A copy of the last recorded warranty deed.
The following documents and letters of consent:
(1) If the property is under joint or several
ownership: a written consent to the application by
all owners of record,
(2) If the applicant is a contract purchaser: a copy
of the purchase contract and written consent of
the owner and seller, and
(3) If the applicant is represented by an authorized
agent: a copy of the agency agreement, or written
consent of the applicant, and
(4) If the applicant is a lessee: a copy of the lease
agreement, and the written consent of the owner,

A sealed boundary survey of the subject parcel by a
surveyor registered in the State of Florida, dated not
more than six (6) months prior to the date of submission
of the application, at a scale prescribed by the
Planning Department, and containing the following
information:

An accurate legal description of the subject
parcel.

A computation of the total acreage of the subject
parcel to the nearest hundredth (1/100) of an
acre.

A tree survey, which conforms to the requirements
of the City of Boynton Beach Tree Preservation
Ordinance. (Also refer to Page 6, Sec. II h.(12)
of this application if property is occupied by
native vegetation.) This requirement may be
waived by the Planning Director where found to be
unrelated to the land use or zoning issues
involved with the application.
A complete certified list of all property owners,
mailing addresses, and legal descriptions for all
properties within at least four hundred (400) feet of
the subject parcel as recorded in the latest official
tax rolls in the county courthouse shall be furnished
by the applicant. Postage, and mailing labels or
addressed envelopes must also be provided. Said list
shall be accompanied by an affidavit stating that to
the best of the applicant's knowledge said list is
complete and accurate. Notification of surrounding
property owners will be done by the City of Boynton
Beach.

A copy of the Palm Beach County Property Appraiser's
maps showing all of the properties referred to in
paragraph e. above, and their relation to the subject
parcel.
A statement by the applicant justifying the zoning
requested, including reasons why the property is
unsuitable for development under the existing zoning
and more suitable for development under the proposed
zoning.
A comparison of the impacts that would be created by
development under the proposed zoning, with the impacts
that would be created by development under the existing
zoning, which will include:
(1) A comparison of the potential square footage or
number and type of dwelling units under the
existing zoning with that which would be allowed
under the proposed zoning or development.
(2) A statement of the uses that would be allowed in
the proposed zoning or development, and any
particular uses that would be excluded.
(3) Proposed timing and phasing of the development.
( 4 )
For proposed zoning of property to commercial or
industrial districts, where the area of the
subject parcel exceeds one (1) acre, projections
for the number of employees.

A: LandUse
A comparison of traffic which would be generated
under the proposed zoning or development, with the
traffic that would be generated under the current
zoning; also, an analysis of traffic movements at
the intersections of driveways that would serve
the property and surrounding roadways, and
improvements that would be necessary to
accommodate such traffic movements. For projects
that generate more than five hundred (500) net
trips per day, a traffic impact analysis must be
submitted which complies with the Municipal
Implementation Ordinance of the Palm Beach County
Traffic Performance Standards Ordinance.
(a) For projects that generate two thousand
(2,000) or more net trips per day, the
traffic impact analysis must be submitted to
the City at least 30 days prior to the
deadline for land use amendment and/or
rezoning, in order to allow for timely
processing of the application and review by
the City's traffic consultant and Palm Beach
County. The applicant shall be billed for
the cost of review by the City'S traffic
consultant.
(b) For projects that generate between five
hundred (500) and two thousand (2,000) net
trips per day, the traffic impact analysis
must be submitted at the application deadline
for land use amendment and/or rezoning, in
order to allow for timely processing of the
application and review by Palm Beach County.

However, if it is the desire of the applicant
to utilize the City's traffic consultant for
review of the traffic impact analysis prior
to review by Palm Beach County, then the
procedure and requirements outlined under
item "a" above shall be followed.
NOTE:
Failure to submit traffic impact analysis in the manner
prescribed above may delay approval of the application.

(6) For parcels larger than one (1) acre, a comparison
of the water demand for development under the
proposed zoning or development with water demand
under the existing zoning. Water demand shall be
estimated using the standards adopted by the Palm
Beach County Health Department for estimating such
demand, unless different standards are justified
by a registered engineer. Commitment to the
provision of improvements to the water system
shall also be included, where existing facilities
would be inadequate to serve development under
the proposed zoning.

For parcels larger than one (1) acre, a comparison
of sewage flows that would be generated under the
proposed zoning or development with that which
would be generated under the existing zoning.
Sewage flows shall be estimated using the
standards adopted by the Palm Beach County Health
Department for estimating such flows, unless
different standards are justified by a registered
engineer. Commitment to the provision of
improvements to the sewage collection system shall
also be included, where the existing facilities
would be inadequate to serve development under the
proposed zoning.
For proposed residential developments larger than
one (1) acre, a comparison of the projected
population under the proposed zoning or
development with the projected population under
the existing zoning. Population projections
according to age groups for the proposed
development shall be required where more than
fifty (50) dwellings, or 50 sleeping rooms in the
case of group housing, would be allowed under the
proposed zoning.
At the request of the Planning Department,
Planning and Zoning Board, or City Commission, the
applicant shall also submit proposals for
minimizing land use conflicts with surrounding
properties. The applicant shall provide a summary
of the nuisances and hazards associated with
development under the proposed zoning, as well as
proposals for mitigation of such nuisances and
hazards. Such summary shall also include, where
applicable, exclusion of particular uses,
limitations on hours of operation, proposed
location of loading areas, dumpsters, and
mechanical equipment, screening of service areas
and mechanical equipment, location of driveways
and service entrance, and specifications for site

lighting. Nuisances and hazards shall be abated
or mitigated so as to conform to the performance
standards contained in the City's zoning
regulations and the standards contained in the
City's noise control ordinance. Also, statements
concerning the height, orientation, and bulk of
structures, setbacks from property lines, and
measures for screening and bUffering the proposed
development shall be provided. At the request of
the Planning and Zoning Board or City Commission,
the applicant shall also state the type of
construction and architectural styles that will be
employed in the proposed development.
At the request of the Planning Department,
Planning and Zoning Board, or City Commission, the
applicant shall also submit the following
information:

maintain common spaces and recreation

A written commitment to the provision of all
necessary facilities for storm drainage,
water supply, sewage collection and
treatment, solid waste disposal, hazardous
waste disposal, fire protection, easements or
rights-of-way, roadways, recreation and park
areas, school sites, and other 'public
improvements or dedications as may be
required.
For rezonings to planned zoning districts, the
specific requirements for submission of
applications for rezoning to such districts shall
also be satisfied. Furthermore, all materials
required for a subdivision master plan shall also
be submitted.
Where conformance with the County's
Environmentally Sensitive Lands Ordinance is
required, an Application for Alteration of
Environmentally Sensitive Lands (Environmental
Impact Study) must be submitted to the Palm Beach
County Department of Environmental Resources
Management (copy to City) prior to or concurrent
with the submittal of the Land Use Amendment and/
or Rezoning Application to the City.

III. APPLICATION FEES. Fees shall be paid at the time that the
application is submitted, according to the fees which have
been adopted by ordinance or resolution. The Planning
Department will inform the applicant as to the fees which
are required. All fees shall be paid by check, payable to
the City of Boynton Beach.
IV. CERTIFICATION

records of the Planning and Zoning Board. (I) (We) hereby

Cr\ditions and Stipulations
1. Definition of Terms
The following terms when used in this policy mean:
(a) "insured": the insured named in Schedule A, and,
subject to any rights or defenses The Fund may have had
against the named insured, those who succeed to the interest
of such insured by operation of law as distinguished from
purchase induding, but not limited to, heirs, distributees,
devisees, survivors, personal representatives, next of kin, or
corporate or fiduciary successors,
(b) "insured claimant": an insured claiming loss or damage
hereunder,
(c) "knowledge"; actual knowledge, not constructive
knowledge or notice which may be imputed to an insured by
reason of any public records,
(d) '1and": the land described, specificalIy or by reference in
Schedule A, and improvements affixed thereto which by law
constitute real property; provided, however, the term "Iand"
does not include any property beyond the lines of the area
specifically described or referred to in Schedule A, nor any
right, title, interest, estate or e.lsement in abutting streets,
roads, avenues, alleys, lanes, ways or waterways, but nothing
herein shall modify or limit the extent to which a right of
access to and from the land is insured by this policy,
(e) "mortgage": mortgage, deed of trust, trust deed, or other
security instrument.
(f) "public records"; those records which by law impart
constructive notice of matters relating to said land,
2. Continuation of Insurance After Conveyance of Title
The coverage of this policy shall continue in force as of
Effective Date of policy in favor of an insured so long as
such insured retains an estate or interest in the land, or holds
an indebtedness secured by a purchase money mortgage
given by a purchaser from such insured, or so long as such
insured shall have liability by reason of covenants of warranty
made by such insured in any transfer or conveyance ot such
estate or interest; provided, however, this policy shall not
continue in force in favor of any purchaser from such insured
of either said estate or interest or the indebtedness secured by
a purchase money mortgage given to such insured,
3. Defense and Prosecution of Actions - Notice of Claim
To Be Given by an Insured Claimant
(a) The Fund, at its own cost and without undue delay, shall
provide for the defense of an insured in all litigation consisting
of actions or proceedings commenced against such insured, or
a defense interposed against an insured in an action to enforce
a contract for a sale of the estate or interest in said land, to the
extent that such litigation is founded upon an alleged defect,
lien, encumbrance, or other matter insured against by this
policy.
(b) The insured shall notify The Fund promptly in writing
(i) in case any action or proceeding is begun or defense is
interposed as set forth in (a) abovt', (ii) in case knowledge shall
come to an insured hereunder of any claim of title or interest
which is adverse to the title to the estate or interest as insured,
and which might cause loss or damage for which The Fund
may be liable by virtue of this policy, or Wi) if title to the estate
or interest, as insured, is rejected as unmarketable, If such
prompt notice shall not be given to The Fund, then as to such
insured all liability of The Fund shall cease and terminate in
regard to the matter or matters for which such prompt notice
is required; provided, however, that failure to notify shall in
no case prejudice the rights of any such insured under this
policy unless The Fund shall be prejudiced by such failure and
then only to the extent of such prejudice,
(c) The Fund shall have the right at its own cost to instilute
and without undue delay prosecute any action or proceeding
or to do any other act which in its opinion may be necessary or
desirable to establish the title to the estate or interest as
insured, and The Fund may take any appropriate action
under the terms of this policy, whether or not it shall be liable
thereunder, and shall not thereby concede liability ur w.;ive
any provision of this policy,
(d) Whenever The Fund shall have brought any actiun or
interposed a defense as required or permitted by the
provisions of this policy, The Fund may pursue any such
litigation to final determination by a COurt of competent
jurisdiction and expressly reserves the right in its sule
discretion, to appeal from any adverse judgment or order.
(e) In all cases where this policy permits or requires The
Fund to prosecute or provide for the defense of any action u[
proceeding, the insured hereunder shdll S\:cure to TIll' FUllLl
the right to so prosecute or provide defense in such ,)ctio1\ or
proceeding, and all appeals therein, and permit The Fund tu
use, at its option, the name of such insured for sllch purp,)s",
Whenever requested by The Fund, such insured shall ~iv"
The Fund all reasonable aid in any such action or proce!:'di/ll~
in effecting settlement, securing evidencl', ubiajning wit-
nesses, or prosecuting or defending such aClioll ur l)fuc"eding,
and The Fund shall reimburse such insured for ;:tny expense
so incurred,
4. Notice of Loss - limitation of Action
In addition to the notices required under paragraph 3 (b) ut
these Conditions and Stipulations, a statement in wriling of
any loss or damage for which it is claimed The Fund is liable
under this policy shall be furnished to The Fund within YO
days after such loss or damage shall have been determined
and no right of action shall accrue to an insured c1aim:lnt until
30 days after such statement shall h,Wl' be!:'ll furni:;!I",!.
Failure to furnish such statement of loss ur di,mag,e 511,,11
terminate any liability of The Fund under tllis policy ,15 Iv
such loss or damage.
5. Options To Payor Otherwise Settle Claims

6. Detennination and Payment of Loss
(a) The liability of Thi:! Fund unch:r this policy shall in lIu
case exceed the least of:
(i) the actual lass of the insured claimant; or
Oi) the amount of insurance stated in Schedule A.
(b) The Fund will pay, in addition tu ,lilY Juss ill'> LJ{l'd

litigation carried on by The Fund for such insured, and aJJ
costs, attorneys' fees and expenses in litigation (,;lfried un by

with the conditions of this policy, the loss or darmlge she,ll
be payable within 30 days thereafter,
7. Limitation of Liability
No claim shalI arise or be maintainable under this policy
(a) if The Fund, after having received notice ot an allo:ted
defect, lien or encumbrance insured against hereunder, by
litigation or otherwise, removes such defect, lien or enCUln-
brance or establishes the title, as insured, within a reasunabJ0
time after receipt of such notice; (b) in the event uf litigatiun
until there has been a final determination by a coun uf
competent jurisdiction, ,md disposition of all appc'.lts thc'rdrOll \,
adverse to the title, as insured, as provided in paragr.lpb J
hereot or (c) for liability voluntarily assumed by an insured in
settling any claim or suit without prior written consellt
of The Fund.

Exclusions from Coverage
The following matters are expressly excluded from the coverage of this policy:
1. (a) Governmental police power.
(b) Any law, ordinance or governmental regulation relating to environmental protection.
(c) Any law, ordinance or governmental regulation (including but not limited to building and
zoning ordinances) restricting or regulating or prohibiting the occupancy, use or enjoyment of the
land, or regulating the character, dimensions or location of any improvement now or 1\l~n~;lfter
erected on the land, or prohibiting a separation in ownership or a change in the dimensions or area
of the land, or any parcel of which the land is or was a part.
(d) The effect of any violation of the matters excluded under (a), (b) or (c) above, unless notice of a
defect, lien or encumbrance resulting from a violation has been recorded at Effective Date of policy
in those records in which under state statutes, deeds, mortgages, lis pendens, liens or other titlt:
encumbrances must be recorded in order to impart constructive notice to purchasers of the bnd for
value and without knowledge; provided, however, that without limitation, such records shall not be
construed to include records in any of the offices of federal, state or local environmental protectiun,
zoning, building, health or public safety authorities.
2. Rights of eminent domain unless notice of the exercise of such rights appears in the public records at
Effective Date of policy.
3. Defects, liens, encumbrances, adverse claims, or other matters (a) created, suffered, assumed or
agreed to by the insured claimant; (b) not known to The Fund and not shown by the public records
but known to the insured claimant either at Effective Date of policy or at the date such claimant
acquired an estate or interest insured by this policy and not disclosed in writing by the insured
claimant to The Fund prior to the date such insured claimant became an insured hereunder; (c)
resulting in no loss or damage to the insured claimant; (d) attaching or created subsequent to
Effective Date of policy; or (e) resulting in loss or damage which would not have been sustained if
the insured claimant had paid value for the estate or interest insured by this policy,

Guests were then excused from the meeting, after being presented a check
for $400.00 from. Bob Borovy on behalf of the MIl Lake Bingo for a Explorer
Scholarship fund. .
Vice' Commander McCarty presented the names of Claude Lee,Thomas Hodgkins,
Edward Walters,James Tinneszfor membership. Scott Adams Motioned to
accept all proposed individuals, s~d by J.J. Farrington.Carried.
Committee Reports: Judge Advocate Sapyta reported obtaining a copy of
the' Club Incorporation papers from the State. Found that the Club Cannot
exceed a debt of $50,000.00 dollars. Will obtain more information from
State regarding amending the Articles of Incorporation.
Paul Martel introduced Architect Blanchette and reported the revised
plans for building expansion are completed.
Dan OBrien 'reported Parking Lot expansion plans and rezoning petition
will come before the PLanning Board on October 13 and the City Commiss-
ion on October 20,1992. Bob Borovy requested the membership turn out
in thier Legion caps for both meetings.

permit Local Retail Commercial. Building heights on this property
shou~d be limited, however, to 2 stories (25 feet), since 1- and
2-story residences lie in close proximity to the south and southeast.

7.k. Unincorporated Parcels on South Side of Boynton Beach Blvd.
These parcels constitute an unincorporated pocket which should be
annexed. The first row of lots lying to the west of the present City
limits, having an east-west dimension of approximately 300 feet
should be placed in the General Commercial land use category and C-4
zoning district. These parcels should be required to dedicate
right-of-way and construct the adjacent street consistent with
requirements that were placed on the u.S. Post Office. The
commercial parcels should be developed so as to be compatible with
the future residential use of the property which lies to the west.
The parcels which lie further to the west may be utilized for future
commercial development subject to rezonings to Planned Commercial
Development Districts and the establishment of adequate buffers
adjacent to a single-family subdivision which lies immediately to the
west of these parcels. Furthermore, building heights on this parcel
should be limited to 2 stores (25 feet) within 150 feet and 3 stories
within 400 feet of these single-family lots.
PLANNING AREA 8--S0UTHWEST QUADRANT OF CITY

8.a. Lake Boynton Estates (language which was included in the draft
Plan and support documents which were transmitted to the City
Commission on October 17, 1989)
The northern portion of this subdivision is zoned primarily for
single-family use, but includes multiple-family zoning along the
eastern boundary, and Neighborhood Commercial zoning at the northern
and southern ends. The southern portion of Lake Boynton Estates and
several unplatted tracts lie within a Planned Unit Development (PUD)
and Planned Commercial Development (PCD), which are the subject of
court-ordered settlement stipulations, concerning the land use and
zoning for the area. On the northern portion of Lake Boynton Estates
the property, which is not within the PUD or PCD, the land use for
the R-1A zoned portion should be changed from Moderate Density
Residential to Low Density Residential, to reflect the existing
zoning and pattern of development, and the land use for the R-3 zoned
portion should be changed from High Density Residential to Medium
Density Residential and R-2 zoning, again, to reflect the existing
pattern of development. The parcel occupied by the American Legion
Clubhouse along the SAL tracks should be placed in the Public and
Private Governmental/Institutional land use category and Public Usage
zoning district to reflect its current use.

Lake Boynton Estates and the unplatted outparcels is the subject of
litigation described in Appendix "0" to the Future Land Use Element
suppbrt Documents, and is to be governed by the court-ordered
settlement stipulations which are or may be in effect for this area.
The use and development of this property shall be construed to be
governed by the Comprehensive Plan in effect on November 6, 1986
(i.e., the 1986 Evaluation and Appraisal Report), Code of Ordinance
requirements, and other development regulations which were in effect
at that particular date, except to the extent that the Comprehensive
Plan,. Code of Ordinance requirements, and development regulations are
specifically superseded by the settlement stipulations. Therefore,
the public parks dedication, private recreation facilities, natural
area preserves, road improvements, utilities, and other public
facilities which are required shall be those which are specified in
the settlement stipulations, and the impact fees which are to be
collected will be equivalent to the fees which were in effect at the
time that the settlement stipulations went into effect. A history of
the litigation involving this property is included as Attachment "D"
to the Future Land Use Element Support Documents.
8.b. Property on Northeast Corner of Golf Road and Congress Ave.
This parcel occupies approximately 4 acres and was formerly shown in
the Moderate Density Residential land use category and R-1AA (PUD)
zoning district, which is the same as the adjacent single-family
portion of Boynton Beach Leisureville. This property is shown in the
Office Commercial land use category on the Future Land Use Map, in
accordance with the Settlement and Stipulation Agreement between
Milnor Corporation and the City (see Appendix "D" to the Future Land
Use Element support Documents). This agreement specifies that the
property is to be developed for offices, and includes specific
conditions for the use and development of the property. The land
use, zoning, and the use and development of this property shall be in
accordance with the above-mentioned Settlement and Stipulation
Agreement.
8.c. Property on Southeast Corner of Golf Road and Congress Ave.
This parcel occupies approximately 8.5 acres and was formerly shown
in the Low Density Residential land use category and R-1AA zoning
district. This property is shown in the High Density Residential
land use category on the Future Land Use Map, in accordance with the
Settlement and Stipulation Agreement between Milnor Corporation and
the City (see Appendix "0" to the Future Land Use Element Support
Documents). This agreement specifies that the property is to be
developed as an adult congregate living facility (ACLF), and includes
specific conditions for the use and development of the property. The
land use, zoning, and the use and development of this property shall
be in accordance with the above-mentioned Settlement and Stipulation
Agreement.

The American Legion, Cline, Pavtisch, ~ott, Post 164 has
it's Headquarters and Club facilities located on Lots 1, 2, and
3, Block I-A, Lake Boynton Estates Plat 1, in a P. U. Zoning
District.
Lets 4 and 5, Block I-A as as shown on the aforementioned
Plat are in a R-2 Zoning District.
The rezoning petition, if approved, would incorporate all
of the Clubs property in the same zoning classification. There-
allowing the Clu~ to construct a parking facility ( lot ) to
accomadate the existing Club facilities and allow for future ex-
pansion.
