We have this date received a response from the City Attorney to
your December 15, 1994 inquiry. He indicates that abandonment is
necessary to accomplish your purpose.
Although I do not necessarily agree that abandonment is necessary,
my opinion does not count on legal issues. Inasmuch as I am unable
to locate any portion of our Code of Ordinances dealing with
abandonment of real estate, I am providing you with a copy of the
paper work which was submitted to the City Commission regarding a
similar recent unsuccessful action. Perhaps it will be helpful to
you. You may also wish to research Florida Statutes for guidance.
We are unable to do that here in our office. Or you may wish to
contact City Attorney Jim Cherof directly (276-9400) for
assistance.

It is my understanding from your recent conversations with Mr.
vincent Maffucci in connection with the above-referenced property
which is owned by Nicholas L. and Carol A. Cucci that (i) the
City's records are inconclusive, (ii) the City has no use for the
property, (iii) the City acknowledges that there is a structure
built on the alley which has been in existence for over 50 years,
and (iv) the City's tax records indicate that no alley exists.
Based on the above and upon your suggestion I have prepared
and am enclosing a Quit Claim Deed for that portion of the 10'
alleyway running between Lots 32 and 33. Kindly have the
appropriate officials sign and return to this office for recording.
