compromise may be in order.

Proposed Abandonment of a Portion of N.W. 3rd. Court
The first Baptist Church of Boynton Beach has proposed that the City abandon N.W. 3rd.
court which land would be annexed to the church property, and presumably used to
provide extra parking for the church. A sidewalk across the existing street is proposed
to be built on the west side of Seacrest Boulevard.
I have inspected the site, and offer the following pre-application comments regarding this
proposal:
1. Existing N.W. 3rd. Court drains to two catch basins on the west side of Seacrest
Boulevard. Measures will have to be taken to insure that this area will properly
drain, since the proposed sidewalk will cut off flow to the catch basins.
2. There is a building immediately north of N.W. 3rd. Court and fronting on Seacrest
Blvd. which has four existing parking places that are accessed from N.W. 3rd.
Court. These spaces will effectively be lost if the street is closed.
3. There is a mid-block building located on Lot No. 136 which would apparently have
no legal frontage on an existing street after the abandonment. Additionally, access
to this building is from N.W. 3rd. Court. Closing of the street will, at the least,
make access to this lot inconvenient, and at the worst, terminate access to the lot.
These issues should be addressed at the time of formal application for abandonment of
N.W. 3rd. Court.

With this letter, please be advised that the First Baptist Church of Boynton Beach
has no plans to make improvements within the section of NW 3rd Court right-of-way
proposed for abandonment which would restrict the City I S access to the existing manhole
within said right-of-way. It is the Church I s intention to maintain the existing paved surface
from the area of the existing manhole, west to the terminus of the abandonment. The
Church agrees to provide the necessary easement to the City for the sewer and access to the
existing manhole.
In addition, the Church agrees to provide a 10-foot easement to Florida Power and
Light and Southern Bell to maintain their existing facilities within the right-of-way. / "

At its meeting of June 15, 1993, the city Commission approved the
request of the First Baptist Church of Boynton Beach to vacate a
portion of N.W. 3rd Court.
This abandonment is subject to your filing of easements and
installing the site improvements in the staff comments. Please
forward these easements to us as soon as they are ready for
review. Upon approval of the easements by the City Attorney, we
will schedule the final resolution abandoning N.W. 3rd Court.
We would ask that the drawings for the site improvements be
submitted to the Building Department prior to this final
resolution.

Accompanying this letter are ten (10) copies of the proposed changes
that have been requested by the First Baptist Church of Boynton Beach
which were discussed in our meeting of August 11 and subsequent
telephone conversations. The following items are those which the
First Baptist Church of Boynton Beach now wants to change in regards
to the platted easements and buffers of Tract F, Woolbright Place
Plat 1, plat Book 67, Pages 47, 48, and 49.
1. The 20' drainage easement, as platted and located in the
northwest corner is to be changed. As can be seen, the
drainage pipe, as constructed, is not located within the
drainage easement. The proposed 20' drainage easement will
run parallel and adjacent to the property line in the
northwest corner. The existing drainage pipe, approximately
290 feet, will be relocated within this proposed 20' drainage
easement.
2. The existing Florida Power & Light transmission lines will be
relocated within the proposed Florida Power & Light 30'
utility easement. After relocation of the transmission lines
within the proposed 30' utility easement, Florida Power &
Light will abandon their existing easement which runs through
the site.
3. An easement will be granted to the Lake Worth Drainage
District in order to provide them with the required 30' of
maintenance area adjacent to the LWDD E-4 Canal.
4. The 25' platted buffer conflicts with the proposed Lake Worth
Drainage District easement and therefore needs to be changed.
The Lake Worth Drainage District will not allow a landscape
buffer area within their easement area. In order to provide
the landscape buffer area, it is proposed that a berm and
landscape area be located between the Lake Worth Drainage
District easement and the Florida Power and Light easement.

Accompanying this letter is a copy of the proposed changes that were
discussed in our meeting of August 11. I apologize for the long delay
but the hurricane forced all of the transmission personnel of FP&L
into service in the Dade County area which made it diffic~]~ to
coordinate with FP&L. The following items are those which the church
now wants to change in regards to the platted easements and buff~r~__

1. The 20' drainage easement, as platted and located in the
northwest corner is to be abandoned. As can be seen, the
drainage pipe as constructed is not located within the
drainage easement and is to be relocated.
2. A new 20' drainage easement is proposed that will run
parallel and adjacent to the property line in the northwest
corner. The existing drainage pipe, approximately 290 feet,
will be relocated within this new 20' drainage easement.
3. The existing FP&L transmission power lines will be relocated
within the proposed FP&L 30' easement. After construction is
complete FP&L will abandon their easement which runs through
the site.
4. An easement will be granted to the Lake Worth Drainage
District in order to provide them with the required 3D' of
maintenance area adjacent to the LWDD E-4 Canal.
5. The 25' buffer as platted, be abandoned along the LWDD E-4
Canal as the proposed Lake Worth Drainage District easement
does not allow for the buffer. As proposed, a new landscaped
area will be located between the Lake Worth Drainage District
easement and the FP&L easement. As required by the drainage
permit, a berm will be constructed within the landscape area
to hold on site the runoff from a 25 year storm event.
