no comments on the landscaping
variance request.

etc.
3. The building must be accessible to the handicapped and
handicapped parking stalls shall be located on the shortest

Section 5-145(c)(4) of the Code of Ordinances requires that when a
variance to Section 5, Article X, Parking Lots is requested, the
Technical Review Committee must forward to the Planning and
Development Board a recommendation, and that the recommendation
forwarded is to be made part of the public hearing proceedings.
Daniel O'Connell, agent for St. Mark Catholic School and Church, is
requesting a variance to Section 5-142 (d) and (f) of the Parking
Lot Regulations. St. Mark Catholic School and Church is located in
the Central Business District, therefore, Chapter 7.5, Article III,
Central Business District Landscape Code of Boynton Beach Code of
Ordinances is applicable. A description of the sections of the
code and the nature of the variances is shown on the attached
Notice of Public Hearing. For an explanation of the code
requirements related to Article III, Central Business District
Landscape Code, see attached Exhibit "A". The applicant's
justification for the variances is described in the attached copy
of the Parking Lot Variance Application. The applicant is
requesting relief from the landscaping and drainage requirements of
the code in connection with the conditional use approval and site
plan review for the pre-school and kindergarten building proposed
for construction at the St. Mark school/church site. Consistent
with Article X, Parking Lots, Section 5-138 (a), when a parking lot
serves an existing building(s) where said building(s) is proposed
to be enlarged or when an additional building(s) is proposed to be
constructed the required improvements specified in Section 5-142 of
the Parking Lot Ordinance are applicable and shall be incorporated
into and made part of the proposed improvements to the entire site.
Section 5-142 (d), described in the attached notice of public
hearing)refers to landscaping and more specifically the landscaping
requirements described in Exhibit "A". Section 7.5-57 of the
Central Business District Landscape Code refers to many aspects of
the site such as: site and pedestrian lighting, landscape and fence
screening for dumpster enclosures, exterior furnishings and
entrance treatment landscaping. The applicant is requesting relief
from the applicable sections of Section 7.5-57 Central Business
Distr ict Landscape Code requirements and the landscape requirements
specified in the Comprehensive Plan Policy No. 4.4.6.. The
Comprehensive Plan landscape specifications refer to planting a
minimum of fifty (50) percent native specie for all required
landscaping. The attached letter from the applicant titled Exhibit
"B" lists the specific sections of the code the applicant is
requesting relief from. Exhibit "c" as submitted by the applicant
are drawings that illustrate the existing landscaping at the site
and the landscaping proposed for the new site. The plan of the
existing site shows the location of the existing wood dumpster
enclosure and site lighting fixtures. Please note, the following
symbol * found on the plan indicates the location of trees on the
existing site that should be in place at the site. However, a field
visit indicated they do not exist.
Section 5-142 (f), described in the attached notice of public
hearing, refers to the drainage specifications listed in the code.
The applicant is aware of the deficiencies in the existing
drainage. The existing storm water drainage primarily is sheet flow
of storm water to the east across the parking lot into the
mangroves that are part of the St. Mark property. The applicant
requests that the Board consider the drainage modifications that

the engineer of record has proposed and grant relief to the
drainage requirements with the condition that the applicant
incorporate the proposed drainage modifications into the
improvements proposed for the site. See the attached Exhibit "0" a
reduced site plan and letter from the engineer of record that
illustrates and describes the proposed drainage modifications.
On Tuesday, January 14 and January 26, 1993, the Technical Review
Committee (TRC) met to review the plans and documents submitted and
to formulate a recommendation with regard to the variances
requested. After review and discussion the TRC recommended that
the variance requests be approved subject to the attached staff
comments from the Police Department Memorandum No. 93-022,
Environmentalist/Forester Memorandum No. 93-038, Engineering
Department Memorandum No. 93-009 and 93-016, Memorandum from
Richard Staudinger dated February 2, 1993, and the following
Planning and Zoning Department Memorandum.

landscaped consistent with Chapter 7.5,

instance of the Central Business
District, Chapter 7.5, Article III,
Boynton Beach Code of Ordinances.
(f) Drainage. Storm water shall be contained
on site. Containment capacity shall be
designated for a minimum of two and one-
half (2!) inches of rainfall in one (1)
hour. Drainage structures and French
drains shall comply with minimum city
standards established by the city
engineer. For impervious areas exceeding
twenty-five thousand (25,000) square
feet, the design of the'~arking lot and
facilities shall be done by an engineer
register~d in the State of Florida, and
the plans submitted shall be sealed.
Maximum storage capacity of soil shall be
considered at the rate of one (1) inch of .
water for each six (6) inches of soil
above the water table. Drainage
calculations are required in all
instances. The hydraulic conductivity of
soil shall be determined by tests made at
the site using test procedures
recommended by the South Florida Water
Management District or other procedures
which have been approved by the city
engineer.

place and not modify the site to comply with the
