please be advised that in accordance with the procedures contained
wi thin the City of Boynton Beach, Florida, Code of Ordinances,
Appendix "C", Subdivision and Platting Regulations, the above
referenced property does not have to enter into the platting
process. Mr. Cherof is correct in his statement that Mr. Cannon
and I have agreed that this project could be constructed without
replatting.
The Code of Ordinances does state however, that the City Planner,
the city Engineer and the Planning and Zoning Board shall make the
final determination in this matter, therefore the Planning
Department should place this matter on any P&Z agenda and I will
support the exemption in the form of a favorable recommendation.

I have attached a copy of'a letter from South Florida Water
Management District that was sent to Shalloway Incorporated.
This letter indicates that Water's Edge Marina and Hotel pro-
ject has not submitted information that was requested by South
Florida water Management District on February 12, 1987, and
that there are only thirty days left to submit such infor-
mation or the application will be processed for denial.
I would appreciate receiving some information concerning the
impact of this water Management District letter on the deve-
lopment timing and potential of Water's Edge Marina and Hotel.

RE: WATER'S EDGE MARINA-SITE PLAN EXTENSION
The above-referenced site plan is due for expiration on February
17, 1988.
If the developer is proposing to construct only a portion of the
proposed improvements (i.e., eliminate the hotel and parking
garage), it may be necessary for the developer to apply for a
site plan modification if certain changes to the approved plan
become necessary. Examples of changes that may be required could
include the construction of additional paved 'parking areas,
changes involving traffic circulation and access, changes to
utility service, and changes to parking lot landscaping.
Considering that the original site plan approval did not provide
for any phased construction, any changes to the approved plan to
allqw for phased construction should be evaluated by the
Technical Review Board to determine if a site plan modification
wouid be necessary to provide for proper coordination of proposed
improvements.

Our Firm represents J & J ventures of Flor ida, a Flor ida
general partnership. J & J ventures, previously had obtained from
the City of Boynton Beach the City's approval for a site plan for
development of a project at the old Sea Mist Marina. This si te
plan approval expires shortly. My client has requested that they
be granted a one year extension on the approval.
, The aforementioned extension is being requested because
th~ partnership has experienced delays in getting the required
financing and developmental permits. These delays have been
occasioned, in part, because of uncertainties relating to the
bridge that is to be built on the north side of the subject
pr.operty and because of the concommitent effects on permits for
th~ bulkheading on the north side of the property and for mangrove
relocation. My client anticipates a sucessfu1 resolution of these
problems and looks forward to providing the City an attractive and
successful development.
Mr. James Hall, the spokesman for the partnership, would
like to attend the public hearing on the extension in order to

As a condition of site plan approval, the following comments should
be incorporated into the related documents by the applicant:
1. Indicate the type of construction of the buildings on the site
plan in accordance with Chapter Six of the 1985 Standard Building
Code and indicate if these buildings will be fully sprinkled. All
structures must comply with Table 400 and 600, SBC.
2. Indicate the proposed phasing of the project on the site plan in
relation to the required appurtenances.
3. Roof lines cannot overhang common property lines. There appears
to be a discrepancy between the horizontal control drawings and the
site plan at the west side of the Ocean Avenue building.
4. The Marina store extends into the D.O.T. right-of-way. Copies of
agreements between the owner and D.O.T. should be provided to the
Building Department prior to requests for permit for this structure.
5. The light pole in the center of the parking lot under the bridge
should be protected from vehicular traffic.
6. The parking garage must be elevated to the base flood elevation
(7' NGVD) or else flood proofed to this elevation.
7. All utility lines and power lines should be run underground in
accordance with the Zoning Code for the Central Business District.
8. Unloading spaces should be provided for the retail buildings.
9. Sewer, water and electrical facilities should be indicated for the
boat slips.
10. Curbing is required for landscaped areas adjacent to all parking
stalls.
11. All buildings must be handicapped accessible. Ramps should not
exceed a slope of 1 in 12.
12. The handicapped should not have to go into the road at the
restaurant parking stalls to use the handicapped ramp.
13. The sidewalk in front of building 2 should be ramped for handicapped
accessibility, also between building 4 and the restaurant. Provide
handicapped ramps to the north of building 2.
In order to facilitate the building permit review process, the following
information should be provided at the time of submittal:
1. Approval from all applicable governing agencies, such as: DOT,
DER, DNR, Army Corps of Engineers, County Health Department and
South Florida Water Management District.
2. Separate permits are required for excavation, drainage, paving,
signs and demolition.

3. Board of Health approval is required for the restaurant, hotel
and pool area.
4. Pool should be designed by a registered Florida engineer and
plans should indicate site lighting and safety fences.
5. Soil tests with engineers' recommendations should be submitted.
6. Buildings must comply with the State Energy Code.
7. Provide details on wood decking, stairs, ramps and railings.
8. Threshold inspectors will be required for the hotel, parking
garage and restaurant.
9. Smoke detectors are required in all individual hotel units.
10. The extinguishing systems should be electrically connected to
the City Fire Department when buildings are sprinkled and the
sprinkler system must comply with NFiPA 13.
11. The restaurant will be classified as a small assembly occupancy
and as such, will have to meet all code requirements for this
occupancy.
12. The parking garage must comply with Section 412.6 of the 1985
Standard Building Code. The door facing the retail building
should be a l~ hr. class D door.
13. Opening protectives are required in exterior walls within 15 feet
of a property line in compliance with Section 703.1, SBC.
14. Construction office trailers must have Building Department and
City Council approval.
The applicant's prompt compliance with the preceding comments will
insure a timely permitting process.

Comments:
1. The existing drainage system in Casa Loma Blvd. should be
shown, including the pipes and outfalls.
2. An explanation of the note "Remove Existing Inlet and Plug
Pipe" is required.
3. Apparently areas north of Casa Lorna Blvd. will drain into
Casa Lorna Blvd. which presently has positive drainage with
outfall storm sewers. The drainage system as shown will
require that half of Casa Lorna Blvd. drain into a privately
maintained system and should be designed for this additional
flow, unless the system is changed.
4. Drainage calculations are required.
5. Does the roof drainage, which is clean water, discharge
directly into the intracoastal?
6. The horizontal control sheet includes tables that are not
coordinated with the plans.
7. The set-back of the west building line of the retail building
on Ocean Avenue should be shown.
8. A cul-de-sac should be provided at the east end of Cas a Lorna
Blvd., rather than a "T" turn-around.
9. The platted limits of Casa Lorna Blvd. should be shown on the
plans, as well as the deck on the Fla. Inland Nav. Dist.
(FIND) property. Access by the public to the observation
deck should be maintained. A connection from the new deck
area with the city maintained deck is required.
10. The survey drawing does not show the wood deck at the end of
Cas a Lorna Blvd.

The following comments pertain to the project above in relation
to requirements of the Landscape Ordinance and Tree Preserva-
tion Ordinance.
1. The applicant must submit a tree survey of all trees on the
property and state what measures will be taken to:

AS a followup to my memo of December 17~ 1986~ (Re: Watersedge
Marina), and as discussed at the T.R.B. Meeting of 1/6/87,
the following additional information is submitted:
1. The Recreation and Park Department seeks an arrangement
for the joint public/private use of Casa Loma Overlook
(which is City property) and the wood deck , boardwalk
and sidewalk system which is being developed by the de-
veloper along Casa Loma Boulevard.
2. Since representatives for the developer have indicated
that such an arrangement may be possible~ we request
the developer to submit plans intergrating Casa Loma
Overlook with the surrounding project in such a way as
to maximize the joint public/private use of the waterfront
area.

We can approve the referenced project subject to the following revisions
or additions to the plans:
1. In that water and electricity are provided at each boat slip,
sanitary services ~ust also be provided. Please subMit details

Z. A gravity sewer line at 10% slope appears to exceed reco~Mended
design standards. Please revise.
3. Utilize drop Manhole construction where inverts are greater than Z
feet above the ~anhole's flow channel.
4. The City has not yet been contracted to construct the off-site 16"
water Main. Because of this, the routing of the Main has not been
finalized and is subject to change. We reCOMMend that the
developer finalize arrangeMents for design of the off-site water
Main as soon as possible 50 as to avoid delays in the approval and
construction of this project.
5. Water Meters and detector check valves are not required on fire
lines by this office.
6. Clarify the location of water Meters, fire sprinkler valving and
sanitary service cleanouts. These should be in landscaped areas
where possible. They will not be accepted in or under the proposed
wooden walkway without appropriate vaults being provided.
7. Indicate the location of gasoline lines relative to water and
sewer lines.
8. It appears that Manhole 13 is currently inactive. The actual
receiving ~anhole Must be field located and verified as active.
9. Gate valves <2> Must be added to the fire lines serving the hotel
and the parking garage. Single gate valves are required on all
fire lines at the tee in the Main.

Water's Edge Marina - Comments Related to
Boynton Beach Boulevard
Among the many issues to be resolved concerning the proposed
marina project is the series of issues related to the
construction of the proposed Boynton Beach Boulevard Intracoastal
Waterway Bridge. These concerns are generally related to the
future right-of-way for the bridge and the use of land if the
bridge is or is not constructed. In order to resolve these
matters, the Planning Department offers for the Downtown Review
Board and Community Redevelopment Agency, recommendations as
follows:
1. The applicant, Mr. Hall, must dedicate to the City of
Beach, a right-of-way of 45 feet south of and adjacent to
northerly property line over the limits of this project.

elevated portion of the proposed bridge through his property as
shown on his proposed site plan.
4. The City of Boynton Beach shall issue a license to the
applicant to use that portion of the dedicated right-of-way which
would lie under the elevated portion of the proposed bridge for
the purposes of constructing parking, landscaping, decking, and
other uses shown on the proposed site plan with all non-required
parking to be available to the public.
5. The ability to construct parking lying north of the section
line, under the bridge will be predicated upon the applicant
securing a license from the Florida Department of Transportation.

6. If a parking lot is to be constructed under the proposed
bridge, the finished elevation of the parking lot must be not
less than 4 feet above mean sea level and provide for a minimum
vertical clearance of 8 feet.
If these recommendations are approved through the plan review
process, it is our belief that the requirements of the Department
of Transportation would be accomodated as well as the needs and
concerns of the applicant and the City.

The Recreation and Park Department has reviewed the Watersedge
Marina preliminary plans and variance requests. The following
information is submitted:
1. Casa Loma Overlook (Park) is located adjacent to the
marina property on Casa Loma Boulevard.
2. Solutions to the traffic problems anticipated with
with this dead-end street (Cul-de-sac, T-turn around,
etc.) should consider the effect on the use of this
public facility.
3. If possible, the developer should incorporate their
sidewalk/boardwalk, landscaping, etc. with the over-
look so the public's use can be maximized.

RE: Water's Edge Marina - Site Plan Comments
1. Section 11-J of Appendix A, Zoning, requires that every
"hospital, institution, hotel, commercial, or industrial
building, or similar use requiring the receipt or
distribution by vehicle of materials or merchandise, shall
have sufficiently permanently maintained off-street loading
space so as not to hinder the free movement of vehicles and
pedestrians over a street or sidewalk." It is the
recommendation of the TRB that three (3) such loading spaces
be provided for the area north of Casa Loma Blvd. to serve
retail/office buildings no. 2 through no. 4 and the
restaurant.
2. Section 6.E.3 of Appendix A, Zoning, requires that all
utility lines in the Central Business District (CBD) shall
be installed underground, and any service equipment required
above ground shall be effectively screened. With respect to
this requirement, it should be noted that the existing
above-ground power lines located on the west side of Orange
Grove Avenue are proposed to be relocated as a part of the
development of the marina project (see paving and drainage
plans). It is recommended that all utilities be relocated
underground and above-ground service equipment be
effectively screened consistent with Section 6.E.3 of
Appendix A, Zoning.
3. Section 7.5-35.1.J of the Environmental Regulations
requires that "all dumpsters should be placed on a concrete
pad ten (10) feet wide" (minimum).
4. Section 7.5-57.1.G.4 of the Environmental Regulations
specifically requires that parking lot lighting in the CBD
be "energy efficient, high pressure sodium". Section
7.5-57.H.4 of the Environmental regulations specifically
requires that pedestrian lighting be "energy efficient,
metal halide". An amendment to the Energy Element of the
Comprehensive Plan Evaluation and Appraisal Report prior to
recent adoption by the City Council allows for greater
flexibility in the provision of energy efficient lighting
throughout the City. This would include the substitution of
metal halide lighting for high pressure sodium lighting as
metal halide lighting, while not as efficient as high
pressure sodium lighting, is still considered to be energy
efficient.
5. Section 7.5-57.1.J. of the Environmental Regulations
requires that "exterior furnishings" be indicated on the
landscape plan and be specified on the drawings." These
details are to be submitted for review and approval by the
Downtown Review Board as part of the design review for the
project and must be included with the set of plans submitted
to the Building Department for the issuance of a building
permit.
6. Section 7.5-57.1.K of the Environmental Regulations
requires that "curbs, wheel stop and stall markings shall be
indicated on the landscape plan and be specified on the
drawings".
7. In the event that the developer constructs the parking lot
within the right-of-way for Boynton Beach Boulevard prior to
the construction of the proposed bridge, a site plan
modification will be required to ensure proper coordination
between the construction of the new bridge and
reconstruction of the existing parking lot.
8. The site plan submission for the marina project does not
include future provisions (such as parking) for any charter
boats, sightseeing boats, etc. The future addition of such
uses will require a site plan modification to ensure that
all code requirements are met.
9. Future changes to the parking lot in the vicinity of the
hotel to allow for access onto Boynton Beach Boulevard will
require a site plan modification.
10. Parking being allocated to the Sea Mist Marina is to be
considered as a part of the required parking for the Water's
Edge Marina project.
