Permits will be needed from the LWDD. 2) 7 - Eleven at Grove Plaza - No objection. However, right-of-way issues involved with this project have not been addressed to the satisfaction of this District. 3) Boynton Commerce Center P.I.D. Phase IT - Operations Center "C" - No objection. Permits will be needed from the LWDD. Should these items come under Plat Review, we would appreciate being allowed to take part in that process, also. Odors and fumes - The proposed use will not emit any odors or fumes. 5. Toxic or Noxious Matter - The proposed use will not create any toxic or noxious matter. 6. Fire and Explosion Hazard - The proposed use will not create any fire and explosion hazards. 7. Heat, Humidity, and Glare - The proposed use will not generate any of these items. Note also that this tower will not be lighted. 8. Liquid Waste - No liquid waste will be generated by this use. 9. Solid Waste - This facility, which will be unmanned, will not generate any solid waste. 10. Electromagnetic Interference - The F.C.C. closely regulates the frequencies over which this equipment will operate. The possibility of interference with other communication devices (Le. radios, televisions, etc.), is very slight. 11. Hazardous Materials and Hazardous Waste - This facility will not generate any hazardous material or hazardous waste. Based on this information we feel the proposed communication facility use (tower and unmanned equipment building) is compatible to the surrounding area and complies with the performance standards. Inclusion of the proposed communications facilities use at the Boynton Commerce Center will enable AT & T Wireless Services to proceed with the planning and approval process for this expansion to their facilities. We are requesting that this Use Determination be considered for approval by the City Planning and Zoning Board and City Commission. Hayden, Planning Director RE: Boynton Commerce Center PJ.D. - Use Determination Dear Ms. Hayden: AT & T Wireless Services, a major cellular telephone provider for this area, currently has offices at the Boynton Commerce Center. In conjunction with, and as an accessory use to, those facilities they are seeking approval to construct a monopole type communications tower and an unmanned equipment building on a portion of this site. In order to move forward with this expansion of their facilities in the City of Boynton Beach we are, on behalf of AT & T Wireless Services, requesting a formal Use Determination for the Boynton Commerce Center P.I.D. that would permit the monopole tower use (and associated unmanned equipment building) as proposed. Presently zoned as a Planned Industrial Park, the zoning regulations recognize such uses as manufacturing, light industrial, and warehouse as permitted operations within this district. Additionally, these regulations allow for radio/television studios but do not specifically designate communications facilities as a permitted use. This request meets with the performance standards established by the City as outlined in the City Ordinances. Those standards and our conformance with them is as follows: 1. Noise - This is an unmanned facility and will in general have no noise associated with the proposed use. It will conform to the City ordinances related to this item. 2. Vibrations - Other than what will be occurring during the construction process, no ground vibrations, perceptible without instruments beyond the property lines, will be associated with this facility. 3. Smoke, Dust, Dirt or Other Particulate Matter - This use, once constructed, will not generate these items. (continued) CIVIL. STRUCTURAL. DRAINAGE. HIGHWAYS. WATER & SEWER. SURVEY
