Proposed Use (warehouse/distribution of commercial turf
equipment)
Dear Mr. Reed:
This letter further clarifies my March 24, 1995 letter to you and
responds to further questions within your March 27, 1995 letter to
me regarding the above-referenced matter. Irrigation equipment is
referenced on the current Boynton Commercenter list of permitted
uses under I.C.1, via a reference to section a.A.1.C of the City's
zoning code. The warehouse distribution of maintenance equipment
(lawn equipment, tools and supplies, mowers, tractors and
associated parts) and the equipment and vehicle repair aspect of
the proposed use is not specifically, or via reference to the
appropriate section a.A.1.C.(9) of the City's zoning code, listed
on the Boynton commercenter list of permitted uses. Therefore, the
repair and warehouse/distribution of the maintenance equipment
would need to be added to the Boynton Commercenter list through the
quick and relatively inexpensive, use approval process described in
my March 24, 1995 letter to you.
As for the likelihood of City approval of such a request, I cannot
make a recommendation at this time, until my staff has researched
the concept behind this particular PID (planned industrial
development) . As for the distribution of fertilizer (currently
prohibited by both the Boynton Commercenter list of permitted uses
and the city's zoning code), if the zoning code were changed and
the use approved for the Boynton commercenter, the proposed user
would be able to distribute fertilizer in either a new building or
an existing building at the Boynton Commercenter.

The process for a zoning code change is submittal of a letter
describing the change and justification, with a $150 fee, to the
Planning and Zoning Department by March 31, 1995 for consideration
by the Commission on April 18, 1995. If the City Commission
directs staff to change the code as requested, an additional fee of
$250 must be submitted for adoption of ordinances and advertising
of the zoning code change, taking an additional month for
finalization on May 16, 1995. please note that pending City
Commission approval on April 4, 1995, processing and submittal fees
for use approvals and reviews of zoning code changes will be
increased from $150 to $250.
In general, let me add that PIDs are a separate and distince zoning
district from the city's M-1, Light Industrial, district,
recognizing that not all M-1 uses are appropriate in a PID and vice
versa. PIDs are intended to fill a niche in the current demand for
light industrial zoned land, which reflects a change in technology
and allows for economies of scale in industrial development. This
often include allowing combining of uses not permitted to be
combined in other zoning districts, in exchange for more stringent
regulations governing unified control, landscaping, open space,
harmony of design and common use of improvements.
I hope this assists you in determining whether to pursue this
proposed use, although I am sure, through previous conversations
with you, that the owner of the Boynton Commercenter, too, has a
concept in mind for the use and development of the PID.

Dear Ms. Heyden:
Thank you very much for responding to my letter requesting zoning determination for a
prospective tenant, The Kilpatrick Turf Equipment Co., at the above-referenced property. As
previously mentioned, the proposed use is for a warehouse and distribution facility to include
mowers, tractors, lawn maintenance equipment and various parts for such equipment. Basically,
the Boynton Beach location will be the warehouse and distribution facility for The Kilpatrick Turf
Equipment Co.
I understand that my original letter did not include specific items which would be warehoused
and distributed from the facility and I hope that this letter will further clarify what will actually be
stored within and distributed from the facility.
Based upon your letter dated 24 March 1995, it is my interpretation that the proposed use falls
under Zoning Code Page No. 1934.2, Section 8.A.1.c.(6) and Section 8.A.1.c.(9). It should also
be noted that vehicle and equipment repair will take place at the facility. I assume that this will
fall under Section II. 10, 11 and 12, even though it is not specifically mentioned. If The Kilpatrick
Turf Equipment Co.'s operation requires Environmental Review, such application will be made
and channeled through the proper department.
Fertilization will not be distributed through the above-mentioned operation; however, if the
prospect wanted to build a facility on the vacant land at Boynton Commerce Center, would the
entity have the ability to distribute fertilizer should the current zoning code be revised to permit
such use? I will await your response on this separate issue.

Dear Ms. Heyden:
As discussed in our telephone conversation yesterday, Acme Plastics of
Florida, Inc., an existing tenant at the above-referenced property, is
entertaining the possibility of relocating and expanding into the 1900 Building.
To interpret the impact on parking at the project, 1 have prepared the
enclosed Tenant Listing which outlines Acme Plastic's expansion into Bays
1910 and 1912 (14,664 square feet) with an Occupational License categorized
as WarehouselDistribution/Wholesale at a 1:800 ratio. Also, the Listing shows
Bays 2019 and 2021, Acme Plastics' existing facility, as vacant (11,445 square
feet) at a 1:500 ratio. My calculations on the impact of this expansion show
a 14 space surplus of parking as noted on the Parking Summary section.
Please review the enclosed and advise on how the City would view this
expansion and the impact on the parking ratios at Boynton Commerce Center.
Thank you for your assistance in this matter. I hope the additional staffing is
approved by the Planning Department for 1995.
