In lieu of approval. we offer the following comments on this
project..
1. Add a second valve on all hydrant lines whenever the hydrant
is greater than 20 feet from the main line.
2. Show all utility easements.
3. Only those tree species approved by the Utility Department
may be placed in utility easements.
4. Dumpsters and enclosures are not permitted in utility
easements.
5. Double check valve assembly will be required on the fire
service line. not on main line.
6. Irrigation is not to be supplied by City water~
7. Reduced pressure backflow preventer required on meters to
boat dock.
8. All fire hose cabinets must be valved.
9. Provide cleanouts to dockside sanitary service.
10. 90. angle in alignment of 24" sewer at manholes #4 and #7 is

boardwalk. Clarify discrepancies between detail and utility
plans.
16. Add note "All OIP to be polyethylene encased in areas of
corrosive soils."
17. Show DIP extending 9' beyond manholes #10 and #11 V (PVC).

SQUARE MARINA (FKA) WATERS BDGB MARINA
Upon review of the above mentioned project, the following list of
comments have been provided as a courtesy with the applicant's
full knowledge that there will be a full review made when the
project is placed on a future Technical Review Board agenda:
1. I recommend showing on the plans a minimum of three (3)
(equally distributed throughout the site) 12'0" wide by
35'0" long loading spaces. Include on the plans a
statement that all loading spaces have a clear
unobstructed height of 14'0".
2. All faces of each building must be represented with a
complete elevation view drawing. Identify all exterior
finish material for each building and appurtenance.
Specify the color by name, color number, and manufacturer
name for each type of exterior finish material.
The bUilding elevation drawings submitted for final

5. Identify the location and width of all walkways. Include
the slope for the entire length of all walkways. Specify
the type of material used to construct the walkways.
Show handicapped accessibility for the use of the walkway
that transverses the west end of the site at the retail
area.
6. Provide handicapped parking on the north side of the
harbor master building.
7. Show the location, width, length and elevation of the
level platform that is required at the handicapped
accessible entrance to each bUilding and each tenant
space of each building.
8. Show and identify the type of surface material and
width proposed for the walkway that starts at the top
of each handicapped ramp, and leads to the handicapped
accessible entrance to each bUilding and/or tenant space.
Specify the slope of each walkway.
9. Show a handicapped ramp adjacent to each handicapped
parking space. Specify on the plans the width, slope,
length and type of material used to construct all
handicapped ramps. Provide handrails for ramps as
required by the State of Florida Accessibility

10. Show on the plans a regular and handicapped parking space
detail drawing. Drawing must include the width and
length of each type of parking space. Identify the
color, size, location and configuration of the required
pavement markings. Show the type, location and specify
the height of the handicapped parking space signage.
11. Identify on the plans the width and length of all
landscape areas show on the plan.
12. All signage requires approval of a sign program. Apply
for site plan approval through the Planing Department.
Provide detail drawings specifying all colors and size
computations of proposed signage, and the location and
type of site amenities for the entire site. All signage
must comply with the Boynton Beach Sign Code.
13. Provide a transverse cross section drawing through the
site starting at the south side canal water edge and
extending to the south side right-of-way of Casa Loma
Boulevard. specify elevation and width, where
applicable, of mean sea level, seawall, dock, rear deck/
sidewalk, building finish floor level, front deck/
sidewalk, parking space, crown of road, parking space
and sidewalk located on the south side of Casa Loma
Boulevard. All elevations to be consistent with the
requirements of all applicable regulatory agencies.
14. Identify on the plans the finished elevation and type of
material proposed for property adjacent to each building,
specifically around center retail building, lighthouse
building, retail area south of boat storage building and
east of boat storage building, restaurant bUilding and
harbor master building.
15. Show and describe on the elevation and plan view drawings
the method by which the boats stored in the boat storage
building will be placed in the canal water.
16. Show and identify on the site plan drawing the location
of all exterior mechanical equipment including any wall
or roof ventilation required for boat storage bUilding.
Include the location and type of visual barrier required
to screen the equipment.
17. Provide a detailed plan view and full section view
drawing of the dumpster enclosure, pad and service area
enclosure. Specify the size and type of all required
vertical and horizontal structural material and
components for the enclosure and associated pad.
Identify the overall height, width and length of each
enclosure. Show the clear width of the dumpster opening
(clear width to be measured inside of gate and post
material or meet with Public Works specifications for
compactor dumpster enclosure). The required minimum
width is ten feet (10'). specify on the plans the method
of holding the enclosure gates in the open and closed
position.
18. Specify on each floor plan drawing the square foot
area for each portion of the project. Include a
floor plan drawing for the boat storage and retail
bUilding.
19. Provide an elevation view drawing of south entry wall
sign that is in conflict with sidewalk.

20. I recommend numbering each of the architectural drawings
and label' the title of each drawing shown on the sheet
with all drawings relating to the buildings shown on the
site plan.
21. Show on the plans a minimum distance of 8'0" from the
water's edge to the closest overhang of the restaurant
and harbor master building.
22. Provide Lease Agreement or ownership and unity of Title
for off-site improvements shown on the plans.
23. Provide a copy of the permit approval as required from
the following regulatory agencies: Army Corps of
Engineers, DER, DNR, DERM, FOOT, and Health Department.
Incorporate their requirements into the drawings
submitted for final sign-off.
24. Show and label the location of the seawall. Specify the
elevation and width of the seawall.
25. Provide written approval and approved plans from the FDOT
for the parking spaces and islands shown on the north
side of the property located on the FDOT easement.
26. The boat storage building at this particular project
has been granted a Conditional Use Approval by
the City Commission with an area of 35,089 square feet.
New plan submission shows 36,450 square feet. The
Building Department shall not issue a building permit
unless such permit plans conform in every respect to the
Conditional Use as approved by City Commission (Appendix
A - Section 11.2, Chapter 5). To acquire final sign-off,
provide plans that match in every respect the plans that
received Conditional Use Approval.
27. Submit landscape plans for the entire site. Landscape
plans shall conform to the requirements of the Landscape
Code.
28. Show the location, height and rail configuration for the
guardrails and handrails that are required as per the
Standard Building Code, 1988 Edition, Chapter 11 and 12
and the state of Florida Accessibility Requirements
Manual.
In order to facilitate the permitting process, the following
information should be included with your documents submitted to
the Building Department for review and permitting:
1. All multi-story buildings, including the lighthouse must
meet the requirements of The State of Florida
Accessibility Requirements Manual.
2. Verification of compliance with the conditions of the
Environmental Review Permit are required prior to the
issuance of the building permit, and obtaining an
occupational license.
3. All building construction must comply with the Standard
Building Code, 1988 Edition, and the applicable
amendments.

For clarification purposes, I list the enclosed as follows:

advised that these are conceptual in nature and
that each tenant will design their respective
design within the size configuration shown.
2.} Decorative site clock to be located on the north
side of the retail shops and centered on the
breezeway. (Color to be teal)

wood color with a black chain) .

Dear Mr. Lewis:
In April 1990, the City requested your comments concerning the
above-referenced request (see attached correspondence dated April
11, 1990). As of this date, comments have not been received
concerning this matter.
On May 15, 1990, the Boynton Beach City Commission approved the
above-referenced request, subject to approval of the tri-party
agreement between the City, DOT, and the developer (J&J Ventures)
concerning construction of the bridge and the use of the area
underneath the bridge for a parking lot. A copy of the draft
tri-party agreement document was forwarded to the City Attorney
for review prior to the issuance of a building permit. The City
Attorney's comments are outlined in the attached memorandum dated
June 26, 1990.
Please provide the city with your comments concerning this matter
so that the City and the developer may proceed accordingly.

Dear Mr. Livingston:
Please l?e advised that on Tuesday, August 21, 1990, the City
Commission approved the referenced site plan modification subject
to staff comments, copies of which are attached. In addition,
the City Attorney is recommending that you complete the attached
site plan rider form and submit same to the Planning Department
prior to sign-off for a building permit.
These plans were approved subj ect to your compliance with the
attached stipulations and must now be modified to incorporate
same. To initiate your sign-off procedure, please submit two (2)
sets of modified plans to the Office of the Site Development
Division of the Building Department, which will record the
required identification markings on each set of the modified
plans.
After each set of modified plans has the appropriate markings,
you should proceed with your sign-off on each set of plans from
each Technical Review Board member who made comments. The Zoning
& Site Development Administrator will provide the Building
Department sign-off and is the last Technical Review Board member
to review and sign-off the plans. If the Building Department did
not have comments that require sign-off, they are still the last
department to handle and process the plans. One (1) set of final
signed-off plans will remain with the Building Department and the
other set of plans will be returned to you to be retained at the
job site.

To help facilitate the sign-off process, you should make an
appointment to meet with each Technical Review Board member (only
those members who made comments), to allow them sufficient time
to review and sign-off the modified plans. After securing all
the required Technical Review Board member signatures and
completing processing by the Site Development Division, you may
apply for building permits by submitting the appropriate
documents and fee to the Plan Review and Permitting Division of
the Building Department. The Building Department will advise you
as to any additional permits which may be required, such as Palm
Beach Health Department (water and sewer), clearing/grubbing,
excavation/fill, drainage, paving, site lighting, landscaping and
irrigation.
The approval of the City entitles you to construct only the
improvements shown on the site plan. The site plan will be
viewed procedurally as an as-built or record drawing. If you
have any questions concerning this matter, please do not hesitate
to contact me.

Dear Mr. Golden:
The Department has reviewed your request of April 11, 1990 to
co~ent on the above-referenced project. We find no objection to the
proposed Water's Edge Marina project providing the following conditions
remain in effect:
1) The Department retains all easement rights to the property as
identified in the Court Order dated January 9, 1968,
Case No. 66-L-1235-E, Palm Beach County.
2) In that the Department of Transportation owns a drainage pipe
on the premises and has the responsibility of maintaining the
pipe, the Department reserves its right of access to the pipe
at all times with no interference to such access rights, and
will not be responsible for damage or injury caused by the
~ existence of the pipe or its appurtenances on the improved
premises.
3) In the event that repairs are required to the drainage pipe
system, the Department will not be responsible for any
damages to the proposed improvements in the easement.

With respect to the above, please be advised of the following:
1. A revised landscape plan was not submitted which corresponds
to the new layout and design shown on the site plan. The
exterior furnishings and pedestrian amenities required in
the Central Business District must be shown on the landscape
plan (Section 7.5-57.1.J of the CBD Landscape Regulations
and Section 19-60 (b)(5) of the Code of Ordinances).
2. Details on project entry signs have not been provided
(Section 6.E.6 of Appendix A-Zoning and Section 19-60(b)(6)
of the Code of Ordinances).
3. Revised elevations and a revised floor plan for the proposed
changes to the layout and design of the dry boat storage
building and the increase in square footage from 35,089
square feet to 36,450 square feet have not been provided.
In addition, the proposed changes to the dry boat storage
building will require a modified conditional use
application, as Section ll.2.C.5 of Appendix A-Zoning states
that "The Building Department shall not issue a building
permit unless such permit conforms in every respect to the
conditional use as approved by the City Commission".
4. Provide a typical pole elevation on the blueprint drawings,
for the pedestrian and parking lot lighting fixtures
proposed. Specify type of energy efficient lighting
required and illumination levels (item no. 26.d on site plan
checklist, Section 19-60 (b)(5) of the Code of Ordinances
and Design Requirements of Article X - Parking Lots).
5. Parking space calculations were not properly delineated on
the application form and site plan drawing. Correct
calculations are as follows:

for the charter boats beyond the 277 spaces
outlined above (Section ll.l6.e(11) of Appendix
A-Zoning).
(3) Loading spaces cannot encroach roadways or access
aisles. Three spaces were required on previous
site plans and should be provided on this site
plan (Section Il.J of Appendix A-Zoning).
6. Construction of the proposed parking lot within the future
right-of-way for Boynton Beach Boulevard, prior to the
construction of the bridge, will require the following:
a) A license agreement from the governmental entity that
currently has jurisdiction over the existing
right-of-way.
b) A lease agreement for that portion of the parking lot
that is proposed on the property which lies north of
the existing right-of-way, owned by Janet Hall. The
lease agreement must be approved by the Community
Redevelopment Agency after review and recommendation by
the Technical Review Board (Section 6.E.4.c(2) and (3)
of Appendix A-Zoning).
c) Compliance with FDOT comments contained within the
attached correspondence dated July 31, 1990.
7. The tri-party agreement concerning construction of the
future bridge and the parking area underneath is currently
being reviewed by FDOT. Preliminary discussions with FDOT
indicate that they are considering abandoning the tri-party
agreement in favor of an alternative solution. Final
comments concerning the tri-party agreement will be
formalized when the response from FDOT is received.
8. The conditions of the previous variance approval for the
fire lane and the backing of cars into Casa Lorna Boulevard
must still be met (provide a note concerning fire sprinklers
and standpipes and show detail for integration of park with
cul-de-sac).
9. License agreements must be approved by the City Commission
for the utilization of public rights-of-way (N.E. 6th Street
and Casa Lorna Boulevard) for parking and other purposes.

10. Easement to be dedicated to connect Casa Lorna Boulevard to
Ocean Avenue and Boynton Beach Boulevard via the private

14. The engineering drawings do not correspond to the site plan
drawing with respect to the loading zones on the south side
of Cas a Lorna Boulevard.
15. The ultimate right-of-way line for the extension of Boynton
Beach Boulevard and the construction of the bridge should
remain on the site plan drawing for reference purposes and
to coordinate future construction drawings for the bridge,
if approved.
16. A loading space was deleted from the plans that was required
in connection with previous approvals. Please modify plans
to restore missing loading space (Section ll.J of Appendix
A-Zoning) .
17. The proposed site plan modification must include a statement
from a Florida Registered Traffic Engineer or, if necessary,
a revised traffic impact analysis which addresses compliance
with the Municipal Implementation Ordinance of the Palm
Beach County Traffic Performance Standards Ordinance.
Considering that this project was approved for 4,796 trips
per day prior to implementation of the Municipal
Implementation Ordinance, any intensification which results
in a net increase of 500 or greater additional trips per day
will require compliance with the Traffic Performance
Standards Ordinance.
18. An additional $~09 is required for the site plan
modification or Conditional Use modifictation ($3U0 total).
A $125 fee is required for the height exception.

1. Add a second valve on all hydrant lines whenever the hydrant
is greater than 20 teet from the main line.
2. Show all utility easements.
3. Only those tree species approved by the Utility Department
may be placed in utility easements.
4. Dumpsters and enclosures are not permitted in utility
easements.
5. Double check valve assembly will be required on the fire
service line, not on main line.
6. Irrigation is not to be supplied by City water.
7. Reduced pressure backtlow preventer required on meters to
boat dock.
8. All fire hose cabinets must be valved.
9. Provide cleanouts to dockside sanitary service.
10. 90Q angle in alignment of 24" sewer at manholes #4 and #7 is
not acceptable.
11. Specify C900 PVC on 8" gravity sewers.
12. Add 8" gate valve on Casa Lorna
13. 2' clearance insufficient between 84" storm sewer and 8" PVC
sanitary sewer.
14. Consider moving gate valve closer to the tee at northeast
terminus.
15. Relocate meters to grassy area between parking lot and
boardwalk. Clarify discrepancies between detail and utility
plans.
16. Add note "All DIP to be polyethylene encased in areas of
corrosive soils."
17. Show DIP extending 9' beyond manholes #10 and #11 V (PVC).
18. Televising on existing sanitary sewer required before and
after resurfacing. Any damage to the sewer to be paid by
developer. Cost of second and any subsequent televising to
be borne by developer at $1.35 L.F.

Upon review of the above mentioned project, the following list of
comments have been provided as a courtesy with the applicant's
full knowledge that there will be a full review made when the
project is placed on a future Technical Review Board agenda:
1. I recommend showing on the plans a minimum of three (3)
(equally distributed throughout the site) 12'0" wide by
35'0" long loading spaces. Include on the plans a
statement that all loading spaces have a clear
unobstructed height of 14'0".
2. All faces of each building must be represented with a
complete elevation view drawing. Identify all exterior
finish material for each building and appurtenance.
Specify the color by name, color number, and manufacturer
name for each type of exterior finish material.
The building elevation drawings submitted for final
sign-off shall match in every respect with the drawings
approved by the City Commission during the approval
process of the project.

area.
6. Provide handicapped parking on the north side of the
harbor master building.
7. Show the location, width, length and elevation of the
level platform that is required at the handicapped
accessible entrance to each building and each tenant
space of each building.
8. Show and identify the type of surface material and
width proposed for the walkway that starts at the top
of each handicapped ramp, and leads to the handicapped
accessible entrance to each building and/or tenant space.
Specify the slope of each walkway.
9. Show a handicapped ramp adjacent to each handicapped
parking space. Specify on the plans the width, slope,
length and type of material used to construct all
handicapped ramps. Provide handrails for ramps as
required by the State of Florida Accessibility
Requirements Manual.

10. Show on the plans a regular and handicapped parking space
detail drawing. Drawing must include the width and
length of each type of parking space. Identify the
color, size, location and configuration of the required
pavement markings. Show the type, location and specify
the height of the handicapped parking space signage.
11. Identify on the plans the width and length of all
landscape areas show on the plan.
12. All signage requires approval of a sign program. Apply
for site plan approval through the Planing Department.
Provide detail drawings specifying all colors and size
computations of proposed signage, and the location and
type of site amenities for the entire site. All signage
must comply with the Boynton Beach Sign Code.
13. Provide a transverse cross section drawing through the
site starting at the south side canal water edge and
extending to the south side right-of-way of Casa Lorna
Boulevard. specify elevation and width, where
applicable, of mean sea level, seawall, dock, rear deck/
sidewalk, building finish floor level, front deck/
sidewalk, parking space, crown of road, parking space
and sidewalk located on the south side of Casa Lorna
Boulevard. All elevations to be consistent with the
requirements of all applicable regulatory agencies.
14. Identify on the plans the finished elevation and type of
material proposed for property adjacent to each building,
specifically around center retail building, lighthouse
building, retail area south of boat storage building and
east of boat storage building, restaurant building and
harbor master building.
15. Show and describe on the elevation and plan view drawings
the method by which the boats stored in the boat storage
building will be placed in the canal water.
16. Show and identify on the site plan drawing the location
of all exterior mechanical equipment including any wall
or roof ventilation required for boat storage building.
Include the location and type of visual barrier required
to screen the equipment.
17. Provide a detailed plan view and full section view
drawing of the dumpster enclosure, pad and service area
enclosure. Specify the size and type of all required
vertical and horizontal structural material and
components for the enclosure and associated pad.
Identify the overall height, width and length of each
enclosure. Show the clear width of the dumpster opening
(clear width to be measured inside of gate and post
material or meet with Public Works specifications for
compactor dumpster enclosure). The required minimum
width is ten feet (10'). Specify on the plans the method
of holding the enclosure gates in the open and closed
position.
18. Specify on each floor plan drawing the square foot
area for each portion of the project. Include a
floor plan drawing for the boat storage and retail
building.
19. Provide an elevation view drawing of south entry wall
sign that is in conflict with sidewalk.

20. I recommend numbering each of the architectural drawings
and label the title of each drawing shown on the sheet
with all drawings relating to the buildings shown on the
site plan.
21. Show on the plans a minimum distance of 8'0" from the
water's edge to the closest overhang of the restaurant
and harbor master building.
22. Provide Lease Agreement or ownership and Unity of Title
for off-site improvements shown on the plans.
23. Provide a copy of the permit approval as required from
the following regulatory agencies: Army Corps of
Engineers, DER, DNR, DERM, FDOT, and Health Department.
Incorporate their requirements into the drawings
submitted for final sign-off.
24. Show and label the location of the seawall. Specify the
elevation and width of the seawall.
25. Provide written approval and approved plans from the FDOT
for the parking spaces and islands shown on the north
side of the property located on the FDOT easement.
26. The boat storage building at this particular project
has been granted a Conditional Use Approval by
the city Commission with an area of 35,089 square feet.
New plan submission shows 36,450 square feet. The
Building Department shall not issue a building permit
unless such permit plans conform in every respect to the
Conditional Use as approved by City Commission (Appendix
A - Section 11.2, Chapter 5). To acquire final sign-off,
provide plans that match in every respect the plans that
received Conditional Use Approval.
27. Submit landscape plans for the entire site. Landscape
plans shall conform to the requirements of the Landscape
Code.
28. Show the location, height and rail configuration for the
guardrails and handrails that are required as per the
Standard Building Code, 1988 Edition, Chapter 11 and 12
and the State of Florida Accessibility Requirements
Manual.
In order to facilitate the permitting process, the following
information should be included with your documents submitted to
the Building Department for review and permitting:
1. All multi-story buildings, including the lighthouse must
meet the requirements of The State of Florida
Accessibility Requirements Manual.
2. Verification of compliance with the conditions of the
Environmental Review Permit are required prior to the
issuance of the building permit, and obtaining an
occupational license.
3. All building construction must comply with the Standard
Building Code, 1988 Edition, and the applicable
amendments.

THlS GRANT of a license executed and delivered this I '
day of septe'rrib~'I<; 1990 by the City of Boynton Beach, a Florida
municipal corporation, located in Palm Beach County, Florida
[BOYNTON or GRANTOR] to J & J Ventures of Florida, a Florida
general partnership [JJ or GRANTEE].
WHEREAS, BOYNTON either owns a parcel of real property in
fee simple or has an interest in a parcel of real property which
is described on Exhibit F attached hereto; and
WHEREAS, JJ owns a parcel of real property in fee simple
and more particularly described on Exhibit B attached hereto.
NOW, THEREFORE, in consideration of the sum of Ten
Dollars ($10.00) and other good and valuable consideration, the
receipt and sufficiency of which is hereby acknowledged by
BOYNTON, BOYNTON has granted, bargained, conveyed and sold to JJ,
its grantees, heirs, successors, assignees and nominees forever, a
perpetual non-exclusive license to use the real property described
on Exhibit F for the following uses:
Parking the vehicles and boats of JJ and the vehicles and
boats of the guests, licensees and invitees of JJ.

above paragraph and for which BOYNTON, its agents, servants or
employees are or are alleged to be liable.
Neither BOYNTON nor any agent, servant or employee of
BOYNTON shall be liable to JJ for any loss, injury or damage to JJ
or to any other person or to its or their property, irrespective
of the cause of such injury, damage or loss.
JJ shall maintain adequate insurance on

JJ at its expense may construct and maintain a parking
lot on a portion of the real property described on Exhibit F. The
par king lot wi 11 be const r ucted in accordance wi th the sit e plan
of the real property approved by the City Commission of the City
of Boynton Beach and as modif ied by the staff of the Ci ty of
Boynton Beach.

the benefit of the parties hereto, their grantees, heirs,
successors, assignees and nominees.

formalities and be of equal dignity with this Agreement.

Blvd. (extended) on the Intracoastal Waterway. This present plan
was approved by the City Commission on August 21, 1990. To the
best of our knowledge this parcel has had an approved site plan
from 1985.
Staff at this time has only- one concern and that is the partial
construction of proposed development as opposed to the entire
development. In its last review the developer verbally committed
to constructing the entire development, however, no condition was
added to the record that would require the same.
If the City Commission chooses to approve the extension of the
site plan, we would ask that a condition regarding our concern be
added to the approval.

As South Florida struggles to cope with the recession that has
effected all of us, my client continues to secure construction
financing for the redevelopment project known as Lighthouse
Square Marina.
We have been negotiating with a Virginia bank that currently is
merging with NCNB, and the merger together with the state of the
economy has impacted the progress.
As we are well aware, the one year site plan approval will
expire on August 22. In relation to the size of this project,
together with the rapidly changing economy, this last year has
gone quickly. We have completed architectural plans for various
components of the project, and have submitted for building
permits for the Lighthouse. We are not in a position to begin
construction, and are here tonight to request an extension to
the current approval.

Livingston for the Lighthouse Square Marina.

realistic than to build everything at once. However, we may not
be able to analyze this proposal in detail. We will report to

The Traffic Impact Statement submitted does not address the Countywide Traffic
Performance Standards (County Ordinance 90-40) and is not acceptable for a
project of this size. Using the rates from the County Fair Share Road Impact Fee
Schedule (Table 10.8-1 of the Unified land Development Code), this 14,147 square
foot Qual i ty Restaurant is determi ned to generate 1161 tri ps per day (after
allowance for 15% passer-by traffic). Because the segment of Boynton Beach
Blvd. between Interstate 95 and Seacrest Blvd. is overcapacity on a daily basis,
a determination needs to be made whether in fact this project can meet Alternate
Test #1 of the Traffic Standards.
Please have the applicant submit for our review and approval a new traffic impact
study for thi s project that addresses the Countywi de Traffi c Performance
Standards. Conceptual approval of this project by the City of Boynton Beach
should be made subject to any conditions that may be required by the results of
this traffic study.

SUBJECT: Water's Edge Marina - Conditional Use
With respect to the above, please be advised of the following:
1. The plans submitted for review by the Technical Review Board
did not include the following:
a. Exterior furnishings and pedestrian amenities (Section
7.S-S7.1.J of the CBD Landscape Regulations and section
19-60(b)(S) of the Code of Ordinances).
b. Sign details (Section 6.E.6 of Appendix A-Zoning and
Section 19-60(b)(6) of the Code of Ordinances).
c. Elevations of all sides of retail buildings proposed
(Section 19-60(b)(4) of the Code of Ordinances).
d. Floor plans for all floors of retail buildings proposed
(Section 19-60(b)(4) of the Code of Ordinances).

e. Schedule and descriptions of proposed uses, tabulation
of square feet proposed for each use; estimated
population and employees; hours of operation;
construction sequence and time schedule for completion
of each phase for buildings, parking and landscaped
areas (Section 19-60(b)(8) of the Code of Ordinances).
f. Proposed building setbacks (item #6 on site plan
checklist).
g. Lighting details (item #26.d on site plan application
checklist, Section 19-60(b)(S) of the Code of
Ordinances and Design Requirements of Article X-Parking
Lots) .
A building permit cannot be issued until the above items have
been submitted for review by the Technical Review. Board, the
Downtown Review Board, the Community Redevelopment Agency and the
City Commission (Sections 19-62 and 19-68(b) of the Code of
Ordinances.

(4) The Community redevelopment Agency or City
Commission can require additional or fewer parking
and loading spaces than those previously outlined
in this memorandum (Section 6. E. 4 . d of Appendix
A-Zoning). However, if fewer parking spaces are
required, quantitative evidence must be provided
substantiating that the requirements are
excessive. In addition, the Community Development
Agency or city Commission shall take into account
existing parking facilities in the vicinity of the
proposed development.
In order to construct the parking lot wi thin the future
Boynton Beach Boulevard bridge right-of-way, prior to the
condemnation of the right-of-way for the bridge, a license
agreement will be required from the governmental entity that
currently has jurisdiction over the existing 30 foot wide
right-of-way (FDOT). In addition, the Community
Redevelopment Agency must approve a lease agreement for that
portion of the parking lot that is proposed on the property
which lies north of the existing 30 foot wide right-of-way,
owned by Janet Hall, after review and recommendation by the
Technical Review Board (Section 6.E.4.c(2) and (3) of
Appendix A-Zoning).
6.
A tri-party agreement had been negotiated to allow for
parking underneath the proposed bridge, as outlined in the
att~ched memorandum from the former Planning Director to the
former Executive Director of the Community Redevelopment
Agency, dated January 5, 1987. Also attached is a draft
copy of the formal agreement which was prepared by Jimmy
Hall's attorney in 1986. It appears that it will be
necessary to update this agreement, and it may be necessary
to include Janet Hall's property.

7.
The conditions of the previous variance approval for the
fire lane and the backing of cars into Casa Lorna Boulevard
must still be met.
8.
The elbow turn in the parking lot driveway on the south side
of the restaurant should be striped for one-way traffic
flow.
9.
License agreements must be approved by the City Commission
for the utilization of public rights-of-way (N.E. 6th Street
and Casa Lorna Boulevard) for parking and other purposes.
10.
If the City Commission approves a license agreement for the
use of the Casa Loma right-of-way, the following provisions
should be incorporated:
a. Reserve two or three areas on the south side of the
right-of-way for loading zones (with a dimension of
twelve feet by thirty-five feet) to serve the existing
businesses.
b. Reserve sufficient area for placement of dumpsters and
enclosures to serve the existing businesses.
c. Dedicate an easement to connect Casa Loma Boulevard to
Ocean Avenue and Boynton Beach Boulevard via the
private street system.

~arking requirements for dry boat storage are not listed in
Appendix A-Zoning. Section 11.H.12 of Appendix A-Zoning states
that "where a use is not listed, parking space requirements shall
be determined by the City Commission after review and
recommendation by the Planning and Zoning Board".
~arking for restaurants is one space per two and one-half seats,
but not less than one parking space per one hundred square feet
of gross leasable floor area (Section 11. H .16. d ( 1) of Appendix
A-Zoning) . Since the gross floor area of the raw bar was not
shown and should be shown, it was assumed that the parking based
on the seating would be greater.

d. Resurface Casa Lorna Boulevard, which is currently in
poor condition.
e. Construct parking stalls in accordance with the design
requirements of Article X-Parking Lots; i.e., provide
curbing or car stops and double-stripe parking stalls.
11. Concerning the roadway extension within the existing
right-of-way to provide access to the signal at Federal
Highway and Boynton Beach Boulevard, the following comments
are relevant:
a. Provide a detail of the proposed extension showing
width of pavement, traffic control, etc. to Federal
Highway.
b. Design of extension should incorporate approved parking
lot plan for Boynton Beach Plaza and area along north
side of motel.
12. On-site utilities must be located underground (Section 6.E.3
of Appendix A-Zoning). A note should be placed on the
construction plans stating the above.
13. Lighting pole that encroaches parking stalls west of N.E.
6th Street should be relocated to a landscaped island or
strip.
14. As a condition of Condi tional Use approval, it is
recommended that the marina and dry boat storage building
require an Environmental Review Permit prior to the issuance
of a Building Permit (Sections 11.3.C.6 and 6.E.l.A of
Appendix A-Zoning).
15. Policy 7.2.11 of the Comprehensive Plan requires sanitary
hook-ups for long-term boat use. Utility drawings do not
provide for such hook-ups. Please modify plans accordingly
prior to sign-off.
16. The City Commission must establish a time limit within which
a conditional use may be developed (Section 11.2. E.l of
Appendix A-Zoning). It is recommended that a one year time
limit be established, during which an application for a
building permit shall be submitted.
17. The Technical Review Board is recommending that the site
plan be resubmitted to address the outstanding submittal
requirements and the technical issues that were raised at
the April 19, 1990 meeting, consistent with the requirements
of Sections 19-62 and 19-68(b) of the Code of Ordinances.
