Consistency of Boat Storage in CBD
with Comprehensive plan
Dry boat storage would be allowed in the CBD zoning district
under Policy 1.16.1 of the Comprehensive Plan. The CBD zoning
district is shown in the "Mixed Use" land use category on the
Future Land Use Plan. The uses allowed under the Mixed Use
category are desc~ibed on p. 28 of the Plan. Commercial uses
allowed in this category are the same as those which are allowed
in the "Local Retail Commercial" category, which are enumerated
on pp. 27-28 of the Plan. This list of uses includes "marinas
and boat storage". Although marinas and boat storage are listed
as a use in this category, it is not mandated that such uses be
permitted, since there is language in Policy 1.16.1--in the first
paragraph on p. 23, which states "The uses allowed under each
land use category shall be construed to be the maximum range of
uses, but shall not indicate that a particular use is necessarily
allowed in a land use category or zoning district. The zoning
regulations or other provisions of the City's Comprehensive Plan
or Code of Ordinances may prohibit or regulate certain specific
uses if doing so would be reasonable."
Policy 1.9.3 of the Comprehensive Plan states "continue to
implement the community Redevelopment Plan for the Central
Business District"; Policy 1.9.4 states "subsequent to Plan
Adoption, modify the land development regulations to require
construction and development projects in the central Business
District to essentially conform to the Community Redevelopment
Plan, the development regulations, and design guidelines for this
district." Sectl.on 163.3194(1)(b), Florida Statutes states that,
until the above-mentioned land development regulations are
adopted, the language in the Plan, which would include Policies
1.9.3 and 1.9.4, If. .shall govern any action taken in regard to an
application for a development order." It is worth noting,
however, that section 6.E.1. of the zoning regulations already
regulates the use and development of land in accordance with the
eRA Plan and CBD design guidelines, but does not contain language
requiring projects "to essentially conform to the Community
Redevelopment Plan." By virtue of Section 163.3194(1) (b),
Florida statutes, and Policies 1.9.3 and 1.9.4, conformance with

the CRA Plan is already required, regardless of whether the city
has adopted land development regulations to this effect.
On page F-IO of the CRA Plan, the Plan states "Redevelopment in
the Downtown Center should encourage land uses that maintain and
improve accessibility to the waterfront and avoid "walling
waterfront views or access". Activities that are on or in
closest proximity to the water should principally be eating and
drinking establishments, pedestrian oriented specialty retail
shops, marina uses, recreational uses and, public uses. Ideally,
a hotel facility and a high density residential project should be
located to provide waterfront views. II paragraph 3 on page F-13
of the CRA Plan st.ates ltDry storage and repair servies may be
able to be located under the proposed bridge to provide space for
retail shops on existing piers. II
The CRA Plan anticipates that dry boat storage facilities will be
located in the CBD, however the CRA plan is ambiguous with
respect to the exact location of such facilities. It is arguable
that the dry boat storage building would "wall off" a certain
portion of the waterfront, contrary to the CRA Plan, and that the
CRA plan implies that dry storage should be located under the
bridge. However, since the CRA Plan is ambiguous, it would be
desir~ble for the Community Redevelopment Agency, Planning and
Zoning Board, and city Commission make a finding that the
proposed boat storage building at the Waters edge Marina project
would, in fact, be consIstent with the CRA Plan. Such a finding
would resolve the ambiguity of the CRA Plan, and would be the
basis for a finding that the proposed boat storage bUilding is
consistent wlth Policies 1.9.3 and 1.9.4 of the Comprehensive
Plan, and thus, would be consistent with the Plan generally.

Issuance of Building Permit - File No. 464
After discussion and negotiation with representatives of the
developer, the Community Improvement Director, and the City
Manager's Office, it has been agreed that this department will
sign-off on the approved site plan, subject to incorporation of
all staff comments, with the exception of the approvals required
by the City commission for the legal agreements outlined in
attached Planning Department Memorandum No. 90-257 and those
items that require future review and approval by the City Boards
and the City Commission, outlined under item no. I of Planning
Department Memorandum No. 90-103.
Although the Planning Department is providing its sign-off on the
revised site plan drawings, a building permit should not be
issued for this project until you receive written notification
from this department that the above items have all been approved
by the City Commission.

Dear Mr. Baugh,
As requested, attached is a copy of the most recent set of plans,
on file in the Building Department, for the Lighthouse Square
Marina project. Please note that these plans reflect an amended
conditional use approval from the Commission that was granted on
August 21, 1990 and received Technical Review Board sign-off on
November 16, 1990. At that time, they were further conditioned, as
noted, upon certain permits being pulled.
since these plans were only valid for one year, and no permits were
issued, an extension was filed and approved by the Commission on
september 2, 1991. This one year Commission extension was
conditioned upon completion of the project without phasing. This
time extension yielded no construction and in order for the
applicant to keep the project.s conditional use approval alive, a
second time .:xtension was filed. The second extension was also
approved by the Commission on August 4, 1992 and was conditioned
upon a three part phasing plan; each phase having its own
commencement date - the last phase being tied to a July 1, 1993
date. A thl.rd time extension was filed to postpone commencement of
the August 4, 1992 three part phasing plan and was approved on
flovember 17, 199~. This third extenslon included an October
1, 1~93 deadline for phase three.

months ago) and no building permits have been issued, new

I have reviewed your draft letter of August 24, 1990 to Craig
Livingston in light of the requirements of Article V, Chapter 19
of the Code of Ordinances. I have also reviewed my notes and the
draft minutes of the last Commission Meeting where action was
taken regarding the proposed site plan modifications. My
analysis is as follows:
1. The threshold question is whether the "total value of
construction" is more or less than $100,000.00. If it is less
than $100,000.00, the application and review is governed by Sub-
section (a) of 19-68. If the total value exceeds $100,000.00 (or
in other circumstances) as outlined in sub-section (b) of 19-68,
a different procedure is required. As applied to applications
for site plan modifications, I believe there is an ambiguity in
this section of the Code which favors the applicant. It was
clearly the Commission's intentions to interpret "total value of
construction" to mean the total value of construction of the new
elements which required modification to the site plan. I cannot
say whether this is a correct or incorrect interpretation as I
find the language ambiguous and undefined. I do believe the
Commission was within its right to exercise its discretion in
interpreting the language of one of its one Ordinances.
Nonetheless, I believe it would be advisable to clarify the
definition of "total value of construction" when the Chapter 19
amendments come before the Commission.
2. The provisions of sub-section a of 19-68 would require
the Community Redevelopment Agency, in this case, the City
Commission, to either approve, approve with modification, or
disapprove the application after reviewing the Technical Review
Board's Report and the Downtown Review Board's recommendations.
In this instance, the application came directly to the Commission
without the benefit of the Technical Review Board or the Downtown
Review Board's reports and recommendations. Although this may be
a technical deviation from the requirements of the sub-section, I
do not believe it affects the Commission action. This is so
because both the Technical Review Board and the Downtown Review
Board's recommendations are advisory only and the Commission
(sitting as the CRA) could reject those recomm;q~~~~~

be prudent for the applicant to have the Commission action
ratified by the Downtown Review Board and the Technical Review
Board, I do not think we are in a position to compel the
applicant to do that.
In light of the foregoing, I believe your draft letter is
appropriate for transmission to Mr. Livingston. You might wish
to add a reference to the Commission's adoption of the site plan
rider. That rider should be provided to Mr. Livingston for
execution and submission to the City along with the modified site
plan. Additionally, you may wish to provide him with a copy of
the memorandum.

Dear Mr. Livingston:
Please be advised that on Tuesday, August 21, 1990, the City
Commission approved the referenced site plan modification
subject to staff comments, copies of which are attached.
These plans were approved subj ect to your compliance with the
attached stipulations and must now be modified to incorporate
same. To initiate your sign-off procedure, please submit two (2)
sets of. modified plans to the Office of the Site Development
Division of the Building Department, which will record the
required identification markings on each set 'of the modified
plans.
After each set of modified plans has the appropriate markings,
you should proceed with your sign-off on each set of plans from
each Technical Review Board member who made comments. The Zoning
& Site Development Administrator will provide the Building
Department sign-off and is the last Technical Review Board member
to review and sign-off the plans. If the Building Department did
not have comments that require sign-off, they are still the last
department to handle and process the plans. One (1) set of final
signed-off plans will remain with the Building Department and the
other set of plans will be returned to you to be retained at the
job site.
To help facilitate the sign-off process, you should make an
appointment to meet with each Technical Review Board member (only

those members who made comments), to allow them sufficient time
to review and sign-off the modified plans. After "securing all
the required Technical Review Board member signatures and
completing processing by the Site Development Division, you may
apply for building permits by submitting the appropriate
documents and fee to the Plan Review and Permitting Division of
the Building Department. The Building Department will advise you
as to any additional permits which may be required, such as Palm
Beach Health Department (water and sewer), clearing/grubbing,
excavation/fill, drainage, paving, site lighting, landscaping and
irrigation.
The approval of the City entitles you to construct only the
improvements shown on the site plan. The site plan will be
viewed procedurally as an as-built or record drawing. If you
have any questions concerning this matter, please do not hesitate
to contact me.

After reviewing the attached correspondence from Craig Livingston
dated August 16, 1990, please be advised of the following:
1. Article V, Section 19-64 of Chapter 19, Central Business
District, states that:
"The technical review board shall review every project plan
and supporting data for the construction of any building or
structure, in order to coordinate the technical advice and
expertise of the committee members and to ensure compliance
with the various provisions and intent of the City Code of
ordinances, prior to forwarding the project submission to
the downtown review board, the community redevelopment
agency and the city council."
2. Article V, Section 19-68(b) of Chapter 19, Central Business
District, states that:
"(b) For all applications for projects with a total value
of construction of one hundred thousand dollars ($100,000)
or more, applications for projects involving construction
which establish new principal uses, and applications for
projects previously approved as required by Chapter 19,
Article'II, of the City of Boynton Beach Code of Ordinances,
and for applications for conditional use approval, the
community redevelopment agency shall review the technical
review board's report and the downtown review board's
recommendation, and shall conduct a public meeting, or in
the instance of a conditional use, a public hearing, and
make written recommendations to the city council."
The language contained within the above-referenced sections of
Chapter 19, which sets forth the review procedures in the Central
Business District, does not provide for administrative approval
of projects (or changes to projects) less than $100,000 in value.

SUBJECT: Lighthouse Square Marina
The revised site plan reviewed by the Technical Review Board
included the following changes to the previously approved site
plan:
1. Significant changes to the parking lot layout and
design within the future right-of-way for Boynton Beach
Boulevard. These changes were made in connection with
a permit issued by the Florida Department of
Environmental Regulation to mitigate destruction of
mangrove habitat. NOTE: Conversations with FDOT
indicate that the new design of the parking lot within
the bridge right-of-way would not be compatible with
the future bridge design and that the original design
is subject to change. Therefore, it appears likely
that most, if not all, of these parking spaces would be
lost if a bridge is built at this location. The loss
of these parking spaces would result in a deficiency of
parking spaces that would be required by the City's
zoning ordinance, as this plan provides for only two
surplus parking spaces.
2. Changes to the approved Conditional Use for the dry
boat storage building which include an increase in
square footage from 35,089 to 36,450, an increase in
the east/west dimension from 260 to 275. feet and a
westward shift in the footprint of this building by
approximately 20 to 25 feet. ROTE: Although the
measured dimension on the new plan is 275 feet, the
architect shows this dimension as 270 feet. It was
also assumed that the scale of the site plan remains
one (1) inch equals 40 feet, as a scale was not
provided on the revised site plan drawing.
3. Increase in square footage of the retail on the south
side of the dry boat storage building from 6,313 to
6,750.
4. Change in the layout and design of the harbormaster
building and an increase in square footage from 3,750
to 4,000.

5. Changes in the layout and design of the restaurant
including the addition of a second floor and an
increase in seating by 25. NOTE: Although the
addition of the second floor appears to have increased
the square footage of this building, the exact increase
cannot be determined, as the square footage for this
building has not been shown on the site plan.
6. A change in the layout and design of the entire retail
frontage on the north side of Casa. Lorna Boulevard.
These changes include the creation of two buildings of
nearly equal size inst.ead of the larger and smaller
retail buildings rTeviously approved and the
elimination of the f~eestanding raw bar. The seating
in the raw bar was increased from 50 to 200.

7. A change in the layout and design of the retail
lighthouse, including a request for a 20 foot height
exception, as outlined in the attached correspondence
in Exhibit "A".
8. Elimination of 3 boat slips on the north side of the
inlet. Ho.wever, the total number of slips is still
shown as 37.
Copies of the approved and proposed site plans are provided in
Exhibit "B".
The Technical Review Board determined at the August 6th meeting
that the revised site plan was incomplete and should not be
forwarded to the Downtown Review Board until the applicant was
able to submit the missing items. The items which were missing

It is agreed by the developer(s) of the Lighthouse Square Marina
Project located in Boynton Beach, Florida that:
The Developer will grant to the City of Boynton Beach certain air
rights over a parcel of land located on the Northern Boundary
of the "Project" in order to facili tate the possible constru.ctioIl
of a new Boynton Beach Bridge. The granting of said Air Rights
will only occur if and when the State of Florida Department of
Transportation is successful in obtaining all necessary permits
and funding for the construction of said bridge at the aforesaid
location.
The Developer will submit two site plans to the City; Plan "A"
will be the plan implemented now. Plan "B" will be such that a
bridge may be constructed over and around said parking areas.
It is understood that Boynton Beach will cooperate with
Developers, their heirs and/or Assigns to make every effort to
facilitate Developers parking areas in the event the bridge is
ultimately constructed.
The Document acknowledging this Agreement will be executed by the
Owner1s of Record prior to the issuance of Building Permits for

Dear Mr. Cheroff:
We are in receipt of correspondence dated August 27, 1990 from Mr.
James J. Golden, Interim Planning Director, relative to the Site
Plan Modification for the Lighthouse Square Marina. We have
reviewed the comments from the Technical Review Board and are
currently incorporating said comments into our plans.
Item 6 C of Mr. Golden's memo requires our compliance with FOOT
comments in correspondence dated July 31, 1990. Mr. William A.
Lewis, Jr. states in said correspondence "The tri-party agreement
is currently under review and our comments will be forwarded
within 2 weeks." As it has been four weeks for FOOT to comment on
the tri-party agreement, it is our position that no comments will
be forthcoming particularly in that FOOT hag been reviewing this
project since April, 1990. We therefore are proceeding with the
position that no comments will be forthcoming.
We respectfully request that you advise FOOT in writing that they
have had ample time to communicate with the City of Boynton Beach
relative to this project and any further delay on the part of FOOT
is delaying our progress for approval.

This is a follow up to Mr. Lewis's response to your office
on July 31, 1990, relative to your request for comments from the
Department of Transportation regarding the subject document.
The Boynton Beach Bridge study is currently in the Project
Development and Environmental phase. The feasibility of several
alternatives are being studied and their environmental impacts
evaluated.
After the Project Development and Environmental studies are
completed a Preferred Alternate will be selected. Until this time
however, we feel that it is not appropriate for the department to
comment on or enter into a Tri-party agreement at this time.

In the review of modifications to the Site Plan Approval of
the above referenced project, we wish to make the following
comments:
1.) The original Boat Storage Building was 35,089
square feet, and has been increased by 5 feet
for a total area of 36,450 square feet. The
total number of boats will remain at 220 boats,
and the total number of employees will remain
at 15, therefore no increase in traffic will
result.
2.) The lighthouse will increase from 45' to 65',
with no increase in floor area, therefore no
increase in traffic.
3.) The retail space has decreased from 33,508 square
feet to 25,203 square feet and the west
restaurant has reduced the seats from 225 to 175.
The east restaurant (originally included in the
33,508 square foot area) has reduced from 225
seats to 175 seats.
4.) The connection of the Gourmet deli and the Raw
Bar to the main building will not increase

I am in receipt of your revised comments for the above
referenced project which I assume is required to be added
prior to your signing off on behalf of the Community Review
Board. I will address each of these as follows:
1. Page 203, Lighthouse Details, is currently labeled
as sheet 205. For site plan approval
purposes, please refer to sheet 205. Upon
submission of contract documents this drawing
will be relabeled as 203. Sheets 103 and 104
have not been included in the set because they
do not exist.
2. For your benefit, I have placed a building legend
on all sheets to show their reference to the site
plan. The site plan then references each floor
plan on drawing sheets.
3. The Building Department Site Department stamp is
on all drawings.
4. A205, as mentioned in item 1, is a revised drawing
number.
5. The north and south elevations of the raw bar are
shown on A404. Please note that the east, north,
and south are all identical.

6. Sheet A 408 indicates restaurant correctl~. Please
see sheet A100(upper right corner) which shows 2
proposed restaurants, 1 'at the west end and 1 at
the east end of the project.
7. The east elevation of the west retail (1st floor)
is shown on section 4 of sheet A410.
8. You indicated sheet A410 is incomplete and needs
information filled in for architectural reference
notes. These detail are construction details that
are currently being finalized for construction
documents. These details are not required for site
plan approval nor will they be submitted for same.
Section 3 on A410 is correct as indicated in
looking west, and looking east would be similar but
opposite hand.
9. DERM Permits are not attached as they have not been
issued yet. Please recall the memorandum from
Jim Golden that indicated the City of Boynton Beach
will allow sign off by all Department Heads for
Site Plan Approval and will hold on construction
permit issuance pending receipt of DERM Permits.
10. Colors and materials have already been submitted to
the City on the Community Appearance Board
Application, on the Materials Boards
submitted to the City, and on sheet A404.
11.
The landscape drawing shows the tree planting
details, which was given to you as a courtesy
drawing for your benefit. As this project has
already been signed off by the Forester on both
occasions, it is my clients position that this ,is
out of the perview of your department and is
unnecessarily holding up the approval of an
important development. As the City requires
construction details as part of the building
permits, they will be submitted with the
construction application.

Dear Tambri:
We are in receipt of your letter of October 22 which
concerns the August Site Plan modification made for the
above referenced project. In reviewing the revised
calculations we agree with all portions except those
concerning the retail area.
You have calculated the trips per day for the entire
25,203 square feet as a retail use; however, the 6,000
square feet on the second floor of the retail has been
leased to a Chiropractic Office which will use 3,000 square
feet for his office and 3,000 square feet for a Therapy
Center. This will reduce the trips per day as follows:
Retail - 22,203 square feet (22.20 x 124 TPD)
= 2,753 trips per day.
Office - 3,000 square feet (3.0 x 26 TPD)
= 78 TPD
This results in a total trips per day of 5,146 and is a
difference of the 1987 Approval of 350 trips per day.
As this is less than 500 trips per day, we are still in
compliance with the original traffic impact.

convenience.

Dear Craig:
I have reviewed your letter of October 3, 1990 and the April 20,
1990 traffic impact analysis for the above-referenced project as
it relates to one of the outstanding comments from the August 7,
.1990 Planning Department memorandum, comment #17.
Based on my attached calculations, there is a net increase of 645
trips per day resulting from the August site plan modification.
Therefore, a revised traffic impact analysis will need to be
submitted prior to final sign-off, to verify that the site plan
changes approved in August do not result in a net increase of 500
trips per day or do result in a net increase of 500 trips per
day; the latter requiring compliance with the Traffic Performance
Standards Ordinance.

Dear Don;
As per your discussions with my architect, Craig Livingston, I
would like to outline for your information the upcoming sequence
for the Lighthouse Square Marina.
The construction drawings for the lighthouse building have been
submitted to your department, and have been returned to us for
response to review comments. The harbormaster drawings will be
submitted shortly, together with the boat storage building,
marina and site improvements. We will also apply for a demo-
ition permit as part of this application.
As a condition of financing, the lenders are looking for an
indication from the City of Boynton Beach that the marina
project can pull all building permits for the individual
buildings or structures, and apply for and receive Certificates
of Occupancy as each building or structure is completed. This
will facilitate the use of different portions of the project as
they are completed, and will contribute to the income stream of
the project.
Please note that each building will comply with city codes
relative to parking spaces and requirements and will be capable
of operating independantly of other structures. All sitework and
utilities are proposed to be installed at the onset of
construction.

We currently have obtained permits from Army Corps of Engineers,
DER and SFWMD, the DERM permit is being typed and is to be
issued shortly.
It is proposed that all construction permits will be obtained at
one time. The initial facilities are to sequenced as follows~
* Sitework, marina and seawall, lighthouse building
and gas pumps, and boat storage building.
During construction of the above referenced work, construction
on the harbormaster building, retail and restaurants will
commence as leases are signed. We anticipate completion of all
parts of the project in the fall/winter of 1991.
If this is acceptable in concept to your department, please
notify us in writing so that we may advise the financial lenders
of our discussions. We appreciate your continued cooperation and
efforts towards what will be a successful investment in Boynton
Beach.
