Heyden Planning and Zoning Director DATE: February 9, 1996 SUBJECT: Charter Drive North, Parcel "C" - Abandonment ABAN 95-013 NATURE OF REQUEST Stuart Cunningham, agent for the Hunters Run Property Owners Association, the property owner adjacent to Parcel "C", is requesting abandonment of Parcel "C" - a portion of the Charter Drive North public right-of-way and Summit Drive private right-of- way. The attached Exhibit "A" is a location map which shows the parcel requested to be abandoned and its relationship to the Charter Drive North right-of-way and the Summit Drive right-of-way. The attached Exhibit "B" contains a legal description and survey of the proposed abandonment. BACKGROUND The agent originally indicated that the limits of the subject abandonment request, Parcel "C", is surrounded by right-of-way that was previously abandoned by the City. A search of City files and the submitted supporting documentation by the agent indicate that the portion of the Charter Drive North right-of-way west of Congress Avenue and north of Summit Drive was not previously abandoned and still belongs to the City. A separate and concurrent request for right-of-way abandonment adjacent to parcel "C" has been submitted by the agent under the reference number ABAN-95-012 and is scheduled to be heard at this same meeting. ANALYSIS The application indicates that the reason for the abandonment request is to abandon surplus right-of -way. It is noted that a portion of parcel "C" protrudes into the Summi t Drive right -of -way. The origin of this protrusion is not quite understood. The Engineering Department has expressed concern that access to Parcel 103, vacant and located immediately west of the terminus of Charter Drive North would be limited if this abandonment were approved (see Exhibit "C" - the Subject Site and Surrounding Area) . The applicant's reasons for filing this abandonment and the grounds that support the request are included in the attached Exhibit "D" - Application. The City departments involved in review of the request for abandonment and the utility companies notified of the request are identified below. Public notice was given to the property owners that abut the right-of-way to be abandoned and has been advertised in the newspaper. Utilities Easements for underground sewer and water lines need to be provided (legally described and recorded) . Planning and Zoning It is recommended that a portion of the Parcel "C", south of the northern alignment of Summit Drive right-of-way should be abandoned as shown in Exhibit F. PUBLIC UTILITY COMPANIES Florida Power and Light No response Southern Bell No response Florida Gas Company No objection Cable Company (Comcast) No objection The following is a description of the zoning districts and land uses of the properties that surround the subject request (see Exhibit "A" - Location Map) . North Charter Drive North and farther Chanteclair Villas, Condos, zoned (Multiple-family Residential) north R-3 East Hunters Run, zoned PUD South Privately owned Summit Drive right-of-way and farther south is Hunters Run PUD West Charter Drive North and farther west is vacant parcel 103, zoned R-3 (Multiple-family Residential) RECOMMENDATION Staff recommends denial of this abandonment request as submitted, but would support abandonment of that portion of parcel "C" shown in Exhibit "F". However, if approval is granted, it should be subject to the following conditions, which shall be addressed prior to adoption of the abandonment resolution: 1. If easements are requested by Florida Power and Light and Southern Bell they shall be legally described and recorded with Palm Beach County. 2. Easements requested by the Utilities Department shall be prepared and recorded. 3. The Hunters Run Property Owners' Association shall provide a permanent access easement to parcel 103 to the satisfaction of the Engineering Division. There is no legal description attached (LOR Chapter 22. Article III. Section 2, Paragraph B. Page 22-6). Reason given (that property is surplus) is only true if it does not deny access to any adjacent property (LOR Chapter 22. Article III, Section 2, Paragraph D. Pg.22-6). No unity of title or written acceptance of all adjacent property owners was submitted (LOR Chapter 22, Article III. Section 2, Paragraph E. Page 22-6).
