Dear Ron:
In accordance with our discussions concerning the landscape and irrigation plan for
the Lake George Estates property, this letter shall be considered an amendment to the
Agreement of Purchase and Sale for the Lake George Estates property dated June 1, 1994 by
and between us (the" Agreement").
You have agreed to undertake preparation of, and obtaining approval of the City of
Boynton Beach to, a landscaping and irrigation plan for Lake George Estates. At your cost
and expense, you will complete such landscaping and irrigation in the manner required by the
City of Boynton Beach. At closing of the sale of the Lake George Estates property to you, I
agree to credit the purchase price due to me in the amount of $7,000 less $1,200 for sod I
recently installed at my expense and with your knowledge and consent. This credit shall be
consideration in full for your preparation and approval of the landscaping and irrigation plan,
as well as your undertaking of all requirements of the City of Boynton Beach to complete
and install the same. You acknowledge that Tindus Investments, Inc. has entered into an
Agreement with the City of Boynton Beach concerning the landscaping and irrigation
requirements, a copy of which is attached hereto (the "City Agreement"). You agree to
complete the landscaping and irrigation improvements within the timeframe and in the
manner required by the City Agreement and the City of Boynton Beach. You understand
that I have currently posted a $20,833.41 refundable cash deposit with the City of Boynton
Beach to secure completion of the landscaping and irrigation, and that upon completion of
portions of the landscaping I will apply to the City of Boynton Beach for a release of said
deposit. I shall not be required to post additional surety based on your landscape plan.
Purchaser agrees to place in escrow with escrow agent an amount equal to $4,000 as security
for the portion of the cash bond posted by Seller with the City of Boynton Beach relating to
the installation of the irrigation loop for the lake maintenance easement area. Purchaser
acknowledges it shall install the irrigation system in the lake maintenance easement area on a
house by house basis. You agree to fully cooperate with me in requesting release of the
deposit, including but not limited providing paid invoices and releases for completion of
landscaping and irrigation. Upon the City of Boynton Beach's release of cash bond monies
to me for (a) the inner irrigation loop, and (b) the water and sewer improvements, the
Escrow Agent will be authorized to release monies to you in like amount.

Purchaser and Seller agree to fully cooperate with each other in the completion of the
subdivision and the fulfilling of the requirements of the Agreement. Purchaser and Seller
acknowledge many of these items survive the closing of the sale of the Property and that the

As a follow-up to Recreation & Park Memorandum #95-316, the master plan modification for
Lawrence Lake P.D.D. requires an adjustment in the recreation impact fee already paid. Listed below
are the calculations required to determine this adjustment:
1. 34 units X .0180 acres = .612 acres (total requirement)
32 units X .0180 acres = 2.Q acres (already paid)
.036 acres (adjustment)
2. Based on a $750,000 purchase price for 13.343 acres:
$725.000 = $54,335.61/per acre
3. $56,209.25 X .036 acres = $1,956.08
A check for this amount was received by the Engineering Department (see attached).
