At present the property would be more suitable for

considerably more Safe Stacking of cars and expand
parking on the subject parcel than exists today.

on-site stacking and expanded parking for the existing car wash facility adjacent to the site.
Currently there is limited stacking room on-site, continuing along NE 1st Street, with the
possibility of flowing over onto Boynton Beach Boulevard.
Yvonne Ziel Traffic Consultants, Inc. was retained to determine if the re-zoning of the subject
parcel would result in additional traffic and meets concurrency.
RE-ZONING
Under the current zoning, the use for the site would be for a residential duplex. Under the
proposed zoning, using a floor area ratio of 0.25, a 2,461 square foot retail project is feasible.
I have enclosed a trip generation comparison for the two uses. Table 1 provides the trip
generation rates used, Table 2 the trip generation and Table 3 the pass-by and new trips
for both uses. Based on the trip generation analysis, the rezoning would increase traffic by
213 daily trips over those of the current zoning.
The new traffic was added to the 2010 traffic projection for Boynton Beach Boulevard
(obtained from the Palm Beach County Traffic Division) to determine if the roadway can
accommodate the re-zoning request. Table 4 provides this data. Since the future traffic with
additional trips from the re-zoning is below capacity, the re-zoning may be permitted.
Currently Boynton Beach Boulevard in the vicinity of the site has 15,275 daily traffic trips
(Source: 1994 Palm Beach County Traffic Count map).

This office is processing a rezoning/land use amendment request for
the above-referenced project, which is located on a 0.23 acre site
on the east side of NE 1st street, immediately north of the
Mainstreet Car Wash. For your information, the applicant is
requesting that this property be rezoned and reclassified from R-2
Duplex Residential to C-3 Community Commercial, and from Medium
Residential to Local Retail Commercial, respectively.
Accompanying this letter you will find the traffic study as
submitted with the above-described application. Please review this
report for compliance with the Palm Beach County Traffic
Performance Standards Ordinance and provide me with your comments.
In addition, in fulfillment of requirements of the Department of
Community Affairs for consistency review, please include in your
response the specific quantitative information which indicates the
actual impacts generated by the maximum development scenario
according to land use, and the resulting surplus (or deficit)
existing on the roadway after the project is completed. If
acceptable to you, I would suggest using the scenario indicated in
the traffic study and assume the construction of a 2,461 square
foot retail project. Lastly, it may assist you to know that the
format and content in your response for the Woolbright Commercial
rezoning (dated January 23, 1995) was ideal.

CONCURRENCY
Since the subject property is proposed to be used for stacking by the adjacent car wash, the
net result will be no new traffic impact, and therefore meets the Countywide Traffic
Performance Standards requirements.
As mentioned previously, the current stacking is on-site and along NE 1st Street with the
possibility of overflows onto Boynton Beach Boulevard, creating potentially hazardous
conditions. The additional stacking provided within the re-zoned property will result in a
safer operation since more of the stacking will be accommodated on-site, eliminating the

to the Treasure Coast Regional Planning Council. the FDOT-District Four. the
South Florida \iIMD, and the Department of Environmental Protection) of the
required t.ransmittal documents for one (1) small-scale Comprehensive Plan
amenrunent. This adopted amenrunent, referred to as Main Street Car WaEh. only
represents an amenrunent to the Comprehensive Plan Future Land Use ;.tap.
In accordance with eh. 163.3187(1)(c)(4). F.S. and Ch. 9J-11.01S, F.A.C.. please
be informed that this amendment qualifies as a small-scale amendment, and is
therefore exempt from the twice per calendar year limitation. This amendment 15
the first small-scale amenrunent to be processed by the City this year. which
represents a cumulative total of 0.23 acre.
The subject amendment was reviewed by the Local Planning Agency (governing body)
on April 18. 1995 and adopted by the governing body (a.k.a City Commission) on
May 2. 1995 at a public hearing that was held subsequent to due public notice
(see AttadlIllent "B"). It is understood that this amendment is to be transmitted
to the Department of Community Affairs within 10 working days of adoption.

In addition to the staff report which indicates, in part, the basis on which the
Future Land Use Map has been amended, the following information further justifies
this small-scale Comprehensive Plan amendment with respect to compliance wit,h
5.163, F.5., Rules 9J-S and 9J-ll, F.A.C., and the City's Comprehensive Plan:
1. The subject property contains no environmentally sensitive or native
feature worthy of consideration in the City'S Comprehensive Plan or Palm
Beach County inventory of native ecosystems. Furthermore, this site
consists of no historic features worthy of recognition by either the City
or Palm Beach County;
2. With respect to the elimination or reduction of land uses inconsistent with
the City's character and, the need to increase or decrease the intensity of
land uses. the City Commission determined that this amendment was
compatible with this 10catioIl and consistent with the Community
Redevelopment Plan and Comprehensive Plan policies which address commercial
encroacllffient and minimizing cOMuercial impacts. It should be noted that
commercial impacts will be minimized by the conditions placed on the
subject property (see memorandum from the City Manager in Attachment "E");
3. The subject property is located within the "C" flood zonej
4. \\ith respect to Traffic Circulation Element analysis requirements, the only
relevant policies that apply at this time, which regard maintaining levels
of service standards, will be followed. Furthermore, the amendment will
specifically improve traffic circulation and safety within the vicinity of
this property by removing parking and stacking traffic from a city street
and state highway (see staff report in Attacrunent "C".

6. With respect to Infrastructure Element analysis requirements.
see Attachment "D" for availability of facilities analysis. It should be
noted that given the conditions placed on the use of the subject property,
the ne\~' demand on infrastructure will be less than that to have been
generated under the current residential land use. The amendments are
consistent with all InfrastI~lcture Element objectives and policies;
7. The Coastal Zone Management Element is not applicable:
8. The Conservation Element is not applicable.
9. The Recreation & Open Space Element is not applicable;
10. The Intergovernmental Coordination Element analysis requirements have been
satisfied as proper notifications and requests for availability of facility
analyses have been sent;
11. With respect to Capital Improvements Element analysis requirements, there
are no impacts upon capital facilities that have not been projected within
the analysis of the Comprehensive Plan. Therefore, levels of service are
met and all othel: related policies are complied with; and
12. With respect to consistency with the State Comprehensive Plan and the
Regional Comprehensive Policy Plan. the above statements, along with the
information provided within the staff report address all pertinent issues
and topics within the State and Regional Plans. Such issues and topics
include housing, natural systems, endangered species, levels of service,
intergovernmental coordination, public facilities, historic resources. and
transportat,ion.

Development Plan Amendment, adopted by Ordinance No. 095-07 on
May 2, 1995, for our review. We have conducted a preliminary
inventory of the amendment package to verify the inclusion of all
required materials. The reference number for this amendment
package is 95S1.
The submission package appears to be complete, and the
Department acknowledges your request for waiver of the Objection,
Recommendations and Comments review process. The Department will
conduct a compliance review and issue a Notice of Intent regard-
ing the adopted small scale development plan amendment in ac-
cordance with procedures contained in section 163.3184, Florida
Statutes. Once the review is underway, you may be asked to
provide additional supporting documentation by the review team to
ensure a thorough review.

Introduction
Pursuant to the Treasure Coast Regional Planning Council's.
contract with the Department of Community Affairs (DCA), the
Council must review comprehensive plan amendments after their
adoption. The City of Boynton Beach has submitted an adopted
amendment to DCA, which in turn is seeking Council's comments.
Council's review of the information provided by DCA is to
focus on the consistency of the adopted amendment with the
Regional Comprehensive Policy Plan (RCPP). A written report
containing a determination of consistency with the RCPP is to
be provided to DCA within 30 calendar days of receipt of the
plan, elements or amendments.
Background
The City of Boynton Beach has adopted an amendment to its
Future Land Use Map (FLUM) under the provisions of Chapter
163.3187(1) (c), F.S., which allows for an expedited review and
compliance determination for small scale amendments. This
will be Council's only opportunity to review the amendment
which was adopted by the City on May 2, 1995. The deadline.
for Council's recommendation is July 25, 1995.
Evaluation
FUTURE LAND USE MAP AMENDMENT
The adopted amendment is for a .23 acre property located on
the east side of NE 1st Street, just north of Boynton Beach

Boulevard. The property is presently developed with a single
family residence. The applicant's intent is to move the
residence and incorporate the .23 acres into the existing car
wash business to the south of this property. The amendment
changes the FLUM designation from Medium Density Residential
(9.7dulacre) to Local Retail Commercial.
Surrounding existing land uses are single family residential
to the north, vacant and NE 2nd Street to the east, car wash
and offices to the south and restaurant and single family to
the west. The surrounding future land use designations are
Medium Density Residential to the north and west, Medium
Densi ty Residential and General Commercial to the east and
Local Retail Commercial and Public and Private Institutional
to the south.
Extrajurisdictional Impacts
There are no significant extrajurisdictional impacts
associated with the amendment. The amendment was processed
through the Palm Beach Countywide Intergovernmental
Coordination Program. No. objections were received according
to the Clearinghouse Coordinator (see attached--
correspondence) .
Effects on Regional Resources or Facilities
No detrimental effects are expected on significant regional
resources or facilities.
Conclusion
Based on the lack of identified extrajurisdictional impacts or
effects on regional resources or facilities, the adopted
amendments are CONSISTENT with the goals and policies of the
RCPP.
Recommendation
Council should adopt the comments outlined above and approve"
their transmittal to the Department of Community Affairs.

Comprehensive Plan Small-Scale Amendment (Ordinance No. 095-07;
DCA No. 95S1) for the City of Boynton Beach adopted on May 2,
1995, and determined that it meets the requirements of Chapter
163, Part II, Florida Statutes, for compliance, as defined in
Subsection 163.3184(1) (b). The Department is issuing a Notice of
Intent to find the plan amendment In Compliance. The Notice of
Intent has been sent to The News for publication on August 10,
1995.
Please note that a copy of the adopted City of Boynton Beach
Comprehensive Plan Amendment, and the Notice of Intent must be
available for public inspection Monday through Friday, except
for legal holidays, during normal business hours, at the City of
Boynton Beach, City Hall, Planning and Zoning Department, 100

CITY OF BOYNTON BEACH
COMPREHENSIVE PLAN AMENDMENT IN COMPLIANCE
DOCKET NO. 95S1-NOI-5005-(A)-(I)
The Department gives notice of its intent to find the
Amendment to the comprehensive Plan for the City of Boynton Beach,
adopted by Ordinance No. 095-07 on May 2, 1995, IN COMPLIANCE,
pursuant to sections 163.3184, 163.3187 and 163.3189, F.S.
The adopted City of Boynton Beach Comprehensive Plan Amendment
and the Department's objections, Recommendations and Comments Report,
(if any), are available for public inspection Monday through Friday,
except for legal holidays, during normal business hours, at the City
of Boynton Beach, City Hall, Planning and zoning Department, 100 East
Boynton Beach Boulevard, Boynton Beach, Florida 33425.
Any affected person, as defined in section 163.3184, F.S., has
a right to petition for an administrative hearing to challenge the
proposed agency determination that the Amendment to the City of
Boynton Beach Comprehensive Plan is In Compliance, as defined in
Subsection 163.3184(1), F.S. The petition must be filed within
twenty-one (21) days after publication of this notice, and must
include all of the information and contents described in Rule 9J-
11.012(7), F.A.C. The petition must be filed with the Agency Clerk,
Department of Community Affairs, 2740 centerview Drive, Tallahassee,
Florida 32399-2100, and a copy mailed or delivered to the local
government. Failure to timely file a petition shall constitute a
waiver of any right to request an administrative proceeding as a
petitioner under section 120.57, F.S. If a petition is filed, the
purpose of the administrative hearing will be to present evidence and
testimony and forward a recommended order to the Department. If no
petition is filed, this Notice of Intent shall become final agency
action.
If a petition is filed, other affected persons may petition for
leave to intervene in the proceeding. A petition for intervention
must be filed at least five (5) days before the final hearing and must
include all of the information and contents described in Rule 60Q-
2.010, F.A.C. A petition for leave to intervene shall be filed at the
Division of Administrative Hearings, Department of Management
Services, 1230 Apalachee Parkway, Tallahassee, Florida 32399-1550.
Failure to petition to intervene within the allowed time frame consti-
tutes a waiver of any right such a person has to request a hearing
under Section 120.57, F.S., or to participate in the administrative
hearing.
