The Recreation & Park Department has reviewed the Boynton Nurseries
masterplan and preliminary plat documents. The following comments
are submitted:
1. In accordance with Recreation & Park memorandums #94-320 and
#94-342, masterplan and preliminary plat documents now reflect
the 2.84 acres recreation dedication as agreed by the
developer and the City Commission. The remaining dedication
requirement will be paid in cash.
Three hundred seventy-three single family units at .018 acres
equals 6.714 acres. 6.714 acres divided by 2 (1/2 credit for
private recreation) equals 3.357 acres.
3.357 acres minus 2.84 acres provided = .517 acres cash.
2. The following recreation elements are noted on the masterplan
qualifying for one-half credit:
1. Children's Play Area
2. Basketball Court
3. Tennis Courts
4. Swimming Pool
5. Recreation Center Building
3. Private recreation facilities and equipment must be of
commercial grade and of sufficient size and scope needed to
provide for the recreation of the residents of the sub-
division.
4. Approval of recreation equipment by this department will be
required prior to issuing a construction permit.

Preliminary Plat review
Our comments on the subject preliminary plats and accompanying plans are as follows:
Plat I
1) Water and sanitary sewer systems within Tract A must be within suitable utility
easements, or the Tract may also be dedicated as a utility easement for potable water and
sanitary sewer only. (Sect. 26-33)
2) The terminal blow-offs for the water main in Victoria Bay Court shall be replaced with
flush hydrant assemblies, so as to allow frequent flushing of this dead-end line at both
ends.
3) The water and sanitary sewer systems will require an HRS permit. We recommend the
project engineer meet with Utilities staff to discuss corrections that must be made prior to
submitting their application. Many of the details shown do not reflect this Department's or
HRS criteria.
Plat II
1) Water and sanitary sewer systems within Tract A must be within suitable utility

2) Tract C is mislabeled as the Lift Station tract. Please correct this, and correctly label

On Tuesday, December 27, 1994 I substituted for Lt. Cummings as the Police
Department's representative at the T.R.C. meeting. The Nautica Development was
discussed and an issue was raised with regard to traffic flow involving the two
entrance/exits at Lawrence Road of this site. It appears that a traffic study was done,
prior to the installation of a traffic signal at Citrus Cove Elementary, and that the
study made some recommendations regarding designated turn lanes for those vehicles
exiting the development.
However, at this meeting, the developer requested that the left turn & thru lanes be
combined and a designated right-turn lane be created. Previous discussions
apparently indicated the opposite should take place, namely the right turn & thru
lanes should be combined and there should be a designated left-turn lane.
Due to the confusion, I will refer this matter to Lt. Cummings upon his return from
Vacation on January 9, 1995. As the former Traffic Coordinator, he is much more
qualified to determine the proper recommendation for these intersections.

Upon retwning from vacation, I received the attached memo from Lt. Yannuzzi indicating that
there was unresolved discussion at a TRC meeting regarding the egress at the Nautica
Development, onto Lawrence Road.
It is my opinion that traffic leaving the proposed site do so by way of two lanes, which are clearly
indicated on the plans provided. The left turn lane should be for only that purpose, while the right
lane should act as both a right turn lane and a through traffic lane. This will provide the most
efficient traffic flow, while also complying with DOT standards regarding intersections.

It has come to my attention that the traffic signal at the entrance to Nautica, on Lawrence Road,
is not going to be a continuous signalized intersection at the present time. With this in mind, I see
no reason that the lane markings cannot remain as they are on the plan. In the event that it causes
a problem later in the project, the developer has agreed to revisit the possible problem. I
recommend this plan go forward.

1. Verify that the dimension of the frontage of the following

Section 3 of the Nautica Declaration of Covenants,
Restrictions, and Easements shall be consistent in specifying
the Home OWners Association having the perpetual
responsibility of maintaining the landscape material located
in the buffer easements.

2. To properly evaluate the document titles, "Declaration of
Covenants, Restrictions and Easements for Nautica", provide
for staff review complete exhibits. If the property
identified in exhibit "A" does not include the entire PUD,
provide for review the supplemental declaration documents
identified in Article I Section 2.
3. Modify, Article II, Section 4. C, of the Nautica Declaration of
Covenants, Restrictions and Easements, to specifically
identify the location of the referenced "landscaped areas or
grassed areas". It is recommended that the text "conunon
ground" be added before the text "landscaped areas or grassed
areas". A definition of "common ground" shall be added to the
association documents.
4. Modify, Article II, Section 4.G of the Nautica Declaration of
Covenants, Restrictions and Easements, to include text that
requires the association to maintain the tree preserve area
(Tract "D").
NOTE: A copy of this memo is being transmitted to the City
Attorney for inclusion with his association document
conunents.
General Comments for Both Plats
1. Provide written verification that the following issues have
been complied with:
a. Dedication to the City of Boynton Beach, for public park
purposes, 3.01 acres is proposed. In addition to this
public park dedication, the cash value of .356 acres of
land would have to be paid at time of platting.
[Previous staff comment #18 from Planning and Zoning
Department memorandum dated September 29, 1994].
b. A posting of a bond for fifty (50%) percent of the cost
of the pedestrian signalization for Lawrence Road shall
be submitted with the plat documents.
c. The private recreation facilities shall be bonded with
approval of the first plat and completed within 21 months
of approval of the first plat. [Previous staff comment
#11 from Planning and Zoning Department memorandum dated
September 29, 1994].
d. The rectified master plan shall have the unconditional
signoff by all Technical Review Committee staff prior to
plat approval.
2. The buffer easement landscape material shall be completed
within twenty-one (21) months of approval of each plat.

Resolution of landscaping and utilities conflict
I would like to thank you both for the time you spent with members of my staff on resolving these
important issues. Following is our understanding of the changes which must be made in the landscaping
and/or utilities plans for these projects:
NAUTICA PLATS 1 & 2
80-foot wide ri~ht-of-way
1) Relocate proposed water main to the back edge of the bicycle path (Le. between bicycle path
and property line);
2) Eliminate trees proposed along the property/right-of-way line, and replace with shrubs as
desired.
50-foot wide ri~ht-of-way
1) Relocate trees to the back edge of the sidewalks along both sides of the street.
THE VININGS
1) Along the east landscape buffer which co-exists with a utilities easement, the cross-section plan
indicates a raised berm which is approximately centered over the proposed water main. We have
no objection to the plantings east of the water main being changed to scrub oak, installed via hand
digging. Landscaping west of the water main shall remain as shown or be reduced to hedges and
sod without any trees. Shrubs may be installed over the water main, but the scrub oak must be
offset a reasonable distance to avoid damaging the main during installation.
2) For the existing sanitary manhole adjacent to building no. 11, a stabilized access way will be
required from the pavement to the manhole, or the manhole may be relocated southward to a point
that is accessible from the pavement.
We would be pleased to meet with the developers of these two projects to discuss the changes if you agree
with them as stated. Please refer any further questions on this matter to Peter Mazzella of this office.

TRAFFIC OBSERVATIONS - LAWRENCE ROAD
The 1994 average traffic count on Lawrence Road between NW 22nd
Avenue (Gateway) and Hypoluxo has been reported to us by the County
to be 7972 trips. The current FDOT Level of Service Manual defines
the threshold traffic level for LOS D for 2 lane undivided streets
as 13,400 trips.
Those two numbers are important in studying Lawrence Road traffic
because the Palm Beach County Traffic Engineering Division has
informed Mr. Hall of this office that widening of two lane roads in
the County system is not seriously considered until LOS D is
reached. Lawrence Road is a County road.
The Traffic Division has also opined that about 1000 more units can
be occupied on Lawrence Road before LOS D is reached. Well over
1000 more units have been approved by either the City or County, as
follows:

The figure 1680 is not propounded to be exact, because each of the
entries marked "unbuilt units" represents our estimate of how many
units remain to be occupied in uncompleted developments. Traffic
from occupied units appears in actual traffic counts totaling 7972
trips. We believe it is reasonable to predict that when all
unoccupied units in all listed developments are in place, the Level
of Service Standard will exceed LOS Standard E, which is 15,000
trips. LOS D will be reached when approximately 2/3 of the 1680
future units are occupied.

We have been unable to obtain accurate estimates of revenue
collected from dwelling units now contributing to the 7972 trips on
Lawrence Road. If we assume 1600 dwelling units have generated
those trips, and the average traffic impact fee collected was $1500
per unit, the total fees generated to date exceed $2,400,000. The
total fees due from 1680 additional units will exceed $2,500,000,
representing a total at build-out of $5,000,000~ generated by these
developments to be spent in the immediate area. These numbers are
estimates, of course, and should be adjusted for traffic impact
fees generated by other users who pay such fees (commercial, etc.)
and those who don't (schools).
Our conclusion is that it is time for the County to begin planning
for widening of Lawrence Road so that when LOS D is reached, action
can be immediately implemented to begin construction. A four lane
undivided road will support 23,520 trips at LOS D, which is
adequate for all completed and currently proposed development along
Lawrence Road.

We have received your plat and plan review comments dated December 16, 1994 for the above
referenced project and offer the following in response:
Nautica - Plat I:
1. A minimum five (5) foot wide limited access easement has been added to the plat along
Lawrence Road and Tract "B" and will be dedicated to the City of Boynton Beach. A
limited access easement is not required for properties adjacent to the LWDD L-21 Canal.
2. Signage easement has been labeled.
3. Dedication notes have been revised.
4. The minimum width for lots on a curve will be 75 % of the minimum width requirement
(40' for "z lots" and 50' for "zero lots") established at the setback distance from the
right-of-way. These lots meet the minimum width at the setback line.
5. A surveyor's note regarding building setbacks has been added to the plans.
6. Plat and plan title has been revised to include "P.D.D".
7. The zero lot line symbol is shown on the paving, grading and drainage plans. Lots
without a symbol indicate a "floater".

During our meeting to discuss the response to comments for the above referenced project, it was
noted that a couple of the items were not sufficiently addressed to your satisfaction. The
following responses shall supersede our letter dated January 17, 1995.
Comment 4
Surety requirements will be met prior to final plat approval. A copy of the engineer's estimate
for on-site improvements is enclosed for review. Please verify the surety amount so we can
promptly notify the developer of the bond requirement.

A certification letter has been provided with this resubmittal.
Comment 9
In addition to the water management calculations submitted previously, we are also providing
copies of the SFWMD criteria for water quality since we are proposing to meet this criteria in
the wet detention system. The suggested alternative of providing dry detention areas possibly
within the drainage easements, and swaling into the lake is unacceptable due to concerns
regarding lot grading. Additionally, out falling directly into a dry detention area is unlikely due
to the level of the water table and bubble-up structures tend to have siltation problems.
The proposed drainage collection system utilizes valley gutters, in lieu of swales for a tightly
controlled, unalterable path for storm water runoff within the subdivision, eliminating the
maintenance problems which are common to swale systems. Soggy areas of grass from water
trapped by driveways within the swale are practically unavoidable and become both unsightly
and a source of resident complaints to the City. In addition, it has been our experience that sod

build up due to repeated cuttings and edging ultimately cause areas of standing water in the
driveways which are again a subject of great concern to the residents. Although the valley gutter
system of drainage is substantia,lly more expensive initially, the resident's long term satisfaction
far outweighs the costs. We believe that the valley gutter system, as designed in conjunction
with the litteral plantings proposed for the water management tracts, meets SFWMD criteria and
will provide for adequate storm drainage, flood protection and water quality while reducing the
long term potential for drainage complaints from residents.
Therefore, we are requesting your consent, as the City Engineer, of the water management
system we are proposing. Should the City insist on modification of the drainage system design,
we would prefer to address specific concerns based on sound engineering principles in lieu of
citing City criteria.
Comment 10
Sumps that were added to the standard drainage structure detail, as requested, will be removed.
After reviewing the intent of our water management system as stated in comment 9, we noted
that these sumps will impede the flushing of the drainage system by collecting silt. These sumps
become a maintenance problem in a short period of time and provide no benefits when in a
submerged system. Sumps can be helpful in collecting silt prior to an ex filtration trench, but
are not recommended for standard drainage transmission systems.
Comment 16
We understand that City personnel will visit a few sites with pavement sections similar to the
proposed section prior to final approval
Section 8.3.4: (Revised underscored items)
The driveway width has been previously addressed through the site plan process. It was our
understanding that the 16' wide driveway was approved by City Commission.
Enclosed for final sign-off are two (2) sets of Nautica Plat One along with two (2) sets of the
paving, grading, and drainage construction plans for Plat One. Pending no additional plat or
plan comments, we will move forward with final platting. A prompt written response to the
surety requirements would be greatly appreciated.

Pursuant to receipt of your letter dated February 16, 1995, enclosed is a copy of the revised
Homeowner's Association documents for final review. Please forward a copy to the City
Attorney and to Mike Haag, Planning Department. His comments on the HOA documents have
been addressed and the lot widths in Plat II have been adjusted as required.
The form of surety for Nautica Plat I will be a bond, not a letter of credit, as stated to you on
the telephone recently. Also, the developer has decided to record only Plat I at this time. We
understand that an additional fee of $2,000.00 will be required during the final platting process
for Plat II.
We are anticipating the final plat to be scheduled for the March 7th City Commission for Plat
I. We will forward the bond and final plat mylars to your office before March 2nd as requested.

additional information will be required,

Pursuant to the issues discussed at the above referenced meeting, G.L. Homes
is in the process of finalizing the Homeowners' Association document for your
final review and approval. Based upon our meeting, it is our understanding that
the Homeowners' document should include the following items:
1. The individual lot owner shall be responsible for the proper maintenance
of that portion of the landscape buffer which occurs on that owner's lot.
2. In the event that the individual property owner does not properly maintain
the landscape buffer, the Association has the right to enter the property
and perform proper maintenance which will be billed to the individual
Homeowner pursuant to the mechanisms contained in the Homeowners'
documents.
3. The Homeowners' document shall contain appropriate maintenance
standards (one of the Exhibits) which shall be the basis by which the
Association can judge whether the landscape buffer is being properly
maintained.
4. The Homeowners' Association documents will contain specific language
regarding the need to maintain a uniformity to both the maintenance and
the aesthetic look of all landscaping within the landscape buffer.
5. Language shall be placed in the Homeowners' Association documents
allowing for the installation of individual fences within the landscape buffer

by individual homeowners. It is intended that these fences be
perpendicular to the planned common fence which will run along the
perimeter of portions of the Nautica project.
6. The fence referenced above will be specifically detailed in the
Homeowners' Association documents to insure that all fences are of
uniform design.
7. Language shall be contained in the Homeowners' Association documents
that any changes to the above referenced standards within the landscape
buffer areas by the Homeowners' Association will additionally require
approval from the City of Boynton Beach,
I believe that this listing accurately represents the final decisions we made in our
meeting. Unless I hear otherwise from you, I will assume that this list is correct
and our attorneys will continue to finalize the documents on this basis.
We appreciate your working with us to resolve these final issues. As we stated
in our meeting, we are striving to make Nautica a first class community which will
make the City of Boynton Beach proud.

This memo is in response to your March 22, 1995 Memorandum No. 95-081 which
was in response to my March 17, 1995 memo, I am in agreement with you that
the word "obligation" should replace the word "right" under item 2 and have
informed my clients as such. In regards to the other issues discussed at the
meeting, the perimeter landscape buffers and the timing of their installation was
determined. With regard to the installation of the buffer along the western and
northern property lines which require fencing, my recollection is that we agreed
that the installation would be completed prior to the issuance of the first Certificate
of Occuoancv of a unit along that buffer as opposed to building permit. If this
item is an issue, please let me know.
I would appreciate your reviewing and responding to my memo so that we can
both move forward on the project with a clear understanding regarding these
issues,

MARCH 7, 1995
Mayor Harmening said he voted against a lot of development as far as the number
of renewals on concurrency and site plan and master plan approval in the last
four years. He was against further development but said that there is not much
we can do in this case.
A roll call vote was polled by the City Clerk. The motion carried 3-2. Vice
Mayor Matson and Commissioner Katz cast the dissenting votes.
Mr. Sherr stated that the concern about the dust will be addressed. He was
willing to try to work out something to make this a little better for everyone.
Vice Mayor Matson felt it would benefit the project if Lawrence Road were to be
widened. She asked Mr. Sherr if we can count on his support when we go to the
County on this issue. Mr. Sherr said he will discuss this with his client and
get back to Vice Mayor Matson.
Mayor Pro Tem Bradley stated that the City's hands are tied and that if the City
were to stop construction, it could be placing itself in a dangerous position.
However, we can slow down future development. He pointed out that development
works both ways. Businesses have prospered because the population in Boynton
Beach and surrounding areas has increased. Development has also created jobs
for people in the construction industry. Four or five years ago, these people
were out of work. However, there is a price we all have to pay for these
things.
He stated that it is important for the Commission to get input from the people
and to know where they want this City to go. He said somebody suggested this
evening that the City buy the land and turn it into a park. He advised that
this can happen. However, it means reaching into our pockets and paying for
it. He appreciated the input from the people and stated that the Commission has
their interests in mind. He advised that the City Manager and the Commission
have already taken steps to try to resolve the problems regarding Lawrence Road.

City Attorney Cherof advised that the process for this hearing is exactly the
same as the last one. Anybody who wishes to testify needs to be sworn in,
including staff members.
Tracy Robb, 2410 Palm Road, the engineer on the project, was sworn in by City
Attorney Cherof. She stated that the plans she submitted comply with the City
requirements. She requested approval of the plans and plat.
Motion
Mayor Pro Tem Bradley moved to approve Nautica - Plat 1, request for approval of
the construction plans on the northwest corner of Lawrence Road and the L.W.D.D.
L-21 canal. Commissioner Aguila seconded the motion. He asked that the maker
of the motion include in his motion a specific finding that the minimum code
requirements have been met. Mayor Pro Tem Bradley agreed to include this in his
motion.
Commissioner Katz said he will vote against this, based on his comments with
regard to the previous project~
The motion carried 3-2. Vice Mayor Matson and Commissioner Katz cast the
dissenting votes.
IX. NEW BUSINESS
A. Items for discussion requested by Vice Mlyor Matson
1. Report on trip to Bass Pro in Springfield, Missouri
Vice Mayor Matson stated that on February 22, 1995, she went with City Manager
Parker and Planning and Zoning Director Heyden to Springfield, Missouri to tour
Bass Pro's retail establishment. She advised that it is not your basic retail
establishment. It is an environment with four levels, a waterfall, indoor
aquariums, a rifle range, and a driving range on site. They toured the museum,
the 600,000 square foot distribution center, and the catalog center, and were
very impressed with this facility.
Vice Mayor Matson said it is absolutely phenomenal and she thinks we should try
to bring Bass Pro i~to the City. She said Bass Pro is considering two sites in
South Florida; one here and one in Broward County. However, a lot hinges on the
County, the State, the City, and the present owner. They are looking for a spe-
cial bill to go through legislation. They are also looking at a Department of
Commerce interpretation. Ten to twelve items are still in discussion stages.
In the near future, Bass Pro will be presenting a fonmal proposal.
Vice Mayor Matson advised that the Tourist Development Council also took the
trip to Springfield. They have set up an Ad Hoc County Committee for tourist
development and incentives.

Mayor Hanmening advised that a recreational vehicle cannot be parked in a swale.
In addition, it has to be parked on hard stands.
Ms. Heyden asked if the Commission is directing staff to delete this policy from
the Comprehensive Plan. Mayor Hanmening answered affinmatively.
3. Proposed Ordinance No. 095-04 Re: Community Design Plan
City Attorney Cherof read Proposed Ordinance No. 095-04 by title only.
No one wished to speak in favor of or in opposition to this proposed ordinance.
Therefore, Mayor Hanmening declared the public hearing closed.
Motion
Commissioner Aguila moved to table Proposed Ordinance No. 095-04. Mayor Pro Tem
Bradley seconded the motion, which carried 5-0.

PROJECT HISTORY
Nautica is located on the west side of Lawrence Road at Citrus Glen
Boulevard. This project, when completed, will contain 177 single
family units on the 42.06 acre site resulting in a density of 4.155
units per acre. Plat documents prepared and submitted by Lawson,
Noble and Associates, Inc. for the Developer have been reviewed by
this writer. The final plat resolution has been prepared by City
Attorney James Cherof who has indicated approval of dedication
sheets and maintenance statements and further indicated that the
plat dedication sheet mirrors the agreement between the City and
Developer (HOA) and/or the HOA documents, and that onsite/offsite
landscaping agreements are acceptable.
DEVELOPMENT DEPARTMENT COMMENTS
The Development Department recommends approval of the final plat of
Nautica Plat I as the Developer has substantially complied with the
provisions set forth in City Code of Ordinances, Appendix C,
Subdivision and Platting Regulations. Surety in the form of a
Performance Bond in the amount of $1,246,229.71 has been posted by
the Developer and is being held by the Finance Director. The
Finance Director and City Attorney have reviewed and approved the
surety. All fees have been received, as have approval from
requisite governmental agencies. The Maintenance Agreement has
been reviewed and approved by both the City Attorney and the Parks
and Recreation Department.
RECOMMENDED CITY COMMISSION ACTION
The City Commission, if they deem it reasonable, should execute the
attached resolution authorizing approval of the submitted final
plat for Nautica Plat I; authorize acceptance of the Maintenance
Agreement; authorize the Honorable Mayor, City Engineer and City
Clerk to execute the plat document; and authorize recording of the
documents into Public Records of Palm Beach County Florida. Upon

Attached please find five copies of plat documents and associated
construction documents for required improvements at subject
location.
HISTORY The Planning and Development Board has previously reviewed
and approved both master plans and site plans for subject project,
subject to staff comments. The City Commission and the Technical
Review Committee have similarly reviewed and approved master plans
and site plans.
Developer G.L. Homes has submitted plat and construction documents
to the City Engineer and to the Technical Review Committee and they
have been found to be in substantial compliance with State and City
regulations except that Utility Department approved documents
submitted to Palm Beach County have not yet received Health
Department approval.
RECOMMENDATION The City Engineer recommends that the Planning and
Development Board approve plat and construction documents for the
Nautica PUD Plats I & II subject to compliance with outstanding
staff comments and thereafter submit an appropriate recommendation
to the City Commission for placement on a City Commission agenda by
the City Manager.

One and Two) - Preliminary Plat and Construction Plans
Please be advised of the following Planning and Zoning Department
comments with respect to the above-referenced request:
Nautica - Plat One
1. Add to the plat documents a five (5) foot wide limited access
easement along the ultimate right-of-way of Lawrence Road,
L.W.D.D. lateral # 21 canal and along both sides of Tract "B".
The easement shall be omitted at intersections of right-of-
ways and the access points to the private and city park sites.
It is recommended that a limited access easement be placed at
the rear property line of the lots abutting both sides of
Bermuda Sound Way. The easements that border Lawrence Road,
L.W.D.D. and Tract "B" shall be dedicated to the City of
Boynton Beach and the proposed easement on Bermuda Sound Way
should be dedicated to the Nautica Homeowner's Association.
2,. Show and label on the plat drawing the location of the signage
easement identified in the dedication note 10.
3. In the plat dedication notes, that reference "without recourse
to Palm Beach County", omit the text "Palm Beach County" and
insert" City of Boynton Beach".
4. The Boynton Nurseries master plan identifies "z lots" as being
forty (40) feet wide and "Zero lots" as being fifty (50) feet
wide. Adjust the width of the following lots consistent with
the applicable type: [Appendix C Article VIII Section 5.]
Lots - 125,126,127,128,129,131,132,133,134,12,13,
14, 15, 16, 17, 18, 32, 33, 34, 35, 36, 95, 94, 93, 92, 91,
63, 64, 65, 66, 67, 68, 153, 152, 151, 150, 149, 148, 146, 145
and 144.
5. Add the following note to the surveyor's notes, sheet 1 of 4:
The building lines shall be consistent with the building lines
established on the approved master plan for the proj ect.

6. Add the following symbol to the title of the plat:

7. On the construction plans for paving, grading and drainage
improvements, also for the water and sewer improvements, add
the location of the zero lot line symbol to all lots. The
location of the zero lot line shall be consistent with the
location depicted on the master plan.
Nautica - Plat Two
1. Add to the plat documents a five (5) foot wide limited access
easement along Old Military Trial and L.W.D.D. lateral #21
canal. The easement shall be omitted at the City access along
Old Military Trial.
2. Add the text," City access easement" to the utility easement
dedication 10, or provide a separate dedication for the access
easement.
3. The plat drawing does not have a letter designation for the
lift station tract. The dedication note 3 identifies the lift
station as tract "c" and the plan depicts tract "c" as road
right-of-way to be dedicated to Palm Beach County. Correct
the inconsistencies accordingly.
4. The plat drawing indicates tract "c" as land to be dedicated
to Palm Beach County and the dedication note 4 identifies the
land as tract "D". Correct the inconsistency accordingly.
5. The plat drawing indicates the preserve area as tract "D" and
the dedication note 5 identifies the area as tract "E".
Correct the inconsistency accordingly.
6. In the plat dedication notes that reference, "without recourSE:

BOYNTON NURSERIES P.U.D. - PRELIMINARY PLAT
We are handing you herewith copies of a preliminary plat together
with construction drawings for your review. Please respond with
your comments by December 16 if at all possible.
The applicant hopes to amend the preliminary plat at that time, and
submit for final plat approval at the TRC meeting of December 27.
That seems very ambitious, but I hope you will do everything
possible to accommodate this plan.
By copy of this memo we are asking the Finance Department to
process and deposit the $2000 application fee.
