time frame, I request that the plans and exhibits be reviewed and
formal written comments transmitted to the Director of the Planning
and Zoning Department no later than 5:00 P.M. on Julv 27. 1994. Do

concurrency statements for traffic and drainage topics. The traffic
statement is covered by the current procedure where the county
provides approval letters, however, Engineering should provide a memo
covering the adequacy of existing drainage for the site where
applicable. please refer to Article VI concurrency Requirements

Dear Mike:
Please accept this letter, along with the attached plans, documents and filing fee, as our
application, on behalf of Apple South, Inc., for site plan approval for a proposed Applebee's
Restaurant at the above referenced location.
We are also requesting a waiver of Design Plan requirements for the project. Specifically, we
are requesting a waiver of the requirement to provide 50 % of the architectural features listed
in Appendix II, Boynton Beach Community Design Standards.
As confirmed by the attached plans, the proposed restaurant will meet the requirements for the
roof (S-tile) and the walls (stucco medium). Under the architectural features, it will meet the
requirements for the windows (multi-pane glass, fixed glass), extra features (decorative lights,
multi-panel doors), amenities (covered walkways and accent tile), and the exterior colors
(earth tones). However, the building design will not meet the 50% requirement for wall
accessories. It is this requirement for which we are requesting a waiver.
The plans drawn for this particular site required substantial changes to the Applebee's
prototype building. The changes have been made in order to conform to the architectural
design and aesthetics required by the City's Design Plan and to ensure a consistency between
the new building and the existing ,center's architecture and appearance. Modifications to
Applebee's prototype include the following: the addition of the tile roofing; the substitution
of stucco for brick; the addition of accent tile, and the substitution of split face eMU for
cedar panels below the windows. We believe the addition of any of the other items on the
list of required accessories would seriously jeopardize the corporate image of Applebee's, and
would detract from the aesthetics of the existing shopping center.

7. Further review of the overall site plan, Applebee's

property line is not consistent between the three drawings.
It is our understanding that some adjustment of this line will
be proposed.
A hedge per code is required along the property lines. If
this hedge does not exist, a variance can be requested by
letter, or the hedge must be installed.

The following is a list of 1st review comments regarding the site
Plan Review of the plans for the above-referenced project. It
should be noted that the comments are divided into two (2)
categories; the first category is a list of comments that identify
deficiencies that are required to be corrected and shown in
compliance on the plans and/or documents submitted for second (2nd)
review in order for the project to continue through the site plan
review process. The second set of comment(s) are recommendations
that the Planning and Zoning Department staff believe will enhance
the proposed development. The applicant shall understand that all
documents/plans submitted for site plan and/or permit review are
subject to additional comments. I recommend that the applicant/
agent contact me regarding questions related to the comments. If
the applicant is not intending to correct code deficiencies they
should contact me regarding the procedures, application forms, fees
and submittal deadline dates for seeking relief from the code
requirement.
I. SITE PLAN REVIEW COMMENTS:
1. Applicant has requested variance for missing features of
Mediterranean Design District requirements. Request must be
approved by the Planning and Development board and the city
Commission or permit drawings must reflect required features.
2. Applicant has indicated that they wish to eliminate loading
zone requirement by variance. Applicant must formally apply
for variance from Board of Adjustment by filling out
application, providing addresses of property owners within 400
feet and application fee. Submittal is required by August 12,
1994 to be considered at the September 19, 1994 Board of
Adjustment meeting. If the variance is not granted, amend the
drawings to show a loading zone.

I am in receipt of the above referenced plan and herein offer the
following comments:
1. Relative to the conceptual site plan review process, I find
this site plan to be acceptable.
2. During the review of this plan, code deficiencies were noted
that will impact the Developer at time of submission for site
plan and building permits. Some of the deficiencies are lack
of traffic control devices at ingress/egress points,
landscaping in conflict with anticipated stop sign locations,
insufficient information regarding levels of parking lot
illumination, insufficient information regarding levels of
illumination for pedestrian walkways, etc. I recommend that
the applicant obtain a copy of the City's Parking Lot
Ordinance, specifically Chapter 5, Article X, section 5-142
inclusive.

Concurrency:

Center. No additional approvals are required.

Parking Facility: The parking facility exists and contains 60
parking spaces. _ parking spaces will be eliminated during
construction. _ parking spaces are required for the restaurant

of the parking spaces be available to Boynton Lakes Plaza.
Landscaping:
Most of the landscaping exists during installation
of Boynton Lakes Plaza.
Additional foundation landscaping and
screening for adjacent properties is being requested for this
project.

This project is located in the
Mediterranean Spanish Community Design Plan District II.

1. Relative to the conceptual site plan review process, I find
this site plan to be acceptable.
2. During the review of this plan, code deficiencies were noted
that will impact the Developer at time of submission for site
plan and building permits. Some of the deficiencies are lack
of traffic control devices at ingress/egress points,
landscaping in conflict with anticipated stop sign locations,
insufficient information regarding levels of parking lot
illumination, insufficient information regarding levels of
illumination for pedestrian walkways, etc. I recommend that
the applicant obtain a copy of the City's Parking Lot
Ordinance, specifically Chapter 5, Article X, Section 5-142
inclusive.

Find attached for your review the plans and exhibits for the above-
referenced proj ect. Si te Plan Review approval for this project
will be granted by the City Commiss ion/Communi ty Redevelopment
Agency. To ensure that the project stays on line with the review
time frame, I request that the plans and exhibits be reviewed and
formal written comments transmitted to the Director of the Planning
and Zoning Department no later than 5:00 P.M. on Julv 27. 1994. Do
not return plans and exhibits. Retain same for the review of the
amended plans (2nd review).
Adhering to the following review guidelines will promote a
comprehensive review and enable the applicant to efficiently obtain
Technical Review Committee approval:
1.
Use the review standards specified in Part III, Land
Development Regulations, Chapter 4, Site Plan Review, Section
8 of the Code of Ordinances to review and Formulate comments.

The documents submitted for the project were determined to be
substantially complete based on the submittal requirements
identified in Section 7 of the Site Plan Review Ordinance.
However, if the data provided to meet the submittal
requirements is insufficient to properly evaluate and process
the project based on the review standards or the documents
show code deficiencies, additional data and/or corrections
should be requested by the reviewer through the Planning and
Zoning Department.

3. Each comment shall reference the section of the code that is
incorre8tly depicted on the documents.
4. Technical Review Committee member (s) shall identify in their
comm~nts when the plans depict or when the location and
installation of their departmental required improvements may
conflict with other departmental improvements.
5. When a TRC Member finds a code deficiency that is outside of
his/her review responslbility, the comment and the specific code
section may be included in their review comments with the name of
the appropriate TRC Member that is responsible for the review
specified.
6. If a TRC member finds the plans acceptable, he/she shall forward
a memo, within the time frame stated above, to the Planning and
Zoning Director stating that the plans are approved and they do
not have any comments on the plans submitted for review and
recommend the project be forwarded through the approval process.
All comments shall be typed, addressed and transmitted to the Director
of the Planning and Zoning Department for distribution to the
applicant. Please include the name and phone number of the reviewer
on this memo. Michael E. Haag will be the Planning and Zoning
Department staff member coordinating the 1st review of the project.
The Planning and Zoning Department will send the applicant a cover
letter which includes the comment(s) and directions to amend the plans
to comply with the comments and the procedures for resubmission. When
the Planning and Zoning Department receives the amended plans, they
will distribute the plans with a cover memo to all TRC Members f8r
review and approval.
