SUBJECT: Lawrence Grove P.U.D. '~;
Master Plan Modification - File No. 403
Enrico Rossi, agent for K. Hovnanian Companies, has requested a
modification to the previously approved master plan for the
Lawrence Grove P.U.D., as outlined in the attached correspondence
in Exhibit "A". The modification requested is for deletion of
one of the conditions of P.U.D. zoning approval that requires the
applicant to construct the missing link (approximatey 629 feet)
of Bedford Boulevard. The western segment of Bedford Boulevard
currently begins at Lawrence Road and dead ends at the eastern
boundary of the Lawrence Grove P.U.D. The eastern segment begins
at Meadows Boulevard,and dead ends at the western boundary of the
Meadows 300 P.U.D. (see attached diagram and location map) in
Exhibit "B". This condition of approval entails acquiring the
necessary land (either by purchase or condemnation) from the
property owner of the undeveloped parcel that lies in Palm Beach
County between the Lawrence Grove P.U.D. and the Meadows P.U.D.,
to construct and dedicate a minimum 60 foot right-of-way
connection to Bedford Boulevard for the following public
purposes: An east/west emergency access which would be an
alternate to Hypoluxo and Miner Roads, and which would allow the
installation of an 8 inch water main.
The applicant is requesting that he be permitted to acquire a 10
foot utility easement in lieu of the 60 foot right-of-way
connection for Bedford Boulevard and construction thereof. This
modification was prompted after the applicant's attorney, G.
Steven Brannock, was notified by Palm Beach County, which is
instituting eminent domain action for the Bedford Boulevard
connection, of Palm Beach County's concerns with said litigation,
specifically cost and justification (see correspondence in
Exhibit "A").
The procedure for approving master plan modifications in planned
unit developments is twofold. First, the City Commission must
make a determination as to whether or not the changes requested
are substantial in nature. A determination of substantial change
on the part of the City Commission, which has sole discretion in
this matter, would require a new application for PUD. On the
other hand, a determination of no substantial change allows the
forwarding of the request to the Planning and Zoning Board. This
procedure appears in Appendix B, Section 12 of the Code of
Ordinances.
With respect to the change requested by Mr. Rossi, the Technical
Review Board (TRB) met on January IB, 1990, to review the plans
and documents submitted and they are recommending that the City
Commission make a finding of substantial change for the requested
modification. This recommendation was based on the Technical
Review Board's determination that due to the fact that east/west

thoroughfares are limited in the vicinity" of the Lawrence Grove
P.U.D., a condition which has not improved since the approval of
the Lawrence Grove P.U.D., there continues to be a need for the
Bedford Boulevard connection to promote rapid response by emer-
gency vehicles. Currently, City emergency vehicles must travel
west from existing fire and police stations to serve the growing
population of new developments on Lawrence Road. Therefore, it
is the Technical Review Board's recommendation that the original
condi tions of the Lawrence Grove P . U . D. approval (which are
reiterated in the attached memoranda in Exhibit "C" from the
Police, Fire and Utilities Departments) not be changed and that
all avenues be pursued to satisfy these conditions.

SUBJECT: TRB Review - Lawrence Groves - Condemnation of Bedford
Blvd. connection to The Meadows
We would like to take this opportunity to reinforce our position
on the need for a potable water interconnection between the
Meadows PUD and Lawrence Groves. Said interconnect is becoming
increasingly critical if we are to maintain reliability of
service and adequate disinfection.
The 10-foot wide easement indicated on the drawings is sufficient
if the main is to be,located adjacent to a future right-of-way.
However, if the right-of-way will not be obtained, then a 20-foot
wide easement is preferred so as to allow for the necessary
minimum setback of 10 feet from any future structures.

The applicant is request~ng that he be permitted to acquire a lO
foot utility easement ~nlieu of the 60 foot right-of-way
connection for Bedford Boulevard and construction thereof. This
moaification was prompted after the applicant's attorney, G.
Steven Brannock, was notified by Palm Beach County, which is
instituting eminent domain action for the Bedford Boulevard
connection, of Palm Beach County's concerns with said litigation,
specifically cost and justification (see correspondence in
Exhibit "A").
The procedurd for approving master plan modifications in planned
unit developments is twofold. First, the City Commission must
make a determination as to whether or not the changes requested
are substantial in nature. A determination of substantial change
on the part of the' City Commission, which has sole discretion in
this matter, would require a new application for PUD. On the
other hand, a determination of no substantial change allows the
forwarding of the request to the Planning and Zoning Board. This
procedure appears' in Appendix B, Section 12 of the Code of
Ordinances. .

With respect~ to the change requested by Mr. Rossi:, the Technical
Review Board (TRB),':" met on January 1B, 1990, to review the plans
and documents sub~itted and they are recommending that the City
Commission make a ,finding of substantial change for the requested
modification. This recommendation was based on the Technical

thoroughfares are limited in the vicinity of the Lawrence Grove
F.U.D., a condition which has not improved since the approval of
the Lawrence Grove P.U.D., there continues to be a need for the
Bedford Boulevard connection to promote rapid response by emer-
gency vehicles. Currently, City emergency vehicles must travel
west from existing fire and police stations to serve the growing
population of new developments on Lawrence Road. Therefore, it
is the Technical Review Board's recommendation that the original
conditions of the Lawrence Grove P.U.D. approval (which are
reiterated in the attached memoranda in Exhibit "C" from the
Police, Fire and Utilities Departments) not be changed and that
all avenues be pursued to satisfy these conditions.
