The following is a list of comments regarding the second review of
the above-referenced project. It should be noted that the comments
are divided into two (2) categories. The first category is a list
of comments that identify unresolved comments either from the first
review or new comments as a result of the second review. To show
compliance with these comments will not substantially alter the
configuration of the site and design of the building. The second
category is a list of recommendations I believe will enhance the
aesthetics and function of the project.
All comments and recommendations can be rectified on the plans
submi tted at time of permitting, if the site plan request is
approved. The applicant must understand that additional comments
may be generated upon review of the documents and working drawings
submitted to the Building Department for permits for the proposed
project.
I. SITE PLAN REVIEW COMMENTS:
1. Add to the drawing tabular site data for the recreation
site. The data shall include tract title, area of tract
in square feet, square footage of pervious and impervious
areas and overall height of the recreation building.
2. Identify on the elevation view drawings of the building
the color name, color des ignation and manufacturer's name
of all exterior materials. The colors shall match the
colors shown on the colored elevation drawings. Omit
the inconsistencies between the colored elevation view
drawing of the sign feature and the sign feature drawings
included with the plans. Identify on the elevation view
drawings of the sign feature that is included with the
set of plans the color name, color designation and
manufacturer's name of all exterior materials.
3. Provide a distinguishable symbol and show on the
landscape plan that the west and southwest views of the
recreation parking lot are screened with the appropriate
size, spacing and specie of hedge material.
4. Show on the recreation site landscape drawings the trees
spaced forty (40) feet on center along the perimeter of
the vehicle use area where the vehicle use area is
adjacent to a right-of-way.
5. Wi th a distinguable symbol, specify and label on the
perimeter buffer planting plan and the Lawrence Road
buffer planting plan the location and width of the
perimeter buffer easements. The location and size shall
match that of the buffer easements shown on the master
plan.

6. Show and dimension on the recreation planting plan the
zoning and "Boynton Beach Landscape Code" line-of-sight
triangles, including the size of the unobstructed cross
visibility space required within the triangles required
on both sides of the ingress/egress and at the
intersection of rights-of-way.
II. RECOMMENDATIONS
7. Modify the recreation area landscape notes to specify
melaleuca mulch instead of shredded cypress mulch.
8. To avoid conflict between the location of the required
si te and pedestrian lighting poles and the landscape
material, show on the recreation area planting plan the
location of the required light fixtures.
9. To avoid conflict between the location of certain types
of landscaping material within a utility easement, show
and identify on the recreation area planting plan the
location and width of all utility easements.
III. NOTES:
a) If recommendations are approved, they shall be
incorporated into the working drawings required for
permits for the project.
b) This submittal reflects the phasing of the
installation of the landscape buffer easement
simul taneously with issuance of a certificate of
occupancy of a unit which abuts a buffer, the
ability to construct private fences within the
buffer and composition of the buffer to include a
chain link fence, ficus hedge and trees spaced 40
feet apart, as agreed at the March 15, 1995 meeting
with the City Manager, the applicant and staff.

DESCRIPTION: This is a request for site plan approval for project

landscaping and buffer landscaping for the Nautica PUD, under
construction at the northwest corner of Lawrence Road at the
L.W.D.D. L-21 Canal.
RECOMMENDATION: The planning and Development Board, with a 7-0
vote, recommended approval of this request, subject to all staff

enable the submittal to be efficiently checked prior to being accepted by the
Planning and Zoning Department.

. Submit an amended Site Plan Review/Conditional Use application form that
reflects the changes that were made as a result of amending the plans
and documents to comply with the Code of Ordinances and the Technical
Review Committee comments. A copy of the original form with a
distinguishable symbol identifying the change(s) may be submitted or a
completed new form with the changes identified. If there are no changes
required to be documented on the application form, a letter from the
applicant stating same must be turned in with the amended submittal.
~ Submit twelve (12) assembled and complete sets of plans and documents,
including surveys that show compliance with the Code of Ordinances and
comments made by the Technical Review Committee. Two (2) of the sets
shall have the appropriate legible raised seal and signature of the
designer responsible for the drawing(s). Plans and documents shall be
assembled in twelve (12) individual complete packages with the title of
the project on all pages and/or sheets and each page or sheet
numerically numbered such as the following example: 1 of 3, 2 of 3, 3 of
03.
3. Submit color photographs of the buildings on the site that are to remain
in their existing condition and photos of existing buildings that are
located on the sites that abut the perimeter of the subject property.
The minimum size is 5" by 7". Each photograph shall be labeled to
identify the location of the existing structures with respect to the
location of the proposed project.

Submit colored elevation view drawings - a colored duplicate copy of all
drawings of the elevation views of each side of all buildings and
signage associated with the project. The colored elevation views shall
match the elevations shown in the documents that were submitted for site
plan review. The applicable exterior surfaces as identified above shall
be colored with the color name and associated color reference number
identified. The type of exterior surface material shall be identified
next to the associated color. The colored elevation drawings shall have
compass direction or title of the side of the building identified. The
title block of the original drawing shall be shown. The maximum size is
24" by 36". Do no submit on board of any kind.
Submit color samples as an example of the proposed colors. Each sample
shall have attached a label that identifies the color by name and
numerical/letter code from an established color chart.
Submit a 8 1/2" x 11" transparency of the landscape site plan drawing to
be used on an overhead projector at board meetings.

The following comments are submitted for your review:
1. Locate all trees within the landscaped right of ways a minimum or eight (8') from the edge of
pavement to provide a clear zone for errant vehicles. F.D.O.T. design standards, index 700.
2. All "typical lake sections" shall specify a slope no greater than 1: 8 within the twenty foot
maintenance casements. App.C,Art.X,Sec.5B.
3. Regarding the three typical road sections (40', 50' & 80' R/W): Do not locate the water mains
underneath the sidewalks. Applicant should confer with the utility dept. to determine if the mains
should be in the ten foot utility easements abutting the sidewalk or within the rights of ways.
4. Correct the egress lane markings to provide a dedicated left turn only onto Lawrence Rd.
5. Plans submitted for the following permits shall conform to the city's ordinances especially the
subdivision and parking lot ordinances: Paving, drainage, water, sewer, lighting, excavation,
landscaping, irrigation, and building. Proof of other required agency permits, such as P.B.County
Eng. and S.FW.M.D. are required at time of application.
RECOMMENDATIONS
1. Move all the sidewalks three to four feet in from the rights of ways and plant treescapes behind
them. Construct the sidewalk so it is above the shoulder grade which will create a four to six inch
"curb" for a safer "clear zone". Use a ground cover within the recommended treescape area. This
will reduce the amount of sod along the rights of ways and more importantly, the watering and
maintenance of same upon project completion.
2. We recommend that the plans be forwarded to the appropriate boards for their review and
consideration.

The recreation facility is to be served by
one, two-way entrance from a private local
street within the PUD. This driveway needs to
be shifted to meet the parking lot
regul~tions.
Parking Facility:
The recreation parking facility is proposed to
contain 31 spaces with two ( 2) handicapped
spaces to be provided.
Landscaping:
The recreation parking facility will fully
meet code requirements when staff comments are
incorporated into the permit set of plans.

Regulations:

with when staff comments are incorporated into
the permit set of plans.
Community Design
Plan:
The clubhouse is of a Spanish/Mediterranean
style with an "S" tile roof, pale peach light
textured stucco walls and darker peach stucco
bands.
Signage:
Two wall signs are proposed at the PUD's south
entrance off of Lawrence and one wall sign is
proposed at the PUD's north entrance off of
Lawrence Road. Brass reverse channel letters,
attached to a dark green marble tile sign
face, which is to be mounted to what appears
to be a peach, stucco sign wall.

The following is a list of comments regarding the second review of
the above-referenced project. It should be noted that the comments
are divided into two (2) categories. The first category is a list
of comments that identify unresolved comments either from the first
review or new comments as a result of the second review. To show
compliance with these comments will not substantially alter the
configuration of the site and design of the building. The second
category is a list of recommendations I believe will enhance the
aesthetics and function of the project.
All comments and recommendations can be rectified on the plans
submi tted at time of permitting I if the site plan request is
approved. The applicant must understand that additional comments
may be generated upon review of the documents and working drawings
submitted to the Building Department for permits for the proposed
project.
I. SITE PLAN REVIEW COMMENTS:
1. Add to the drawing tabular site data for the recreation
site. The data shall include tract title, area of tract
in square feet, square footage of perviOUS and impervious
areas and overall height of the recreation building.
2. Identify on the elevation view drawings of the building
the color name, color designation and manufacturer I s name
of all exterior materials. The colors shall match the
colors shown on the colored elevation drawings. Omit
the inconsistencies between the colored elevation view
drawing of the sign feature and the sign feature drawings
included with the plans. Identify on the elevation view
drawings of the sign feature that is included with the
set of plans the color name, color designation and
manufacturer's name of all exterior materials.
3. Provide a distinguishable symbol and show on the
landscape plan that the west and southwest views of the
recreation parking lot are screened with the appropriate
size, spacing and specie of hedge material.
4. Show on the recreation site landscape drawings the trees
spaced forty (40) feet on center along the perimeter of
the vehicle use area where the vehicle use area is
adjacent to a right-of-way.
5. Wi th a distinguable symbol, specify and label on the
perimeter buffer planting plan and the Lawrence Road
buffer planting plan the location and width of the
perimeter buffer easements. The location and size shall
match that of the buffer easements shown on the master
plan.

6. Show and dimension on the recreation planting plan the
zoning and "Boynton Beach Landscape Code" line-of-sight
triangles, including the size of the unobstructed cross
visibility space required within the triangles required
on both sides of the ingress/egress and at the
intersection of rights-of-way.
II. RECOMMENDATIONS
7. Modify the recreation area landscape notes to specify
melaleuca mulch instead of shredded cypress mulch.
8. To avoid conflict between the location of the required
si te and pedestrian lighting poles and the landscape
material, show on the recreation area planting plan the
location of the required light fixtures.
9. To avoid conflict between the location of certain types
of landscaping material within a utility easement, show
and identify on the recreation area planting plan the
location and width of all utility easements.
III. NOTES:
a) If recommendations are approved, they shall be
incorporated into the working drawings required for
permits for the project.
b) This submittal reflects the phasing of the
installation of the landscape buffer easement
simultaneously with issuance of a certificate of
occupancy of a unit which abuts a buffer, the
ability to construct private fences within the
buffer and composition of the buffer to include a
chain link fence, ficus hedge and trees spaced 40
feet apart, as agreed at the March 15, 1995 meeting
with the City Manager, the applicant and staff.

Second modification request (jacuzzies and whirlpools)
NATURE OF REQUEST
Kilday and Associates, agent for Boynton Nurseries, property owner,
contract purchaser of the Boynton Nurseries PUD, is requesting
approval to modify the previously approved master plan to establish
setbacks for whirlpools and jacuzzies on zero-Iot-line lots and "z"
lots. The proposed setbacks are the same setbacks that are approved
for pools on zero-lot-Iine lots as follows:

Boynton Nurseries, platted under the name "Nautica", is a single-
family development located on the west side of Lawrence Road and
the L,W.D.D. L-21 Canal (See Exhibit "B" - location map).
BACKGROUND
The Boynton Nurseries PUD master plan was approved by the City
Commission on September 5, 1990, subject to numerous conditions.
Subsequently, a one year time extension and concurrency exemption
for traffic, drainaqe and neiqhborhood parks were ;ranted throu;h
March 5, 1993. A second one year time extension/concurrency
exemption was granted and also a third. As they have now begun
work on the PUD, they are no longer in need of another extension.
This is the second master plan modification that has been
requested, unless construction of required improvements is not
completed within 21 months.
Chapter 2.5, Planned Unit Development, of
development regulations states that changes

"Changes in plans approved as a part of the zoning to PUD may
be permitted by the Planning and Zoning Board upon application
filed by the developer or his successors in interest, prior to
the expiration of the pun classification, but only [after] a
finding that any such change or changes are in accord with all
regulations in effect when the change or changes are requested
and the intent and purpose of the comprehensive plan in effect
at the time of the proposed change. Substantial changes shall
be proposed as for a new application of PUD zoning. The de-
termination of what constitutes a substantial change shall be
within the sole discretion of the City Commission. Nonsubst-
antial changes as determined by the City Commission in plans
shall not extend the expiration of the eighteen month approval
for the PUD classification."
ANALYSIS
Staff has reviewed this request for consistency with the pun
development standards, and the intent and purpose of planned unit
developments as stated in the following sections of Chapter 2.5 of
the City's land development regulations:
Section 1. Intent and purpose,
"A Planned Unit Development District (Pun) is established. It
is intended that this district be utilized to promote effi-
cient and economical land use, improved amenities, appropriate
and harmonious variety in physical development, creative
design, improved living environment, orderly and economical
development in the City, and the protection of adjacent and
existing and future City development. The district is
suitable for development, redevelopment and conservation of
land, water and other resources of the City. Regulations for
planned unit developments are intended to accomplish the
purposes of zoning, subdivision regulations and other applica-
ble city regulations to the same degree that they are intended
to control development on a lot-by-lot basis. In view of the
substantial public advantages of planned unit development, it
is the intent of PUD regulations to promote and encourage
development in this form where tracts sui table in size,
location and character for the uses and structures proposed
are to be planned and developed as unified and coordinated
units."
Section 9. Internal PUD standards.
B. INTERNAL LOTS AND FRONTAGE. Within the boundaries of the
PUD, no minimum lot size or minimum yards shall be required;
provided, however, that PUD frontage on dedicated public roads
shall observe front yard requirements in accordance with the
zoning district the PUD use most closely resembles and that
peripheral yards abutting other zoning districts shall be the
same as required in the abutting zone.
With respect to the changes requested, these setbacks are in-
keeping with the building and screen enclosure setbacks approved
October 18, 1994 with the first master plan modification for the
PUD. Find attached Exhibit "CII - approved master plan. The
Technical Review Committee did not recommend in favor of many of
the setbacks requested at that time, however since this request
does not further reduce the previously approved setbacks, this
request has little impact on each parcel and the overall develop-
ment as a whole as previously approved by the Planning and
Development Board and city Commission.

RECOMMENDATION
On Tuesday, June 13, 1995, the Technical Review Committee (TRC) met
to review this master plan modification request. The Board
recommends that the City Commission make a finding of no substan-
tial change for the proposed modification, and that the Planning
and Development Board approve the request, subject to staff
comments (see Exhibit liD" - Building Division Memorandum No. 95-
182) .

Please accept and process the attached information for a'Mmef Master Plan Modification to the
previously approved Nautica f.k.a. Boynton Nursery PUD located on the west side 01 Lawrence
Road, north of Gateway Boulevard. We are submitting this MiR&r Master Plan Modification
application on behalf of GL Homes of Florida, Inc., owners of the property. The rectified master
plan, approved March 14, 1995, reflects a total of 374 units which are comprised two (2) different
product types, one a lero lot line product which utilizes a 5,000 s.1. lot and the other a "l" lot
product which utilizes a 4,000 s.f. lot.
The approved Rectified Master Plan allows pools on the Zero Lot Une units. The proposed minor
master plan modification utilizes the same setbacks for pools on the Zero lot line units for the
proposed jacuzzis and whirlpools on the Zero and 'l' Lot units. The specific setbacks are
located in the matrix on sheet 2-1 of 5 and are graphically depicted on sheets 4-1 of 5 and 5-1
of 5.

Find attached for your review the plans and exhibits for the above-
referenced project. Site Plan Review approval for this project
will be granted by the City Commission. To ensure that the project
stays on line with the review time frame, I request that the plans
and exhibits be reviewed and formal written conunents transmitted to
the Director of the Planning and Zoning Department no later than
5:00 P.M. on January 17, 1994. Do not return plans and exhibits.
Retain same for the review of the amended plans (2nd review).
Adhering to the following review guidelines will promote a
comprehensive review and enable the applicant to efficiently obtain
Technical Review Committee approval:
1. Use the review standards specified in Part III, Land
Development Regulations, Chapter 4, Site Plan Review, Section
8 of the Code of Ordinances to review and formulate comments.
2. The documents submitted for the project were determined to be
substantially complete based on the submittal requirements
identified in Section 7 of the Site Plan Review Ordinance.
However, if the data provided to meet the submittal
requirements is insufficient to properly evaluate and process
the project based on the review standards or the documents
show code deficiencies, additional data and/or corrections
should be requested by the reviewer through the Planning and
Zoning Department.
3. Each comment shall reference the section of the code that is
incorrectly depicted on the documents.
4. Technical Review Committee member ( s) shall identify in their
comments when the plans depict or when the location and
installation of their departmental required improvements may
conflict with other departmental improvements.

5. When a TRC Member finds a code deficiency that is outside of
his/her review responsibility, the comment and the specific code
section may be included in their review comments with the name of
the appropriate TRC Member that is responsible for the review
specified.
6. If a TRC member finds the plans acceptable, he/she shall forward
a memo, within the time frame stated above, to the Planning and
Zoning Director stating that the plans are approved and they do
not have any comments on the plans submitted for review and
recommend the project be forwarded through the approval process.
All comments shall be typed, addressed and transmitted to the Director
of the Planning and Zoning Department for distribution to the
applicant. Please include the name and phone number of the reviewer
on this memo. Michael E. Haag will be the Planning and Zoning
Department staff member coordinating the 1st review of the project.
The Planning and Zoning Department will send the applicant a cover
letter which includes the comment(s) and directions to amend the plans
to comply with the comments and the procedures for resubmission. When
the Planning and Zoning Department receives the amended plans, they
will distribute the plans with a cover memo to all TRC Members for
review and approval.
