Further research informs me that on July 3, 1990, the city Commission approved Resolution No. 90-BBBBB, a replat for Lawrence Grove to specifically allow "Z" lot homes. A "z" lot home is not allowed on the current, approved master plan for the Lawrence Grove PUD. Before this replat can be recorded and permits issued, a master plan modification needs to be filed through our office for review and recommendation by the TRB and approval by the City Commission and planning and Zoning Board. However, any project of size will impact needs for people. Police: Developments of this size are part of this department's over- all growth plan. Fire: Consideration of extension of Miner Road at earliest convenience for proper access. We currently use either 22nd Avenue or Hypoluxo Road causing some delay in response time. Public Works: The combined developments of Citrus Glen and Lawrence Groves will result in the following ex- penditures: Salary increase: 3 x 18,268 = 54,804 Operating and Maintenance: 3 x 153 = 459 Capital Outlay: 1 rear loadpacker = 85,000 Personnel and Purchasing: The Personnel and Purchasing staff would be directly impacted by this annexation contingent upon how many additional em- ployees, supplies and equipment is needed by the rest of the City. If we are told the total numbers, we can respond with a definite response. Utilities: The Utilities Department is strictly revenue supported. As such, anticipated revenues will offset increased outlay for salaries and operation and main- tenance personnel. The project can go forward regardless of the ability of the applicant or City to acquire the right-of-way between this project and the Meadows PUD. 2. Only cash is acceptable for surity purposes regarding the acquisition of the proposed right-of-way. 3. No credits against capital facilities fees are recommended for costs associated with the proposed acquisition of the right-of-way. 4. Box 310 Boynton Beach, FL 33435 Re: Project: Citrus Glen/Lawrence Groves Clarification of Staff Comments Dear Mr. Annunziato: In accordance of our meeting on June 26, held in preparation of the public hearing held before the City Commission on June 21, 1987, I respectfully submit proposed language clarifying the comments issued by Staff which have been imposed as conditions for any approval of the applications pending on the projects referred to above. With reference to the Lawrence Grove application, I wish to confirm that modifications to the proposed site plan establish a three-foot landscape buffer along the collector road where double-frontage lots exist, and that this modification was found acceptable to the Planning Department and otherwise adequately responded to Mr. Jaeger's comment in his memorandum dated June l6, 1987. Comments issued in furtherance of the Lawrence Grove application by John A. Guidry, Director of utilities, called for approval of the project being conditioned upon the developer providing the funds to pay all expenses associated with acquisition of a future right-of-way between Meadows Tract and Lawrence Groves. It also Ilrecommendedll that construction of the project not commence until acquisition of the right-of-way has been finalized. During our meeting on June 26, I attempted to clarify the intent of your Department and the developer with regard to such conditions, and propose the following language incorporated into the Staff's comments for the purpose of clarification: July lO, 1987 Page 2 "Approval should be conditioned upon developer providing funding for the acquisition of right-of-way between the "Meadows Tract" and nLawrence Groves" by the City of Boynton Beach. Developer may satisfy this condition of approval by posting cash bond, letter of credit, or equivalent, in an amount equal to funding for acquisition and miscellaneous related costs. The amount of funds required shall be based on the appraised value of property which is subject to the right-of-way taking." "Developer may commence construction of the project, notwithstanding acquisition by the City of the right-of-way has not been finalized, providing the developer complete utilities connections in accordance with the present site plan and engineering plans submitted in furtherance of his original application. Developer shall be obligated to reconnect utility hook-ups to water lines established along the subject right-of-way, upon notice by the City within three (3) years from the date of the City's approval of developer's application. The developer shall be entitled to credits for the costs relative to acquisition and installation of water lines to be constructed in such right-of-way.- The final comment pertains to Staff's memo indicating that tree management plans (for both projects) have not been submitted. I wish to confirm that such plans have been revised and resubmitted (prior to the Planning Commission hearing) in response to Mr. Hallahan's comments. ANNUNZIATO, PLANNING DIRECTOR RE: REQUESTS FOR ANNEXATION, FUTURE LAND USE ELEMENT AMENDMENT AND REZONING SUBMITTED BY MICHAEL D. GORDON FOR GNM ASSOCIATES INTRODUCTION Michael D. Gordon, agent for GNM Associates, and contract purchaser, is proposing to annex into Boynton Beach a 48.231 acre tract of land located at the southeast corner of Lawrence Road and the L-19 Canal (see Exhibit"A"). This property is currently zoned AR (Agricultural Residential) and it is occupied by a mature citrus grove in commercial production. There is a USDA agricultural experimental station in the northwest corner of the tract and a maintenance building in the center of the tract. Paralleling this request for annexation is a request to amend the Future Land Use Element of the Comprehensive Plan to show annexed land as Low Density Residential, and to rezone this property to a Planned Unit Development with a Land Use Intensity=4 (PUD w/LUI=4). The proposed PUD, to be named "Lawrence Groves", provides for the construction of 231 fee simple units, including 103 zero lot line, single family, detached units and 128 duplex units, with a gross density of 4.79 dwelling units per acre (see Exhibi t "B"). PROCEDURE These applications for annexation, amendment to the Future Land Use Element of the Comprehensive Plan and rezoning are being processed consistent with State Statutes, and Boynton Beach Codes, Ordinances and Resolutions as follows: 1. F.S. 163.3161: Local Government Comprehensive Planning and Land Development Regulation Act. 2. F.S. 166.041: Procedures for Adoption of Ordinances and Resolutions. 3. F.S. 171.011: Municipal Annexation and Contraction Act. 4. Boynton Beach Code of Ordinances, Appendix A, Section 3A5(e): Boundary and Zoning. -2- 5. Boynton Beach Ordinance #79-24. 6. Boynton Beach Resolution #76-X: Procedures for Annexation. 7. Boynton Beach Ordinance #86-54: Comprehensive Plan Evaluation and Appraisal Report. These regulations have been listed for informational purposes. Paraphrasing, these regulations require review by the City Department Heads, newspaper advertisements, public hearings with the Planning and Zoning Board and the City Commission and Commission adoption of ordinances to annex, amend the Future Land Use Element and rezone. CURRENT LAND USE AND REZONING As previously discussed, this property is undeveloped and zoned AR (Agricultural Residential). Lawrence Road forms the western limit of the City's Reserve Annexation Area as set forth by the Commission's policy which is reflected in the Comprehensive Plan Evaluation and Appraisal Report. It is contemplated that all lands between Lawrence Road and Congress Avenue to the south of Hypoluxo Road will eventually be annexed. This proposal is a continuation of previous actions to close unincorporated pockets in this portion of the reserve annexation area. The land use category requested, Low Density Residential, is representative of that which exists to the east in the City and is lower than that which exists to the south and west in Palm Beach County. To the north, within the City, is the Knollwood Groves property which has an agricultural land use designation. As noted in the correspondence in Exhibit "c" from the Palm Beach County Planning Department, the proposed land use is consistent with the current development pattern and the future plans for land use in Palm Beach County for this area. Since the grove is in commercial production, there are many mature citrus trees existing on site. It is recommended that the existing citrus trees within the grove be preserved to the greatest extent possible and incorporated as an amenity to the proposed project as outlined in the memorandum from the Forester/Horticulturist which appears in Exhibit "C". COMPREHENSIVE PLAN POLICIES There are three policies in the Comprehensive Plan which address annexations as follows: 1. "Annex only property which is reasonably contiguous to present municipal boundaries;" 2. "Annex property only after the preparation of a study evalu- ating the fiscal benefits of annexation versus the cost of providing service;" and 3. "Annex only properties which are of sufficient size to provide efficient service and on which urban development is anticipated." In order to determine the consistency of the GNM Associates request with the Comprehensive Plan Policies, each of the three policies will be addressed individually. Policy 1 - "Annex only property which is reasonably contiguous to the present municipal boundaries." -4- GNM Associates' property is contiguous with present corporate limits along the northern property boundary and approximately 720 feet of its eastern property boundary (39% of its entire boundary). Its western boundary is coterminous with Lawrence Road. In addition, this property lies in the path of urban devel- opment. Policy 2 - "Annex property only after the preparation of a study evaluating the fiscal benefits of annexation versus the cost of providing services." In response to policy two, you will find in Exhibit "C", an evaluation of the costs to the City of annexing this parcel and the dollars returned to the City in taxes. Policy 3 - "Annex only properties which are of sufficient size to provide efficient service and on which urban development is anticipated." As previously reported, the GNM Associates tract is 48.231 acres in size. It is anticipated that this parcel will experience urban development for the following reasons: 1. The availability of public utilities within the Lawrence Road right-of-way; 2. The existence of this parcel as a County pocket in a developing portion of the Reserve Annexation Area, as outlined in the correspondence from the Palm Beach County Planning Department in Exhibit "C"; 3. The efficiency of services to be provided when analyzed in connection with existing property on Lawrence Road currently in the City (Knollwood Groves), the proposed 53.60 acre Citrus Glen annexation, and the proximity to developing properties within Palm Beach County; and 4. Recent and proposed improvements to the surrounding road system, including the 4-laning of Hypoluxo Road, the proposed 6-laning of Boynton Beach Boulevard from Congress Avenue to Military Trail, the proposed 5-laning of Old Boynton Road from Knuth Dairy Road to Military Trail, and the proposed 4-laning of Military Trail from Old Boynton Road to Hypoluxo Road. RECOMMENDATION The Planning Department recommends that the applications submitted by Michael D. Gordon, for GNM Associates, trustee, be approved subject to the comments which accompany this memorandum as Exhibit "C". -5- This recommendation is based in part on the following: 1. The parcel is contiguous to Corporate limits; 2. The parcel lies within a County pocket and it is in the path of urban development. 3. The parcel is located within the City's municipal service area; 4. The intensity of land use desired is appropriate for the location; 5. The request is consistent with the Comprehensive Plan policies for annexation; 6. The land use category requested must be considered as a part of an overall strategy for annexation and it is appropriate; 7. The zoning is consistent with the proposed use of the site; 8. In reviewing the plans for the above listed developments, there is a concern that no plans were made for sidewalks or bicycle paths. Since this type of construction will likely draw a "young family" purchaser and a high density population, there is no place for pedestrian and bicycle travel other than in the roadways. Since there is a planned recreation area, I would recommend sidewalks in front of the units built or bicycle paths leading to the recreation area in order to assure safe travel of children. The applicant should address these comments prior to re-submittal. 1. Show all future, anticipated buildable areas. 2. Provide adequate pedestrian circulation throughout the site. 3. Landscaping for all common areas must be reviewed and approved by the Community Appearance Board. All common landscaped areas and landscaped areas in the right-of-way must be fully sprinkled. 4. There is a small parcel of land at the northeast section of the property, just north of the L-19 Canal which is not contiguous to the development. Indicate how the parcel will be treated when the project is developed. 5. Conflicts on the Lawrence Road right-of-way dedication must be resolved. 6. Acquisition and development funding for such a project would come from the Land Dedication Trust Fund. The subject developments will be required to provide fees in lieu of land per our subdivision regulations which would be applied to these costs. Operation and maintenance costs for the new park site would be funded from the general fund and would add to the Park Divisions budget requirements.
