Easement Dear Mr. Standinger: Responding to your October 27, 1992 letter, I do not believe the City of Boynton Beach was ever responsible for the above- referenced easement costs incurred by the County. Rather, Hovnanian was the responsible party. I hope this answers your concerns. Box 310 Boynton Beach, FL 33425 RE: LAWRENCE GROVE P.U.D. - UTILITY EASEMENT ABANDONMENT ACROSS FOSTER PROPERTY TO MEADOWS "30"'''. Dear Mr. Cutro: Pursuant to our last discussions in your office with Steve Brannock, I have outlined the sequence of events as I understand them relative to the water main easement. 1. Or ig inal cond i t ion of zon i ng requ i red a 6"" right of way de d i cat ion by H 0 v n ani a n bet we e n Law r en c e G r 0 v e P. U . D. and Meadows "30"''' P.U.D. across property located in the County. A water main was to be constructed by Hovnanian within the 6"" R/W. 2. The Developer was to pursue acquisition from Mr. Foster through the County's Rights of Eminent Domain, if a stale- mate developed. 3. City modified its zoning condition by requiring developer to dedicate a 2'" foot wide utility easement only for the proposed water main interconnect with Meadows "3"'0". 4. Difficulties were encountered with owner of the land, Mr. Foster, Developer requested easement width be reduced to 12 foot wide easement. The 12 foot width was approved by Pete Mazzella, with the Utilities Department. You indicated that the City may require Master Plan Modification procedures for changing from 2'" to 12 feet wide. Enclosed is a print showing the proposed 12 foot utility easement. Please schedule the required action to move this request forward.
