Please accept my apologies for the delay in preparing this letter.
Following our meeting of June 22, 1999, the City will provide the surety of $24,622, retained
for plantings in the littoral area, to the Lawrence Lakes Homeowners Association (LLHA).
These funds can be used at the discretion of the LLHA for landscape design services;
landscaping services; plant materials and irrigation coverage for the littoral area.
The first action the LLHA needs to take is to prepare a design for application for a Landscape
Permit. To facilitate this, a draw against the surety may be taken to cover the cost of a design
professional or the materials required to prepare the drawing. That amount should, be
approved and submitted by LLHA to the City. A check would then be prepared to the LLHA's
contractor.
Once the permit has been secured, all additional invoices or draws must be approved and
submitted by LLHA. The City will not release funds to any contractor or agent of LLHA
without prior approval of LLHA.

questions or concerns.

AGREEMENT
THIS AGREEMENT entered into between THE CITY OF BOYNTON BEACH,
FLORIDA, (hereinafter "CITY") and TINDUS INVESTMENTS, INC., (hereinafter
"DEVELOPER") this
day of July, 1994,
WHEREAS, TINDUS INVESTMENTS, INC., is the property owner and developer of the
Lawrence Lake PUD (alk/a Lake George Estates); and
WHEREAS, the City Commission approved the final plat for the subdivision on November
21, 1989; and
WHEREAS, DEVELOPER has completed all subdivision improvements with the exception
ofthe landscaping improvements prior to the expiration of that time period permitted for completion
of subdivision improvements, including prior extensions granted by the City Commission; and
WHEREAS, the CITY and DEVELOPER have negotiated a complete and satisfactory
agreement calculated to insure the completion of the landscaping subdivision improvements and at
the same time grant to the DEVELOPER additional time to complete those improvements.
NOW, THEREFORE, in consideration ofthe mutual covenants expressed herein the parties
agree as follows:
1, CITY grants to DEVELOPER a time extension for the completion of the landscaping
subdivision improvements retroactive from August 21, 1993, to August 20, 1994, and an additional
one year extension from August 21, 1994 to August 20, 1995.
'2. DEVELOPER shall, within twenty (20) days ofthe approval of this Agreement by the

The Engineering Department has coordinated departmental revisions for the referenced
Surety Release. Only the Utilities Department and Engineering Department request any
of the existing $53,000.00 in surety to be retained.
The project has been completed to the satisfaction of Lake Worth Drainage District, Palm
Beach County (off site improvements) and has been certified complete by the Engineer
of Record, Rossi & Malavasi, on July 20,1993. Attached to this memo is correspondence
evidencing these approvals and certifications.
The City of Boynton Beach Utilities Department requests $6,000 of surety be retained to
insure against damage to utilities during construction of homes. The Engineering
Department is requiring $2,000 of surety be retained to insure completion of the remaining
sodding of the recreation area and road right-of-ways.
The applicant has supplied documentation indicating lake slope irrigation will be the
responsibility of individual lot owners. All building permit applications for Lawrence Lakes
Homes will be required to show compliance with this requirement before a building permit
can be issued by the City.
Therefore, the Engineering Department recommends reduction in the surety on Lawrence
Lakes from $53,000 to $8,000, a total reduction of $45,000. This m should be on the

Dear Mr. Newbold:
Thank you for your letter dated February 10/ 1997/ regarding
the issuance of building permits and certificates of occupancy for
the last two lots in Lawrence Lake PUD. The purpose of this letter
is to clarify any remaining issues regarding the completion of
Lawrence Lake PUD.
As you may be aware, my client, Lawrence Lakes Development,
Inc., purchased individual lots from the original developer of the
PUD. Lawrence Lakes Development/ Inc., did not assume any of the
obligations or liabilities pertaining to the infrastructure at the
PUD which was installed by the original developer; however, in the
interest of expediting the build out of this community, Lawrence
Lakes Development, Inc., cooperated with the City and the existing
residents regarding community issues. More specifically, Lawrence
Lakes Development, Inc., has posted a $24,000 cash bond with the
City to assure the completion of the landscaping improvements and
irrigation. This cash bond replaced the bond provided to the City
by the original developer, Tindus Investments, Inc./ under its
Agreement wi~h the City dated July 13, 1994. Regarding the release
of this cash bond, I request that you provide me the City's
position as to any additional actions necessary by my client in
order to receive the refund of this bond_ We would like to be
clear as to exactly what the City is expecting to be accomplished
at this time in order to have the bond refunded.
Also, considering that this community has been built out,
except for the last two lots, we would request information as to
whether or not the City considers there to be any other open items.

Dear Mr. Staudinger:
Referring to our discussion of August 20th, 1993, about the
maintenance of the common areas of this property, I enclose a
photocopy of page 9, of the Recorded Declaration of Covenants,
Conditions and Restrictions.
Specifically, I have underlined the portion of Section 6.3,
"Owner's Responsibility", which directly refers to the easement
area between the lot boundary and the lake water's edge.
Please take note that the property owner is obligated to maintain
and irrigate this easement area.
Further, in accordance with our discussion, we agree to submit an
irrigation plan that displays how that particular easement area
will be watered when applying for a building permit, enclosing it
along with the other plans and documents typically submitted to
the Building Department. Further, we agree that without such an
irrigation plan for that particular lot, the City need not issue
the permit until such irrigation plan is in hand and approved.
If we elect to use the master plan permitting system, such master
plan will include the irrigation plan as well.
Please advise if you need any additional data for your submission
to the City.

In the event the Association shall fail to carry out any of
its maintenance activities hereunder, tr.en any aggrieved Owner(s)
may seek to enforce the provisions of this Declaration subject to
~he terms and provisions hereof.
Section 6.3 Owner's Responsibility. Each Owner shall
maintain his or her Lots and all structures, driveways, walkways
and other improvements thereon. The Board of Directors has the
right to require the Owners to maintain their Lots in accordance
with the Community-Wide Standards; and it is the responsibility of
the Owner to maintain landscaping in a neat and trimmed manner, and
to remove all objectionable debris or material that may be located
on their Lot. In the event a Lot is going to be unoccupied for a
consecutive period of two (2) months or longer, the Owner must
designate a responsible firm or individual to undertake his or her
general maintenance responsibilities, which responsibilities shall
include, at a minimum maintaining exterior appearance, safeguarding
the property to prepare for hurricane or tropical storm watches and
warnings by, among other things, removing any unfixed items on
patios, balconies and lanais and storing same indoors and repairing
the property in the event of any carnage therefrom. The name (s) and
address of such firm or inc~ividual must be furr:ished to the

Lots which are adjacent to any portion of the Common Area on which
walls' or fences have been cons~ructed shall maintain and irrigate
that portion of the area which lies between the wall or fence and
the Lot boundary. Owners of Lots fronting on any roadway \lithin
the Property shall maintain driveways serving their respective Lots
and shall maintain and irrigate landscaping on that portion of the
Common Area, if any, or right-of-way between the Lot boundary and
the nearest pavement edge.
All maintenance required by this Section 6.4 shall be
performed in a manner consistent with the Community-Wide Standard.
If any Owner fails properly to perform his or her maintenance
responsibility, the Association shall have the right, but not the
obligation to maintain such property and assess all costs incurred
by the Association (inClUding a 10\ surcharge for administrative
overhead) against the Lot and the Owner thereof as a Benefit
Assessment. Provided, however, except when entry is required due
to an emergency situation, the Association s~~ll afford the Owner
a minimum of seven (7) day's notice and an oppo~tunity to cure the
problem prior to entry. In order to provide corrective
maintenance, the Members grant unto the Board of Directors, its
agents, employees, and all others designated by the Board of
Directors, the right to enter upon the Lot of any Member for the

Dear Sir:
We repond to your inquiry about the inner irrigation system. A
permit for the system was applied for last year, the electrical
work completed and approved, but the irrigation work postponed.
At this time I request that the irrigation permit be kept active.
As you know I just recently started on this project. It is very
clear to me that the system designed was flawed. Accordingly we
are in the process of having the system properly redesigned to
assure that each lot and the 20' easement area behind each lot
receives adequate irrigation from this central which will draw
its water from the lake as per the permit we received from the
South Florida Water management.
We will have a system that is controlled by the Homeowners
Association and thus the entire community will be served.
We anticipate installing the irrigation system on a continuing
schedule keepinp pace with the build out of the single family
homes which we anticipate starting in the immediate future.
The outer perimeter and front entry irrigation system is in place
and functioning.
We will submit the revised plans for the

Your letter of inquiry to Ms. Tambri J. Heyden, Director of Planning & Zoning, was forwarded to me for
response.
Lot 16 and Lot 34, as described in your request, are part of the Lawrence Lakes P.U.D. A single family
home may be constructed on anyone of the lots, providing the plans comply with all the conditions of
the approved Plat and Master Plan, and the Building Code in use at the time of application and plans
submittal for a permit. If the construction is completed per approved plans in compliance with
applicable codes and ordinances, the Certificate of Occupancy will be granted.
This letter is not to be construed as a grantee that codes will not change by the time a permit application
with plans is submitted, however, a permit can be issued today as stated above. Any change from the
Plat or Master Plan would need to be address by the Planning & Zoning Department.
We do not perform title search to confirm liens or assessment obligations or owner's liability on his
property; nor do we keep such records as a requirement of permitting or issuance of Certificates of
Occupancy.

After our meeting on Tuesday, June 7, 1994 I reviewed the situation with the City Attorney,
the Planning Director and staff and would propose the following:
1. An agreement be drafted by the City Attorney and placed on the City Commission
agenda of June 21, 1994.
2. The agreement will set forth a time extension retroactive from August 1993 to
August 1994 and add an additional one year time extension from August 1994 to
August 1995.
3. . Your existing landscaping bond will be increased, based on a certified estimate from
a registered engineer for the landscape improvements remaining, which include
landscaping, sodding and irrigation of the 20' maintenance area surrounding the
lake, landscaping the littoral zone, and landscaping, sod and irrigation of the buffer
area along the outside perimeter roadway (Lawrence Lakes Drive ).
4. The City will agree that the 20' maintenance area may be completed on a house-by-
house basis, however, failure to landscape, sod or irrigate the area will result in the
City withholding CO's on a house by house basis.
5. The bond for the water and sewer improvements currently in place is for protection
of the system during construction, therefore, that bond will still need to stay in place
until construction is completed.
6. The agreement will be recorded and become binding on the property.

reduce the front building setback from 25 to 20 feet, establish a
rear setback of 3 feet for screen roof enclosures, an 8 foot side

Gentlemen;
We recently acquired properties known as Lawrence Lakes Estates, consisting of 30 lots, and
two homes that had been seriously vandalized.
We have experienced many inquiries as to our plans to build and sell the remaining homes. It
has become evident that a major portion of our prospective buyers prefer to have their own pool. At
present, we plan to build a home of approximately 2000 sq. ft. under air. However, present front set back
requirements, and rear pool set back requirements, would prohibit an adequate pool and deck.
In previewing the Master Plan of the 32 lots, please observe the additional 20 ft. easement
abutting each lot surrounding the lake. With this additional 20 ft. in the rear, we could ask the board to
extend the property line in the rear to include this 20 ft. easement, or extend it to the center of the lake.
However, it has been suggested to us, that requesting that the front set back line be modified to a 20ft.
front setback, and the rear 8 ft IlQW, setback be modified to a 3 fl rear set back, would accomplish the
same objective. lbere would still be no encroachment of the easement itself, with these modifications,
and it would enable the homeowner to put a 14 ft. pool and screen enclosure in.
As a builder with first baird knowledge of the danger and unsightly appearance of above ground
pools, we would like to incorporate a restrictive covenant to our recorded documents prohibiting above
ground pools. We therefore, respectively submit this master plan revision to change the current front line
set back from 25 ft. to 20 ft., and the rear &wI set back line from 8ft. to 3 ft.
We intend to make Lawrence Lakes a first rate single family home development, and feel this
modification would benefit everyone concerned. Your timely review and consideration would be most
appreciated.

20' wide to 12' wide.
This change would require an amendment to the Master Plan which
originally required a 60' road right-of-way which was
subsequently reduced to a 20' utility easement and now is reduced
to a 12' utility easement.
I assume that this Master Plan amendment can be handled
administratively. We will need verification of this amendment so
that K-Hovnanian of Palm Beach can pursue acquisition from the
property owner, Leila Foster.
