has reviewed the above referenced plan and herein offer the
following comments:

The site lighting depicted on page 1 of 6 is inadequate, and
in all liklihood, will not provide a level of illumination
consistent with COdE! provisions set forth in City Code of
Ordinances, Chapter 5, Article X, Section 142 (a) (b) ," Required
Parking Facility and Pedestrian Walkway Lighting".
Provide fully sodded and irrigated swales within the public
rights-of-way of SE 4th Street. Swale construction must
conform to City standards.

The Engineering Department has no objection to this plan moving
forward conditioned upon compliance with items #1 & #2 prior to
issuance of building permits.

We would ask that you review this amended site plan documents to

Department in writing.

1) WHIPOWILL ARMS - The site plan does not allow any space for a
garbage truck to turn around and the alternate idea of backing
into the main highway is unacceptable.
2) The new hiqh school site needs to have an adequate 4gft.
radius area for turn around for a garbage truck at the service
area. We also want them to consider planning for recycling of
any materials possible and access to those containers by the
City of SWA vehicles.

We recommend that the subject development be forwarded to the appropriate boards subject to
the following comments and recommendations:
COMMENTS:
1. A satisfactory lighting plan with photometries shall be submitted for permitting and subject to
a final inspection. The paving and drainage plans shall be subject to the parking lot ordinance at
time of permitting.
2. Arrow markings along west end of parking lot not necessary,
RECOMMENDATIONS:
1. Install continous concrete curbing along front of buildings in lieu of wheel stops. This will
provide a 3,75' wide landscape area instead of 1.75'. It will eliminate potential tripping over
wheel stops, provide a more esthetic appearance, and eliminate repair/replacement of wheel
stops.
2. Use decorative gravel or stone in lieu of sod in the new areas mentioned above.

Since the second review is for hotel apartments rather than
apartments, the Building Division offers the following comments
which must be complied with prior to building permit issuance:
1. The square footage of the openings on the north side of
building 1 must comply with Table 600 of the Standard
Building Code.
2. The State of Florida Handicap Code requires three handicap
parking spaces when the total number of parking spaces is
between 51 and 75. Therefore, you are required to provide a
third handicap space and it should be located near the south
building handicap ramp.

submit an amended Site Plan Review/conditional Use application form that
reflects the changes that were made as a result of amending the plans
and documents to comply with the Code of Ordinances and the Technical
Review Committee comments. A copy of the original form with a
distinguishable symbol identifying the change(s) may be submitted or a
completed new form with the changes identified. If there are no changes
required to be documented on the application form, a letter from the
applicant stating same must be turned in with the amended submittal.
Submit twelve (12) assembled and complete sets of plans and documents,
including surveys that show compliance with the Code of Ordinances and
comments made by the Technical Review Committee. Two (2) of the sets
shall have the appropriate legible raised seal and signature of the
designer responsible for the dra~ing(s). Plans and documents shall be
assembled in twelve (12) individual complete packages with the title of
the project on all pages and/or sheets and each page or sheet
numerically numbered such as the following example: 1 of 3, 2 of 3, 3 of
3 .
Submit color photographs of the buildings on the site that are to remain
in their eXisting condition and photos of existing buildings that are
located on the sites that abut the perimeter of the subject property.
The minimum size is 5" by 7". Each photograph shall be labeled to
identify the location of the existing structures with respect to the
location of the proposed proJect.
Submit colored elevation view drawings - a colored duplicate copy of all
drawings of the -=levation views of each side of all buildings and
signage associated with the project. The colored elevation views shall
match the elevations shown in the documents that were submitted for site
plan review. The applicable exterior surfaces as identified above shall
be colored with the color name and associated color reference number
identified. The type of exterior surface material shall be identified
next to the associated color. The colored elevation drawings shall have
compass direct10n or title of the side of the building identified. The
title block of the original drawing shall be shown. The maximum size is
24" by 36". Do no submit on board of ant kind.

shall have attached a label that identifies the color by name and

Staff has reviewed the above referenced project and offers the following comments:
1. A reservation fee of $2.411.64 is due within thirty (30) days of Commission
approval or upon request for my signature on HRS/DEP forms, (Sec.26-34[ED.
2. Please show location and size of water main to serve fire hydrant, (Sec. 26.16[aD.
3. Plan shall show location of all utility easements (fire hydrant line), (Sec. 26.33[a]
and Appendix C, Art. X, Sec. 6).
4. Relocate proposed water meters to approximately one foot inside property, (Sec.
26.16[cD.
5. A sanitary sewer cleanout shall be installed at the property line (approximately
one foot in property), (Sec.26.33[bD.
6. Provide fire flow test indicating the flow available with a residual pressure of at
least 20 psi (1500 gpm @20 psi commercial). Offsite water main improvements
may be required, at developer's expense, to meet minimum fire flow standards.
We have no objection to this project proceeding at developer's risk but we
strongly recommend that he confirm adequate flow and pressure at this time,
(Appendix C, Art. X, Sec. 16).
7. Palm Beach Health Department permit will be required, (Sec. 26.12).
8. A grease trap will be required for building #1 (kitchen units), (Chapter 26, Art.
IV, DivA, Sec. 26.143[B] and Sec. 26.145).
It is our recommendation that the plan proceed through the review process.

garbage truck to turn around and the alternate idea of backing
into the main highway is unacceptable.
2) The new hiqh school site needs to have an adequate 4J"ft.
radius area for turn around for a garbage truck at the service
area. We also want them to consider planning for recycling of
any materials possible and access to those containers by the
City of SWA vehicles.

The following is a list of 1st review comments regarding the Site
plan Review of the plans for the above-referenced project. It
should be noted that the comments are divided into two (2)
categories; the first category is a list of comments that
identify defic1encies that are required to be corrected and shown
in compliance on the plans submitted for second (2nd) review in
order for the project to continue through the site plan review
process. The second set of comment(s) are recommendations that
the Planning and Zoning Department staff believe will enhance the
proposed development. The applicant shall understand that all
documents/plans submitted for site plan and/or permit review are
subject to add1tional comments. I recommend that the applicant/
agent contact me regarding questions related to the comments. If
the applicant is not intending to correct code deficiencies they
should contact me regarding the procedures, applicat10n forms,
fees and subm1ttal deadline dates for seeking relief from the
code requirement.
I. SITE PLAN REVIEW COMMENTS:
1. The intended use identified on the site plan review
application is weekly rentals. This use falls into two (2)
permitted use categories of the zoning code for the subject site.
Both uses have specific and different zoning regulations
regarding design requirements. The two (2) uses are apartment
motel/hotel or multi-family. Find attached copies of zoning code
sections relative to both uses. Amend the plans to identify a
use as specified above. Also, amend the plans to show the
building and site in conformance with the appropriate
requirements including density (units per acre) and required
number of regular and handicapped park1ng spaces. I recommend
setting up a meeting with Tambri Heyden to discuss the remainder
of the review process for the project. [Appendix A-Zoning
Section 6 C. 1. h. & j.]
2. The setback dimension is measured from the property line to
the edge of the building that is the closest to the property line
including overhang. Show on the site plan drawing, the overhang
of each building, and amend the setback dimensions accordingly.
The setback dimensions shall be in compliance with the
requirements specified in the code for the subject use.
3. Submit for review a trafflc impact study. The traffic study
shall ident1fy the daily trips for the subject use. The study
will be sent to Palm Beach County for their review for
conformance with the County Traffic Performance standard.

6. Exterior display and storage of merchandise. Exterior dis-
play of retail merchandise shall be permitted, provided
that such merchandise is owned by the operator of the
business occupying the building, and is the same type of
merchandise that is typically sold within the building.

time which, on a daily basis, shall not exceed eighteen (18)
hours. Exterior storage or display of motor vehicles and
boats, excluding wrecked motor vehicles, shall also be per-
mitted to the extent that same is integral to the operation
of a conforming use or a legal nonconforming use, and
without limitation on length of time. Exterior display of
merchandise shall be completely contained within prop-
erty lines, and shall not completely block walkways or
otherwise create a hazard to the public. Parking areas
shall not be used for such displays except for a period or
periods of time which shall not exceed seven (7) days within
anyone 0) calendar year. Permission from the building
official or his authorized representative shall be required
for any use of parking areas for display of merchandise.
The exterior display or storage of growing plants shall be
permitted in connection with a lawful principal use, with-
out limitation on length of time.
7. Sidewalk sales. Sidewalk sales in rights-of.way shall re-
qu.re approval by the city manager or such person as may
be designated by the city manager.
8. Sale of used merchandise: The sale of used merchandise
shall be permitted as an accessory use to the sale of new
merchandise. meaning that used merchandise shall be of
the same type as the new merchandise sold on the prem-
ises, and shall be permitted as an accessory use to a repair
shop which is permitted in the district, provided that in aU
cases. the floor area occupied by used merchandise shall
not exceed twenty-five (25) percent of the gross floor area.
Stores <including pawnshops) which deal primarily in wted
merchandise. other than antique shops or auction houses
(see l.c. above), shall be limited to sale of retail merchan-
dise of the type that is allowed in accordance with the list

wood; also, furniture repair, refinishing, and reupholstering.
GARAGE, PUBLIC PARKING. A building or other structure
which provides parking or storage for motor vehicles.
GENERAL DEVELOPMENT PLAN. The official public docu.
ment adopted by the City of Boynton Beach as a policy guide to

GRADE, FINISHED. The average level of the finished surface
of the ground adjacent to the exterior walls of the structure.
GROSS FLOOR AREA. The total floor area of a building or a

10.8 dwelling units per acre. It is the intent of this district to
provide a higher residential density which encourages
vertical structures and flexibility in multiple-family living

RE: SITE PLAN REVIEW PROCEDURES
1st Review - Major Site plan Modification

Find attached for your review the plans and exhibits for the above
referenced project. site Plan Review approval for this project
will be granted by the City Commission/Community Redevelopment
Agency. To ensure that the project stays on line with the review
time frame, I request that the plans and exhibits be reviewed and
formal written comments transmitted to the Director of the Planning
and Zoning Department no later than 5:00 P.M. on Februarv 15. 1994.
Do not return plans and exhibits. Retain same for the review of
the amended plans (2nd review).
Adhering to the following review guidelines will promote a
comprehensive review and enable the applicant to efficiently obtain
Technical Review Committee approval:
1. Use the review standards specified in Part III, Land
Development Regulations, Chapter 4, Site Plan Review, Section
8 of the Code of Ordinances to review and formulate comments.
~. The documents submitted for the project were determined to be
substantially complete based on the submittal requirements
identified in Section 7 of the Site Plan Review Ordinance.
However, if the data provided to meet the submittal
requirements is insufficient to properly evaluate and process
the project based on the review standards or the documents
s11m"1 code deficiencies, additional data and/or corrections
should be requested by the reviewer through the Planning and
Zoning Department.

3. Each comment shall reference the section of the code that is
incorrectly depicted on the documents.
4. Technical Review Committee member (s) shall identifv in their
comments when the plans depict or when the location and
installation of their departmental required improvements may
conflict with other departmental improvements.
5. When a TRC Member finds a code deficiency that is outside of
his/her review responsibility, the comment and the specific code
section may be included in their review comments with the name of
the appropriate TRC Member that is responsible for the review
specified.
6. If a TRC member finds the plans acceptable, he/she shall forward
a memo, within the time frame stated above, to the Planning and
Zoning Director stating that the plans are approved and they do
not have any comments on the plans submitted for review and
recommend the project be forwarded through the approval process.
All comments shall be typed, addressed and transmitted to the Director
of the Planning and Zoning Department for distribution to the
applicant. please include the name and phone number of the reviewer
on this memo. Michael E. Haag will be the Planning and Zoning
Department staff member coordinating the 1st review of the project.
The Planning and Zoning Department will send the applicant a cover
letter which includes the comment(s) and directions to amend the plans
to comply with the comments and the procedures for resubmission. When
the Planning and Zoning Department receives the amended plans, they
will distribute the plans with a cover memo to all TRC Members for
review and approval.
