Survey Dear Mr. Haag: This is to confirm our conversation on or about February 8, 1994 when we discussed the possibility of the captioned. Although the survey submitted with my application to abandon/ vacate shows the S.W. 3rd Street property involved to be a 50 foot right of way, I am not requesting that the entire width be abandoned. If half of the entire width or 25 feet is abandoned or 25 feet the density would calculate as follows: 283.63' plus 48' (to Woolbright-I95 right of way) or 331.6 331.6 x 25 = 8290 added square feet of property plus existing 61839 or 70129 s/f or 1.61 acres for density purposes. 1.61 x 10.8 = 17.39 x 2.3 = 39.99 or 40 beds not including respite beds. Adult Care Facil- ities would grant necessary easements to the City and pay its share of maintenance. This would once, and for eternity, establish the highest density and bed count. If the above is not agreeable then the following alternative is requested: Sidewalk and swale to beginning of asphalt payment - 15'. Cal- culated as follows: 283.63 + 45 = (to Woolbright-I95 right of way) or 328.6 328.6 x 15' 4929 added land + existing 61839 = 66768 s/f or 1.53 x 10.8 16.6 x 2.3 = 38.2 beds not including respite beds. There would be no change from what is now in existance or taking place. Should you need further information please call me. My 1994 Review Schedule indicates the next P & D meeting is 3/8 and the City Commission is 3/15. Because of the abandonment applica- tion this may not be the "timeframe". The plans are the end result of several changes re- commended by Mr. Haag. - Following these meetings, I was under the impression that since we already have a conditional use this addition received administrative approval and a building permit could be applied for. This site, which remains the same today, received a conditional use in 1985 following notices to surrounding owners. Public hearings conducted by the Planning and Zoning Department and the City Commission without any objections from the public. For that matter the surrounding owners met among themselves and expressed support. In February of 1986, I applied to the Planning and Zoning Depart~ ment for an addition of approximately 800 sq. ft. in the same east- west direction. This was administratively approved without notification to the owners or public hearings and a building permit was issued. Since we began in 1985, the facility has served over 1000 Alzheim- er's or similar dementia patients and their families with full time re- sidential, overnight or short term respite and daily care. The facility has provided these programs and services for more than 2000 consecutive days without interruption and at virtually 100% capacity. Since opening, in 1985, our staff has accumulated approximately 75 years of experience, concern and ability to deliver quality of care and life to every resi- dent, daily care participant, family and friend. Praxis) Dear Ms. Moore, This is to confirm our discussion with respect to the captioned, at which time you were informed that I shall file an Application to Abandon prior to February 17, 1994, the next cut-off date for such applications. In view of the foregoing, please defer until the very next cycle, processing and sending out notices to the adjoining property owners within 400 feet of our property. This deferral request is to synchronize the timely processing of all applications being sought so that only one public notice will be necessary and that all applications will appear on the same day of the City Commission agenda and the public hearing. In the notice to surrounding owners a simple statement could be inserted such as "if you have any objection please advise this of- fice by return mail within seven days". If a majority do not object then I think an administrative approval and issuance of a building permit per City Code would be appropriate. This would save the City and me a lot of time and expense. There are 44 surrounding owners and I have the labels. If the aforementioned procedure is not possible, then I have no alternative but to file a formal Conditional Use Approval Application. I was informed that the next cut-off date was December 29, 1993. Today it appears to be January 3, 1994. ~ Please advise me when you return from Jury Duty whether or not my suggested alternate procedure is acceptable and what cut-off date is applicable. I shall be away from December 24, fly back from a Christ- mas Holiday on December 28, 1993.
