NATURE OF REQUEST
As indicated in the attached letter from Douglas McMillen (Exhibit
"A"), property owner of the Boynton Festive Center, dated March 22,
1995, Mr. McMillen is appealing an administrative determination
regarding the building material and design changes resulting from
a change in one of the tenants proposed at the Boynton Festive
Center. Originally Best Buy was proposed at the center, Circuit
City is now proposed. The substitution results in building facade
changes that are depicted on Exhibit liB". The Boynton Festive
Center is under construction at the northwest corner of Congress
Avenue and Old Boynton Road. This request is being reviewed under
the new Community Design Plan adopted March 21, 1995.
BACKGROUND
The Boynton Festive Center project was approved by the City
Commission in July of 1994. That site plan approval of the project
included a main building consisting of 88,489 square feet which
included two tenants; The Sports Authority at the north end and
Best Buy at the south end (see Exhibit "c" - site plan). At time
of site plan approval, Commission granted relief from the window
and wall accessory requirements of the Modern District of the
former Community Design Plan. The main building is parallel with
Congress Avenue and set back approximately 621 feet from the right-
of-way. Site plans have been approved for two leased restaurant
outbuildings; a Red Robin and a Longhorn Steaks. These
outbuildings front on Congress Avenue and are 70 to 80 feet from
the right-of-way. The Longhorn building is presently under
construction.
The dominant colors of the main building are coconut cream (Sherwin
Williams SW 3253 - Sundrop) and dusty rose (Sherwin Williams SW
2281 - Reddish Dusk). The exterior wall material is a combination
of stucco and split face block.
The exterior of the Sports Authority tenant space consists of split
face block at the lower eight (8) feet of the front wall. The
remainder of the walls have a stucco finish with vertical grooves
spaced around the building to break-up the mass of the stucco
finish. A white band is used as an accent feature.
All of the walls for the Best Buy tenant space are predominately
split face block. A black accent metal coping is specified around
the top of the walls. A blue sand-blasted textured, synthetic
stucco finish is specified for the front entry feature which
includes a large red storefront with clear glass.

ANALYSIS
The applicant has assured staff that the Sports Authority facade
will remain as previously approved. The applicant is requesting
that the City Commission allow the following changes to take place
for the Circuit city portion of the main building:
1. Omit the split face block from the upper portion of the front
of the building.
2. Omit the black metal coping around the top of the walls and
replace with brushed mill finish metal.
3. Omit the blue entry feature and replace with a maroon colored,
metal entry. The entry feature has a cylindrical shape that
extends 5 to 10 feet above and out from the main wall of the
building. The entry feature also includes a red storefront
which is smaller in scale than the Best Buy storefront.
The remainder of the exterior walls will remain basically as
previously approved.
The components of this request that are of issue are the
unarticulated cylindrical, metal form proposed for the entry
feature; the combination of the maroon and red colors, maroon being
a new color added to the center; and the elimination of the split
face block. These aspects are contrary to the use of materials on
the other buildings on the site and the adjacent tenant facade,
causing a significant reduction in the unifying elements of the
outbuildings and tenants.
RECOMMENDATION
For the reasons stated above, staff recommends denial of the
request as submitted. However, staff recommends the following
changes be accepted for the proposed Circuit City facade:
1. Omi t the metal coping trim proposed around the top of the
walls and replace with the white and dusty rose projecting
trim matching the design, material and color specified on the
Sports Authority facade.
2. Change the front wall material and color which is not
specified on the plans to match the front of the Sports
Authority, thereby lending continuity in the facade for the
main building through the use of color and materials.
3. Omit the maroon colored, formed metal, cylindrical shaped,
entry feature and replace with maroon colored, split face
block. The split face block shall have right angle corners
rather than radii and be laid in a stack bond pattern to match
the other split face block specified for the building. The
white and dusty rose, projecting trim will continue around the
top of the entry feature.
4. Change the color of the red, metal, swinging doors and
overhead doors to a color that is more compatible with the
color of the walls of the building.
5. Change the color of the red storefront to white which will
match the Sports Authority storefront.

staff believes the proposed recommendations will unify the design
elements while maintaining the individual tenant identity. All
documents shall be amended to comply with the final Commission
determination of this request. Each exterior material shown on the
plans shall be identified by color name, color number or
designation and manufacturer.

Thank you for reviewing our updated plans reflecting the
substitution of Circuit City for Best Buy.
It is my understanding that your department has approved the
modifications to the parking lot and the modifications to
the Best Buy store footprint.
It is my further understanding that once Mike Haag
determines that the color "Red" used for Circuit City's sign
is compatible with the color "Red" used for Longhorn Steaks
sign, your department will approve the pylon sign and the
Circuit City sign.
Regarding the Circuit City elevations, I understand that
your department believes that some of the materials used on
the Circuit City elevations is not compatible with the other
materials used on the balance of the elevations at the
project. Since Circuit City feels very strongly about using
these materials, as they are used on a nationwide basis, we
would like to appeal the decision to disapprove their
elevations.
I'll file the appeal by Monday, March 27, 1995 in order to
make the meeting on April 4, 1995. At that time I'll meet
with Mike Haag to determine the drawings to be used.
