Box 310 Boynton Beach, FL 33435 RE: WATER'S EDGE MARINA Dear Carmen: I have had numerous meetings with the owners of the Water's Edge Marina project relative to their inability to proceed with this project and they have come to the conclusion that for the near future a hotel does not make economic sense on this site. Based on their market experience, they feel the best and highest use of this property would be for a dry boat storage facility. They are aware that as the Central Business District Ordinance currently reads, a boat storage facility is specifically excluded. I have been directed to apply to the City Commission to amend the CBD language to allow a boat storage building as a conditional use thereby allowing an opportunity for a responsible development that would provide the Commission with a review process and input. As you are no doubt aware, my clients have failed within the past six months to begin construction of the proposed project. This has been occasioned by an inabili ty to obtain proper financing. After a review of the project wi th several proposed lender s, my clients have determined that it is not economically feasible to construct the project as originally proposed. It will be necessary for the site plan to be modified in order to take into account the uncertainties regarding the proposed Boynton Beach bridge and the market condition of East Boynton Beach. My client does not wish to lose the momentum already existing with respect to the development of the site. An approved site plan is an essential element of any request for financing. I fear that if the request for extension is denied the ultimate development of the project will be delayed significantly. Annunziato, AICP page 2 August II, 1988 Please note that my client's failure to construct the proposed development has not been occasioned by a lack of cooperation on the part of the ci ty of ficials. Rather, the problems stern from uncertainties related to the proposed bridge and the viability of the proposed hotel. My client, in order to address this primary problem must change plans wi thout any further significant developmental delays. In particular, my client now contemplates developing the project in stages. The first stage would be the construction of the mar ina facili ties. This would be a general improvement of the facility, construction of marine slips and renovation of the existing marine store and fuel dispensing outlets. It is contemplated that construction of stage one improvements could commence within the next four to six months. The second stage of development would be the construction of a restaurant and shops on the southern port ion of the property. The thi rd stage would be the construction of shops along the western edge of the water (inlet) . The fourth and final stage would be the construction of the hotel, parking garage and associated retail space. This four stage project also includes some design changes. In particular, the outlet for fuel would remain in its present location rather than being moved to a location near the proposed bridge. This change has been occasioned by uncertainties wi th respect to the ability to construct fuel pumps in the vicinity of the bridge. Furthermore, the restaurant would have to be moved to the west about 20 feet or so in order to permit construction of the marine store and fuel outlets. Other modest changes are also contemplated by the Developer. Because of the staging of the project and the change in location of structures, it is anticipated that the entire site plan may have to undergo a renewed review. This review could not be accomplished within the original six month extension nor is it possible to make the requisite submission within the next 60 days. Accordingly, a six month extension of the exist ing si te plan is requested wi th the understanding that within the next 60 to 90 days revisions to the site plan will be submitted in accordance with review standards. Please note that the "staging" of this project may also require an approval of a site plan providing for a phased development of the site. For instance, in a "phased" development, stages one and two may be combined to represent a single phase with the hotel being a final phase in and to itself. The staging and phasing of the project presently is under review. Discussions regarding the makeup of the phases should be completed within the time period of 60 - 90 days required to develop revised plans. 2842L Carmen S. Annunziato, AICP Page 3 August II, 1988 My client continues to be committed to the construction of the project in the Town of Boynton Beach. Long term prospects for the area are quite good. In order for the project to be successful the cooperation of city government will be essential. This cooperation includes not only the granting of the requested extension, but also rapid review of proposed revisions to the site plan and execution of necessary supporting agreements. It is in this spirit of cooperation that my clients wish to conf i rm, in wr i ting, the ir desi re to donate to the Ci ty for its new municipal building the stand of 9 to IS Royal Palms presently on the marina property. It is my understanding that the City will be solely responsible for the relocation of the trees. I trust that this responsibility includes not only the removal of the trees but also the filling of any holes occasioned by their removal. If the developer is proposing to construct only a portion of the proposed improvements (i.e., eliminate the hotel and parking garage), it may be necessary for the developer to apply for a site plan modification if certain changes to the approved plan become necessary. Examples of changes that ~ay be. required could include the construction of additional paved parking areas, changes involving traffic circulation and access, changes to utility service, and changes to parking lot landscaping. Golden Assistant City Planner RE: Water's Edge Marina - Parking Lot Variance Section 5-144(c)(4) of the Code of Ordinances requires that when a variance to Section 5, Article X, Parking Lots is requested, the Technical Review Board must forward to the Downtown Review Board a recommendation, and that the recommendation forwarded is to be made part of the public hearing proceedings. To that end, this memo is forwarded, consistent with Section 5-144(c)(4). Craig Livingston, agent for J & J Ventures of Florida, has requested two such variances: (1) A variance to Section 5-141(m) "Fire Lanes", of the Parking Lot Regulations which requires that all shopping centers, retail-office complexes, and retail establishments for which the gross floor area is fifteen thousand (15,000) square feet or greater shall have fire lanes along the front of all buildings which shall allow efficient access to the fronts of all buildings by fire protection vehicles. In this instance, the applicant is requesting relief from the requirement for fire lanes along the fronts of the buildings on the north side of Cas a Lorna Boulevard and the retail building that fronts on Ocean Avenue; (2) A variance to Section 5-141(H)(2) "Maneuvering and Access Areas", which requires that maneuvering and access areas shall be of sufficient size to permit vehicles to enter and exit the parking lot in a safe and efficient manner. More specifically, the design standards within the Parking Lot Regulations require that a 27 foot wide access aisle be provided adjacent to a row of parking stalls set at a 90 degree angle. The Water's Edge Marina is proposed to be located on the Intracoastal Waterway between Ocean Avenue and East Boynton Beach Boulevard extended. For an explanation of the code requirement, the nature of the variance requested, and the variance justification, please refer to the attached Notice of Public Hearing and application. 1 On Tuesday, January 6, 1987 the Technical Review Board (TRB) met to review the plans and documents submitted, and to formulate a recommendation with regard to the variances requested. After review and discussion, the TRB recommended that both variances be approved in part and denied in part. With respect to the recommendation for approval of a variance to Section 5-141(M), the TRB made findings that requiring the applicant to construct a fire lane along the front of all the buildings would impose an unreasonable hardship owing to the overall configuration of the parcel, particularly the narrowness of the area between the right-of-way for Casa Lorna Boulevard and the seawall on the south side of the inlet. Therefore, the TRB recommended approval of this variance request subject to the condition that fire sprinklers and standpipes be provided for all buildings that are inaccessible to fire apparatus. With respect to recommending approval for a variance to Section 5-141(H)(2), the TRB made findings that requiring the applicant to provide the required 27 foot wide access aisle would also impose an unreasonable hardship for the reason previously stated; that the overall configuration of the parcel, particularly the narrowness of the area between the right-of-way for Casa Lorna Boulevard and the inlet, poses a severe constraint on the developability of this area with respect to the requirements of the City's Parking Lot Regulations. Therefore, the TRB recommended approval of this variance request subject to the following conditions: 1. That the T-turnaround be eliminated in favor of a cul-de-sac with a minimum diameter of 73 feet, extending from the southern right-of-way line for Casa Lorna Boulevard north to the boardwalk in front of the restaurant. This will require elimination of at least four parking spaces and the westward relocation of the restaurant stairway. It was the consensus of the TRB that providing a cul-de-sac as opposed to a T-turnaound would serve as a much more effective mechanism in maintaining traffic flow and mitigating congestion on Casa Lorna Boulevard, particularly at times of peak hour use. 2. Adequate pedestrian circulation is provided by boardwalks, stairs and ramps for the handicapped directly in front of the proposed retail and restaurant buildings in a location adjacent and to the North of the required sidewalk. See Drawing A-1. b. We have located 36 parking spaces for the convenience of shoppers and patrons to the restaurant along the north right-of-way of Casa Loma Blvd. These 36 parking spaces are also needed to meet the City of Boynton Beach Zoning Code Parking Requirements for this project. Cars parked along the north right-of-way of Casa Loma Blvd. will need to back out directly into this public right-of-way, therefore a sidewalk along the north right-of-way line would be in total conflict with this parking facility. The peak hour flows were taken from a study done by Russel & Axon in 1983 for the City of Boynton Beach Utilities. Three analysis were run to determine what size pipe would be required to serve this project. It was determined that a 10" line would be needed down N.W. 2nd Avenue and down through the project. WHEREAS, DOT intends to construct a four lane bridge over the Intracoastal Waterway connecting BOYNTON with the Town of Ocean Ridge. The new bridge would replace the existing bridge between BOYNTON and Ocean Ridge and would be located approximately 700 feet north of the existing bridge and the proposed si te of the br idge in BOYNTON would be the extension of Boynton Beach Boulevard to the Intracoastal Waterway; and WHEREAS, DOT prepared and recorded in the Official Records of Palm Beach County, Florida, the right-of-way map extending State Road 804 to Highway AlA and including the right-of-way for the construction of the four lane bridge over the Intracoastal Waterway; and WHEREAS, BOYNTON included the right-of-way map prepared by DOT and recorded in the Official Records of Palm Beach County, Florida, in its comprehensive plan; and 4 WHEREAS, palm Beach county included the right-of-way map prepared by DOT and recorded in the Official Records of palm Beach County, Florida, in its comprehensive plan; and WHEREAS, In accordance with the procedures of DOT, the location of the bridge was referred to a hearing officer for his determination. The hearing officer determined that the bridge could not be located at the si te proposed by DOT and that the bridge should be located at the existing site of the present bridge. The recommendation or ruling of the hearing officer was appealed to DOT and DOT rejected his recommendation. The action of DOT was appealed to the Fourth District Court of Appeal and the Appellate Court held that the action of DOT was erroneous and constituted an abuse of discretion and reversed and remanded the question for a full hearing. In rendering its decision, the Fourth District Court of Appeal recognized the great public importance of the decision and certified several issues raised in its decision to the Supreme Court. The Supreme Court has not rendered a decision on the certified questions; and WHEREAS, J&J purchased a tract of real property located in BOYNTON, and more particularly described on Exhibit wAw. The northern part of the real property of J&J falls wi thin the area DOT intends to acquire in order to construct the four lane br idge. J&J is in the process of prepar ing and submitting to BOYNTON a site plan wherein J&J intends to deve lop the real proper ty as a hotel/motel mar ina complex wi th commercial buildings, boat docks, and other ancillary uses; and -2- . WHEREAS, the real property described in Exhibit wAw is within the Municipal limits of BOYNTON and BOYNTON must approve the site plan before the property may be developed by J&J. NOW, therefore, in consideration of Ten Dollars ($IO.OO) and other good and valuable consideration, the receipt and sufficiency of which each party acknowledges receiving, the parties agree as follows: I. J&J agrees to perform the following obligations: a) J&J, at its expense, will cause to be prepared engineering plans which will provide for the reduction of the right-of-way on the south side of the bridge and the construction of a retaining wall on the south side of the bridge. Attached hereto as Exhibit WBW is a copy of said plans. b) In the event the bridge over the Intracoastal Waterway is finally located at the extension of State Road 804/Boynton Beach Boulevard, J&J agrees to transfer to DOT that portion of the real property of J&J which is described on Exhibit wCw. The real property described on Exhibit wCw includes the fee title to a portion of the real estate and the fee title to a portion of the air rights but not the . underlying ground which J&J wi II retain for its use. The parties to this agreement recognize that J&J is obligated to transfer the real property described in Exhibi t WCW to DOT and that the consideration which J&J shall receive for the transfer of the real property will be determined at a later date. -3- . , c) J&J agrees to convey to DOT construction and maintenance easements which will enable DOT to construct the bridge in accordance with its plans and specifications and to maintain the bridge after it is constructed. A description of the easements is attached hereto as Exhibit wDw. d) In the event the bridge over the Intracoastal Waterway is not finally located at the extension of state Road 804/Boynton Beach Boulevard, J&J shall donate to BOYNTON that portion of the real property described on Exhibit wAw which will enable BOYNTON to complete an 80 foot right-of-way to the Intracoatal Waterway. 2. DOT agrees to complete the following obligations: a) DOT shall bulkhead that portion of its property which is adjacent to the Intracoastal Waterway. b) DOT shall construct a retaining wall on the south side of the bridge in accordance with the plans and specifications set forth on Exhibit wBw and DOT shall maintain the retaining wall. c) DOT shall enter into a lease agreement wi th J&J wherein DOT will agree to lease to J&J the real property descr ibed on Exhibi t W EW and in accordance wi th the terms set forth on Exhibit wEw. Said real property is located within the bridge right-of-way and under the bridge. -4- 3. resolutions obligations: BOYNTON agrees obligating BOYNTON to to enact a undertake resolution or the following a) Attached hereto as Exhibit .F. is a copy of the plans and specifications of DOT to construct the bridge as modified by the engineering plans prepared by J&J, and attached hereto as Exhibit .B.. BOYNTON has reviewed said plans, as modified, and approves them. b) BOYNTON recognizes that the site plan which will be submitted by J&J to BOYNTON for approval does not provide for access to Boynton Beach Boulevard. BOYNTON shall authorize J&J to use that portion of its real property as depicted on Exhibit .Gw as an access route for emergency vehicles through the development pending final resolution of issues relating to the DOT extention of state Road 804. c) I. In the event DOT is not authorized to construct the bridge at the proposed site, BOYNTON shall extend Boynton Beach Boulevard/804 east to the Intracoastal Waterway and along the northern boundary of the real property described on Exhibit .A.. 2. In the event DOT is authorized to construct the bridge on the proposed site, BOYNTON shall authorized J&J to use that track of ground located at the east end of Casa Loma Boulevard. -5- .
