Based on the trip generation analysis, the rezoning would increase traffic by 213 daily trips over those of the current zoning. The new traffic was added to the 2010 traffic projection for Boynton Beach Boulevard (obtained from the Palm Beach County Traffic Division) to determine if the roadway can accommodate the re-zoning request. Table 4 provides this data. Since the future traffic with additional trips from the re-zoning is below capacity, the re-zoning may be permitted. The City of Boynton Beach has submitted an adopted amendment to DCA, which in turn is seeking Council's comments. Council's review of the information provided by DCA is to focus on the consistency of the adopted amendment with the Regional Comprehensive Policy Plan (RCPP). A written report containing a determination of consistency with the RCPP is to be provided to DCA within 30 calendar days of receipt of the plan, elements or amendments. Background The City of Boynton Beach has adopted an amendment to its Future Land Use Map (FLUM) under the provisions of Chapter 163.3187(1) (c), F.S., which allows for an expedited review and compliance determination for small scale amendments. This will be Council's only opportunity to review the amendment which was adopted by the City on May 2, 1995. The deadline. for Council's recommendation is July 25, 1995. Evaluation FUTURE LAND USE MAP AMENDMENT The adopted amendment is for a .23 acre property located on the east side of NE 1st Street, just north of Boynton Beach J1I W' 'WI ,. Boulevard. The property is presently developed with a single family residence. The applicant's intent is to move the residence and incorporate the .23 acres into the existing car wash business to the south of this property. The amendment changes the FLUM designation from Medium Density Residential (9.7dulacre) to Local Retail Commercial. Surrounding existing land uses are single family residential to the north, vacant and NE 2nd Street to the east, car wash and offices to the south and restaurant and single family to the west. The surrounding future land use designations are Medium Density Residential to the north and west, Medium Densi ty Residential and General Commercial to the east and Local Retail Commercial and Public and Private Institutional to the south. Extrajurisdictional Impacts There are no significant extrajurisdictional impacts associated with the amendment. The amendment was processed through the Palm Beach Countywide Intergovernmental Coordination Program. No. objections were received according to the Clearinghouse Coordinator (see attached-- correspondence) . Effects on Regional Resources or Facilities No detrimental effects are expected on significant regional resources or facilities. Conclusion Based on the lack of identified extrajurisdictional impacts or effects on regional resources or facilities, the adopted amendments are CONSISTENT with the goals and policies of the RCPP. The adopted City of Boynton Beach Comprehensive Plan Amendment and the Department's objections, Recommendations and Comments Report, (if any), are available for public inspection Monday through Friday, except for legal holidays, during normal business hours, at the City of Boynton Beach, City Hall, Planning and zoning Department, 100 East Boynton Beach Boulevard, Boynton Beach, Florida 33425. Any affected person, as defined in section 163.3184, F.S., has a right to petition for an administrative hearing to challenge the proposed agency determination that the Amendment to the City of Boynton Beach Comprehensive Plan is In Compliance, as defined in Subsection 163.3184(1), F.S. The petition must be filed within twenty-one (21) days after publication of this notice, and must include all of the information and contents described in Rule 9J- 11.012(7), F.A.C. The petition must be filed with the Agency Clerk, Department of Community Affairs, 2740 centerview Drive, Tallahassee, Florida 32399-2100, and a copy mailed or delivered to the local government. Failure to timely file a petition shall constitute a waiver of any right to request an administrative proceeding as a petitioner under section 120.57, F.S. If a petition is filed, the purpose of the administrative hearing will be to present evidence and testimony and forward a recommended order to the Department. If no petition is filed, this Notice of Intent shall become final agency action. If a petition is filed, other affected persons may petition for leave to intervene in the proceeding. A petition for intervention must be filed at least five (5) days before the final hearing and must include all of the information and contents described in Rule 60Q- 2.010, F.A.C. A petition for leave to intervene shall be filed at the Division of Administrative Hearings, Department of Management Services, 1230 Apalachee Parkway, Tallahassee, Florida 32399-1550.
