Box 310 Boynton 'Beach, Florida 33425 Re: Lawrence Grove P.U.D./Extension of Bedford Blvd. Dear Mr. Rea: As you know, one of the requirements of approval of the Lawrence Grove P.U.D. was that the developer acquire a 628 foot segment of property and construct on it a road to connect Bedford Blvd. with Meadows Blvd. In this regard, I met with patricia Franklin, Manager of the Right-of-Way Acquisition Department with Palm Beach County Engineering Department, to discuss the possibility of their helping out in this matter. Ms. Franklin advised me that this would be possible and all that she would need from the city is a letter indicating this is a requirement of our approval. At that point, we would enter into a Developers Agreement with Palm Beach County. The County would then have an appraiser do an appraisal of the property and then make an offer to the owner requesting a decision within thirty (30) days - thereafter. If the owner fai 1 s to accept the offer, then the'm~tter is sent to the Palm Beach County Attorney's Office for the institution of condemnation proceedings. I have enclosed herewith a copy of the form Developer's Agreement which the County uses. As you can see, the agreement is very comprehensive and requires the developer to advance to the County the cash necessary for the acquisi tion of the right-of-way plus twenty five percent (25%) of that total for staff charges and the appraiser's fee. As a result, it would appear reasonable that the City of Boynton Beach only require the developer to post a bond in the amount of the actual costs of the road construction improvements plus ten percent (10%). Dear Mr. Annunziato: In accordance of our meeting on June 26, held in preparation of the publ ic hearing held before the City Commission on June 21, 1987, I respectfully submit proposed language clarifying the comments issued by Staf'f which have been imposed as conditions for any approval of the applications pending on the projects referred to above. With reference to the Lawrence Grove application, I wish to confirm that modifications to the proposed site plan establish a three-foot landscape buffer along the collector road where double-frontage lots exist, and that this modification was found acceptable to the Planning Department and otherwise adequately responded to Mr. Jaeger's comment in his memorandum dated June 16, 1987. Comments issued in furtherance of the Lawrence Grove application by John A. Guidry, Director of Utilities, called for approval of the project being conditioned upon the developer providing the funds to pay all expenses associated with acquisition of a future right-of-way between MeadowsT~act and Lawrence Groves. It also "recommended- that construction of the project not commence until acquisition of the right-of-way has been finalized. During our meeting on June 26, I attempted to clarify the intent of your Department and the developer with regard to such conditions, and propose the following language incorporated into the staff's comments for the purpose of clarification: July 10, 1987 Page 2 "Approval should be conditioned upon developer providing funding for the acquisition of right-of-way between the "Meadows Tract" and "Lawrence Groves" by the City of Boynton Beach. Developer may satisfy this condition of approval by posting cash bond, letter of credit, or equivalent"in an amount equal to funding for acquisition and miscellaneous related costs. The amount of funds required shall be based on the appraised value of property which is subject to the right-of-way taking." "Developer may commence construction of the project, notwithstanding acquisition by the city of the right-Of-way has not been finalized, providing the developer complete utilities connections in aocordance with the present site plan and engineering plans submitted in furtherance of his original application. Developer shall be obligated to reconnect utility hook-ups to water lines established 'along the subject right-Of-way, upon notice by the City within three (3) years from the date of the City's approval of developer's application. The developer shall be entitled to credits for the costs relative to acquisition and installation of water lines to be constructed in such right-of-way.- The final comment pertains to Staff's memo indicating that tree management plans (for both projects) have not been submitted. I wish to confirm that such plans have been revised and resubmitted (prior to the Planning Commission hearing) in response to Mr. Hallahan's comments. In that the 16" water Main is currently fed only frOM the south, the dual interconnect serves only to enhance reliability of water supply in the event of an internal failure within the subdivision. Any probleMs with the 16" water Main between the future ground storage tank in Miner Road and this site would leave this entire subdivision, plus a few others, without dOMestic water or fire protection. A SiMple reMedy to this dileMMa would be to interconnect the Lawrence Groves water systeM with the existing Meadows systeM approxiMately 600' to the east. This action would effect an additional interconnect with the 16" water Main along Congress Avenue and greatly enhance reliability to Lawrence Groves and all other custOMers along Lawrence Road and north of, Miner Road. To summarize, I have contacted the following people: Palm Beach County Recreation Ken Greenwood 964-4420 He suggested that I call Gene Joyner at IFAS. IFAS Gene Joyner He suggested that I call Boynton nurseries. 683-1777 Boynton Nurseries 732-2721 I called on 4-14-88 and they never returned my call. Additionally, I spoke to Cindy Lamb at the Citrus Commission 832-0463 She advised that they require 3 negative inspections at 30 day intervals as well as a limited permit prior to movement of any trees. Local Government Comprehensive Plan Review - Amendments to the City of Boynton Beach Future Land Use Element Introduction Pursuant to the prOV1Slons of the Local Government Comprehensive Planning and Land Development Regulation Act, Chapter 163, Florida Statutes, the Council must be provided an opportunity to review and comment on comprehensive plan amendments prior to their adoption. The City of Boynton Beach has submitted proposed amendments to the State Department of Co~nunity Affairs, which in turn is seeking Council.s comments. Backgroun~ The City of Boynton B'each is considering two amendments to the Future Land Use Element. Locations of the properties under consideration are shown on the accompanyi ng map, ana the number of acres and proposed changes in 1 and use designations are summarized in the attached list. Evaluation The proposed amendments to the Future Land Use Element have been reviewed in accar-dance with the requirements of Chapter 163, Florida Statutes, Council's review procedures, and Council's adopted plans and policies. The following comment is offered as a result of that review. IBased on the information provided, the proposed amendments do not appear to be in conflict or inconsistent with the policies contained in the Regional Comprehensive Policy Plan. The City should continue to work with Palm Beach County in addressing traffic impacts to County-maintained roads and in maintaining an acceptable level of service on the regional roads affected by proposed land use changes. Recommendation Council should adopt the comment outl ined above wi th respect to the Future Land Use Element and approve its transmi ttal to the State Department of Community Affairs in fulfillment of the requir~ments of Chapter 163, Florida Statutes. In order for your client to comply with the conditions to the approval received from the City Commission, it is necessary that your client fund this City's eminent domain action for the road right-of-way extension between the Meadows Tract and the entranceway of the proposed subdivision (Lawrence Groves) . Because of this projects inter-relationship with the Comprehensive Plan Amendment process, the City will not take official action with regard to the annexation until the Department of Community Affairs signs off on the amendments to our Comprehensive Plan. We anticipate that this should be sometime in late October or early November. At that time this Ci ty will require that your client deposit an amount of money sufficient to cover the cost associated with legal fees for the condemnation as well as funds sufficient to cover the purchase price of the road right-of-way. Those sums which are not expended in this process would be returned to your client once the condemnation process is completed in its entirety. Gordon, Agent for GNM Associates Boynton Grove (Lawrence Grove) Subsequent to the City Commissioner's approval of the Application referenced above, a meeting was held between Alan Miller (a principal of the contract vendee) and Carmen Annunziato in order to review the specifics of conditions for such approval. One of the requirements called for the funding of all costs related to the purchase of property to be dedicated for a road right-of-way extending between the Meadows Tract and the entranceway of my client's proposed subdivision (Lawrence' Grove), and joining with its collector road. My client assured Carmen that sincere attempts have been made to purchase the subject parcel, but the owner expressed no desire in pursuing such a sale. The Planning Director has requested that I formally notify you of the facts and circumstances surrounding this matter and request that the City assist my client in taking such action as you deem necessary in furthering the City's need fOr obtaining the subject right-of-way extension. I would request that, upon your receipt of this correspondence, you contact Mr. Annunziato to confirm my understanding of the City's position and to advise me of what steps to take in behalf of my client to further comply with the conditions to the approval received from the City Commission. The following comments are submitted for your consideration: 1) Dedication of right-of-way should be required in accordance with the County's Thoroughfare Right-of-Way Protection Map. Lawrence Road requires an 80' right-of-way and Miner Road a 108' right-of-way. 2) Turn lanes on the internal collecter roadways and all main development accesses should be required in accordance with the traffic studies you sent us. 3) Since Miner Road is required for site access and traffic distribution, the segment of Miner Road adjacent to the site should be constructed by the developer as a two lane cross section in accordance with. County standards and over an alignment that will connect with the segment committed to the east. 4) Payment of traffic impact fees should be required in accordance with Palm Beach County Ordinance #85-10.
