RE: BOYNTON BEACH INTERLOCAL AGREEMENT/LAWRENCE OAKS
Dear Carrie:
subsequent to our recent telephone conversation regarding the
timing of an Interlocal Agreement needed by the City of Boynton
Beach, I spoke with Kurt Eisman, Kris Garrison and other County
staff. It was suggested that the City of Boynton Beach take the
initiative of drafting and presenting an agreement to the County
staff for review and comment.
When Palm Beach County staff is approached by a municipality
requesting an agreement, it is generally the municipality which
presents initial drafts for review. After agreement is reached,
the City can execute the document which is then presented to the
Board of County Commissioners for their approval. .
I enclosed for your review,a memo from Kurt,Eisman outlining
some of the issues that were discussed at the meeting with you and
your staff and which must be addressed in the draft agreement.
In addition, pursuant to our meeting, the following provisions
must be included:
1. provisions regarding who will handle plats and required
improvements.
2. Conditions of development approvals must be incorporated
into any development approvals granted by the city unless
the City'S conditions are more stringent.

3. The agreement should not be piecemeal but should address
the issues on a global perspective.
a. If no permits are issued by the County, just site
plan or zoning approval is given, then the City
should take over full responsibility. The trigger
for permitting responsibility should be where the
project enters the process.

Beach County has developed. Please feel free to utilize it.

Boynton's request for the Palm Beach County Building Division to provide plan
review and inspection service for specific subdivision(s) within its political jurisdiction
raises some interesting questions and concerns.
Along with the standard language contained in our typical interlocal agreement, the
following must be resolved:
· . A time certain limitation to the agreement, not dependent on the percent of build
out in the subdivision. I am concerned that the agreement couJd wm into the never
ending story. Perhaps a general undemanding on this point could be reached as to
its approximate limitation, aud then we could terminate the agreement.
- The city would need LO adopt our codes for the subdivision.
-Once the termination of the agreement talces place, the City will be responsible for
the completion of inspections and Issuance of the Certificate ot' Occupancy.
· .Pcrmits for ancillary strUctures fonowing the completion of the primary stnlcture
will be issued by tbe County in order to eliminate inspection confusion. The City
may not agree with what our ULDC allows in these instances.

INTERLOCAL AGREEMENT
This Interlocal Agreement is made the day of

and Palm Beach County, a poli tical subdivision of the state of
Florida, '(hereinafter "COUNTY"), each one constituting a public
agency as defined in Part I of Chapter 163, Florida statutes.'

WHEREAS, Section 163.01, Florida Statutes, known' as the
"Florida Interlocal Cooperation Act of 1969" authorizes local
governments to make the most eff icient use of their powers by
enabling them to cooperate with other localities on a basis of
mutual advantage and thereby to provide services and facilities
that will harmonize geographic" economic, population and other
factors influencing the needs and development of local communi ~ies;
and
WHEREAS, Part I of Chapter 163, Florida statutes, permits
public agencies as defined therein to enter into interlocal
agreements with each other to jointly exercise any power,
privilege, or authority which such agencies share in common and
which each might exercise separately; and

CITY agrees to protect, defend, reimburse, indemnify and hold
COUNTY , its agents, employees and elected officers, and each of

suits, actions, legal or administrative proceedings, claims,
demands, damages, liabilities, interest, attorney's fees, costs and
expenses of whatsoever kind or nature whether arising in any manner
directly or indirectly caused, occasioned or contributed to in
whole or in part, by reason of . any act,' omission or fault whether
active or passive of COUNTY, of anyone acting under its direction
or control, or on its behalf in connection with or incident to the
performance of this Agreement. CITY'S aforesaid indemnity and hold
harmless obligations, or portions or applications thereof, shall
apply to the fullest extent permitted by law but in no event shall
they apply to liability caused by the negligence or willful

misconduct of the COUNTY, its respective agents, servants,
employees or officers, nor shall the liability limits set forth in
768.28, Florida statutes, be waived.
Section 21. Insurance
The CITY shall, during the term of this agreement, and any
extensions hereof maintain in full force and effect, general and
[property] insurance, which specifically covers all exposures
incident to the intent and responsibilities under this Agreement.
Such insurance shall be with a company acceptable to the COUNTY
Risk Manager and in an amount of not less than [ ]

agreement of indemnity. POlicy(ies) shall be endorsed to show Palm
Beach County, a political subdivision of the state of Florida, as
an additional insured as its interests may appear; and shall also
provide that insurance shall not be canceled, limited or. non-

to the COUNTY. Current certificates of insurance evidencing
required coverage must be on file with the COUNTY at all times.
CITY expressly understands and agrees that any insurance protection
furnished by CITY shall' in no way limit its responsibility to
indemnify and save harmless COUNTY under the provisions of section
20 of,this agreement.

This Agreement shall be construed by and governed by the laws

of the state of Florida. Any and all legal action necessary to
enforce the Agreement will be held in Palm Beach County. No remedy

and shall be in addition to every other remedy given hereunder or
now or hereafter existing at law or'in equity or by statute or
otherwise. No single or partial exercise by any party of' any
right, power, or remedy hereunder shall preclude any' other or

The parties expressly agree that time is of the essence in
this Agreement and the failure by a party to complete performance
within the time specified, or within a reasonable time if no time
is specified herein, shall, at the option of the other party
without liability, in addition to any other rights or remeaies,
relieve the other party of any obligation to accept such
performance.
Section 25. Eaual ODDortunitv provision
The COUNTY and the CITY agree that no person shall, on the
grounds of race, color, sex, national origin, disability, religion"
ancestry, marital status, or sexual orientation be excluded from
the benefits of, or be subjected to any form of discrimination
under any activity carried out by the performance of this
Agreement.

The captions and section designations herein set forth are for

convenience only and shall have no substantive meaning.

In the event that any section, paragraph, sentence, clause, or
provision hereof be held by a court of competent jurisdiction to be
invalid, such shall not affect the remaining portions of this
Agreement and the same shall remain in full force and effect.

REQUESTING THAT LAWRENCE ROAD BETWEEN
GATEWAY BOULEVARD AND HYPOLUXO ROAD BE
ADDED TO THE PALM BEACH COUNTY FIVE YEAR
ROAD IMPROVEMENT PROGRAM.

WHEREAS, Lawrence Road is a designated public road
belonging to Palm Beach County; and

I' WHEREAS, over 1,680 units have been approved
, for development by both the City of Boynton Beach and Palm
'I Beach County; and
WHEREAS, these developments when constructed, will
I considerably exceed the threshold level of trips for Level of
Service "D" on Lawrence Road; and
WHEREAS, these developments will pay to Palm Beach County
traffic impact fees in excess of 2.5 million dollars; and
WHEREAS, if this road is not constructed concurrent with
development, the City of Boynton Beach residents will suffer
for the estimated 2 to 4 year design and construction time
table with a severely overcrowded, unsafe roadway.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:

COUNTY, FLORIDA, UPON ADOPTION.
WHEREAS, the Comprehensive Plan for the City of Boynton
Beach requires the development of an Annexation Program;
WHEREAS, the City of Boynton Beach, through the
Annexation Program, has identified adjacent properties that
are the subjects of agreements for water service with the
City;
WHEREAS, said agreements for water service are also
considered voluntary petitions for annexation pursuant to
Florida Statutes, which can be executed by the City of Boynton
Beach at any time such properties are eligible for annexation
according to Florida Statutes;
WHEREAS, the City of Boynton Beach hereby exercises its
option to annex the following property as hereinafter
described, in nrrnrnAnrp with Article I, Section 7 (32) of the
Charter of the City and Section 171.044, and 171.062(2)
Florida Statutes: and
WHEREAS, said tracts property lying and being within Palm
Beach County is contiguous to the existing City limits of th~
Ci ty of Boynton Beach, Florida and will, upon annexation,
constitute a reasonably compact addition to the City

newspaper of general circulation in the City of Boynton Beach,
Florida, as required by the City Charter and Section 171.044,
Florida Statutes.
Section 7:
This Ordinance shall become effective
immediately upon passage.
Section 8: Specific authority is hereby given to codify
this Ordinance.

Boynton Beach, a municipality located in Palm Beach County, Florida (hereinafter "CITY") and Palm
P{L-~
Beach County, a political subdivision of the State of Florida (hereinafter "COUNTY"), each one
constituting a public agency as defined in Part I of Chapter 163, Florida Statutes. 11 (~Af.AI~:~i

WHEREAS, Section 163.01, Florida Statutes, known as the "Florida Interlocal Cooperation
Act of 1969" authorizes local governments to make the most efficient use of their powers by enabling
them to cooperate with other localities on a basis of mutual advantage and thereby to provide services
and facilities that will harmonize geographic, economic, population and other factors influencing the
needs and development of local communities; and
WHEREAS, Part I of Chapter 163, Florida Statutes, permits public agencies as defined
therein to enter into interlocal agreements with each other to jointly exercise any power, privilege,
or authority which such agencies share in common and which each might exercise separately; and
WHEREAS, pursuant to CITY's Ordinance Number 95-14, adopted June 20, 1995, the
CITY annexed property known as the "Lawrence Oaks" subdivision, containing forty acres, more or
less, (hereinafter, "property"); and
WHEREAS, prior to the annexation, the property was in the unincorporated area of the
COUNTY and thus subject to the Codes and Ordinances of the COUNTY, including the COUNTY's
Building Codes; and
WHEREAS, prior to annexation, the COUNTY issued a portion ofthe building permits and
conducted the required building inspections pursuant to those permits for development on the
