We are handing you herewith copies of a preliminary plat together
with construction drawings for your review. Please respond with
your comments by December 16 if at all possible.
The applicant hopes to amend the preliminary plat at that time, and
submit for final plat approval at the TRC meeting of December 27.
That seems very ambitious, but I hope you will do everything
possible to accommodate this plan.
By copy of this memo we are asking the Finance Department to
process and deposit the $2000 application fee.

Please be advised of the following Planning and Zoning Department
comments with respect to the above-referenced request:
Nautica - Plat One
1. Add to the plat documents a five (5) foot wide limited access
easement along the ultimate right-of-way of Lawrence Road,
L.W.D.D. lateral # 21 canal and along both sides of Tract "B".
The easement shall be omitted at intersections of right-of-
ways and the access points to the private and city park sites.
It is recommended that a limited access easement be placed at
the rear property line of the lots abutting both sides of
Bermuda Sound Way. The easements that border Lawrence Road,
L.W.D.D. and Tract "B" shall be dedicated to the City of
Boynton Beach and the proposed easement on Bermuda Sound Way
should be dedicated to the Nautica Homeowner's Association.
2. Show and label on the plat drawing the location of the signage
easement identified in the dedication note 10.
3. In the plat dedication notes, that reference "without recourse
to Palm Beach County", omit the text "Palm Beach County" and
insert" City of Boynton Beach".
4. The Boynton Nurseries master plan identifies "z lots" as being
forty (40) feet wide and "Zero lots" as being fifty (50) feet
wide. Adjust the width of the following lots consistent with
the applicable type: [Appendix C Article VIII Section 5.]

the location of the zero lot line symbol to all lots. The
location of the zero lot line shall be consistent with the
location depicted on the master plan.
Nautica - Plat Two
1. Add to the plat documents a five (5) foot wide limited access
easement along Old Military Trial and L.W.D.D. lateral #21
canal. The easement shall be omitted at the City access along
Old Military Trial.
2. Add the text," City access easement" to the utility easement
dedication 10, or provide a separate dedication for the access
easement.
3. The plat drawing does not have a letter designation for the
lift station tract. The dedication note 3 identifies the lift
station as tract "c" and the plan depicts tract "C" as road
right-of-way to be dedicated to Palm Beach County. Correct
the inconsistencies accordingly.
4. The plat drawing indicates tract "c" as land to be dedicated
to Palm Beach County and the dedication note 4 identifies the
land as tract "D". Correct the inconsistency accordingly.
5. The plat drawing indicates the preserve area as tract "D" and
the dedication note 5 identifies the area as tract "E".
Correct the inconsistency accordingly.
6. In the plat dedication notes that reference, "without recourse
to Palm Beach County", omit the text, "Palm Beach County", and

General Notes for Both Plats
1. A legally constituted maintenance association agreement is
required for improving, perpetually operating, and maintaining
all common facilities; including streets, drives, parking
areas, open space and recreation facilities. These documents
are subject to approval of the City's legal staff, and
required prior to final plat approval. [Appendix B, Section
11.D and Appendix C, Article VIII, Section 6.12.]
2. Dedication to the city for public park purposes of 2.84 acres
is proposed. In addition to this public park dedication, the
cash value of .517 acres of land would have to be paid at time
of platting. [Previous staff comment #18 from Planning and
Zoning Department memorandum dated September 29, 1994].
3. A posting of a bond for 50% of the cost of the pedestrian
signalization for Lawrence Road shall be submitted with the
plat documents. [Previous staff comment #14 from Planning and
Zoning Department memorandum dated September 29, 1994].
4. At both entrances show through/right turn lane exiting the
site to Lawrence Road. [Previous staff comment #13 from
Planning and Zoning Department memorandum dated September 29,
1994] .
5. The private recreation facilities shall be bonded with
approval of the first plat and completed within 21 months of
approval of the first plat. [Previous staff comment #11 from
Planning and Zoning Department memorandum dated September 29,
1994]
6. The rectified master plan shall have the unconditional sign-
off by all Technical Review Committee staff prior to plat
approval.

TRAFFIC OBSERVATIONS - LAWRENCE ROAD
The 1994 average traffic count on Lawrence Road between NW 22nd
Avenue (Gateway) and Hypoluxo has been reported to us by the County
to be 7972 trips. The current FDOT Level of Service Manual defines
the threshold traffic level for LOS D for 2 lane undivided streets
as 13,400 trips.
Those two numbers are important in studying Lawrence Road traffic
because the Palm Beach County Traffic Engineering Division has
informed Mr. Hall of this office that widening of two lane roads in
the County system is not seriously considered until LOS D is
reached. Lawrence Road is a County road.
The Traffic Division has also opined that about 1000 more units can
be occupied on Lawrence Road before LOS D is reached. Well over
1000 more units have been approved by either the City or County, as
follows:

The figure 1680 is not propounded to be exact, because each of the
entries marked "unbuilt units" represents our estimate of how many
units remain to be occupied in uncompleted developments. Traffic
from occupied units appears in actual traffic counts totaling 7972
trips. We believe it is reasonable to predict that when all
unoccupied units in all listed developments are in place, the Level
of Service Standard will exceed LOS Standard E, which is 15,000
trips. LOS D will be reached when approximately 2/3 of the 1680
future units are occupied.

We have been unable to obtain accurate estimates of revenue
collected from dwelling units now contributing to the 7972 trips on
Lawrence Road. If we assume 1600 dwelling units have generated
those trips, and the average traffic impact fee collected was $1500
per unit, the total fees generated to date exceed $2,400,000. The
total fees due from 1680 additional units will exceed $2,500,000,
representing a total at build-out of $5,OOO,000I generated by these
developments to be spent in the immediate area. These numbers are
estimates, of course, and should be adjusted for traffic impact
fees generated by other users who pay such fees (commercial, etc.)
and those who don't (schools).
Our conclusion is that it is time for the County to begin planning
for widening of Lawrence Road so that when LOS D is reached, action
can be immediately implemented to begin construction. A four lane
undivided road will support 23,520 trips at LOS D, which is
adequate for all completed and currently proposed development along
Lawrence Road.

I have reviewed item 2 in the March 17 Kilday letter and do not
concur with the word "right" in line two. It should be
"obligation" not "right".
The reference line and the content do not agree. Other issues \
were discussed not closely related to the HOA documents. One such
agreement was that no building permits would be issued along
western and northern property lines requiring fencing and planting
until all required elements were in place along the line (except /
sod on individual lots).

Pursuant to the issues discussed at the above referenced meeting, G.L. Homes
. is in the process of finalizing the Homeowners' Association document for your
final review and approval. Based upon our meeting, it is our understanding that
the Homeowners' document should include the following items:
1. The individual lot owner shall be responsible for the proper maintenance
of that portion of the landscape buffer which occurs on that owner's lot.

2. In the event that the individual property owner does t properly maintain
the landscape buffer, the Association has the' to enter the property
and perform proper maintenance which will i1led to the individual
Homeowner pursuant to the mechanisms contained in the Homeowners'
documents.
3. The Homeowners' document shall contain appropriate maintenance
standards (one of the Exhibits) which shall be the basis by which the
Association can judge whether the landscape buffer is being properly
maintained.
4. The Homeowners' Association documents will contain specific language
regarding the need to maintain a uniformity to both the maintenance and
the aesthetic look of all landscaping within the landscape buffer.
5. Language shall be placed in the Homeowners' Association documents
allowing for the installation of individual fences within the landscape buffer

by individual homeowners. It is intended that these fences be
perpendicular to the planned common fence which will run along the
perimeter of portions of the Nautica project.
6. The fence referenced above will be specifically detailed in the
Homeowners' Association documents to insure that all fences are of
uniform design.
7. Language shall be contained in the Homeowners' Association documents

Resolution of landscaping and utilities conflict
I would like to thank you both for the time you spent with members of my staff on resolving these
important issues. Following is our understanding of the changes which must be made in the landscaping
and/or utilities plans for these projects:
NAUTICA PLATS 1 & 2
80-foot wide ri~ht-of-way
1) Relocate proposed water main to the back edge of the bicycle path (i.e. between bicycle path
and property line);
2) Eliminate trees proposed along the property/right-of-way line, and replace with shrubs as
desired.
50-foot wide ri~ht-of-way
1) Relocate trees to the back edge of the sidewalks along both sides of the street.
THE VININGS
1) Along the east landscape buffer which co-exists with a utilities easement, the cross-section plan
indicates a raised berm which is approximately centered over the proposed water main. We have
no objection to the plantings east of the water main being changed to scrub oak, installed via hand
digging. Landscaping west of the water main shall remain as shown or be reduced to hedges and
sod without any trees. Shrubs may be installed over the water main, but the scrub oak must be
offset a reasonable distance to avoid damaging the main during installation.
2) For the existing sanitary manhole adjacent to building no. 11, a stabilized access way will be
required from the pavement to the manhole, or the manhole may be relocated southward to a point
that is accessible from the pavement.
We would be pleased to meet with the developers of these two projects to discuss the changes if you agree
with them as stated. Please refer any further questions on this matter to Peter Mazzella of this office.

Upon returning from vacation, I received the attached memo from Lt. Yannuzzi indicating that
there was unresolved discussion at a TRC meeting regarding the egress at the Nautica
Development, onto Lawrence Road.
It is my opinion that traffic leaving the proposed site do so by way of two lanes, which are clearly
indicated on the plans provided. The left turn lane should be for only that purpose, while the right
lane should act as both a right turn lane and a through traffic lane. This will provide the most
efficient traffic flow, while also complying with DOT standards regarding intersections.

On Tuesday, December 27, 1994 I substituted for Lt. Cummings as the Police
Department's representative at the 'f.R.C. meeting. The Nautica Development was
discussed and an issue was raised with regard to traffic flow involving the two
entrance/exits at Lawrence Road of this site. It appears that a traffic study was done,
prior to the installation of a traffic signal at Citrus Cove Elementar~ and that the
study made some recommendations regarding designated turn lanes for those vehicles
exiting the development.
However, at this meeting, the developer requested that the left turn & thru lanes be
combined and a designated right-turn lane be created. Previous discussions
apparently indicated the opposite should take place, namely the right turn & thru
lanes should be combined and there should be a designated left-turn lane.
Due to the cpnfusion, I will refer this matter to Lt. Cummings upon his return from
Vacation on January 9, 1995. As the former Traffic Coordinator, he is much more
qualified to determine the proper recommendation for these intersections.

Our comments on the subject preliminary plats and accompanying plans are as follows:
Plat I
1) Water and sanitary sewer systems within Tract A must be within suitable utility
easements, or the Tract may also be dedicated as a utility easement for potable water and
sanitary sewer only. (Sect. 26-33)
2) The terminal blow-offs for the water main in Victoria Bay Court shall be replaced with
flush hydrant assemblies, so as to allow frequent flushing of this dead-end line at both
ends.
3) The water and sanitary sewer systems will require an HRS permit. We recommend the
project engineer meet with Utilities staff to discuss corrections that must be made prior to
submitting their application. Many of the details shown do not reflect this Department's or
HRS criteria.
Plat II
1) Water and sanitary sewer systems within Tract A must be within suitable utility

The Recreation & Park Department has reviewed the Boynton Nurseries
masterplan and preliminary plat documents. The following comments
are submitted:
1. In accordance with Recreation & Park memorandums *94-320 and
*94-342, masterplan and preliminary plat documents now reflect
the 2.84 acres recreation dedication as agreed by the
developer and the City Commission. The remaining dedication
requirement will be paid in cash.
Three hundred seventy-three single family units at .018 acres
equals 6.714 acres. 6.714 acres divided by 2 (1/2 credit for
private recreation) equals 3.357 acres.
3.357 acres minus 2.84 acres provided = .517 acres cash.
2. The following recreation elements are noted on the masterplan
qualifying for one-half credit:
1. Children's Play Area
2. Basketball Court
3. Tennis Courts
4. Swimming Pool
5. Recreation Center Building
3. Private recreation facilities and equipment must be of
commercial grade and of sufficient size and scope needed to
provide for the recreation of the residents of the sub-
division.
4. Approval of recreation equipment by this department will be

Attached please find five copies of plat documents and associated
construction documents for required improvements at subject
location.
HISTORY The Planning and Development Board has previously reviewed
and approved both master plans and site plans for subject project,
subject to staff comments. The City Commission and the Technical
Review Committee have similarly reviewed and approved master plans
and site plans.
Developer G.L. Homes has submitted plat and construction documents
to the City Engineer and to the Technical Review Committee and they
have been found to be in substantial compliance with State and City
regulations except that utility Department approved documents
submitted to Palm Beach County have not yet received Health
Department approval.
RECOMMENDATION The City Engineer recommends that the Planning and
Development Board approve plat and construction documents for the
Nautica PUD Plats I & II subject to compliance with outstanding
staff comments and thereafter submit an appropriate recommendation
to the City Commission for placement on a City Commission agenda by
the City Manager.
