Scott Miller City Manager ~ -~ Chri~opher cutro planning and Zoning Director TO: DATE: June 9, 1993 RE: Abandonment of N.W. 3rd Court walter Bertschinger, from McMahon Associates and representing the First Baptist Church, has requested abandonment of a section of N.W. 3rd Court between Seacrest Boulevard and N.W. 1st Street. This is the closest intersection to Boynton Beach Boulevard at the northwest corner of seacrest Boulevard. It is the intention of the First Baptist church to close off N.W. 3rd Court, remove the pavement and make improvements to this property as far as landscaping and parking. At the present time, no permanent structures are planned for the abandoned area. The Technical Review Committee has reviewed this item and the utilities Department had one comment regarding the movement of a manhole. The applicant has suggested providing a permanent easement to the existing manhole. Our understanding is that this is acceptable to Utilities, however, written confirmation was not available at the planning and Development Board meeting. utility providers have been contacted and southern BellI Comcast and Florida Power & Light have requested easements for their facilities. On June S, 1993, the Planning and Development Board reviewed this request and forwarded it to the City Commission with a recommendation for approval subject to provision of the requested easements. Abandonment for the First Baptist Church Please place the above-referenced item on the City Commission agenda for April 5, 1994 under Resolutions. DESCRIPTION: Adoption of the attached resolution will finalize the action taken by the City Commission at the June 15, 1994 City Commission meeting. At that meeting, the City commission approved the abandonment of a portion (that portion requested by the First Baptist Church) of N.W. 3rd Court. This approval was subject to a) dedication of a utility easement to the City for access to an existing manhole within the right-of-way, b) dedication of a ten foot easement to Florida Power and Light, Southern Bell and Comcast to access their existing facilities within the right-of-way and to c) submittal of a bUilding permit for removal of the pavement/curb cut at the intersection of N.W. 3rd Court and North Seacrest Boulevard and installation of curb/gutter, sidewalk, irrigation and landscaping within the area to be abandoned. RECOMMENDATION: The Planning and Zoning Department recommends approval of this resolution.
