The list of permitted us~s and parking requirements at the Boynton Cornmercenter has been
amended by the Planning and Development Board, at their May 11, 1993 meeting, for the
warehouse buildings located in this Planned Industrial Development (PID) as follows:
1. Permitted Uses, Not Requiring Environmental Review Approval.

1. Carpet and Upholstery Cleaning
B. Manufacturing, including compounding, assembly, repair, or treatment of articles or
merchandise from following previously prepared materials:
1. Cellophane
2. Canvas
3. Fiber (i.e., wood, except that furniture manufacturing requires environmental
review)
4. Fiberglass
5. Glass
6. Leather
7. Textiles
8. Yarn
C. Warehouse, Distribution, Wholesale
1. Any manufacturing category listed above, or any use listed in Sections 8.A.l.c (2),
(3), (4), (6), (7), (14), and (16) ofthe "M-l INDUSTRIAL DISTRICT" Zoning

III. All uses not specifically listed above are prohibited. Furthermore, the following uses are
expressly prohibited:
1. Fertilizer manufacturing, sale or distribution
2. Millwork
3. Metal casting
4. Welding shops
5. Contractor's shops, storage, or truck parking
6. Retail sales, where the value of goods sold at retail exceeds 50% of the total value
of goods sold from the premises.
7. Any warehouse or wholesale use which is listed in Section 8.A.2.B., 8.A.3.c., or
Section 8.A.5.b. of the "M-l INDUSTRIAL DISTRICT" Zoning Regulations.
Parking Requirement:
Warehouse. distribution. wholesale: One (1) parking space per eight hundred (800)
square feet of gross floor area (subject to the conditions outlined in notes 1-3 below).
Manufacturing: One (1) parking space per two (2) employees, but not less than one (1)
parking space per five hundred (500) square feet of gross floor area (subject to the
conditions outlined in notes 1-3 below),
1. Showrooms associated with the principal use are permitted as an ancillary use.
2. Offices associated with the principal use are permitted as an ancillary use with a
maximum of 25% of the total gross floor area devoted to such use.
3. Office floor area which exceeds 25% ofthe total gross floor area shall be considered a
principal use and shall provide parking at the rate of one (1) parking space per three
hundred (300) square feet of the entire gross floor area devoted to such use.
Operations Center: One (1) parking space per three hundred (300) square feet of gross

Use approval (communication towers)
NATURE OF REQUEST
Frederick Roth, Jr., P.E., from Michael B. Schorah & Associates, Inc., agent
for AT&T Wireless Services, currently a tenant at the Boynton Commerce Center
PID, is requesting approval to amend the list of permitted uses for this PID
to add communication towers (see Exhibit II All - Letter of Request. More
specifically, AT&T wishes to construct a monopole type communication tower
and unmanned equipment building at the Boynton Commerce Center PID (Planned
Industrial Development) - see attached Exhibit "BII - location map.
ANALYSIS
According to Chapter 2, Section 7.E. of the city's zoning code, in approving
uses in the PID, the Planning and Development Board shall make findings that
the use proposed will not be in conflict with the performance standards
listed in Section 4.N. of the zoning regulations, and that the use proposed
is consistent with the intent and purpose of the planned industrial
development district. The applicant's letter of request addresses all the
performance standards of the zoning code and indicates that the proposed use
conforms to those standards pertaining to noise, vibration, smoke, dust, or
other particulate matter, odors, fumes, toxic or noxious matter, glare, heat,
humidity, radiation, fire, explosive hazards, liquid waste and solid waste.
Regarding electromagnetic interference, the performance standards prohihit
any use which causes abnormal degradation of performance of any
electromagnetic receptor of proper design, or which causes electromagnetic
interference with normal radio or television reception. The City's
communication tower, located along the east side of Interstate 95, north of
the Boynton C-16 Canal, is far enough away from this proposed tower at the
southeast corner of the Boynton Commerce Center, to not interfere with the
City's facility. There is a very slight possibility, as with the case with
any communication tower, of some interference with radio or television
reception in close proximity to the tower. However, most radios and
televisions are equipped with filters for this reason.
Regarding the intent and purpose of the PID district which, among other
things, is to privide a zoning classification for light industrial
development that will better satisfy current demands for light industrial
zoned lands, the M-1, Light Industrial District, Appendix A, Section 8.A.4.b
permits commercial television, radio and microwave broadcasting or relay
towers as a principal use subject to conditional use approval. This implies
that relay towers are an appropriate light industrial use subject to certain
restrictions or provisions to mitigate any negative impacts. Of the following
standards for evaluating conditional uses: ingress/egress, parking, refuse
and service areas, utilities, buffering, landscaping, setbacks, traffic
safety, structure height, economic effects, and compatibilty and harmony with
nearby properties, all but the last two standards listed, will be reviewed
with the futu~e site plan approval and height exception necessary for the 100
foot tower. With respect to the last two standards (economic effects and
compatibility of the tower with nearby properties) the proposed tower
location, adjacent to Golf Road, is at least 750 feet from the residential
developments in the area (Leisureville, Golf View Harbour, High Point West
Condomini~ms and Forest Hills) - see location map in "Exhibit "B".

The proposed tower location is immediately adjacent to the Seaboard Airline
Railway, Golf Road and the remainder of the PID which, as is required, has an
existing perimeter greenbelt (see Exhibit "C" - roposed site plan of monopole
tower and equipment building). In addition, Golf Road is at an elevation
higher than the height of the one-story industrial buildings at the southeast
corner of the PID where the tower is proposed. The applicant has prepared
line-of-site drawings to demonstrate the visibility of the tower (see Exhibit
"D" - monopole tower line of site plan) .
Based on the analysis above rgarding the nature of the proposed use with the
performance standards, consistency of the proposed use with the intent and
purpose of the PID district and compatibility of the proposed use with the
permitted uses (see Exhibit "E") which have been approved at the Boynton
Commerce Center, it is recommended that the list of permitted uses for the
Boynton Commerce Center be amended to include communication towers, as an
accessory use to a lawful principal use (AT&T is already leasing space at the
PID) and provided that the number of towers located within the PID is limited
to one.

Dear Ms. Hayden:
AT & T Wireless Services, a major cellular telephone provider for this area, currently has
offices at the Boynton Commerce Center. In conjunction with, and as an accessory use
to, those facilities they are seeking approval to construct a monopole type
communications tower and an unmanned equipment building on a portion of this site.
In order to move forward with this expansion of their facilities in the City of Boynton
Beach we are, on behalf of AT & T Wireless Services, requesting a formal Use
Determination for the Boynton Commerce Center P.I.D. that would permit the monopole
tower use (and associated unmanned equipment building) as proposed. Presently zoned
as a Planned Industrial Park, the zoning regulations recognize such uses as
manufacturing, light industrial, and warehouse as permitted operations within this district.
Additionally, these regulations allow for radio/television studios but do not specifically
designate communications facilities as a permitted use.
This request meets with the performance standards established by the City as outlined
in the City Ordinances. Those standards and our conformance with them is as follows:
1 . Noise - This is an unmanned facility and will in general have no noise
associated with the proposed use. It will conform to the City ordinances
related to this item.
2. Vibrations - Other than what will be occurring during the construction
process, no ground vibrations, perceptible without instruments beyond the
property lines, will be associated with this facility.
3. Smoke, Dust, Dirt or Other Particulate Matter - This use, once constructed,
will not generate these items.

4. Odors and fumes - The proposed use will not emit any odors or fumes.
5. Toxic or Noxious Matter - The proposed use will not create any toxic or
noxious matter.
6. Fire and Explosion Hazard - The proposed use will not create any fire and
explosion hazards.
7. Heat, Humidity, and Glare - The proposed use will not generate any of
these Items. Note also that this tower will not be lighted.
8. Liquid Waste - No liquid waste will be generated by this use.
9. Solid Waste - This facility, which will be unmanned, will not generate any
solid waste.
10. Electromagnetic Interference - The F.C.C. closely regulates the frequencies
over which this equipment will operate. The possibility of interference with
other communication devices (Le. radios, televisions, etc.), is very slight.
1 1. Hazardous Materials and Hazardous Waste - This facility will not generate
any hazardous material or hazardous waste.
Based on this information we feel the proposed communication facility use (tower and
unmanned equipment building) is compatible to the surrounding area and complies with
the performance standards.
Inclusion of the proposed communications facilities use at the Boynton Commerce Center
will enable AT & T Wireless Services to proceed with the planning and approval process
for this expansion to their facilities. We are requesting that this Use Determination be
considered for approval by the City Planning and Zoning Board and City Commission.

Boynton Commercenter has been amended by the Planning and
oevelopment Board, at their May 11, 1993 meeting, for the
warehouse buildings located in this Planned Industrial
Development (PID) as follows. This list supersedes the latest
list dated February 25, 1991 from myself:

Parking Requirement:
Warehouse. distribution. wholesale: One (1) parking
space per eight hundred (800) square feet of gross
floor area (subject to the conditions outlined in notes
1-3 below).
Manufacturinq: One (1) parking space per two (2)
employees, but not less than one (1) parking space per
five hundred (SOO) square feet of gross floor area
(subject to the conditions outlined in notes 1-3
below) ,
1. Showrooms associated with the principal use are
permitted as an ancillary use.
2 .
Offices associated with the principal use are
permitted as an ancillary use with a maximum of
25% of the total gross floor area devoted to such
use.

to warehouse use. Where both office and warehouse uses
are intermixed, parking shall be calculated based on
the requirement for office use.
Personal Services and offices: One (1) parking space
per three hundred (300) square feet of gross floor
area.
