If the developer is proposing to construct only a portion of the proposed improvements (i.e., eliminate the hotel and parking garage), it may be necessary for the developer to apply for a site plan modification if certain changes to the approved plan become necessary. Examples of changes that may be required could include the construction of additional paved 'parking areas, changes involving traffic circulation and access, changes to utility service, and changes to parking lot landscaping. Considering that the original site plan approval did not provide for any phased construction, any changes to the approved plan to allqw for phased construction should be evaluated by the Technical Review Board to determine if a site plan modification wouid be necessary to provide for proper coordination of proposed improvements. Indicate the type of construction of the buildings on the site plan in accordance with Chapter Six of the 1985 Standard Building Code and indicate if these buildings will be fully sprinkled. All structures must comply with Table 400 and 600, SBC. 2. Indicate the proposed phasing of the project on the site plan in relation to the required appurtenances. 3. Roof lines cannot overhang common property lines. There appears to be a discrepancy between the horizontal control drawings and the site plan at the west side of the Ocean Avenue building. 4. The Marina store extends into the D.O.T. right-of-way. Copies of agreements between the owner and D.O.T. should be provided to the Building Department prior to requests for permit for this structure. 5. The light pole in the center of the parking lot under the bridge should be protected from vehicular traffic. 6. The parking garage must be elevated to the base flood elevation (7' NGVD) or else flood proofed to this elevation. 7. All utility lines and power lines should be run underground in accordance with the Zoning Code for the Central Business District. 8. Unloading spaces should be provided for the retail buildings. 9. Sewer, water and electrical facilities should be indicated for the boat slips. 10. Curbing is required for landscaped areas adjacent to all parking stalls. 11. All buildings must be handicapped accessible. Ramps should not exceed a slope of 1 in 12. 12. The handicapped should not have to go into the road at the restaurant parking stalls to use the handicapped ramp. 13. The sidewalk in front of building 2 should be ramped for handicapped accessibility, also between building 4 and the restaurant. Provide handicapped ramps to the north of building 2. In order to facilitate the building permit review process, the following information should be provided at the time of submittal: 1. Approval from all applicable governing agencies, such as: DOT, DER, DNR, Army Corps of Engineers, County Health Department and South Florida Water Management District. 2. Threshold inspectors will be required for the hotel, parking garage and restaurant. 9. Smoke detectors are required in all individual hotel units. 10. The extinguishing systems should be electrically connected to the City Fire Department when buildings are sprinkled and the sprinkler system must comply with NFiPA 13. 11. The restaurant will be classified as a small assembly occupancy and as such, will have to meet all code requirements for this occupancy. 12. The parking garage must comply with Section 412.6 of the 1985 Standard Building Code. The door facing the retail building should be a l~ hr. class D door. 13. Opening protectives are required in exterior walls within 15 feet of a property line in compliance with Section 703.1, SBC. 14. Construction office trailers must have Building Department and City Council approval. The applicant's prompt compliance with the preceding comments will insure a timely permitting process. Apparently areas north of Casa Lorna Blvd. will drain into Casa Lorna Blvd. which presently has positive drainage with outfall storm sewers. The drainage system as shown will require that half of Casa Lorna Blvd. drain into a privately maintained system and should be designed for this additional flow, unless the system is changed. 4. Annunziato, Planning Director RE: Water's Edge Marina - Comments Related to Boynton Beach Boulevard Among the many issues to be resolved concerning the proposed marina project is the series of issues related to the construction of the proposed Boynton Beach Boulevard Intracoastal Waterway Bridge. These concerns are generally related to the future right-of-way for the bridge and the use of land if the bridge is or is not constructed. In order to resolve these matters, the Planning Department offers for the Downtown Review Board and Community Redevelopment Agency, recommendations as follows: 1. The applicant, Mr. Hall, must dedicate to the City of Beach, a right-of-way of 45 feet south of and adjacent to northerly property line over the limits of this project. dedication is necessary in order to accomodate the bridge construction or the extension of Boynton Beach Boulevard, eastward to the Intracoastal Waterway if the bridge is not constructed consistent with Comprehensive Plan policies. The ability to construct parking lying north of the section line, under the bridge will be predicated upon the applicant securing a license from the Florida Department of Transportation. 1 6. If a parking lot is to be constructed under the proposed bridge, the finished elevation of the parking lot must be not less than 4 feet above mean sea level and provide for a minimum vertical clearance of 8 feet. If these recommendations are approved through the plan review process, it is our belief that the requirements of the Department of Transportation would be accomodated as well as the needs and concerns of the applicant and the City. Golden, Assistant City Planner RE: Water's Edge Marina - Site Plan Comments 1. Section 11-J of Appendix A, Zoning, requires that every "hospital, institution, hotel, commercial, or industrial building, or similar use requiring the receipt or distribution by vehicle of materials or merchandise, shall have sufficiently permanently maintained off-street loading space so as not to hinder the free movement of vehicles and pedestrians over a street or sidewalk." It is the recommendation of the TRB that three (3) such loading spaces be provided for the area north of Casa Loma Blvd. to serve retail/office buildings no. 2 through no. 4 and the restaurant. 2. Section 6.E.3 of Appendix A, Zoning, requires that all utility lines in the Central Business District (CBD) shall be installed underground, and any service equipment required above ground shall be effectively screened. With respect to this requirement, it should be noted that the existing above-ground power lines located on the west side of Orange Grove Avenue are proposed to be relocated as a part of the development of the marina project (see paving and drainage plans). It is recommended that all utilities be relocated underground and above-ground service equipment be effectively screened consistent with Section 6.E.3 of Appendix A, Zoning. 3. Section 7.5-35.1.J of the Environmental Regulations requires that "all dumpsters should be placed on a concrete pad ten (10) feet wide" (minimum). 4. Section 7.5-57.1.G.4 of the Environmental Regulations specifically requires that parking lot lighting in the CBD be "energy efficient, high pressure sodium". Section 7.5-57.H.4 of the Environmental regulations specifically requires that pedestrian lighting be "energy efficient, metal halide". An amendment to the Energy Element of the Comprehensive Plan Evaluation and Appraisal Report prior to recent adoption by the City Council allows for greater flexibility in the provision of energy efficient lighting throughout the City. This would include the substitution of metal halide lighting for high pressure sodium lighting as metal halide lighting, while not as efficient as high pressure sodium lighting, is still considered to be energy efficient. 5. Section 7.5-57.1.J. of the Environmental Regulations requires that "exterior furnishings" be indicated on the landscape plan and be specified on the drawings." These details are to be submitted for review and approval by the Downtown Review Board as part of the design review for the project and must be included with the set of plans submitted to the Building Department for the issuance of a building permit. 6. Section 7.5-57.1.K of the Environmental Regulations requires that "curbs, wheel stop and stall markings shall be indicated on the landscape plan and be specified on the drawings". 7. In the event that the developer constructs the parking lot within the right-of-way for Boynton Beach Boulevard prior to the construction of the proposed bridge, a site plan modification will be required to ensure proper coordination between the construction of the new bridge and reconstruction of the existing parking lot. 8. The site plan submission for the marina project does not include future provisions (such as parking) for any charter boats, sightseeing boats, etc. The future addition of such uses will require a site plan modification to ensure that all code requirements are met. 9. Future changes to the parking lot in the vicinity of the hotel to allow for access onto Boynton Beach Boulevard will require a site plan modification. 10.
