The City has committed to providing certain services in this
area. Master and site plans have all reflected Fire Department
input pertaining to roads and water service. Presently, research
is being conducted pertaining to additional annexation in this
same area. Fire Department staff have consistently placed a high
priority on connective roads in this area. NOW, due to
circumstances, planning and expectations have sunk to a critical
level.
Examples: KNOLLWOOD GROVES - request to modify impact fees for
Miner Road.
LAWRENCE GROVE - previously released from agreement to
provide 60' right of way road connection with the
meadows; ie Bedford Blvd.
CITRUS GLEN - unfulfilled agreements with regard to
Miner Road.
Prior expectations by staff in the Fire Department were that
Miner Road would be complete at approximately the same time Fire
Station III was brought on line. It appears that several more
years will pass before this will be accomplished.
This situation is becoming untenable as response time elevates
along with additional value in the area served. It is the
Department's position that NO EXCEPTIONS CONCERNING MINER ROAD BE
MADE and that THE PROCESS TO ATTAIN A COMPLETED ROAD BE
EXPEDITED.

Master Plan Modification (utility easement width)
The above-referenced request for a modification to the Lawrence
Grove master plan, as described in the attached correspondence to
city Manager J. Scott Miller, dated October 14, 1992, was reviewed
by the City commission at their October 20, 1992 meeting. At this
meeting the City Commission unanimously determined that the
requested reduction in width of the off-site utility easement from
20 feet to 12 feet was not a substantial change.
Consistent with Appendix B, Section 12 of the Code of Ordinances,
a determination of no substantial change allows the forwarding of
the request to the Planning and Development Board for final
disposition. Therefore, it is recommended that the Planning and
Development Board approve this request as submitted.

Master Plan Modification - File No. 692
Enrico Rossi, agent for K. Hovnanian Companies, has requested a
modification to the previously approved master plan for the
Lawrence Grove P.U.D., as outlined in the attached correspondence
and diagrams in Exhibit "A". The modification requested is for
reduction of a 20 foot wide utility easement to 12 feet in width.
The subject easement is located east of the Bedford Boulevard
dead end; between the Lawrence Grove P.U.D. boundary and the
Meadows P.U.D. boundary as shown on the attached location map in
Exhibit "B".
One of the conditions of the Lawrence Grove P.U.D. zoning
approval was constructioh of Bedford Boulevard extended (a 60
foot wide right-of-way) to connect to an existing dead end off of
Meadows Boulevard within the Meadows P.U.D. This condition was
imposed to provide an east/west emergency access alternative to
Hypoluxo and Miner Roads and a looped water line system within
Lawrence Grove that would connect to the Meadows utility system.
However, in January, 1990, the applicant requested a master
modification to substitute the 60 foot wide right-of-way
extension of Bedford Boulevard with a 10 foot utility easement
due to legal problems with acquiring the right-of-way for the
road extension. The City Commission and Planning and Zoning
Board approved the deletion of the right-of-way extension for a
20 foot wide utility easement.
The procedure for approving master plan modifications in planned
unit developments is twofold. First, the City Commission must
make a determination as to whether or not the changes requested
are substantial in nature. A determination of substantial change
on the part of the City Commission, which has sole discretion in
this matter, would require a new application for P.U.D. On the
other hand, a determination of no substantial change allows the
forwarding of the request to the Planning and zoning Board. This
procedure appears in Appendix B, Section 12 of the Code of
Ordinances.
With respect to the change requested by Mr. Rossi, the Technical
Review Committee (TRC) met on October 8, 1992 to review the
letter and diagrams submitted. The TRC recommends that the City
Commission make a finding of no substantial change for the
requested modification and that this request be forwarded to the
Planning & Development Board for approval, as submitted.
Please note in Exhibit "c" Fire Department Memorandum No. 92-254,
wherein the Fire Department reiterates their position regarding
the immediate need for an east/west emergency access linking
Congress Avenue and Lawrence Road between Hypoluxo Road and N.W.
22nd Avenue.

Dear Mr. Cutro:
Enclosed is a copy of a letter from John Guidry, Director of
Utilities, dated February 25, 1992, approving our request for
reduction in the width of the water main utility easement from
20' wide to 12' wide.
This change would require an amendment to the Master Plan which
originally required a 6l?l' road right-of-way which was
subsequently reduced to a 2l?l' utility easement and now is reduced
to a 12' utility easement.
I assume that this Master Plan amendment can be handled
administratively. We will need verification of this amendment so
that K-Hovnanian of Palm Beach can pursue acquisition from the
property owner, Leila Foster.
