LEGAL APPROVAL :.. MINUTES - REGULAR CITY C0It41SSION MEETING BOYNTON BEAtH, FLORIDA OCTOBER 20, 1992 Mr. Cutro completed his presentation by stating that the Board forwarded this request with a recommendation for approval with a request for a definition of a nightclub. COll1l1issioner Aguila suggested the City Attorney work on the definition of a nightclub while this return,s to the Planning and Development Board. George Gent'le. represent1ng the app11cant. said they have no problem with this and they understand the concerns involved. They want to be sure the Planning and Development Board knows about the additional M-l Zoning District. It was noted that no motion was necessary to remand to the Planning and Dev~lopment Board. 3. Consider request to extend the time lim1t for filing for prelimi- nary plat for Knol1wood Groyes PUD (Southeast corner of Hypoluxo Road and Lawrence Road approximately 800' south of intersection) Mr. ,Cutro made the presentation. A modification to the master plan of this dev~lopment was approved in February of 1991. This approval would have expired on August 15, 1992; however, the owners did apply for an extension prior to that dat~. The Technical Review Committee reviewed this request and had no comments. At ~he Planning and Development Board meeting, a decision was made to forward thiS to the City Conmission with a reconrnendation for approval. Motion CO~issioner Harmening moved to grant Knollwood Groves PUD a one-year time ext~nsion. Commissioner Aguila seconded the motion. Co~issloner Aguila clarified that when the extensions come back before the Cormliission, he would like to see if there is anything else the City can get in ret~rn for granting the extension. Mayor Weiner feels it is the responsibility of ~he Comm1ssioners to review the prior approval to see if there is anything new~~. hich is pertinent. Commissioner Harmening suggested the Comnissioners dis uss these time extensions with the Planning Department if there are any pro ,1ems. The motion carried 5-0. 4. Master Plan Modtftc~tton for the reduction of requirements for 20' uti11ty easement to a 12' utility easement on the east side of the development (Southeast corner of Lawrence Road and l-19 Clnal) Motion Commissioner Hannening moved to find this a minor modification. Commissioner Agui1a seconded the motion. Commissioner Hannening said if he had been here at the time the original 60' right-of-way was abandoned, he would have been dead set against this. There is no reason to have a 20' easement when a 121 easement would .suff1ce. Vice Mayor 22 ... Proposed Ordinance No. 092-51 Re: Authorizing execution of Drug Free Work Place Policy for the City of Boynton Beach Attorney Cherof read Proposed Ordinance No. 092-51 by title only: AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING ARTICLE I, CHAPTER 2, ADMINISTRATION, BY CREATING A NEW SECTION 2-19 ENTITLED "DRUG FREE WORK PLACE PROGRAM" IN ORDER TO ESTABLISH A DRUG FREE WORK PLACE PROGRAM IN ACCORDANCE WITH THE FLORIDA STATUTES; PROVIDING FOR DEFINITIONS, GENERAL PROCEDURES, POLICY REQUIRE- MENTS, CONFIDENTIALITY; PROVIDING THAT EACH AND EVERY OTHER PROVISION OF CHAPTER 2 NOT HEREIN SPECIFICALLY AMENDED SHALL REMAIN IN FULL FORCE AND EFFECT AS PREVIOUSLY ENACTED; PROVIDING FOR CONFLICTS, SEVERABILITY, CODIFICATION, AND AN EFFECTIVE DATE. ~ i ' Commissioner Harmening moved the adoption of Proposed Ordinance No. 092-51 on seco~d reading.
