Building Division, please provide this division a memorandum containing a
description of the unresolved conditions. If the unresolved conditions
are not permit related, please notify the owner or the owner's agent to

and major Eite plan modification to add a one thousand, seven
hundred forty-seven (1,747) square foot addltion to an existing and
previously approved 1.42 acre: 32 bed adult congregate liv11:9
facility. The facility is presently occupled and located at 1613
S.W. 3rd Street. The existln9 thirty-two (32) ,jed facility is
located in the R-3, Multi-family, zoning distrlct and recelved
condltlonal use approval by the City Commission on June 18, 1985.
On February 18, 1986, the City CommlSSlon approved a 756 square
foot addl tion to the cri9inal building. The addition was for a
recreation activities area and did not include adding patient beds.
The three (3; patlent beds included with the 1/747 square foot
addltlon lS an intensiflcation of the project that requires
ccnditional use approval. 7his request is being forwarded for
reVIew conslstent with Section 11.2 of P.ppendix A-Zo~llng and
Chapter 4 of the Site plan Review Ordinance.
PROPOSED USE: The applicant is requestlng to expand an existing
adult congregate Ilv~ng facility.

Proposed Development: The Sl te 1S located directly south of
Woolbright Road, west of S. W. 3J..-d Street 3.nd east of 1-95. The
portion of S.W. 3rd Street that abuts the project does not form an
interse~tion at Woolbright Road. The site contains a one story,
9,857 square foot adult congregate llvlng facility that houses 32
beds, plus 1 resp1te bed (day bed). There are twenty (20) parkin~
spaces provided at the S l te and the parkl.ng area t...as direct
ingre8Sjegress access to S. W. 3rd Street. The request 1S to
construct a 1,747 square foot addition to the W'9St end of the
existing buildlng. The proposed addition includes a new
administrative offlce space, medical treatment room, v1sitation
room and three (3) new patl.ent beds. There is ample parking 1n the
existing parklng facillty tc accommodate the proposed addition and
new beds. The required parkIng space count is established as 1
space per 3 patlent bEds.
Native plant material w1ll be added to the vehicle use area hedge
screen1ng to comply w1th the native speCles requlrements. The
remainder of the slte landscaping is shown 1n compliance wIth the
code.
The exterior finish and color of the proposed addition will match
the e:dsting buildIng. J\ddlng square footage tc the eX1st1ng
b~ilding activates the requirements of the Community Design Plan.
The slte is located in the Modern Design Distr1ct. The build1ng
does not meet the archItectural theme desIgn requirement3 specified
in the code and the owner has submltted an appeal to seek relief
from the requirerr,ents. The request for relief from the des1gn
req'cnrements 1S runnIng concurrently with the conditIonal use
rt~que:3t .
The Oy/11(;:>r is also seeJung abandonment of a portion of S. W. 3rd
Street. 'The aba:1donment 1S also running concurrently with the
conditional use request. The a~andcnme:1t 13 for the portion of the
west one-half of s.w. 3rd Street that abuts the subject property.
The rea30n the owner 1S seeking approv31 of the abandonment is to
allow the area of the site to increase, Wh1Ch in turn, would allow
the total bed count (dens1ty) to increase. The density allowed for
aeult congregate 11vlng facll1tles is a conversion to beds based on
the permitted number of unIts per acre allowed by zoning. The use
of this conver310n was established wlth the 1986 Comprehensive Plan
Evaluation and Appraisal Report. ApplY1ng the COLverSIon to the
existIn~ area of the site w1ll allow a total of thirty-flve (35)
beds, conSIstent with the subject request. Applying the conversion
to Include the land that would be acquIred through approval ot the
applicant's abandonment applicatlon, a total of thlrty-nine (39)
beds would be allowed. If the abandonment is granted and the
cond1tional use request is modifIed to include a total of 39 beds
plus 1 respite bed, the only change required would be the slte data
regarding requlred park1ng spaces. However, the existing spaces
located on the site woul~ accommodate the 39 beds.
SURROUNDING LAND USES AND ZONIKG (See attached location map);
The subject property 15 located 1n the R-3, MUltiple-fam1ly
Dwelllng, zon1ng distr1ct. The following is a description of the
land uses a~d zonIng districts of the propertles that abut the
subject site:

STANDARDS FOR EVALUATING CONDITIONAL USES: Section 11.2.D of the
ZonIng Code contaIns the fcllowlng standards to WhICh conditional
uses are requIred to conform. FollowIng each of these standards is
the Planning and Zoning Department's evaluation of the application
as it pertaIns to the standards.
The Planning and Development Board and City CommIssion
shall consIder only such conditional uses as are
authorIzed under the terms of these zoning regulations
and, in connection therewith, may grant conditional uses
absolutely or conditioned upon the conditions including,
but not limIted to, the dedicatIon of property for
streets, alleys, reCl-eatlOl1 space and sidev1alks, as shall
be determined necessary for the protection of the
surrounding area and the citizens' general welfare, or
deny conditional uses when not in harmony with the intent
and purpose of this sectIon. In evaluating an
ap:.)llcatIon for concH tIol1al use I the Board and CommissIon
shall consIder the effect of the proposed use on the
general health, safety and welfare of the community and
make written findings certIfying that satisfactory
provision has been made concernIng the following
standards, where applIcable:
1. Ingress and egress to the subject property and
proposed structures thereon, with partIcular reference
to automobile and pedestrian safety and convenience I
traffIC flow and control, and access in case of fire
or catastrophe.
The ingress/egress to the site IS an eX1st1ng two-way
driveway. The driveway links directly to the on-site parking
spaces. The traffic flow and number cf parking spaces is the
same as the original approval. No changes are being made to
the layout of the parking area. A sidewalk that abuts the
parking area leads to an entrance to the buildIng.
z. Off-street parking and loading areas where required, with
partlc~lar attentlon to the items in subsection labove,
and the economlC, glare, noise, and odor effects the
condItional use will have on adjacent and nearby properties,
and the city as a whole.
Twenty (20) parking spaces are provided at the site 1ncluding
one (1) handicapped space. The parkIng space requirement for
the use is as follows: one (1) space for each three (3) beds.
As shown on the plans, the existing (20) parking spaces WIll
adequately serve the facIlity. A loading space is also
existIng to allow delivery of provisions to the fac1lIty. The
parking facility is located on the north side of the bUilding
which allows the build1ng to separate the parkIng area from
the residential buildings that abut the south property line of
the fIte.
3. Retuse and service areas, with particular reference to the
1tems In subsection land 2 above.
The existing dumpster enclosure and dumpster WIll remain. The
Director of Public Works 1S satisfied with the locatIon and
SIze of the eXIstIng dumpster area.
4. UtilIties, wIth reference to locations, avaIlability, and
compatIbilIty.
The eXIsting utili tIes will adequately serve the proposed
additi.on.

5. Screen1ng, butter1Lg and landscaping with reference to
type, dimenslons, and char3cter.
The existlng landscaping exceeds the requirements of the :ode.
As indicated en the landscape plan, the eXlstlng landscape
mater::".3.l forms a buffer between the subj ect site and tile
multl-farnily buildings to the south.
6. Signs, and proposed exterior llghting, with reference to
glare, traffic safety, econOffilC effect, and cornpatiDllity
and harmony wlth adjacent and nearby propertles.
BUllding and site signage are not proposed for the project.
As previously stated, the parking fac1lity is located on the
north side of the bU1lding. Any llght1ng fixtures required or
eXisting will be located in the parking area and shielded from
the V1ew of the adjacent residential buildings by the eXisting
structure.
7. Requ1red setbacks and other open spaces.
The existing building meets the setbacks reqlured for the
zoning d1str1ct. The new addition violated the rear setback
and the owner recElved Board of Adjustment approval (Case No.
192) to allow a reduction in the rear setback from forty (40)
feet to tlnrty-two (32) feet. The maximum lot coverage
allowed per the code is forty (40) percent. As 1ndicated on
the plans, the building footprint coverage 1S seventeen (17)
percent.
8. General compatibility wlth adjacent properties, and
other property in the zoning district.
ThE~ proposed llse is different than the uses that abut the
slte. The adult co~gregate facility is slmilar to a boarding
house and the adjacent residentlal use cO:lsists cf multi-
fam1ly buildings. These two uses are compatible and both are
allowed in the R-3 zoning district.
9. Height of bU1ldings and structures, w1th reference to
compatibility and harmony to adjacent and nearby properties,
and the City as a whole.

the Planning and Zoning Department comment regarding the Community
Design Plan. Compliance with the comment will change the exterior
finish and features of the building. The applicant has requested
an appeal to the requIrements of the design plan. Considering all
comments, the project has been forwarded for Planning and
Development Board and City CommIssion review. The applicant must
understand that the per~it plans shall be amended to comply wIth
the attachec staff comments and that additional comments may be
generated by staff following their reVIew for technical compliance
of perml t documents that are required to be submitted for the
development of the project.
RECOMMENDATION:
The Planning and Zoning Department recommends approval of the
request for conditional use approval and site plan review subject
to the permit plans for the project being amended to show
complIance wIth staff comments and the applicable City of Boynton
Beach Code of OrdInances.

Site Plan Review Comments
1. The applicant agrees with Recommendation II and is preparing an
application requesting abandonment of S.W. 3rd Street where the
street abutts the property line. If the request is granted 42 beds
(exclusive of day care quiet room - formerly referred to as respite
room) should be permitted. The conversion is 78,309 s/f divided by
43560 s/f = 1.7 acres, more or less; 10.8 units x 1.7 = 18.4 x 2.3
= 42.3 beds. Please see new Site Plan, Sheet 1 and Note A.
2. Day care quiet room beds a/k/a/ respite beds should not be included
in the bed count. Respite is a misnomer. These beds are exclusively
for day care clients and are not income producing, long or short
term care. HRS does not permit the use of these beds other than mo-
ments of naps, quieting down or rest. Day care residents are not per-
mitted in long or short term residential care and residential care
residents are not permitted to use quiet room beds.
3. Corrections of bed count made. Please also see Sheets 1-5-6.
4. No additional parking spaces will be required. Please see Sheets
1-4-6.
5. Handicapped parking space corrected as required. Please see Sheets
1-4-6.
6-7. Identified per Appendix II of TRL Recommendations. Please see
Sheet 2.
8. A continuous hedge will be install.ed on the southeast part of the
parking lot as recommended using Ligustrum to conform with existing
Ligustrum hedges on site. Please see Sheets 1 and 4.
The applicant does take appeal and respectfully requests relief from
this 1st deficiency (Ligustrum not being a native specie as required
by current landscape code requirements).
The existing landscape plant (Sheet 4) was approved in 1985, includ-
ing the use of Ligustrum for hedges. This species was installed,
carefully cared for and provides all the screening and amenities ne-

The city of Boynton Beach has completed its first review of the
documents submitted for the above-referenced project. Attached are
comments made by the reviewing departments during their initial
review of your project.
In order to complete the review process, the site plan and
documents must be amended to comply with these comments within 90
days of the date of this letter. (If amended plans are not
submitted in 90 days, a new application fee will be required.) When
there are comments made by the reviewers that you feel are not
applicable to the approval of the proj ect or will be addressed
separately and you have not amended the plans to comply with the
comment(s)I you must prepare written explanation for each comment
stating why the comment is not applicable and return the
explanation with the amended plans and documents.
After amending the plans and documents, please submit twelve (12)
complete sets (including surveys) of the plans to the Planning and
Zoning Department. When the amended plans and documents have been
submi tted to the Planning and Zoning Department I they will be

1. submit an amended Site Plan Review/Conditional Use application form that
reflects the changes that were made as a result of amending the plans and
documents to comply with the Code of Ordinances and the Technical Review
Committee comments. A copy of the original form with a distinguishable
symbol identifying the change{s) may be submitted or a completed new form
with the changes identified. If there are no changes required to be
documented on the application form, a letter from the applicant stating
same must be turned in with the amended submittal.
2. Submit twelve (12) assembled and complete sets of plans and documents,
including surveys that show compliance with the code of Ordinances and
comments made by the Technical Review Committee. Two (2) of the sets shall
have the appropriate legible raised seal and signature of the designer
responsible for the drawing(s). Plans and documents shall be assembled in
twelve (12) individual complete packages with the title of the project on
all pages and/or sheets and each page or sheet numerically numbered such
as the following example: 1 of 3, 2 of 3, 3 of 3.
3. Submit color photographs of the buildings on the site that are to remain
in their existing condition and photos of existing buildings that are
located on the sites that abut the perimeter of the subject property. The
minimum size is 5" by 7". Each photograph shall be labeled to identify the
location of the existing structures with respect to the location of the
proposed project.
Submit colored elevation view drawings - a colored duplicate copy of all
drawings of the elevation views of each side of all buildings and signage
associated with the project. The colored elevation views shall match the
elevations shown in the documents that were submitted for site plan
review. The applicable exterior surfaces as identified above shall be
colored with the color name and associated color reference number
identified. The type of exterior surface material shall be identified next
to the associated color. The colored elevation drawings shall have compass
direction or title of the side of the building identified. The title block
of the original drawing shall be shown. The maximum size is 24" by 36". Dc

The Engineering Department for the City of Boynton Beach, Florida
has reviewed the above referenced plan submission and herein offer
the following comments:
1. Drainage information provided is insufficient to perform a
comprehensive review as elevations, dimensions, stormwater
flow patterns, percolation test data and cross sections of
drainage retention or detention areas have been omitted from
the plan. Applicant shall revise plan and submit the required
information.
2. Plans shall be revised to provide for fully sodded and
irrigated swales along the west rights-of-way of SW 3rd St.
for the entire distance of the property boundary line. Swales
shall be constructed in accordance with minimum City standards
available in the Engineering Department, 2nd floor, West wing
of the City Hall Complex.
3. Site lighting shall be upgraded to comply with current Code of
Ordinances therefore the applicant shall submit a photometric
plan depicting levels of illumination within the parking
facility as well as levels of illumination for pedestrian
walkways.
4. The raised continuous concrete curbing wi thin the public
rights-of-way of SW 3rd Street shall be deleted.
5. The applicant shall install raised continuous concrete curb
within the parking facility where motor vehicles abut
landscaped areas.

The following is a list of 1st review comments regarding the Site
Plan Review of the plans for the above-referenced project. It
should be noted that the comments are divided into two (2)
categories; the first category is a list of comments that
identify deficiencies that are required to be corrected and shown
in compliance on the plans submitted for second (2nd) review in
order for the project to continue through the site plan review
process. The second set of comment(s) are recommendations that
the Planning and Zoning Department staff believe will enhance the
proposed development. The applicant shall understand that all
documents/plans submitted for site plan and/or permit review are
subject to additional comments. I recommend that the
applicant/agent contact me regarding questions related to the
comments. If the applicant is not intending to correct code
deficiencies, they should contact me regarding the procedures,
application forms, fees and submittal deadline dates for seeking
relief from the code requirement. '

1. The following equation is used to determine maximum density
of beds for uses (such as yours) that are evaluated by bed count
rather than unit count. Add the calculations to the site data
inserting the total area of the subject site:

2. When employing the equation, identified in comment numter I,
the total number of beds allowed for the subject site is thirty-
five (35) including the respite bed. Delineate on the plan the
location of each bed indicating the existing and new beds.
Correct the total number of beds shown on the floor plan (sheets
2, 3 & 5) and the site plan (sheet 1) to equal no more than (35)
beds including the respite bed. Also, include in the site data,
the eXisting number of beds previously approved and list the
number of beds requested at this time. Note: fee comment number
3 for previously approved bed count.

3. Correct the inconsistency with regard to identifying the
existing bed count. The site plan (sheet 1 & 6) identifies
thirty-four (34) existing beds with one (1) respite. The total
number of beds previously approved for the subject site and use
was thirty-three (33), thirty-two (32) beds and one (1) respite
bed. A change to the approved bed count requires City approval.
Correct the bed count accordingly.

4. Correct the site data with regard to the number of beds used
to determine the total number of required parking spaces. Note:
Maximum number of beds allowed is thirty-five (35).
5. Include in the parking calculations the total number of
required handicapped parking spaces. Note: 1 through 25 regular
spaces requires one (1) of the total number to be shown and
designed for the handicapped. Correct the size and shape of the
existing handicapped space, shown on sheet 1, 4, 6 and 7, to be
in compliance with the current handicapped requirements. See
attached City standard drawing No. B-90012.
6. The Praxis site is located in the Modern Design District as
identified in the Community Design Plan. Modify the drawings to
comply with the required modern design theme for the roof element
of the building, and incorporate into che drawings the
appropriate type and number of required architectural features
and/or treatments as identified in the attached Appendix II
Boynton Beach Community Design Plan Standards or be granted
approval of an appeal to the specific section of the Community
Design Plan.
7. Specify on the section and elevation view drawings found on
sheet 2 the color of the following existing and new exterior
finish materials: roof shingles (type cement or fiberglass),
T-l1 plywood, metal drip edge, wood fascia, metal doors, window
frames, glass, existing screen material and screen frame-work,
and stucco finish. If the color is to match the color of the
same material on the existing building, add a note to indicate
the color will match the existing building following where the
color of the new material is identified.

8. To ensure that the landscaping meets the current code
requirements: identify on the landscape plan the following
distances around the perimeter of the vehicle use area (all areas
where vehicles transverse the site): The length of the edge of
the vehicle use area that faces toward the north, toward the west
(including the dumpster and service areas), toward the south
(excluding where the building is located, but including the area
east of the building), and toward the east (including the portion
of the service area, but excluding the width of the driveway.
The sum total of each length is the total lineal footage of
vehicle use area that is visible from the property line. A
continuo~s hedge shall be formed to screen the vehicle use area.
The following describes the code specifications for hedge
material: Maximum spacing (2) feet on center of which 50% of the
total number shall be native, minimum height at time of planting
(18) inches. The plans indicate for the most part that the
location of the existing hedge material is correctly screening
the vehicle use area and the spacing and size meet the code
specifications. The following describes the aspects of the
existing landscaping that are not in compliance with the current
code requirements: The south side of the vehicle use area where
the two (2) parking spaces are located east of the building does
not have a continuous hedge. The existing hedge specie
(Ligustrum) is not native. Therefore, the existing plan shall be

the landscape requirements, I recommend taking the total lineal
footage of vehicle use area identified above. This total
represents the area that is required to be screened. Divide the
total lineal footage by four (4). The quotient equals the total
number of native hedge plants required. Incorporate the total
number of required native plants into the existing landscaping by
either showing a double hedge in some locations and/or add native
hedges in other areas around the perimeter of the vehicle use
area. On the landscape plan, indicate with a distinguishable
symbol, the location on the new native plants and identify the
total number of native hedges required. Identify the name of the
new native specie and add the specie, including spacing and
height specifications, no less than code required, to the plant
list.

1. To increase the bed count, I recommend seeking approval of
an abandonment of S.W. 3rd Street where the street abuts the
site. Approval of the abandonment will increase the size of the
property and, therefore, increase your allowed bed count. S.W.
3rd Street is a City street. I recommend contacting all City
departments that use the street to access the City property that
abuts the east side of the street to see whether they would be in
favor of abandoning the street. Also contact the Engineering
Department to acquire a list of the utility services that may
have an interest in the abandonment of the street. The applicant
should contact me as soon as possible, if he wants to seek
abandonment of the street.

The Engineering Department for the City of Boynton Beach, Florida
has reviewed the above referenced plan submission and herein offer
the following comments:
1. Drainage information provided is insufficient to perform a
comprehensive review as elevations, dimensions, stormwater
flow patterns, percolation test data and cross sections of
drainage retention or detention areas have been omitted from
the plan. Applicant shall revise plan and submit the required
information.
2. Plans shall be revised to provide for fully sodded and
irrigated swales along the west rights-of-way of SW 3rd St.
for the entire distance of the property boundary line. Swales
shall be constructed in accordance with minimum City standards
available in the Engineering Department, 2nd floor, West Wing
of the City Hall Complex.
3. Site lighting shall be upgraded to comply with current Code of
Ordinances therefore the applicant shall submit a photometric
plan depicting levels of illumination within the parking
facility as well as levels of illumination for pedestrian
walkways.
4. The raised continuous concrete curbing within the public
rights-of-way of SW 3rd Street shall be deleted.
5. The applicant shall install raised continuous concrete curb
within the parking facility where motor vehicles abut
landscaped areas.

determined that the submittal is substantially complete and accepted
for further processing. A Planning & Zoning Dept. staff member will
be responsible for the review and coordination of your site plan
thru the remainder of the Site Plan Review process.
The next step in the review process is for the Technical Review
Committee to review the submittal for compliance with the review
standards identified in Part III, Land Development Regulations:
Chapter 4, Site plan Review, Section 8 and all applicable sections

Find attached for your review the plans and exhibits for the above
referenced project. Site Plan Review approval for this project
will be granted by the City Commission/Community Redevelopment
Agency. To ensure that the project stays on line with the review
time framer I request that the plans and exhibits be reviewed and
formal written comments transmitted to the Director of the Planning
and Zoning Department no later than 5:00 P.M. on Januarv 25, 1994.
Do not return plans and exhibits. Retain same for the review of the
amended plans (2nd review).
Adhering to the following review guidelines will promote a
comprehensive review and enable the applicant to efficiently obtain
Technical Review Committee approval:
1. Use the review standards specified in Part III, Land
Development Regulations, Chapter 4, Site plan Review, section
8 to review and formulate comments. (See Planning
& Zoning Department memo #92-020)
2. The documents submitted for the project were determined to be
substantially complete based on the submittal requirements
identified in Section 7 of the Site plan Review Ordinance.
However, if the data provided to meet the submittal
requirements is insufficient to properly evaluate and process
the project based on the review standards, additional data
should be requested by the reviewer through the Planning and
Zoning Department.

3. Each comment shall reference the code section and include the
language of the submittal requirements and review standards
that require the data to be submitted for review.
4. Technical Review Committee member (s) shall identify in their
comments when the plans depict or when the location and
installation of their departmental required improvements may
conflict with other departmental improvements.
5. When a TRC Member finds a code deficiency that is outside of
his/her review responsibility, the comment and the specific code
section may be included in their review comments with the name of
the appropriate TRC Member that is responsible for the review
specified.
6. If a TRC member finds the plans acceptable, he/she shall forward
a memo, within the time frame stated above, to the Planning and
Zoning Director stating that the plans are approved and they do
not have any comments on the plans submitted for review.
All comments shall be typed, addressed and transmitted to the Director
of the Planning and Zoning Department for distribution to the
applicant. Please include the name and phone number of the reviewer

Department staff member coordinating the review of the project.
The Planning and Zoning Department will send to the applicant a cover
letter which includes the comment(sj and directions to amend the plans
to comply with the comments and the procedures for resubmission. When
the Planning and Zoning Department receives the amended plans, they
will distrlbute the plans with a cover memo to all TRC Members for
review and approval.
