Dear Ms. Heyden:
In connection with the development of the above-referenced
property by BGI Industries, Inc. and the site Plan Application and
Zoning Code Variance Application that have been filed of even date,
we are requesting an appeal from Chapter 9, Section 11(J) of the
City's Code of Ordinances. This section requires that overhead
doors facing Gateway Boulevard and other roads that are listed in
that section are not permissible. However, it is the intent of BGI
to utilize overhead doors in connection with the loading dock
facilities on BGI's property which will face Gateway Boulevard.
We understand that the purpose of this requirement is aesthetic in
nature; however, we believe there are several factors mitigating
in favor of the granting of an appeal in this matter.
First, the site will be heavily landscaped with the overhead
doors sitting no closer than approximately 275 feet from Gateway
Boulevard. The utilization of overhead doors is critical to the
manufacturing business to be undertaken by BGI Industries inasmuch
as deliveries of materials will be made by truck and the only
appropriate method of unloading is through the use of loading docks
with overhead doors.
Further, the configuration of this parcel is rather unusual
because of its triangular shape which requires that the physical
plant at some point face the external roadways serving the
property. If there were a way to place the overhead doors in the
rear of the property out of the line of sight of traffic from
Gateway Boulevard, we certainly would have designed the site in
that manner. However, it was not possible to do so and to maintain

necessary interior vehicular circulation and property configuration
necessary for the conduct of BGI's business.
Therefore, we request that the appeal be considered and
approved by the city.
