American Legion Hall Phased Expansion Project
Parking Lot Upgrade and Small Building Expansion
During the week of November 1, 1993, Mr. Bob Borovy, Building
Committee Chairman for the American Legion, scheduled and attended
a meeting with the City Manager's Office and City staff regarding
the above referenced American Legion Post situated at 571 West
Ocean Avenue.
The City Engineer's Office as well as the Building Department
conducted a cursory review of the plans and have determined that
the issuance of building permits for the subject construction could
be easily handled administratively as the site plan is in a substantial
state of compliance with City codes to that degree which would warrant
the waiver of the City's site plan review process, as provided for in
City Code of Ordinances, specifically Chapter 4, "Site Plan Review",
Section 2, "Applicability", Subsection 2.3.3 which indicates that
site plan review may be waived if "there is compliance with the
development regulations of the City of Boynton Beach."
Additionally, Chapter 19, entitled "Planning and Development Generally",
Section 19-87, "Administration of Article", authorizes the City Manager
to designate other City Officials to administer this article or any
portion thereof. Therefore, in the absence of a permanent Planning
and Zoning Director (as dicussed during our meeting)~ the City Commission
appears to have the full authority to consider the Legion's request for
a site plan review waiver, especially in light of the small size and
location of their project.

Should the City Commission rule favorably upon the Legion's request,
staff will take all necessary actions to assist the American Legion
in satisfying City codes, reference an administrative review by the
major affected departments.

Rezoning
Danny O'Brien, agent for the American Legion Club of Boynton Beach,
Inc., has requested that certain property adjacent to, and owned by
the American Legion Club of Boynton Beach, Inc. be rezoned from R-2
(Duplex Residential) to PU (Public Usage) .
At its regular meeting of October 13, 1992, the Planning and
Development Board forwarded this request to the City Commission
wi th a recommendation for approval, subj ect to the following
conditions:
1) A deed restriction be recorded that restricts the single
family house on lot 5 to be used only for single family
residential use; and
2) If any portion of lot 5 is used for parking for the
American Legion club facility, a buffer shall be installed to
separate and buffer the adjacent single family home to the
north from the American Legion club property.
The City Commission, at its regular meeting on October 20, 1992,
approved this item on First Reading subject to the recommendations
of the Planning and Development Board as described above.
With respect to the deed restriction, the applicant submitted a
copy to this office and, it was forwarded to the City Attorney for
his review.
This item is scheduled to be considered by the city Commission on
Second Reading at their regular meeting on November 4, 1992.

Attached please find a copy of the deed restriction as submitted by
the applicant for the American Legion Club of Boynton Beach, Inc.
rezoning. You will recall that the City Commission, at their
regular meeting held on October 19, 1992, required that the
applicant record a deed restriction which will limit the single-
family structure, as located on the subject property, to
residential use. This deed restriction is to be recorded prior to
Second Reading of the ordinance, which is scheduled for Wednesday,
November 4, 1992.
Please review this document to see whether it accomplishes that
which the City Commission has required. I will provide your
comments to the applicant so they may be incorporated into the
document prior to Second Reading of the ordinance.

Danny O'Brien, agent for the American Legion Club of Boynton Beach, Inc. is
requesting that the two lots on the north side of the ...~ American
Legion Club, located on the east side of N.W. 6th street, be rezoned from
R-2 to Public Usage. As indicated by the justification statement provided
by the applicant, the rezoning would allow them to construct additional
parking facilities to accommodate existing needs, as well as future needs
if the existing Club facility were to be expanded.
Surrounding land uses include:
single-family homes to the west, and a single family home to the north;
The Seaboard Airline Railway, and Industrial uses within the M-1 zoning
district to the east; and
the American Legion Club and a commercial retail store to the south.
With the existance of the single family homes to the west, and the
industrial area to the east, a small transition zone is created inbetween.
Based, in part, on this circumstance, it is staff's opinion that the
proposed use would not be inappropriate for this area.
However, one conflict area has the potential for being created. This is
where the north side of the subject area directly abuts a lot with a single
family home. Although staff feels that this circumstance is unavoidable,
the potential effects should not be avoided, but mitigated with specific
buffer requirements that should be applied during the development review
stage.
staff therefore recommends that this application be appoved, as the
-Proposed rezoning is not in ,conflict with any goal, objective, or policy
of the Comprehensive Plan;
-The proposed rezoning and use is reasonably consistent with the
established land use pattern within the surrounding area;
-The proposed use of the subject area would be compatible with the current
and future use of adjacent and nearby properties; and
-The proposed use of the subject area is of a scale which is reasonably
related to the needs of the neighborhood and the City as a whole.

IMPACT STATENENT
re: proposed rezoning for the American Legion Club of Boynton
Beach, Inc.
The rezoning of Lots 4 and 5, Block 1-A, Lake Boynton
Estates, Plat 1, from a R-3 designation to a P. U. designation
in accord with the Ordnances of the City of Boynton Beach wOuld
not create any noticeable impacts to the City'S traffic, sewage
collection, potable water demand nor to other Governmental ser-
vices.
There is an existing single family unit on the site and the
present zoneing would allow the construction of .a resident:.al
duplex on the property.
It is the Club's intention to construct a parking facility
( lot ) on the site accomadate the existing Club facilities on
property South of and adjacent to the subject site. The addi-
tion to the parking area would also allow future expansion of
the Post facilities.
