Dear Mr. Haag:
I appreciate the opportunity to meet with you and Ms. Heyden the
following day after the "Planning and Development Board Meeting".
As per the Boards recommendation, we met to further refine our sign
criteria. We felt great pressure from the city to make the canopy
signs as uniform as possible. In response, we agree to the
following:
Anchor Tenant
Anchor Tenant, as we agreed during the meeting, is defined "as all
tenants in line that meet or exceed 10,000 s.f.". We agree to your
recommendation as listed with your memorandum dated December 10,
1993 to the Planning & Zoning Board which allows anchors to use
their established logo type and face color. An anchor does not have
to use a raceway, and may have a (5) five inch margin on the top
and bottom vice (12) inches.
Outparcel Building
We agree with your recommendations listed on the same Planning &
Zoning memo allowing users to use their logo and face color if they
have an established sign. Note: An outparcel building does not
necessarily need to use a raceway.
In-Line Tenant
As per our discussions both the developer and city staff agreed to
the following revisions to your original recommendation.

Please place the above-referenced item on the City Commission
agenda for Tuesday, December 21, 1993, under Development Plans,
Non-Consent Agenda.
DESCRIPTION: Fru-Con Development Corporation, part owner of
Boynton Lakes Plaza, is requesting an appeal of the
administrative determination made by the Planning and Zoning
Department to deny the requested modifications to the 1990, sign
program approved for the shopping center. Denial was based on
lack of visual harmony of the proposed signs; specifically
coloring, letter style and configuration.
EXISTING SIGN PROGRAM
The existing sign program allows letter styles to be used that
are associated with a corporate logo, however, the color is
limited to "Terra Sand". All other tenant signage would be a
Fritz Quadrata letter style of the "Terra Sand" color. Logo
symbols are not addressed.
PROPOSED SIGN PROGRAM
All tenants that have a corporate identity would be allowed to
use their logo letter style, design symbols and colors. All
other tenants would be limited to the Fritz Quadrata letter style
and red signage.
RECOMMENDATION: The Planning and Development Board, with a 3-2
vote, recommended approval of this request, subject to staff's
revised sign program conditions set forth on page 4 and 5 of
Planning and Zoning Department Memorandum #93-312 and subject to
no signage being placed on the building towers, except the north
face of the tower that is located at the entrance to Walgreen's.
Briefly, the main points contained within staff's recommended
revised sign program are as follows:
Non-Anchor Tenant within Main Buildinq
a) Logo signage may include logo letter style, design,
symbols and color.
b) Each tenant's logo signage is limited to 30% of the
total allowed tenant signage; remaining 70% shall be
Fritz Quadrata letter style with individual internal
illuminated channel letters that have red faces and
dark bronze returns.

RECOMMENDATION: (Continued)
c) Maximum height of any Fritz Quadrata letter shall
not exceed 30 inches.
d) The allowable tenant sign length shall be a maximum
of 80% of the width of the tenant frontage.
e) The allowable tenant sign width is the area 12
inches down from the top of the sign fascia and 12
inches up from the bottom of the sign fascia.
Anchor Tenants
a) Logo signage allowed.
b) If no logo, then the letter style shall be Fritz
Quadrata, individual internal illuminated channel
letters. Letter face shall be red; returns shall be
dark bronze.
c) Signage shall not be closer than 12 inches from the
top and bottom of the sign fascia.
d) Signage is limited to the front (west or north
sides) of the main building.
e) Anchors shall be a minimum of 14,000 square feet
(gross floor area).
Outparcels
a) Logo signage allowed.
b) If no logo signage, then b) under anchor tenants
above shall apply.
On Wednesday, December 15, 1993, the day following the Planning
and Development Board meeting, the applicant informed staff that
he has reconsidered some of the modifications proposed due to
comments from staff and the Planning and Development Board. His
reconsiderations will be available in letter form to the
Commission at the City Commission meeting.

Again, I want to thank you and Mike for your participation in the
telephone conversation with Walgreen's and myself.
stuart Wilson, the developer's field representative, should be
arriving in your office today to make the modifications to our sign
application. We understand that the Planning Board is scheduled to
meet December 14, 1993, and the Board of Commissioners on December
21, 1993. We will be present for both meetings.
Enclosed lS a copy of our April 29, 1993 letter with the sign
criteria package that we provided Chris Cutro. We would appreciate
the staff review of this situation as we are seeking approval of
Walgreen's red signage as quickly as possible. The delay of this
sign approval has a direct impact, as discussed, on Walgreen's
moving into the center.
In response to your question about Winn Dixie's sign that has been
permit.ted, "Winn Dixie" has a white face and "Marketplace" a red
(#2793 RED LEXAN) face.
I recently learned another concern from Mr. Harms about the "terra
sand" color, a color we did not choose, but the city is requiring
us to use. since this color is not a common sign color, the color
has to be specially made by each sign company that is hired by the
tenant. This could cause inconsistencies in shade throughout the
various signs.

Dear Mr. Goins:
The Engineering Department for the City of Boynton Beach, Florida
is in receipt of the above referenced letter of inquiry and herein
provide a response to questions contained in paragraph #2 of your
letter.
1. I've spoken to Mr. Cutro and according to him, the requirement
to place maximum square footage for the shopping center on the
plat documents for both Tract A & Tract B was originally
generated by the Planning & zoning Director, as a direct
result of our initial meeting with Mr. Jacobe (the previous
owner) and representatives of Lennar wherein Lennar and Mr.
Jacobe agreed to "cover under the umbrella of vesting",
Lennar's tract as part of the shopping center tract. The
maximum square footage for the shopping center as set forth on
the original plat was determined to be a "vesting point"
established and based on the maximum square footage of the
original approved 1988 site plan (in accordance with the
County's Traffic Circulation Plan). It is my understanding
that in order to increase this number, a current traffic study
should be submitted by your group to Palm Beach County and the
City for our evaluation.
2. Since the Honorable Mayor, City Engineer and City Clerk, as
well as others have executed the plat document, an amendment
to the plat document shall be performed by replatting the
affected sheet. Such action must be approved by the City
Commission. Should A.G. Development Group propose other
alternatives, they may contact the City Attorney, that being
Mr. James Cherof, at #(407) 375-6050 for assistance.

Dear Mr. Haag:
Per the Planning Departments directions and with your assistance please find enclosed a revised
signage criteria for the tenants fascia signs. These revisions are being made in order to clarify
the limited information provided on the approved 1990. In addition to the clarification we are
also requesting a color change to the letter faces. This change is at the recommendation of
different sign companies we spoke to because there would be no way to assure consistent color
quality since the original color is not a standard manufactured color and could vary on different
manufactured acrylics. The requested color has already been approved for use in the Winn Dixie
slgnage.

quality since the original color is not a standard manufactured color a.nd could vary on different
manufactured acrylics. The requested color has already been approved for use in the Winn Dixie
signage.

Please be advised that, after reviewing "The Boynton Beach Sign
Ordnance", the owners of the above referenced project do hereby
adopt chapter 21 SIGNS "The Boynton Beach Sign Ordnance" as the
projects approved sign criteria.
Further it is the intent of said owners not to restrict the
individual tenants as to color or style of signs.
All signs must be submitted by each Tenant to the Owner for his
approval prior to application for sign permit. Owner will attach
a cover letter noting his approval.
The persons who will be representing the owner in their approval
will be Mr. Terry Harms or Mr. Jim Tepper. Either one can approve
the Tenant's signs. They can be reached at 314-391-6700 if you
need to talk with them.

I am writing to clarify the purpose of the sign criteria that was supplied, at your request, by Mr.
Stuart Wilson. This sign criteria is what the Landlord is requiring for the small shop tenants.
It has never been the Landlord's intent to limit the anchor tenants signage to these requirements.
The Landlord considers Winn Dixie and Walgreens as the anchor tenants for Boynton Lakes
Plaza.
The Landlord's requirements for the anchor tenants signage is simply that their signage meets the
local signage codes of the mWlicipality. I would ask that you review the anchor tenants sign
permit applications separate from the criteria supplied by Mr. Wilson and only apply the City's
code requirements to their application requests. I would also ask that their permits be released
prior to the Tenant receiving their C.O.. They would customarily have their signs fabricated and

bottom edge of the sign band and use acrylic type
face material.
