Re: Request for Platting Exemption - warnke
Dear Mr. Shuey:
Planning and Zoning Director Heyden has denied approval of an
exemption to platting for the Warnke property for two reason, as
follows:
1. Adequate access to the easternmost lot is inadequate, and
2. The proposed property line between the two lots is close
to, but does not mirror, the zoning line separating
commercial zoning from residential zoning.
Her position apparently is that these two circumstances can only be
resolved through the platting process. If you have specific
questions for her, she can be reached at 375-6261.

The attached material has been submitted to this office to obtain
an ~xemption to platting. It is our opinion that subject parcel is
indeed eligible for exemption according to LDR Chapter 5, Article
II, pages 5-1 and 5-2. If you are in agreement (see Section 2,
page 5-2) please countersign the extra attached copy of this memo
and return to my office. If you do not agree, please so indicate
and advise your rationale.

Dear Mr. Hukill:
In response to your recent letter, enclosed please find a sealed boundary
survey dated September 18, 1995, which shows the parcel and legal description
for the portion of Mr. and Mrs. Warnke's property which they wish to subdivide.
For your reference, I also enclose a copy of a sealed survey dated July 12, 1990,
for the entire parcel which has attached the surveyor's July 24, 1995, legal
description for the parcel to be subdivided.
