RE: Lake View Homes (f.k.a. Best Homes/Boynton Lakes Plat #5) - Landscaping Requirements
Dear Mr. Shlesinger:
As you requested, I am writing to reiterate the necessity that the above-referenced project be completed in accordance
with plans approved by the City of Boynton Beach.
The above-referenced project received site plan approval in 1991, and was subsequently granted time extensions until
permitted in 1995. A portion of the project has been completed and issued certificates of occupancy. These individual
approvals have been granted based on completion of the project in accordance with all details of the approved site
plans and/or permit drawings. It should be noted that if any portion of the project is not completed consistent with
approved drawings, the project will not be given final approval nor issued a certificate of occupancy. Using
landscaping as an example, if the landscaping materials planted on the site do not match those exact species
indicated on the approved site plan and/or permit drawings, the project will not receive final approval nor further
certificates of occupancy. Furthermore, any alterations of the existing landscaping on the approved portions of the
project would be detected when final inspections are conducted, and would result in halting further approvals and
certificates of occupancy. Specifically, any landscaping removed inconsistent with the approved plans must be re-
installed consistent with the approved plans, prior to further inspections and approvals.
As a further consequence of altering, following a final inspection and issuance of a certificate of occupancy, any
portion of the project that originally complied with the City's development regulations, the responsible party/owner
would be sited by the City's Code Compliance Division. If the site is not returned to a condition consistent with the
approved plans, or if modifications to the plans, consistent with the alterations made, are not approved by the City,
fines would eventually be issued.

Re: Lake View Homes Landscaping Requirements
Dear Mr. Rumpf:
As you know, part of the landscaping at Lake View has been unlawfully and arbitrarily
removed by the Boynton Lakes North HOA.
On Monday, November 10, 1997, I will be going before a Judge to request "injunctive
relief" with regard to this matter.
At this time we would request that you supply us with a letter stating the following:
1. The landscaping plans for Lake View, which have already been approved by
the City of Boynton Beach, reflect the minimum landscaping requirements
according to the City Codes.
2. These plans must be adhered to and complied with and any removal of plants
or trees without approval will result in fines and enforcement of restitution.
In light of the fact that we have been trying to follow the City Codes and meet all the
requirements for completing our project at Lake View, we appreciate your helping us by
writing this letter to clarify this situation for the Judge.

As per our conversation on Thursday 19 ht of January, I would like you to consider
the following matters:
As you already know, we have purchased 35 lots of land from the Resolution Trust
Corporation, in addition there are 6 lots under contract with Institutional Mortgages Inc. which
is a subsidiary of Lennar Homes. All of these are located in Plat #5 of the proyect known as
Boynton Lakes North.
As per the list of comentaries given to us by your department, the majority have been
resolved, with the exception of the T-Turn and the additional parking spaces for visitors.
We would like to call your attention to the fact that all our company did, was to
purchase a group of lots already platted and with services.
The common areas of the proyect were handed over to the neighbor association at
the corresponding time, and before our company bought this land, so in effect we have no
control over these.
For your information according to the condominium documents, in Article I , Section I,
Numeral F, it says that whatever change in the use or transfer of any portion of space for any
reason (in this case for parking places), should be approved by 2/3 of the neighbor
association.
As you can see, getting 2/3 of almost 500 owners is not an impossible task, but a
very complicated and lenghty one, that could take years.
We understand that the next commissioner's meeting will be held on the 7 th of
February, which we would be more than happy to attend, to present our case along with you,
but this should not cause any further delay in the approval of our plans, since we need this
approval so that the Construction Department can grant us the corresponding pennission to
start the construction.

SURFACE WATER MANAGEMENT SYSTEM, THE PERMITTEE SHALL SUBMIT THE CERTIFICATION AND NOTIFY THE
DISTRICT THAT THE FACILITIES ARE READY FOR INSPECTION AND APPROVAL. UPON APPROVAL OF THE
COMPLETED SURFACE WATER MANAGEMENT SYSTEM, THE PERMITTEE SHALL REQUEST TRANSFER OF THE
PERMIT TO THE RESPONSIBLE ENTITY APPROVED BY THE DISTRICT.
5. ALL ROADS SHALL BE SET AT ORABOVE ELEVATIONS REQUIRED BY THE APPLICABLE LOCAL GOVERNMENT FLOOD
CRITERIA.
6. ALL BUILDING FLOORS SHALL BE SET AT OR ABOVE ELEVATIONS ACCEPTABLE TO THE APPLICABLE LOCAL

8. NO CONSTRUCTION AUTHORIZED HEREIN SHALL COMMENCE UNTIL A RESPONSIBLE ENTITY ACCEPTABLE TO THE
DISTRICT HAS BEEN ESTABLISHED AND HAS AGREED TO OPERATE AND MAINTAIN THE SYSTEM. THE ENTITY MUST
BE PROVIDED WITH SUFFICIENT OWNERSHIP SO THAT IT HAS CONTROL OVER ALL WATER MANAGEMENT
FACILITIES AUTHORIZED HEREIN. UPON RECEIPT OF WRITTEN EVIDENCE OF THE SATISFACTION OF THIS

Boynton Lakes P.U.D.
Dear Carmen:

Please consider this as our 'response to the questions
raised by the Recreation Department through its memor-
andum to you from John Wildner, dated September 4, 1985.
Existing facilities are located within Plat No. ~ and
consist of a .swimming pool, pool cabana, two tennis courts,
a picnic area and a multi-purpose clubhouse. The site.
is 2.75 acres..
Proposed facilities are to be located within Plat No. 4
and the future Plat No.3-B. The facilities within the
former plat, which have site plan approval and have been
bonded, include an open playfield, children's playground,
a picnic area, a swimming pool and a pool cabana. This
site is 2.3 acres. The site plan for this area will be
revised to include a meeting room facility. This structure
.will have air conditioned space for sixty people and will
incorporate the cabana facilities. The use of this
recreational area will be limited to those residing north
of the L-19 canal and maintained by its separate property
owners. association.
The facilities within future Plat No. 3-B will consist
of two racquetball/handball courts, swimming pool, pool
cabana, picnic area and children.s playground. The land
area will be 1.6 acres. A detailed site plan for this
area has not been prepared. It is our intention to bond
these recreational facilities concurrently with the approval
of Plat No.3-B.

At our meeting of September 24,. 1985, it was mutually
determined that our public park is deficient by 0.54
acre. It is our understanding that the City will accept
cash in lieu of dedication in the amount of $15,387.49.
This will be paid concurrently with the approval of
Plat Nos. 3-A, 5 and 6.
I trust that this will sufficiently resolve the ques-
tions raised by Recreation Department to enable us to

RE: Boynton Lakes plat 3-A (Replat of phase #3)
Since the original masterplan (including the application for one-half
credit towards the Recreation Impact Fee) was first submitted in 1978, tr.e
scope of this project has continued to evolve. This seems to be an
appropriate time for the Ci ty to review the recreation package in this PUD
. . to insure that it still meets the requirements of the Sub-division Ordinan.ce.
The developer should submit the following:
1. A list of all private recreation, currently provided,
under construction, or planned, which demonstrates that
the PUD meets the recreation requirements of the code.
2. Si te details for the pri vate recreation elements to
be provided in phase 3 (3A, 3B, etc.).
3. Proof of bonding for all those recreation elements to
be included in Phase 3 (3A, 3B, etc.).

To add to our previous modification ( Permit # 95.1817) the elimination of the 3
Sobol palmetto and the 5 Tripsacum dadyloides on the west side of block 11
( The Group of trees. planted on the east side of block 11 by the time we got the
COD for the lot 1, 2 & 3 were removed by the homeowner) due to the fad that
these plants are to be on the common ground and could affed the pending
fi1igation between Boynton lakes North qnd Shlesi,nger Homes.
Please take in consideration that we planted 3 more trees than the required on the
common ground on the back of the building on block 16. Is in our understanding
that there is an adequate surplus of trees base on the 32 original required and
