REQUEST FOR REZONING OF THE AMERICAN LEGION CLUB OF
BOYNTON BEACH, INC. SUBMITTED BY DANNY O'BRIEN
INTRODUCTION
Danny O'Brien, agent for Andrew Hershman, President of the American
Legion Club of Boynton Beach, Inc., is proposing to rezone 0.34-
acre of property located on the north side of the American Legion
Club, at the southeast corner of N.W. 1st. Avenue and N.W. 6th
Street (see Attachment flAil). The subject area consists of two lots
that are owned by the American Legion club of Boynton Beach, Inc.
and, are currently zoned R-2 (Duplex Residential).
The applicant requests that the subject lots be rezoned from R-2
(Duplex Residential) to Public Usage, which would result in the
incorporation of all the property owned by the American Legion Club
into the same zoning district. The justification for this request
is to provide for additional parking facilities as would be
required in order to expand the existing Club facility (see
Attachment IlB").
CURRENT LAND USE AND ZONING
As indicated above, the subject property consists of two lots owned
by, and located adjacent to the American Legion Club of Boynton
Beach, Inc. The lot located nearest to the Club is vacant, while
the second lot has been developed with a single-family home. The
land use and zoning in the surrounding area varies and is presented
in the table that follows:

CONSISTENCY WITH APPLICABLE COMPREHENSIVE PLAN POLICIES
With the exception of one objective, Objective 1.17, no other goal,
objective, or policy directly applies to the characteristics of
this request. Objective 1.17 reads as follows:
"Minimize nuisances, hazards, and other adverse impacts
to the general public, to property values, and to
residential environments by preventing or minimizing
land use conflicts."
As indicated above, the subject property is currently zoned for

residential development. However, given the proximity of this
property to both the railroad tracks and the adjacent M-1 zoning
district, residential development may not be preferable. By
expanding the Public Usage zoning district in this area, potential
land use conflicts, that could be generated if this property were
to be developed residential, might be avoided. Furthermore, the
proposed zoning and potential use of this property could provide
for the necessary separation between the railroad tracks and
industrial area to the east, and the residential neighborhood to
the west.
In contrast, the rezoning would allow the existing parking lot to
be expanded, and therefore constructed adjacent to the existing
single-family dwelling unit to the north. Although it is typically
undesirable to allow such a use adjacent to a single-family home,
this circumstance is unavoidable. However, to address the
potential impacts of the American Legion Club upon the adjacent
residential use, a buffer should be included in any future
development plans for the subject area.
CONSISTENCY WITH THE ESTABLISHED LAND USE PATTERN
As indicated above, the proposed rezoning would simply expand an
existing zoning district north along the Seaboard Airlines Railroad
tracks and, provide for a small buffer or setback between the
railroad tracks and the M-1 zoning district to the east, and the
residential neighborhood to the west.
RECOMMENDATION
The Planning and Zoning Department recommends that the application
submitted by Danny O'Brien for the American Legion club of Boynton
Beach, Inc. be approved, and this recommendation is based upon the
following:
1. The proposed rezoning is not in conflict with any goal,
objective, or policy of the Comprehensive Plan;
2. The proposed rezoning is consistent with the established land
use pattern within the surrounding area;
3. The proposed use of the subject area would be compatible with
the current and future use of adjacent and nearby properties; and
4. The proposed use of the subj ect area is of a scale which is
reasonably related to the needs of the neighborhood and the City as
a whole.

(APPLICANT'S JUSTIFICATION STATEMENT)
STATEMENT OF JUSTIFICATION
re: proposed rezoning for The A merican Legion Club of Boynton
Beach, Inc.
The American Legion, Cline, pavtisch, {ott, Post 164 has
it's Eeadquarters and Club facilities located on Lots 1, 2, and
3, Block I-A, Lake Boynton Estates Plat 1, in a P. U. Zoning
District.
Lets 4 and 5, Bloc}c I-A as as shown on the aforementioned
Plat are in a R-2 Zoning District.
The rezoning petition, if approved, would incorporate all
of the Clubs property in the same zoning classification. There-
allowing the Clu~ to construct a par~ing facility ( lot) to
accomadate the existing Club facilities and allow for future ex-
pansion.
