E. The landscaping plans were approved by the City of Boynton Beach Planning
& Recreation Departments in April 1995.
H. Please find enclosed the Certificate of Compliance by the Engineer of Record.
N. As stated previously, the recreation site for this project is private and will be
monitored and maintained by the Homeowner's Association.
Please find enclosed two copies of the revised drainage plan with additional grades
clarifying the drainage at the northeast corner along the proposed 6' walkway.

RIDER TO SITE PLAN APPLICATION
The undersigned as applicant for Final Site Plan Approval does
hereby acknowledge, represent and agree that all plans,
specifications, drawings, engineering, and other data
submi tted with this application for review by the City of
Boynton Beach shall be reviewed by the various boards,
commissions, staff personnel and other parti6s designated,
appointed or employed by the City of Boynton beach, and any
such party reviewing the same shall rely upon the accuracy
thereof, and any change in any item submitted shall be deemed
material and substantial.
The undersigned hereby agrees that all plans,
specifications, drawings, engineering and other data which may

Dear Ms. Walter:
The City of Boynton Beach has completed its first review of the
documents submitted for the above-referenced project. Attached are
conunents made by the reviewing departments during their initial
review of your project.
In order to complete the review process, the site plan and
documents must be amended to comply with these conunents within 90
days of the date of this letter. (If amended plans are not
submitted in 90 days, a new application fee will be required.)
When there are conunents made by the reviewers that you feel are not
applicable to the approval of the proj ect or will be addressed
separately and you have not amended the plans to comply with the
conunent(s), you must prepare written explanation for each conunent
stating why the conunent is not applicable and return the
explanation with the amended plans and documents.
After amending the plans and documents, please submit twelve (12)
complete sets (including surveys) of the plans to the Planning and
Zoning Department. When the amended plans and documents have been
submi tted to the Planning and Zoning Department, they will be
distributed to the reviewing departments for a second review and
the reviewers will reconunend if the site plan will be placed on a
board meeting agenda for approval (see attached meeting schedule).
If there are major conunents not addressed by new plans or the
reviewers recommend that the plan not be forwarded through the
approval schedule, this office will notify you of your alternatives
regarding the site plan as soon as possible.

The following list and information is provided as a checklist to ensure that
the submittal of amended plans and documents is substantially complete for
review. Turning in this list and the appropriate plans and documents will
enable the submittal to be efficiently checked prior to being accepted by the
Planning and Zoning Department.
Project Name: Nautica PUD (aka Boynton Nurseries)
1. Submit an amended Site Plan Review/Conditional Use application form that
reflects the changes that were made as a result of amending the plans
and documents to comply with the Code of Ordinances and the Technical
Review Committee comments. A copy of the original form with a
distinguishable symbol identifying the change(s) may be submitted or a
completed new form with the changes identified. If there are no changes
required to be documented on the application form, a letter from the
applicant stating same must be turned in with the amended submittal.
2. Submit twelve (12) assembled and complete sets of plans and documents,
including surveys that show compliance with the Code of Ordinances and
comments made by the Technical Review Committee. Two (2) of the sets
shall have the appropriate legible raised seal and signature of the
designer responsible for the drawing(s). Plans and documents shall be
assembled in twelve (12) individual complete packages with the title of
the project on all pages and/or sheets and each page or sheet
numerically numbered such as the following example: 1 of 3, 2 of 3, 3 of
3.
3. Submit color photographs of the buildings on the site that are to remain
in their existing condition and photos of existing buildings that are
located on the sites that abut the perimeter of the subject property.
The minimum size is 5" by 7". Each photograph shall be labeled to
identify the location of the existing structures with respect to the
location of the proposed project.
4. Submit colored elevation view drawings - a colored duplicate copy of all
drawings of the elevation views of each side of all buildings and
signage associated with the project. The colored elevation views shall
match the elevations shown in the documents that were submitted for site
plan review. The applicable exterior surfaces as identified above shall
be colored with the color name and associated color reference number
identified. The type of exterior surface material shall be identified
next to the associated color. The colored elevation drawings shall have
compass direction or title of the side of the building identified. The
title block of the original drawing shall be shown. The maximum size is
24" by 36". Do no submit on board of any kind.
5. Submit color samples as an example of the proposed colors. Each sample
shall have attached a label that identifies the color by name and
numerical/letter code from an established color chart.
6. Submit a 8 1/2" x 11" transparency of the landscape site plan drawing to
be used on an overhead projector at board meetings.

The following is a list of 1st review comments regarding the Site
Plan Review of the plans for the above-referenced project. It
should be noted that the comments are divided into two (2)
categories; the first category is a list of comments that identify
def iciencies that are required to be corrected and shown in
compliance on the plans and/or documents subrni tted for second (2nd)
review in order for the project to continue through the site plan
review process. The second set of comment(s) are recommendations
that the Planning and Zoning Department staff believe will enhance
the proposed development. The applicant shall understand that all
documents/plans submitted for site plan and/or permit review are
subject to additional comments. I recommend that the applicant/
agent contact me regarding questions related to the comments. If
the applicant is not intending to correct code deficiencies they

Pursuant to your request we have reviewed subject modifications
using only Code Section 8, Chapter 4, Part III. The only parts of
that section which involve us are included in 8.3. Based on that,
the applicant complies with 8.3.1 through 8.3.3, 8.3.5, 8.3.7 and
8 . 3 . 8 .
With respect to 8.3.4 we have repeatedly commented that the
driveways are too narrow to accommodate maximum vehicle storage.
We assume the requested modification does not include any change
from Commission imposed approvals since nothing shows up on the
most recent documents.
The remaining paragraph, 8.3.6, requires sidewalks as required by
City regulations. Documents continue to show sidewalks on only one
side of local streets, and omit some sidewalks completely,
particularly at intersections with Lawrence Road. Additionally,
handicapped walks are not consistently provided at all
intersections.

Attached, please find an amended Site Plan Review Application, twelve (12)
revised sets of the Site Plan Application package for Nautica P.U.D., (f.k.a.
Boynton Nurseries P.U.D.) and a $1,500.00 filing fee check. This Site Plan
Application is for perimeter landscaping, signage, and the recreation area layout
and landscaping. As required, colored elevation view drawings and
transparencies of the Recreation Area Site Plan and Landscape Plan are included.
Also included in the landscape portion of this application is a tree survey, Tree
Management Program and a set of littoral planting plans to address conditions
placed on the project by Kevin Hallahan, the City Forester. Pursuant to a letter
from Tambri Heyden dated January 27, 1995, these plans have been amended
to reflect the staff comments issued for this project.
With regards to the Planning and Zoning Department Memorandum No. 94-009,
the Recreation Area Site Plan and Landscape Plan have been amended to
address comments 1- 8. Items 9-14 are also addressed and are noted on the
appropriate sheets of the Site Plan Review application. Item No. 15 is addressed
in the Homeowners documents which were approved as part of the plat.
In regards to the Utilities Department Memorandum, No. 95-012, trees have been
deleted from the utility easements and the utility easements are clearly defined on
the landscape plan sheets.
In response to Building Memorandum No. 95-010, the square footage of the entry
sign does not exceed 32 square feet and is noted on the plans. The temporary
construction easement has since been deleted from the surveys.

The Building Division has reviewed the plans for the above
referenced project and our only comment is that the site plan
does not show street names. The plan should contain the same
names as shown on the plat.
We recommend that the project be forwarded to the Planning and
Development Board.

The following is a list of comments regarding the second review of
the above-referenced project. It should be noted that the comments
are divided into two (2) categories. The first category is a list
of comments that identify unresolved comments either from the first
review or new comments as a result of the second review. To show
compliance with these comments will not substantially alter the
configuration of the site and design of the building. The second
category is a list of recommendations I believe will enhance the
aesthetics and function of the project.
All comments and recommendations can be rectified on the plans
submi tted at time of permitting, if the site plan request is
approved. The applicant must understand that additional comments
may be generated upon review of the documents and working drawings
submitted to the Building Department for permits for the proposed
project.
I. SITE PLAN REVIEW COMMENTS:
1. Add to the drawing tabular site data for the recreation
site. The data shall include tract title, area of tract
in square feet, square footage of pervious and impervious
areas and overall height of the recreation building.
2. Identify on the elevation view drawings of the building
the color name 1 color designation and manufacturer's name
of all exterior materials. The colors shall match the
colors shown on the colored elevation drawings. Omit
the inconsistencies between the colored elevation view
drawing of the sign feature and the sign feature drawings
included with the plans. Identify on the elevation view
drawings of the sign feature that is included with the
set of plans the color name, color designation and
manufacturer's name of all exterior materials.
3. Provide a distinguishable symbol and show on the
landscape plan that the west and southwest views of the
recreation parking lot are screened with the appropriate
size, spacing and specie of hedge material.
4. Show on the recreation site landscape drawings the trees
spaced forty (40) feet on center along the perimeter of
the vehicle use area where the vehicle use area is
adjacent to a right-of-way.
5. Wi th a distinguable symbol, specify and label on the
perimeter buffer planting plan and the Lawrence Road
buffer planting plan the location and width of the
perimeter buffer easements. The location and size shall
match that of the buffer easements shown on the master
plan.

6. show and dimension on the recreation planting plan the
zoning and "Boynton Beach Landscape code" line-of-sight
triangles, including the size of the unobstructed cross
visibility space required within the triangles required
on both sides of the ingress/egress and at the
intersection of rights-of-way.
II. RECOMMENDATIONS
7. Modify the recreation area landscape notes to specify
melaleuca mulch instead of shredded cypress mulch.
8. To avoid conflict between the location of the required
si te and pedestrian 1 ighting poles and the landscape
material, show on the recreation area planting plan the
location of the required light fixtures.
9. To avoid conflict between the location of certain types
of landscaping material within a utility easement, show
and identify on the recreation area planting plan the
location and width of all utility easements.
III. NOTES:
a) If recommendations are approved, they shall be
incorporated into the working drawings required for
permits for the project.
b) This submittal reflects the phasing of the
installation of the landscape buffer easement
simul taneously with issuance of a certificate of
occupancy of a unit which abuts a buffer, the
ability to construct private fences within the
buffer and composition of the buffer to include a
chain link fence, ficus hedge and trees spaced 40
feet apart, as agreed at the March 15, 1995 meeting
with the City Manager, the applicant and staff.
