RIDER TO SITE PLAN APPLICATION
The undersigned as applicant for Final Site Plan Approval does
hereby acknowledge, represent and agree that all plans,
specifications, drawings, engineering, and other data
submitted with this application for review by the City of
Boynton Beach shall be reviewed by the various boards,
commissions, staff personnel and other parties designated,
appointed or employed by the City of Boynton Beach, and any
such party reviewing the same shall rely upon the accuracy
thereof, and any change in any item submitted shall Qe deemed
material and substantial.
The undersigned hereby agrees that all aspects of the proposed
project shall be constructed in strict compliance with the form in
which they are approved, and any change to the same shall be deemel
material and shall place the applicant in violation of this
application and all approvals and permits which may be granted.
The applicant acknowledges that the City of Boynton has all rights
and remedies as provided by the applicable codes and ordinances of
the City of Boynton Beach to bring any violation into compliance,
and that in the event of enforcement action by the City, the
applicant shall indemnify, reimburse and save the City of Boynton
Beach harmless from any costs, expense, claim, liability or any,
action which may arise due to their enforcement of the same.

THIS DECLARATION is made on the date hereinafter set forth by SHLESINGER ..
HOMES-BOYNTON BEACH, LTD., a Florida limited partnership, hereafter "SHLESINGER"
and BOYNTON LAKES NORTH COMMUNITY ASSOCIATION, INC., a Florida not-for-
profit corporatio!l, hereafter " ASSOCIATION" .
WITNESSETH:
WHEREAS, SHLESINGER is the owner of 35 lots in Boynton Lakes Plat No.5 and is
also the contract vendee of the remaining 6 lots in said subdivision, and, as such, desires certain
wall maintenance and roof overhang easements and ingress and egress easements for the
construction of sidewalks to be adopted by ASSOCIATION for the full use of the property
owned or to be owned by SHLESINGER and to be developed into nine townhome buildings
comprised of either 3 units, 4 units, 5 units or 6 units (the "Property"); and
WHEREAS, ASSOCIATION and SHLESINGER also want to insure that the exterior
walls and roofs of the townhome buildings are properly maintained; and
WHEREAS, the Property is subject to that certain Declaration dated November 5, 1985
and recorded March 24, 1986 in Official Records Book 4826 at Page 111, as amended, of the
Public Records of Palm Beach Coun~y, Florida ("Declaration"); and
WHEREAS, the Property includes Lots, as more completely described in the Declaration,
some of such Lots having appurtenant easements pursuant to this Declaration of Easements and
Maintenance Obligations, as follows:
Lots 1 and 4 of Block 8, Lots 1 and 5 of Block 9, Lots 1 and 6 of
Block 10, Lots 1 and 6 of Block 11, Lots 1 and 6 of Block 12,
Lots 1 and 4 of Block 13, Lots 1 and 3 of Block 14, Lots 1 and 3
of Block 15, and Lots 1 and 4 of Block 16, all lying within Tract
"R" of the Plat of Boynton Lakes - Plat No.5 (P.D.D.), as
recorded in Plat Book 52, Pages 105 through 108, of the Public
Records of Palm Beach County, Florida.
WHEREAS, ASSOCIATION owns the common elements, including Tract "R", and has
certain rights pursuant to the Declaration with regard to the Property; and
WHEREAS, ASS:lCIATION is willing to grant the wall maintenance and roof overhang
easements and the ingress and egress easements hereinafter described for the benefit of the
platted Lots to which each of such easements is appurtenant, and to consent to the imposition
of certain exterior maintenance obligations on t~e aforementioned lots, but only upon certain
terms and conditions, including, but not limited to, that SHLESINGER, its successors or
assigns, Jlssume any, liability in connection with the granting of these easements.
NOW, THEREFORE, SHLESINGER and ASSOCIATION, hereby declare the following
easements:

I. Tract "R" of the Plat of Boynton Lakes - Plat No.5 (p.U.D.) and recorded in Plat
Book 52, Pages 105 through 108, of the Public Records of Palm Beach County, Florida, is
hereby encumbered with the following ingress and egress easements:
A. The eighteen easements described in the F.R.S. & Associates "Description
of the Ingress and Egress Easements" attached hereto as Exhibit" A" and hereby incoIp9rated
herein. Each particular ingress and egress .easement is appurtenant to a particular lot as '
identified in said Exhibit "A".
B. The eighteen easements described in the F.R.S. Associates; "Description
of Wall Maintenance and Roof Overhang Easements" ~ttached hereto as Exhibit liB" and hereby
incorporated herein. Each particular wall maintenance and roof overhang easement is
appurtenant to a particular lot as identified in said Exhibit "B".

2. Each Lot Owner of the above-described Lots benefitted by the above easements,
shall have and bear the obligation to maintain in good and safe condition all easements described
in Exhibit It A" and Exhibit "B" hereof that are appurtenant to such Owner's Lot, including the
sidewalk located or to be located in said easement described in Exhibit "A". Each Lot Owner
shall indemnify and hold ASSOCIATION, its directors, officers, employees and/or agents,
harmless from any liability, loss, or expense incurred or suffered in consequence of bodily injury
to any person (including death) or damage to any property (a) by reason of such Lot Owner's
negligent maintenance or failure to maintain an appurtenant easement, (b) relating to or arising
from the use of such easement or construction of improvements thereon or (c) by reason of the
ASSOCIATION granting the easement set forth herein. Should any sums due ASSOCIATION
by any Owner due to the terms of this Paragraph be unpaid, ASSOCIATION shall have a lien
against the Lot and Unit of such Owner, and ASSOCIATION shall have all remedies available
for payment of such obligation as set forth in Article V of the Declaration, including, but not
limited to, reimbursement of costs and attorney's fees.
3. Each Owner of a Lot to which any of the easements described in Exhibit" A If or
Exhibit liB" attached hereto are appurtenant shall maintain at all times liability insurance in an
amount not less than $100,000.00, concerning the liability set forth above in Paragraph 2, with
the ASSOCIATION declared as a coinsured. The ASSOCIATION shall be provided with an
endorsement. Any such liability insurance policy cannot be cancelled on less than 30 days notice
to the ASSOCIATION. Each Owner of a lot shall maintain such insurance and shall furnish the
ASSOCIA nON a certificate of insurance on an annual basis.
4. The easements described on Exhibit" A" or Exhibit "B" hereto, and the terms and
covenants of this Declaration of Easements and Maintenance Obligations, run with the land.
S. Any construction of improvements in the easements is subject to prior approval
of the ASSOCIA nON as provided in the Declaration.
6. Without limiting any of its other rights and remedies pursuant to the Declaration,
this Declaration of Easements and Maintenance Obligations, or at law, the ASSOCIA nON shall
have the right to enforce the provisions hereof through an action for injunctive relief. If the
ASSOCIATION takes any action to implement or enforce this Declaration Qf Easement and

Maintenance Obligations; the Owner of the Lot to which an affected easement is appurtenant
shall be liable to the ASSOCIATION for costs and attorney's fees, which shall constitute a lien
against the Lot and Unit of such Owner, and ASSOCIATION shall have all remedies available
for payment of such obligation as set forth in Article V of the Declaration, including, but not
limited to, reimbursement of costs and attorney's fees.
7. Any sal~ contract with regard to the Lots and Units on which the easements

described on Exhibit "A" or Exhibit "B" attached hereto are appurtenant shall contain a

provision notifying the proposed purchaser of the terms of this Declaration of Easements and ·
Maintenance Obligations.
8. General Maintenance of Exterior of Townhome Buildinp. SHLESINGER
intends to construct attached townhome buildings as set forth on Exhibits "A" and "B". Because
the anticipated construction is different from other Units within the Boynton Lakes North
development, the parties recognize that the Declaration's Covenant for Maintenance must be
supplemented. Thus, each owner of a lot subject to the provisions of this Declaration of
Easements and Maintenance Obligations shall be jointly and severally responsible and liable for
exterior (including, for the purposes of this sections, roofs) maintenance with all other owners
of lots which share a townhome building. Similarly, if any owner of a lot subject to the
provisions of this Declaration of Easements and Maintenance Obligav.ons desires to change or
alter the exterior appearance of the building or portion of lot, then all owners sharing the
owr.er's townhome building must join in the owner's written request for the alteration. The
Association may enforce this covenant in the same manner as the Association may enforce any
provision of the Declaration, and the lot owner shall pay the Association's attorney's fees and
costs for any Association effort to enforce the provisions of this paragraph "8".
9. SHLESINGER acknowledges on its own behalf and on behalf of its successors
andlor assigns that each of the 41 lots of Boynton Lakes Plat No.5 owned or to be owned by
SHLESINGER shall at all times be responsible for its full prorata share of homeowner
maintenance payments to the ASSOCIATION as a lot owner, regardless of any developer status
SHLESINGER may acquire. "
