DATE: September 3, 1993 RE: Proposed Abandonment of a Portion of N.W. 3rd. Court The first Baptist Church of Boynton Beach has proposed that the City abandon N.W. 3rd. court which land would be annexed to the church property, and presumably used to provide extra parking for the church. A sidewalk across the existing street is proposed to be built on the west side of Seacrest Boulevard. I have inspected the site, and offer the following pre-application comments regarding this proposal: 1. Existing N.W. 3rd. Court drains to two catch basins on the west side of Seacrest Boulevard. Measures will have to be taken to insure that this area will properly drain, since the proposed sidewalk will cut off flow to the catch basins. 2. There is a building immediately north of N.W. 3rd. Court and fronting on Seacrest Blvd. which has four existing parking places that are accessed from N.W. 3rd. Court. These spaces will effectively be lost if the street is closed. 3. There is a mid-block building located on Lot No. 136 which would apparently have no legal frontage on an existing street after the abandonment. Additionally, access to this building is from N.W. 3rd. Court. Closing of the street will, at the least, make access to this lot inconvenient, and at the worst, terminate access to the lot. The 20' drainage easement, as platted and located in the northwest corner is to be changed. As can be seen, the drainage pipe, as constructed, is not located within the drainage easement. The proposed 20' drainage easement will run parallel and adjacent to the property line in the northwest corner. The existing drainage pipe, approximately 290 feet, will be relocated within this proposed 20' drainage easement. 2. The existing Florida Power & Light transmission lines will be relocated within the proposed Florida Power & Light 30' utility easement. After relocation of the transmission lines within the proposed 30' utility easement, Florida Power & Light will abandon their existing easement which runs through the site. 3. An easement will be granted to the Lake Worth Drainage District in order to provide them with the required 30' of maintenance area adjacent to the LWDD E-4 Canal. 4. The 25' platted buffer conflicts with the proposed Lake Worth Drainage District easement and therefore needs to be changed. The Lake Worth Drainage District will not allow a landscape buffer area within their easement area. In order to provide the landscape buffer area, it is proposed that a berm and landscape area be located between the Lake Worth Drainage District easement and the Florida Power and Light easement. I apologize for the long delay but the hurricane forced all of the transmission personnel of FP&L into service in the Dade County area which made it diffic~]~ to coordinate with FP&L. The 25' buffer as platted, be abandoned along the LWDD E-4 Canal as the proposed Lake Worth Drainage District easement does not allow for the buffer. As proposed, a new landscaped area will be located between the Lake Worth Drainage District easement and the FP&L easement. As required by the drainage permit, a berm will be constructed within the landscape area to hold on site the runoff from a 25 year storm event.
