BGllndustries cosmetic and perfume manufacturing facility (Phenix Project) Request for variances from the City of Boynton Beach Land Development Regulations, Chapter 2, Section 7.H.11 - Off-street loading to allow off-street loading fronting Gateway Boulevard. BACKGROUND The property which is the subject of this variance request consists of eight platted lots located within the Quantum Corporate Park PID. Six (6) of these lots (34A, 34B, 35, 36, 37 and 38) are included within a recently approved site plan application to construct a 160,033 square foot perfume and cosmetic manufacturing facility. The size of the parcel is 18.35 acres. The approved site plan shows off-street loading facilities fronting Gateway Boulevard (see Exhibit "A" - Location Map, Exhibit "B" - Survey and Exhibit "C" - Site Plan). A condition of the site plan approval was submittal of the subject variance, prior to building permit issuance. Due to advertising and the time needed by the applicant to submit this application, it could not be processed concurrently with the site plan approval. The zoning designation of the subject parcels, as well as the entire Quantum Corporate Park, is PID (Planned Industrial Development). The following is a description of the zoning districts and land uses of the properties that surround the subject request: North - undeveloped lots, zoned PID I Page 2 Memorandum No. 97-387 BGI Case No. 239 Staff Report - Planning and Development Board South - Gateway Boulevard right-of-way and farther south is a retention area for Quantum Corporate Park East - undeveloped land, zoned R1-AAA. West - Quantum Boulevard right-of-way, and farther west are undeveloped lots and Motorola, zoned PID. ANAL YSIS The City of Boynton Beach Land Development Regulations, Chapter 2 - Zoning, Section 7.H.11 - Off-street loading requires that: "In no instance shall off-street loading facilities front on a public right-of-way and in no event shall these facilities be located within eyesight of a residential district". The proposed facility requires the assemblage of numerous lots totaling 18.35 acres. The longitudinal shape of the parcel in conjunction with its location on the corner of two major city streets, provides high visibility of the site (the combined length of the two street frontages of the parcel accounts for 2/3 of the total length of its perimeter). In addition, the multi- functional industrial complex design is dictated by operational requirements to meet the efficiency standards for manufacturing. This limits the design flexibility, as it relates to reconfiguration of design schemes. The above-mentioned inflexibility due to industrial function, in conjunction with the peculiar characteristics of the site, precluded any reconfiguration that would fully comply with the code. In order to alleviate the problem of off-street loading fronting Gateway, which is a public right-of-way, the architect has prepared a site visibility analysis of the area of concern showing incorporation of extensive buffering and screening measures (see Exhibit "0" - Analysis of Overhead Doors Visibility). Along Gateway Boulevard a 5-foot high continuous berm with a 6-foot high hedge on the top of this berm is proposed. As shown on the diagram, the visibility of the off-street loading facilities will be eliminated from any point on Gateway Boulevard. The degree of visibility is reduced by a proposed building setback, measured from the Gateway Boulevard, of approximately 300 feet. See also Exhibit "E" - Application. The code states that zoning code variances cannot be approved unless the board finds the following: ~ Page 3 Memorandum No. 97-387 BGI Case No. 239 Staff Report - Planning and Development Board a. That special conditions and circumstances exist which are peculiar to the land, structure, or building involved and which are not applicable to other lands, structures or buildings in the same zoning district. b. That the special conditions and circumstances do not result from the actions of the applicant. c. That granting the variance requested will not confer on the applicant any special privilege that is denied by this ordinance to other lands, buildings, or structures in the same zoning district. d. That literal interpretation of the provisions of this ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same zoning district under the terms of the ordinance and would work unnecessary and undue hardship on the applicant. e. That the variance granted is the minimum variance that will make possible the reasonable use of the land, building, or structure. f. That the grant of the variance will be in harmony with the general intent and purpose of this chapter [ordinance] and that such variance will not be injurious to the area involved or otherwise detrimental to the public welfare. Exhibit "F" contains the applicant's response to the above criteria. Unlike other development applications, the code does not require staff to make a recommendation regarding whether an applicant should be permitted to violate the city's ordinance. However, staff believes, that the petitioner has made an extraordinary effort to fully screen the off-street loading areas from view from Gateway Boulevard. In addition, the property has "shape" hardships contributing to its high degree of visibility.
